Marlow The Acting Secretary read a letter submitted by Joe Evans, representing the applicant, requesting withdrawal of Use Permit No. 69-55. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO GRANT THE REQUEST OF THE APPLICANT TO WITHDRAW USE PERMIT NO. 69-55. Commission discussion followed. A MOTION WAS MADE BY DUKE AND SECONDED BY BOKOR TO DENY CONDITIONAL EXCEPTION NO. 69-12 FOR THE FOLLOWING REASONS: 1. The Top -of -Pier Plan, as adopted by the City Council, shows this area proposed for office or commercial use. 2. There is no hardship on the property which would justify the granting of this request. 3. If this request were granted, it would constitute a spot zoning. 4. The request would be contrary to the Top -of -Pier Plan. ROLL CALL VOTE: AYES: Duke, Bokor, Bazil, Tom NOES: Slates, Miller ABSENT: Porter THE MOTION CARRIED. The Commission reviewed the suggested conditions for approval. A MOTION WAS MADE BY BOKOR AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO. 7102 UPON THE FOLLOWING CONDITIONS: 1. The tentative map received December 11, 1969, shall be the approved layout. 2. The tract shall be approved for construction of single family homes only. 3. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. COMMISSIONER PORTER ARRIVED AT 7:13 P.M. AND ASSUMED HIS DUTIES. A MOTION WAS MADE BY DUKE AND SECONDED BY BAZIL TO APPROVE CONDITIONAL EXCEPTION NO.69-42 UPON THE FOLLOWING CONDITIONS: 1. Telephone conduit shall be installed by the developer at the northwest corner of Warner Ave. and Gothard St. to facilitate the installation of a fire alarm box. 2. A FURTHER MOTION WAS MADE BY SLATES AND SECONDED BY TOM TO INITIATE A RESOLUTION OF INTENT TO REZONE THE NORTHWEST CORNER OF WARNER AVE. AND GOTHARD ST. FROM R3 TO C4 WITH THE CONSENT OF THE APPLICANT. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Miller, Porter, Tom, Duke NOES: None ABSENT: None THE MOTION CARRIED. ZONE CASE NO. 69-35 Applicant: John MacLeod Change of zone from R5 Office - Professional district and R2 Two Family Residence District, to R3 Limited Multiple Family Residence District. Located on the south side of Detroit Ave. and west of the extension of Delaware St. The hearing was opened to the audience. John Botich, Voorheis-Trindle- Nelson, Inc., representing the applicant, addressed the Commission and displayed sketches of the proposed development. Bill Hartge, City Engineer, addressed the Commission and stated that his department is in the process of preparing a precise plan of street align- ment for the southerly extension of Delaware St. and it will be at least two months before plans are far enough along to use them as a basis for any decision. There being no other comment, the hearing was closed. It was the consensus of the Com- mission to continue Zone Case No. 69-35 for two months to allow time for the Department of Public Works to prepare a precise plan of street alignment for Delaware St. A MOTION WAS MADE BY MILLER AND SECONDED BY BOKOR TO CONTINUE ZONE CASE NO. 69-35 TO FEB- RUARY 3, 1970, FOR THE AFOREMENTIONED REASONS. Change of zone from RI-0 Single Family Residence District combined with oil production to R1 Single Family Residence District and R1-02 Single Family Residence District - Combining Oil District. Located north of Palm Ave. and west of Golden West St. The Acting Secretary informed the Commission that Article 968, the Combining Oil District, is in the process of being revised. Mr. Palin stated that these revisions will not be consistent with the request as submitted inasmuch as the 1102" designation will be dropped. He stated that the proposed revision should become effective within the next few months; therefore, the staff recommends continuance of Zone Case No. 69-34 to February 3, 1970, so that the zone change can be enacted in conformance with the revisions to Article 968. CODE AMENDMENT NO. 69-11 Said amendment proposes to amend the R1 Single Family District to allow the construction of garden or wing walls within the 5 ft. interior side yard setback and to within 5 ft. of the exterior property line, provided they are constructed perpendicular to the dwelling or property line and a 3 ft. wide accessway is provided to the -rear yard. Such wall shall not exceed the height of the first floor plate and in no case shall it exceed a height of 9 feet. The Acting Secretary reviewed Code Amendment No. 69-11 with the Commission. The hearing was opened to the audience. There being no comment, the hearing was closed. Commission discussion followed. PLANNED RESIDENTIAL DEVELOPMENT CODE AMENDMENT NO. 69-2 The Acting Secretary informed the Commission that the City Attorney's office stated that changes in Code Amendment No. 69-2 necessitated changes in Article 984 - "Use Permits", therefore, action on Code Amendment No. 69-2 should be continued and a public hearing should be set for the proposed changes to Article 984. -4- 12/16/69-PC Minutes: H.B. Planning Commission Tuesday, December 16, 1969 Page 5 A MOTION WAS MADE BY PORTER AND SECONDED BY BAZIL TO INSTRUCT THE SECRETARY TO SET THE PRO- POSED CHANGES TO ARTICLE 984 FOR PUBLIC HEARING AND TO CONTINUE ACTION ON CODE AMENDMENT NO. 69-2 TO THE JANUARY 6, 1970, MEETING. