BOARD MEMBERS PRESENT: McFarland, Lovejoy, Palin
USE PERMIT NO. 70-4
Applicant: Atlantic Richfield Company
To permit the construction of a
gasoline service station. Located at the southeast corner of
Brookhurst St. and Adams Ave. in the C2 Community Business
District. A legal description is on file in the Planning
Department office.
The Chairman read the request.
The hearing was opened to the audience.
Mr. Palin stated that by Resolution
No. 3110 adopted by City Council, a moratorium existed on the
subject property requiring that a Use Permit be obtained. Also,
the Planning Commission has requested that all such applications
on this property be referred to them for action.
The hearing was closed.

SECONDED BY LOVEJOY TO REFER USE PERMIT NO. 70-4 TO THE PLANNING
COMMISSION MEETING OF FEBRUARY 3, 1970, AT 7:00 P.M. IN THE
COUNCIL CHAMBERS.

CONDITIONAL EXCEPTION NO. 70-3
Applicant: Roy Lenord Day
To permit a reduction in the required
open space of 900 sq. ft. to 531 sq. ft. on a 25 ft. lot.
Located on the north side of Acacia Ave. on the east side of
10th St. in the R2 Two Family Residence District. A legal
description is on file in the Planning Department office.
The Chairman read the request and
opened the hearing to the audience.
Roy Lenord Day, applicant, was
present and explained his request. It was noted that the
existing dwelling on the lot had been ordered demolished by
the Building Department because it was substandard and hazardous.
A suggested 2/z ft. dedication on
the alley was explained to the applicant.
There being no further comment,
the hearing was closed.

A MOTION WAS MADE BY PALIN
AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION
NO. 70-3 WITH THE FOLLOWING CONDITION:
1. Applicant shall dedicate 216 ft. on the alley and the garage
shall be positioned within 5 ft. of such right-of-way to
increase the minimum dimension to 23 ft. 10 in. within such
open space area.
FOR THE REASON:
1. There is sufficient hardship on a 25 ft. lot in the R2
zone as a similar 25 ft. lot in the Rl zone would only
have to provide 90 sq. ft. of open space for each 5 ft.
of property frontage or a total of 450 sq. ft. of open
space on a lot similar to subject property having a
minimum dimension of 15 ft.

CONDITIONAL EXCEPTION NO. 70-4
Applicant: Trefoni Rizzi
To permit a roof to be
constructed over an existing boat storage area enclosed on
three sides to within 6 inches of the side property line in
lieu of the 5 ft. side yard setback. A legal description is
on file in the Planning Department office.
The Chairman read the request
and opened the hearing to the audience.
Mr. Palin read a letter
received from Mr. Zimmerman, adjacent property owner, which
stated he felt the proposed roof over the storage area would
generally improve the property and aesthetics of the neighbor-
hood.
Mr. Trefoni Rizzi, applicant,
was present and answered various questions. Mr. Palin informed
the applicant that the Planning Commission was concerned about
requests of this nature when the code amendment to allow garden
or wing walls to be constructed into the required sideyard
setback was approved.
There being no further
comment, the hearing was closed.
Board discussion followed.
The Board felt it essential to learn the Planning Commission's
view on such enclosed areas before decision could be made on
this request.

Applicant: Jan Allan Nagel
To permit an addition to an
existing dwelling eliminating the required 25 ft. turning
radius for maneuverability for one of the required off-street
parking spaces. Located at 7837 Newman Avenue in the R2
Two Family Residence District.
The Chairman read the request.
The hearing was opened to the audience.
The applicant was present and
explained his request. He stated his two -car garage structure
could only be used as a one -car garage as there is only a
single garage door, and laundry fa6ilities are in the other
half of said structure.
Mr. Wilkinson, nearby property
owner, spoke in opposition and stated he felt it unfair to
allow this exception, and that it might create parking conjes-
tion on the street.

There being no further comment,
Board discussion was held.
It was noted that if the existing
garage is a single car garage as stated by the applicant, the
request should be to reduce the number of parking spaces
instead of an elimination of the 25 ft. turning radius.
It was felt the City Attorney
should be consulted regarding this request and that a field
trip to the subject property would be beneficial to inspect
the garage in question.
