MINUTES: On motion by Cook and second by Palin, minutes for
December 17, December 24, December 31, 1969, and
January 7, 1970, were accepted as transcribed.
USE PERMIT NO. 70-3
Applicant: Beacon Bay Enterprises, Inc.
To permit the construction of a
full service car wash and dispensing of gasoline.
Located at the southeast corner of
Brookhurst Street and Adams Avenue in the C2 Community Business
District. A legal description is on file in the Planning
Department Office.
In Conjunction With
DIVISION OF LAND NO. 70-1
Applicant: Beacon Bay Enterprises, Inc.
To permit a division of land of a
legal parcel of land into two legal parcels of land.
Located 280 ft. east of Brookhurst
Street and 300 ft. south of Adams Avenue in the C2 Community
Business District. A legal description is on file in the
Planning Department Office.
It was noted by the Acting Secretary
that the City Council had adopted a moratorium on issuance of
all building permits on subject property unless a use permit
is first obtained for the use. Also, the Planning Commission
has requested that the Board refer all applications for use
permits on this property to them for decision.
A MOTION WAS MADE BY PALIN AND
SECONDED BY COOK TO REFER USE PERMIT NO. 70-3 AND DIVISION OF
LAND NO. 70-1 TO THE PLANNING COMMISSION FOR DECISION AT THEIR
FEBRUARY 3, 1970, MEETING AT 7:00 P.M. IN THE COUNCIL CHAMBERS,
CIVIC CENTER.

PLOT PLAN AMENDMENT NO. 70-1
Applicant: Michael Duffy
To permit an amendment to UV No. 760
as previously approved by the Planning Commission for construction
of a new church at the northeast corner of Springdale Street and
Heil Avenue in the R1 Single Family Residence District. A
legal description is on file in the Planning Department Office.
The hearing was opened to the audience.

Father Duffy and John Bartlett,
representing the applicant, addressed the Board and answered
various questions. Father Duffy was informed that the City
is drafting service station standards which at this time precludes
the construction at the intersections of any secondary highway.
There being no further comment, the
hearing was closed.
Board discussion was held.
A MOTION WAS MADE BY MCFARLAND AND
SECONDED BY PALIN TO APPROVE PLOT PLAN AMENDMENT NO. 70-1
WITH THE FOLLOWING CONDITIONS:
1. Heil Avenue, Springdale Street, Orlando Drive and Bradbury
Lane shall be dedicated and fully improved to City standards
at the time each parcel is developed. Improvements shall
include street trees, street signs, street lights, fire
hydrants, sewer and:water main extensions.
2. Water supply shall be through the City of Huntington Beach's
water system.
3. Sewage disposal shall be through theCity of Huntington Beach's
sewage system.
4. The water, sewer, and fire hydrant system shall be approved_
by the Department of Public Works and Fire Department.
5. The property shall participate in the local drainage assess-
ment district.
6. Soil reports as required by the Building Department and the
Department of Public Works shall be submitted to the City
prior to issuance of building permits.
7. All utilities'shall be installed underground.
8. Off-street parking facilities shall conform to Article 979-
9. Parking compounds shall be screened with a -combination of
fencing and landscaping. Said plan shall be approved by
the Planning Department.
10. There shall be no fence, structure or landscaping constructed
or maintained over 3yz feet high within a 10 ft. by 10 ft.
triangular area at the intersection of driveways and streets
or within a 25 ft. by 25 ft. triangular area at the inter-
section of streets.
11. No structures, other than those shown on the approved plot
plan, shall be constructed within the project.
12. All applicable City Ordinances shall be complied with.

CONDITIONAL EXCEPTION NO. 70-1
Applicant: Huntington Pacific Corp.
To permit an increase in the
height of an existing wall from 4 ft. to 5.4 ft. and adding
to such wall a sign having an area of 44 sq. ft. Such sign is
to be designed as existing wall and constructed of the same
material and finish. Overall height of the wall and sign will
not exceed a height of 8 ft. 4 in.
Located on the southwest side of
Pacific Coast Highway at the intersection of 8th Street in
the Cl Neighborhood Commercial District. A legal description
is on file in the'Planning Department Office.
The hearing was opened to the
audience.
There was no one present to represent
the applicant.
Mrs. Tovatt, adjacent property
owner, addressed the Board and asked to'see'the plans and
asked the reason given by the applicant for the added height.

There being no further comment, the
Board discussion was held.
A MOTION WAS MADE BY COOK AND SECONDED
BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 70-1 FOR THE
FOLLOWING REASON:
1. The addition to the wall and sign area is not excessive
and is attractive.

