MINUTES: On motion by Tom and seconded by Porter, the Minutes of
tiWeHuntington Beach Planning Commission of October 14, 21, and
November,=3, 1969,were accepted as transcribed and mailed by the
Secretary.
AGENDA ITEMS TO BE CONTINUED:
ZONE CASE NO. 69-38
RESOLUTION OF INTENT Change of Zone from RA-0 to RA, located on
the east side ot Brookhurst Street, approximately 200 ft. south
of Hamilton Avenue.
The Acting Secretary informed the Commission
that Zone Case No. 69-38 was inproperly advertised there fore, it
has been readvertised for the January 20, 1970, meeting.

ZONE CASE NO. 69-36 - PREZONE
Applicant - Standard -Pacific Corp. Prezone property located be-
tween Gartield and Ellis Avenues, east to the extension of New-
land Street to RS zone.
The Acting Secretary informed the Commission
that the applicant requested continuance to February 3, 1970,and
that the staff also recommends continuance so that additional in-
formation relative to the soil condition can be submitted to the
Commission for review.

CODE AMENDMENT NO. 69-3 Said Code Amendment proposes to amend
Article Combined Oil District) by renumbering, reword-
ing and adding various sections within such Article. Also, said
amendment proposes to reword Section 9700 (n) Definitions.
The Acting Secretary suggested that Code Amend-
ment No. 69-3 be continued to February 3, 1970, to allow the Oil
Committee to review said amendment and submit their comments to
the Commission.

The Assistant City Attorney made a presenta-
tion regarding street dedication for the Signal Oil property, lo-
cated on the north and south sides of Adams Avenue and east of
Beach Boulevard,
The Planning Commission was informed that this
matter was referred to them by the City Council for a recommenda-
tion,
The Commission reviewed the street dedication
agreement.

TER TO RECOMMEND THAT THE CITY COUNCIL AUTHORIZES THE MAYOR AND
CITY CLERK TO EXECUTE SAME,

Subdivider: Premier Homes 37 lots on 7.774 acres, located
776 eet north o Varner Avenue, east of the So. Pacific Rail-
road right-of-way,
The Commission reviewed the suggested condi-
tions.
A MOTION WAS MADE BY PORTER AND SECONDED BY
BOKOR TO APPROVE TENTATIVE TRACT MAP NO. 7154 UPON THE FOLLOWING
CONDITIONS:
1, The tentative map received November 26, 1969, shall be
the approved layout,
2. The flood control channel shall be fenced to Flood Con-
trol District Standards and to City Standards, A 6 ft.
high masonry wall may be used to satisfy this require-
ment,
3. A 6 ft, hi h masonry wall shall be constructed along
the east OW line of the railroad and a combination
fence and gate as approved by the Department of Public
Works shall be constructed across the sanitation dis-
trict easement along the north and south boundaries of
the tract:
4. All conditions out -lined in the Orange Cour!ty Sanitation
District's letter of December 18, 1969, shall be comp-
lied with.

CONDITIONAL EXCEPTION NO. 69-43
Applicant - Ter'an, Inc. To permit the operation of a car
wash in the GZ Gommunity Business District, located on the south-
west corner of Yorktown Avenue and Beach Boulevard.
A letter submitted by Ivan Hooker, property
owner, requesting withdrawal of the application was received by
the Commission.
The Assistant City Attorney informed the Com-
mission that the City could not accept a withdrawal request from
the property owner as he was not the applicant on this applica-
tion.
The hearing was opened to the audience.
Mr. N.R. Lewis, Secretary of Terjan Corpora-
tion, addressed the Commission and presented remderings--bf'the
proposed car wash.
There being no other comment the hearing was
closed.
A MOTION WAS MADE BY BAZIL AND SECONDED BY TOM
TO APPROVE CONDITIONAL EXCEPTION NO. 69-43 UPON THE FOLLOWING
CONDITIONS:
1. Beach Boulevard and Yorktown Avenue shall be fully im-
proved to City and State Standards. Improvements shall
include street trees, street signs, street lights, and
fire hydrants.
2. All applicable fees shall be paid.
3. Additional landscaping shall be provided along the
south and west property lines as approved by the Plan-
ning Department.
4. Off-street parking facilities shall conform to Article
979. The amount of parking to be provided shall be de-
termined by the Planning Department.
S. All applicable City Ordinances shall be complied with.
6. Uses associated with the car wash shall be conducted in
the rear of the building.
7. No subsidiary facilities shall be allowed. Only sale
of gasoline and car wash facilities.

Jim Corning, owner of the Continental Body
Shop, addressed the Commission and stated his reasons for the
request.

A FURTHER MOTION WAS MADE BY PORTER AND SECON-
DED BY BAZIL TO DENY CONDITIONAL EXCEPTION NO. 69-44 FOR THE FOL-
LOWING REASON:
1. Said construction would be an addition to a non -conforming
building.

