Wednesday, December 17, 1969 BOARD MEMBERS PRESENT: McFarland, Cook, Harlow MINUTES: On motion by Cook and seconded by Harlow, the minutes for November 5, November 12, November 19, November 26 and December 3, 1969, were accepted as transcribed. ADMINISTRATIVE REVIEW NO. 69-25 - Continued Applicant: Carpenters Local Union No. 1453 To permit the construction of an 18.75 sq. ft. identification sign. Located on the south side of Atlanta Ave. approximately 1600 ft. east of Beach Blvd. in the R3 Limited Multiple Family District. It was noted that this item should be withdrawn as the Board of Zoning Adjustments does not have the authority to act on it. A MOTION WAS MADE BY HARLOW AND SECONDED BY COOK TO WITHDRAW ADMINISTRATIVE REVIEW NO.69-25 AND TO RETURN THE FILING FEE TO THE APPLICANT. CONDITIONAL EXCEPTION NO. 69-92 - Continued Applicant: Huntington Harbour Corporation To permit construction of 72 ft. high wing walls within the 5 ft. interior side yard setback in lieu of the permitted 6,ft. high wall. Such walls are to be construc- ted on lots 331, 332, and 333 of Tract 5481. Located on the island west of Humboldt Drive in the R1 Single Family Residence District. The hearing was opened to the audience. George Parry, representing the appli- cant, addressed the Board and answered various questions. Ms. Claire Everson, adjacent property owner, addressed the Board and requested that the boat storage area be enclosed as they sometimes become trash collection areas. A letter submitted by Lewis Abel, '..owner of Lot 65, objecting to the height of the wing walls was read by the Secretary. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 69-92 WITH THE FOLLOWING CONDITION: 1. A fence enclosure with a minimum height of 6 feet shall be constructed along the side property line for screening purposes. FOR THE REASON: 1. Such walls are to be constructed on lots 61, 64, 739 75, 96, 100, 103 and 106 of Tract 5050. Located on the island west of Daven- port Dr. in the R1 Single Family Residence District. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 69-93 WITH THE FOLLOWING CONDITION: 1. There was no one present to represent the applicant and there being no other comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY HARLOW TO DENY CONDITIONAL EXCEPTION NO.69-95 FOR THE REASON: 1. The applicant failed to sufficiently justify any hardship. CONDITIONAL EXCEPTION NO. 69-98 Applicant: LaCuesta To permit a 17 ft. minimum dimension for the required 1200 sq. ft. of open space in lieu of the required 25 ft. Located at the southeast corner of Atlanta Ave. and Bushard St. in the R1 Single Family Resi- dence District. Legally described as Tract 6893, lot 73. The hearing was opened to the audience. Buz Tupman, representing the applicant, addressed the Board and answered various questions. There being no further com- ment, the hearing was closed. It is a continuation of an existing subdivision. Any new tract would be designed to meet the standards. 2. Sufficient open area has been provided on the lot. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 69-100 Applicant: R.M. Galloway & Assoc. To permit a 21 ft. minimum dimension for the required 1200 sq. ft. of open space in lieu of the re- quired 25 ft. minimum dimension. Located approximately 660 ft. east of Magnolia St. and 600 ft. north of Indianapolis Ave. in the R1 Single Family Residence District. Legally described as lots 1 and 17 of Tract 5603. The hearing was opened to the audience. Ron Phillips, representing the appli- cant, addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY HARLOW TO APPROVE CONDITIONAL EXCEPTION NO.69-100 FOR THE FOLLOWING REASONS: 1. The applicant is providing sufficient open space. 2. The 21 ft. minimum dimension only occurs on one corner of the lot. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 69-97 Applicant: Pacific Capri To permit laundry facilities, hot water heating equipment, gas meters and semi -enclosed trash areas to be constructed at 110" side and rear yard setback in lieu of the required 5 ft. setback. Such facilities to be located within carport structures which were previously approved at 110" side and rear yard setback by CE No.69-57. Located on the south side of Edinger Ave., approximately 528 ft. east of Springdale St. in the R3 Limited Multiple Family District. A legal description is on file in the Planning Department Office. The hearing was opened to the audience. Roger Hedrick, representing the applicant, addressed the Board and answered various questions. Lindy Leifheit, representing surround- ing homeowners, addressed the Board in opposition to the re- quest. He presented a petition of opposition signed by 38 homeowners. The question was asked whether this would raise homeowners' fire insurance. The homeowners feel that the laundry facility location would create traffic and noise at all hours of the night. Concern was expressed over the appearance of the wall after completion. Charles Canfield, adjacent property owner felt the location of the laundry facilities would create a noise problem. -3- 12/17/69-BZA Minutes: H.B. