Wednesday, January 7, 1970 BOARD MEMBERS PRESENT: McFarland, Cook, Harlow CONDITIONAL EXCEPTION NO. 69-103 Applicant: E. G. Bixler To permit a room 14 ft. of the rear property line causing required minimum open space to 705 sq. ft. required 900 sq. ft. Located on the east Lane, approximately 160 ft. south of Terry Single Family Residence District. Legally lot 3, Tract 5735. Mr. Bixler pointed out that due to the orienta- tion of the proposed addition to the kitchen, garage door and sliding glass door, relocation of the proposed structure to the side would eliminate a window in the living room. He also pointed out that there was in excess of 1400 sq. ft. of open space in the rear yard and that the only problem was with the minimum dimension. There being no further comment, the hearing was closed. Board discussion was held. It was noted that the intent of the ordinance had been met in that additional open space would be provided elsewhere in the rear yard. A MOTION WAS MADE BY HARLOW AND SECONDED BY COOK TO APPROVE CONDITIONAL EXCEPTION NO.69-103 FOR THE FOLLOWING REASONS: 1. The intent of the ordinance has been met. 2. 1400 sq. ft. of open space has been provided in the rear yard. The only problem appears to be that the minimum dimension has not been met for all of the open space. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED. USE PERMIT NO. 69-69 Applicant: American Mobilehome Corp. To permit the construction of a 255 space mobilehome park on approximately 31.34 acres of land. Located on the southwest corner of Atlanta Ave. and Beach Blvd., in the R5 Office -Professional District and the R5-0 Office -Professional District combined with oil produc- tion. A legal description is on file in the Planning De- partment Office. The Secretary read a letter sub- mitted by the Chairman of the Planning Commission, request- ing that the subject use permit be heard by the Planning Commission at a regularly scheduled meeting. The letter further requested that the hearing not be held until the Citizens Steering Committee is contacted and they advise the Planning Commission as to the effect the subject use permit will have on the Top of the Pier and Mid Beach Plan. He also asked that if the matter was referred to the Planning Com- mission, that the Board set the hearing for a specific date. Earl Martin, owner of the adjacent trailer park, addressed the Board and asked questions regarding the project. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY HARLOW AND SECONDED BY MCFARLAND TO REFER USE PERMIT NO. 69-69 TO THE PLANNING COMMISSION FOR DECISION AT THEIR FEBRUARY 3, 19709 MEETING TO BE HELD AT 7:00 P.M. in the COUNCIL CHAMBERS OF THE CIVIC CENTER. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED. - ADMINISTRATIVE REVIEW NO. 69-29 Applicant: Kaufman & Broad To permit eight 15 sq. ft. on -site feature signs in conjunction with model homes within Tract 5603. Located at Village Dr. and Sunshine Dr., 1500 ft. south of Adams Ave., west of Magnolia St., in the R1 Single Family Residence District. A legal description is on file in the Planning Department Office. Raymond Murphy, representing the applicant, addressed the Board and explained the request. It was noted by the Board that the plot plan as submitted contains insufficient informa- tion and asked if the applicant would agree to a continuance to allow time for the Board to receive a more specific plot plan showing where the proposed signs would be located, the distance between signs, the type of sign copy. Mr. Murphy felt that the information could be submitted to the Board at their next regular meeting. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY COOK TO CONTINUE ADMINISTRATIVE REVIEW NO. 69-29 TO JANUARY 14, 1969, TO ALLOW TIME FOR THE APPLICANT TO SUBMIT ADDITIONAL INFORMATION. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 69-32 Applicant: Macco Corp. To permit eight 15 sq. ft. on -site feature signs in conjunction with a sales office within an apartment complex. Located at Warner Ave. and St. George St. A legal description is on file with the Planning Department Office. Mr. Raymond Murphy,representing the applicant, addressed the Board and explained his request. It was noted by the Board that this application contains insufficient information and that plans should be submitted showing the precise location of the signs, the distance between the signs and the proposed sign copy. -2- 1/7/70 - BZA- Minutes: H.B. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY HARLOW TO CONTINUE ADMINISTRATIVE REVIEW NO. 69-32 TO JANUARY 14, 1970, TO ALLOW TIME FOR THE APPLICANT TO SUBMIT ADDITIONAL INFORMATION. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED. CONDITIONAL EXCEPTION NO' 69-36 (Planning Commission) Applicant: Carpenters Local Union 1453 To permit the construction of a 24 sq. ft. free-standing pole sign in the R3 Limited Multiple Family Residence District. Located on the south side of Atlanta Ave., approximately 1600 ft. east of Beach Blvd. It was noted by the Board that this item had been referred to them by the City Council and that the City Council required the Board to approve the location and illumination of the proposed sign. Mr. Serle Fritz, Secretary -Treasurer of the Carpenters Local Union, addressed the Board and stated that this sign would not project beyond the property line. In fact, it would be set back 9 inches from the front property line. Also that the sign would be located approximately in the center of the parcel and it would be set perpendicular to Atlanta Ave. He further informed the Board that the illumination of the sign would be equivalent to 800 milliamps and that he has been advised that the lighting from the sign would not be visually intrusive to surrounding property. He further stated that if the illumina- tion of the sign was objectionable to surrounding property owners, that the Board of Zoning Adjustments could review the sign upon its completion and, if necessary, they would reduce the amount of light from the sign. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY HARLOW TO APPROVE THE LOCATION AND'ILLUMINATION OF THE PROPOSED SIGN FOR CONDITIONAL EXCEPTION NO. 69-36 SUBJECT TO THE FOLLOWING CONDITION: 1. Illumination of the proposed sign shall be reviewed by the Board of Zoning Adjustments when such sign is complete and if it is determined by the Board that the sign is too bright, the applicant shall reduce the amount of illumination in a manner acceptable to the Board of Zoning Adjustments. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY HARLOW TO APPROVE USE VARIANCE 6337 AND USE VARIANCE 6338 SUBJECT TO THE FOLLOWING CONDITION: 1. All conditions as outlined in the Sunset Beach-Surfside Study Technical Report, Phase 1, March 18, 1967, shall be complied with. ROLL CALL VOTE: AYES: McFarland, Cook, Harlow THE MOTION CARRIED.