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Miller, Porter, Tom, Duke NOES: None ABSENT: None THE MOTION CARRIED. SITE PLAN NO. 69-5 Applicant: John Pucella To permit on -sale of alcoholic beverages in the C3 General Business District. Located on the north side of Pacific Coast Highway, approximately 50 ft. west of 15th St., and legally described as Lots 3 and 4, Block 168, Huntington Beach Tract. The Acting Secretary informed the Commission that this property is surrounded by C3 zone on the northwest and southeast and R4 zone on the northeast. Mr. Palin, Assistant Planner, stated that surrounding properties are vacant with scattered oil -wells and tanks in the area. Also, the staff, including the Police Department, has reviewed the request and does not find the proposed use or location objectionable. A MOTION WAS MADE BY TOM AND SECONDED BY BOKOR TO APPROVE SITE PLAN NO. 69-5 WITH THE FOLLOWING CONDITION: 1. All applicable provisions of the Huntington Beach Ordi- nance Code shall be complied with. DIVISION OF LAND NO. 69-43 Applicant: Roy Sakioka To permit the division of a parcel of land into two separate parcels. Located at the southeast corner of Adams Ave. and Brookhurst St. The Acting Secretary stated that this application was referred to the Commission by the Board of Zoning Adjustments, pursuant to the Commission's request that any application filed on this property be re- ferred to them for decision. The Commission's request was based on the fact that a resolution of intent has been initiated to rezone the property C4 as was a request that the City Council declare a moratorium on the issuance of building permits until such time as the C4 zone is effective. Mr. Palin, Assistant Planner, informed the Commission that the staff's recommendation was for a continuance of this application until such time as the applicant can submit an application for a use permit for the proposed development. COMMENTS FROM THE STAFF: The Acting Secretary informed the Commission that t e City Council referred the Oil Ordinance back for further review and recommendation. Mr. Palin stated that this item would be on January 6, 1970, agenda. ZONE CASE NO. 69-33 - Referred back to the Planning Commission for further consideration. Applicant: Bross Brothers Change of Zone from Rl Single Family Residence District to C4 Highway Commercial District with a 50 ft. setback from the ultimate right-of-way line and R3 Limited Multiple Family Residence District. The Acting Secretary informed the Commission that Zone Case No. 69-33 was referred back to them by the City Council for further review and recommen- dation. Some members of the Council are concerned with how the R3 portion will be developed in relation to the existing RI development immediately to the north. Commissioner Bazil recommended a re-alighment'between the C4 and R3. Mr. Bazil stated that this would result in a much better development with no R3 south of the C4 portion. A representative for the appli- cant stated that he was agreeable to work with the staff on re -aligning the R3 and C4 boundaries. A MOTION WAS MADE BY BOKOR AND SECONDED BY PORTER TO APPROVE ZONE CASE NO. 69-33 FOR THE FOLLOWING REASONS: 1. The subject property fronts on Magnolia St. which is primarily arterial highway; therefore, exposure will be sufficient. 2. The size and shape of the property lends itself to this zone. 3. Proximity to the freeway off -ramp. 4. This property is suitable for light commercial use. ROLL CALL VOTE: AYES: Bazil, Miller, Porter, Tom, Bokor NOES: Duke ABSENT: Slates THE MOTION CARRIED. By minute action the Planning Commission recommended that the Board of Zoning Adjustments pay special attention to such items as front yard setbacks from Heil Ave., location of carports, landscaping, traffic circulation and to give special consideration to surrounding land uses at such time as a use permit is filed for the apartment development. -6- 12/16/69-PC Minutes: H.B. Planning Commission Tuesday, December 16, 1969 Page 7 MINORITY REPORT: Commissioner Duke stated that he was of the opinion that the parcel should not be divided into C4 and R3 because it is only 4.4 acres in size. In addition, R2 zoning should be considered rather than R3 because R2 would solve the applicant's problems as well as those of surrounding property owners. MEMO FROM PLANNING DEPARTMENT: The Commission reviewed a memo from the Planning Department regarding densities in the R1, R2, R3 and R4 zones. The densities were as follows: Low density, 0-8 units per acre; Medium den- sity, 8-21 units per acre; Medium High density, 21-35 units per acre and High density, 35 units and up. The Acting Secretary informed the Commission that this memo is primarily for clarification of various residential zones. A MOTION WAS MADE BY BAZIL AND SECONDED BY BOKOR TO ADOPT THE DESIGNATION OF RESIDENTIAL DENSITY TO BE USED ON THE MASTER PLAN OF LAND USE BY MINUTE ACTION.
