Located at Village Dr. and Sunshine Dr., 1500 ft. south of Adams Ave., west of Magnolia St., in the R1 Single Family Residence District. A legal description is on file in the Planning Department office. AND ADMINISTRATIVE REVIEW NO. 69-32 - Continued Applicant: Macco Corporation To permit eight 15 sq. ft. on - site feature signs in conjunction with a sales office within an apartment complex. Located at Warner Ave. and St. George St. A legal description is on.file with the Planning Department office. It was noted that these items had been continued to allow time for the applicant to submit detailed plans. New plan had been submitted. Mr. Murphy, representing both applicants, addressed the Board and answered various questions. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NOS. 69-29 and 69-32. To permit the construction of a Handyman hardware store on approximately 6.2 acres of land. Located at the southeast corner of Adams Ave. and Brookhurst St. in the C2 Community Business District. A legal description is on file in the Planning Department office. It was noted that there is a moratorium to suspend the issuance of building permits on this property. Also, that the Planning Commission has requested all items on this property be referred to them. A MOTION WAS MADE BY PALIN AND SECONDED BY COOK TO REFER USE PERMIT NO 69-70 TO THE PLANNING COMMISSION FOR A PUBLIC HEARING TO'BE HELD FEBRUARY 3, 1970, AT 7:00 P.M. IN THE COUNCIL CHAMBERS, CIVIC CENTER. ROLL CALL VOTE: AYES: Gerarden, Cook, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 69-105 Applicant: Richard MacGregor To permit support columns of an open patio cover to be located within 3 ft. of the side property line in lieu of the required 5 ft. setback. Located at 6132 Softwind Dr., in the R1 Single Family Residence District. Legally described as lot 58, Tract 5536. The hearing was opened to the audience. The Acting Secretary read two letters from adjacent property owners requesting the removal of the vines covering the patio cover as debris blows into their yards and pools. Mr. MacGregor addressed the Board and presented a petition of signatures stating they had no objection to the patio cover and support columns. The patio's support columns, violating the setback, were of brick and no apparent hazard. A MOTION WAS MADE BY GERARDEN AND SECONDED BY PALIN TO APPROVE -CONDITIONAL EXCEPTION NO. 69-105 WITH THE FOLLOWING CONDITION: 1. The vinesshall be removed from the patio cover by February 2, 1970, and no vines are to be grown thereon in the future. ROLL CALL VOTE: AYES: Gerarden, Cook, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 69-107 Applicant: Jim Bentson To permit three detached units on one parcel of land in lieu of three attached units. Located on the east side of Chapel Lane, 660 ft. south of Ellis Ave. in the R3 Limited Multiple Family Residence District. A legal description is on file in the Planning Department office. In Conjunction With USE PERMIT NO 69-71 Applicant: Jim Bentson T6 permit the construction of three units having a driveway in excess of 150 ft. in depth. Located on the east side of Chapel Lane, 660 ft. south of Ellis Ave. in the R3 Limited Multiple Family Residence District. The hearing was opened to the audience. The Acting Secretary read a letter from the State Division of Highways stating that this property would be taken for Route 39 freeway eventually. It was noted that this project could be built to conform to ordinance and that the applicant could build a total of 16 units on this property. There being no further Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY GERARDEN TO APPROVE CONDITIONAL EXCEPTION NO. 69-107 WITH THE FOLLOWING CONDITION: 1. A Division of Land application shall not be filed for a lot split on this property in the future. FOR THE REASONS: 1. The plan, as shown, would be much more desirable esthetically than if it were made to conform to the Ordinance. 2. This property will be taken by the State Division of Highways for the freeway in the future. ROLL CALL VOTE: AYES: Gerarden, Cook, Palin NOES: None THE MOTION CARRIED. A MOTION WAS MADE BY PALIN AND SECONDED BY GERARDEN TO APPROVE USE PERMIT NO. 69-71 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received December 30, 1969, shall be the approved layout. 2. Chapel Lane shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. . 3. Water supply shall be through the City of Huntington Beach's water system at the time said parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time said parcel is developed. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Easements for utilities or walkways shall be provided to Department of Public Works standards. 7. The property shall participate in the local drainage assess- ment district at the time said parcel is developed. 8. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. -4- 1/14/70 - BZA Minutes: H.B. Off-street parking facilities shall conform to Article 979. 11. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 12. All applicable City Ordinances shall be complied with. FOR THE REASONS: 1. The driveway meets City requirements. 2. Provision has been made for the required 40 ft. turnaround at the end of the driveway. ROLL CALL VOTE: AYES: Gerarden, Cook, Palin NOES: None THE MOTION CARRIED. MISCELLANEOUS: Green Hills Development - Precise Plan for fences within Tract 6453. It was noted that the Planning Commission approved Conditional Exception 68-13 with the condition that a precise plan be submitted to the Board for approval. A MOTION WAS MADE BY PALIN AND SECONDED BY COOK TO APPROVE THE SECOND PHASE OF THE PRECISE PLAN FOR FENCES IN TRACT 6453. ROLL CALL VOTE: AYES: Gerarden, Cook, Palin NOES: None THE MOTION CARRIED.