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY HARLOW TO APPROVE CONDITIONAL EXCEPTION NO. 69-97 WITH THE FOLLOWING CONDITION: 1. The laundry facilities adjacent to the R1 District shall be removed and relocated in a manner meeting with the approval of the Board of Zoning Adjustments. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 69-96 Applicant: Huntington Capri Co. To permit laundry facili- ties,' -hot water heating equipment, gas meters and semi - enclosed trash areas to be constructed at 110" side and rear yard setback in lieu of the required 5 ft. setback. Located on the south side of Heil Ave. approximately 725 ft. east of Bolsa Chica St. in the R2 Two Family Residence District. A legal description is on file in the Planning Department Office. In Conjunction With USE PERMIT NO. 69-65 Applicant: Stellrecht & Bartoli To permit the construction of an 84 unit apartment complex on 3.55 acres of land. Loca- tion and legal are the same as the above. In Conjunction With DIVISION OF LAND NO. 69-41 - Continued Applicant: Stellrecht & Bartoli To permit a division of land into four separate parcels each being 66.2 ft. in width by 620 ft. in depth. A MOTION WAS MADE BY COOK AND SECONDED BY HARLOW TO APPROVE CONDITIONAL EXCEPTION NO. 69-99 WITH THE FOLLOWING CONDITION: 1. The carport wall constructed on property line shall be of maintenance free block with a stucco color coating on the exterior side. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED. A MOTION WAS MADE BY HARLOW AND SECONDED BY COOK TO APPROVE USE PERMIT NO. 69-65 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received December 9, 1969, shall be the approved layout. 2. Heil Ave. shall be. -dedicated and fully improved to City standards. Improvements shall include street trees, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's -water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district. 7. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 8. All utilities shall be installed underground. 9. Fire alarm system -conduit and appurtenances shall be installed by the developer at locations and to specifica- tions provided by the Fire Department. 10. Off-street parking facilities shall conform to Article 979. 11. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 12. A lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works for approval. 13. The structural street section of all private drives shall be approved by the Department of Public Works. 14. Access to Heil Ave. shall be approved by -:the Traffic Engineer. 15. Landscaping and a screening wall shall be provided along Heil Ave. and approved by the Board of Zoning Adjustments. 16. All applicable City Ordinances shall be complied with. 17. All of the above conditions shall be complied with prior to issuance of a Certificate of Occupancy by the Building Department. Board of Zoning Adjustments Wednesday, December 17, 1969 Page 6 A MOTION WAS MADE BY MCFARLAND AND SECONDED BY COOK TO APPROVE DIVISION OF LAND NO. 69-41 WITH THE FOLLOWING CONDITIONS: 1. Heil Ave. shall be dedicated and fully improved to City standards across the entire frontage of all par- cels prior to development of any parcel. Improvements shall include street trees, street lights, fire hydrants, sewer and water main extensions. 2. Mutual driveway easements over abutting lots shall be to the requirements of the Board of Zoning Adjustments. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district. 7. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to -the City prior to issuance of building permits. 8. All utilities shall be installed underground. 9. A parcel map shall be filed with the City and recorded. Such recordation shall not occur until the developer requests a framing inspection on the project. 10. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the con- ditions listed above. ROLL CALL VOTE: AYES: Cook, McFarland NOES: Harlow THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 69-29 Applicant: Donald Honer To permit the placement of an additional pole with overhead utilities to serve an en- largement of an existing use. Located at 18820 Fiberglass Road. A legal description is on file in the Planning De- partment Office. Mr. Muir, electrical con- tractor, representing the applicant, addressed the Board and answered various questions. Board discussion was held. It was noted that the Board of Zoning Adjustments does not have the authority to act on this application.