Applicant: Coogan & Walters
To permit the construction of a
122,000 sq. ft. commercial building on a 11.5 acre parcel of
land.
Located at the southwest corner of
Garfield Avenue and Magnolia Street in the C4 Highway Commercial
District. A legal description is on file in the Planning
Department Office.
The hearing was opened to the
audience.
Mr. Priest, representing the
applicant, addressed the Board and answered various questions.
There being no further comment, the
hearing was closed.

A MOTION:WAS MADE BY COOK -AND SE-
CONDED BY PALIN TO APPROVE USE PERMIT NO. 70-2 WITH THE
FOLLOWING CONDITIONS:
1. Garfield Ave. and Magnolia Street shall be dedicated and
fully improved to City standards. Improvements shall in-
clude street trees, street signs, street lights, fire
hydrants, sewer and water main extensions.
2. Water supply shall be through the City of Huntington Beach's
water system.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
4. The water, sewer, and fire hydrant system shall be
approved by the Department of Public Works and Fire Depart-
ment.
5. The property shall participate in the local drainage
assessment district.
6. Soil reports as required by the Building Department and the
Department of -Public Works shall be submitted to the City
prior to issuance of building permits.
7. All utilities shall be installed underground.
8. Fire alarm system conduit and appurtenances shall be installed
by the developer at locations and to specifications pro-
vided by the Fire Department.
9. Off-street parking facilities shall conform to Article 979-
10. A masonry wall shall be constructed along the west property
line. The hei ht of said wall shall be such that the top
will be six (6 feet above the highest ground surface within
twenty (20) feet of the common property line.
11. No structures, other than those shown on the approved plot
plan, shall be constructed within the project.
12. All applicable City Ordinances shall be complied with.
13. A Division of Land application, separating this parcel
from the remaining property held udder the same ownership,
shall be filed with the City, approved and recorded,
Application shall be filed by February 3, 1970.
14. All the above conditions shall be complied with prior to
issuance of a Certificate of Occupancy by the Building
Department.
15. Easements for utilities or walkways shall be provided to
Department of Public Works standards.
16. The plot plan received January 21, 1970, shall be the
approved layout.

CONDITIONAL EXCEPTION NO. 70-2
Applicant: Wilkes & Steinbrueck - Architects
To permit the construction of carports
at "0" side and rear yard property lines in lieu of the required
5 ft. setback and within 10 ft. of the front property line in
lieu of the required 50 ft. setback for detached carports. Such
construction to be within a 120 unit apartment complex.
Located at the southeast corner
of Garfield Avenue and Magnolia Street in the R3 Limited Multiple
Family Residence District. A legal description is on file in
the Planning Department Office.

Applicant: Wilkes & Steinbrueck - Architects
To permit the construction of a
120 unit apartment complex on approximately 5.5 acres of land.
Located at the southeast corner of
Garfield Avenue and Magnolia Street in the R3 Limited Multiple
Family Residence District. A legal description is on file in
the Planning Department Office.
The hearing was opened to the
audience.
Mr. Steinbrueck, representing the
applicant and Mr. Weissman addressed the Board and answered
various questions. Mr. Weissman then made a presentation to
the Board and the homeowners present on the proposed development.
Mr. Steinbrueck displayed the plans and answered various questions
asked by the home owners abutting subject property.
Mr. Gibbs, representing the home
owners submitted a petition to the Board opposing the proposed
development as it was,.a violation of the zoning principal.
The Board informed the home owners
that the appeal period on the zone change has expired but that
any or all conditions of approval by the Board for Conditional
Exception 70-2 and Use Permit 70-1 could be appealed to the
Planning Commission within 10 days of the Board decision.
There being no further comment, the
hearing was closed.

A MOTION WAS MADE BY MCFARLAND AND
SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 70-2
WITH THE FOLLOWING CONDITION:
1. The carports located on the property lines shall be constructed
of maintenance free masonry material that is compatible with
the existing block wall on adjacent property. -Such material
shall be reviewed by the Board of Zoning Adjustments on site
prior to construction.

approved by the Department of Public Works.
14. All applicable City Ordinances shall be complied with.
15. All of the above -conditions shall be complied with prior to
issuance of a Certificate of Occupancy by the Building
Department. I.
16. A plan depicting the design and location of the trash collec-
tion areas shall be submitted to the Board for approval.
17. Speed bumps shall be installed within the driveways to control
traffic speed.
18. The plan received January 9, 1970, shall be the approved layout.