THE MOTION CARRIED.
ADDITONAL INFORMATION: Commissioner Bazil requested the Staff
to prepare a code amendment to allow auto -body shop in the C4
zone subject to a use permit and that such amendment be review-
ed by the Commission at a study session.
ZONE CASE NO. 69-37
RESOLUTION OF INTENT Change of zone from C2 Community Business
District to C4 Highway Commercial District with a 50 ft. setback
from the ultimate property line.
Located at the southeast corner of Adams Ave-
nue and Brookhurst Street.
The Acting Secretary informed the Planning
Commission that this resolution of intent was initiated by them
at the request of the Meredith Gardens Homeowners Association to
provide for the orderly development of the property.
The hearing was opened to the audience.
Ed Kerins, representing Meredith Gardens Home-
owners Association, addressed the Commission and spoke in favor
of the zone change. He also stated that their reason for reques-
ting the -Planning Commission to initiate the zone change was to
have control of the corner through the use permit procedures and
not to permit highway related commercial uses.
There being no other comment, the hearing was
closed.
Commission discussion followed.
RESOLUTION NO. 69-37 A resolution of the City Planning Commis-
sion of the City o Huntington Beach, California, recommending
approval of Zone Case No. 69-37 to the City Council.
A MOTION WAS MADE BY PORTER AND SECONDED BY
DUKE TO ADOPT RESOLUTION NO. 69-37 RECOMMENDING APPROVAL OF ZONE
CASE NO. 69-37 TO THE CITY COUNCIL FOR THE FOLLOWING REASON:
1. The C4 zone will afford better planning and a more orderly
development.

ZONE CASE NO. 69-40
Applicant - Wm. Lyon Com an . Change of zone from C4 Highway
Commercial District anoffice-Professional District to R3
Limited Multiple Family Residence District.
Located on the north and south side of Hol-
land Drive, approximately 1801 feet east of Beach Boulevard.
Video tape of the area was shown.
The hearing was opened to the audience.
Mrs. Robert Oswald, 8202 Holland Drive, and
R.H. Bauer, 18911 Bedford Lane, addressed the Commission and op-
posed the request. Numerous property owners in the area who op-
posed the change of zone made their presence known to the Commis-
sion.
R.W. Farrell, Wm. Lyon Company, explained the
proposal and the type of apartments to be built. Ray Quigley,
realtor, representing the property,owner, north of the subject
property, spoke in favor of this request.
There being no other comment the hearing was
closed.

A MOTION WAS MADE BY DUKE AND SECONDED BY
BOKOR TO DENY ZONE CASE NO. 69-40 FOR THE FOLLOWING REASONS:
1. The use will result in a traffic problem on Holland
Drive.
2. There:is no traffic signal located at Holland Drive and
Beach Boulevard.
3. The property is master planned for highway commercial.

Applicant - Donald Honer To permit the placement of an ad-
ditional pole with overhead uti ities to serve an enlargement of
an existing use.
Located on the east side of Gothard Street and
west side of Fiberglass Road.
Video tape was shown of the location and of
the proposed structure.

Donald Honer, architect for Ferro Corporation
addressed the Commission and explained the request. A represen-
tative for Ferro Corporation, addressed the Commission and stated
that the Corporation intends to construct a 60,000 square foot
building within the next 18 to 24 months in addition to this pro-
posed structure and that the corporation will at that time under-
ground all utilities..
There being no other comment the hearing was
closed.

DUKE TO DENY CONDITIONAL EXCEPTION NO. 69-45 FOR THE FOLLOWING
REASON:
1. A general trend has been established throughout the City to
require underground utilities for all new structures.

PLANNED RESIDENTIAL DEVELOPMENT
CODE AMENDMENT NO. 69-2 - (Continued)
CODE AMENDMENT NO. 69-12 - USE PERMITS It was the consensus of
the Commission to continue Gode Amendment No. 69-2 Planned Resi-
dential Development and Code Amendment No. 69-12 - Use Permits,
to a Study Session on January 13, 1970, at 2:00 P.M.
CONDITIONAL EXCEPTION NO. 69-96 - APPEAL
Applicant - Huntin ton Capri Co. To permit laundry facilities,
of water heating equipment, gas meters and semi -enclosed trash
areas to be constructed at 110" side and rear yard setback in lieu
of the required 5 ft. setback. Located on the south side of Ed-
inger Avenue approximately 928 ft. east of Springdale Street in
the R-3 Limited Multiple Family Residence District.
Video tape was shown of the subject property.
The hearing was opened to the audience.
Roger Hedrick, representing Huntington Capri
Co., gave his reasons for the request. Mr. Hedrick stated that
it would be a hardship to relocate the laundry facilities at this
time.
The following property owners addressed the
Commission and opposed the request: L.D. Leifheit, H.E. Kling,
Dr. Rode, N. Haws and N.R. Lewis, on grounds that the laundry
facilities would generate additional noise if allowed to remain
at the present location.

A MOTION WAS MADE BY SLATES AND SECONDED BY
BOKOR TO SUSTAIN THE DECISION OF THE BOARD OF ZONING ADJUSTMENTS
TO APPROVE CONDITIONAL EXCEPTION NO. 69-96, WITH THE FOLLOWING
CONDITION:
1. The laundry facilities adjacent to the Rl District shall be
{._ removed and relocated inVa. manner meeting with the approval
of the Board of Zoning Adjustments.

THE MOTION CARRIED.
COMMUNICATION: The Acting Secretary read a legal notice submit-
ted y the WFstminster City Planning Commission, regarding an
application for a Conditional Use Permit No. C-199, to permit the
drilling of an exploratory oil well on 5.54 acres of land, loca-
ted at the northeasterly corner of Bolsa Chica Road and Rancho
Road, in the M2 Medium Industrial District.
The cowunication was received and ordered
filed.
COMMENTS FROM COMMISSIONERS:
COMMISSIONER DUKE: Commissioner Duke requested that the staff
investigate met ods of screening the trailer parks from the street
view.
COMMISSIONER PORTER: Commissioner Porter discussed the possi-
bility ot amending Section 9730.1 - Effect of Height Limitations
by adding a height limitation to radio towers.
It was the consensus of the Commission that the
staff should prepare a code amendment to require a height limi-
tation for said towers.
