RESOLUTION OF INTENT cultural District, RA-0 Residential Agri-
cultural District combined with oil production, RI Single Fam-
ily Residence District, R5 Office -Professional District and MI
Light Industrial District to CF-R Community Facilities -Recrea-
tional District. The property consists of 147 acres of land,
located near the northeast, southeast andsouthwest corners of
Talbert Avenue and Golden West Street and is known as Phase I
of the Central City Park.
The Acting Secretary informed the Commis-
sion that such zone case should be withdrawn, since the City
Attorney's revised version of Code Amendment No. 70-1, which
will establish a Community Facilities District will satisfy
the intent of the City and the concern the property owners
have with respect to Zone Case No. 70-1.

The Acting Secretary informed the Commission
that this zone case was originally heard at their August 5, 1969
meeting at which time it was continued to the February 3, 1970
meeting. Mr. Harlow stated that later on the agenda the Plan-
ning Commission will consider a request to construct a 255 space
mobilehome park on the same property.
The hearing was opened to the audience. Mark
Botich, representing the applicant, addressed the Commission and
indicated that the applicant no longer wishes to pursue this re-
que:st.
There being no other comment the hearing was

Mark Botich, representing the applicant, ad-
dressed the Commission and stated that he has been working with
the Department of Public Works regardingathe=alignment'of"Dela-
ware Street. Bill Hartge, City Engineer, informed the Commis-
sion that the Department of Public Works has been working on
said alignment which will be submitted to the Commission for
consideration at their March 3, 1970, meeting; therefore, con-
tinuance of Zone Case No. 69-35 to the March 3, 1970, meeting
would be in order.
There being no other comment the hearing
was closed.

Tom Shelton, representing one of the pro-
perty owners, 17612 Beach Boulevard, Huntington Beach, addres-
sed the Commission and reviewed a soils report pertaining to the
subject property. Bill Hartge, City Engineer, concurred with
Mr. Shelton's soils report and recommended that no public streets
be constructed within the proposed development, nor should the
sewer and wafer lines which would have to be placed in the
streets be dedicated to the public. Mr. Hartge further discus-
sed peat conditions in the area.
Mel Harper, 2649 South Batson, Rolling
Heights, addressed the Commission and spoke in favor of the re-
zoning.
There being no other comment the hearing was
closed.
Commission discussion was held.
It was the consensus of the Commission to con-
tinue Zone Case No. 69-36 to allow time for the property owner
to investigate alternates for development of this property.

CONDITIONAL EXCEPTION NO. 7071
Applicant - W.M. Elliott Jr. To, permit the reactivation of
an of we which as bee idle for more than 6 months, located
north side of Utica Avenue, approximately 100 feet east of Dela-
ware Street in the R2 Two Family Residence District.
A video tape of the subject property and sur-
rounding area was shown.
A letter, submitted by Herbert Day, Oil Field
Superintendent, stating that this oil well meets all requirements
of the present Huntington Beach Oil Code was presented to the
Planning Commission.
The hearing was opened to the audience.
R.W. Shull, 1704 Coral Place, Seal Beach, a
property owner to the south, addressed the Commission and oppo-
sed the request. W.M. Elliott, Applicant, stated that he feels
the oil well has some potential and that he did not have the op-
portunity to re -activate this well prior to this time. He also
stated that he was unaware of the non -conforming section of the
Huntington Beach Code.

signation was taken off the subject property, therefore, this
request is contrary to City's policy which is for clean up of
the oil fields.

MILLER TO APPROVE CONDITIONAL EXCEPTION NO. 70-1 UPON THE FOL-
LOWING CONDITIONS:
a) The property shall be maintained in a neat, clean and
orderly manner.
b) All provisions of the Huntington Beach Oil Code and
Fire Code shall be complied with..
c) A concrete block wall shall be installed to Fire De-
partment standards around the existing tanks for aes-
thetic and safety reasons.
d) The applicant shall secure all necessary permits as
required by the Huntington Beach Ordinance Code.
e) The conditional exception shall be reviewed by the
Planning Commission during the month of September
1970, for the purpose of establishing additional con-
ditions of approval that are consistent with city or-
dinances effective at.that time; or, such conditional
exception shall become null and void on October 1, 1970.

f) The applicant shall screen the site with 5*-gallon my-
oporum trees arranged in such manner so as to adequate-
ly screen the oil well and tanks from view. A plan
showing the placement of such trees shall be approved
by the Board of Zoning Adjustments.
AND FOR THE FOLLOWING REASONS:
a) Properties in the immediate vicinity are of an oil-
field nature,
b) There are no. residences nearby and this use is com-
patible with the area.
c) The subject property within the area is taken for the
interchange of Routes 1 and 39 Freeways which will be
constructed within the next 8 to 10 years.
d) The action of the Planning Commission was sustained by
the City Council after the matter was considered on an
appeal.

1. Reactivation of said oil well will infringe on surrounding
property rights.
2. Said request is contrary to City's policy for cleaning up
the oil fields.
3. Said oil well is non -conforming.

CONDITIONAL EXCEPTION NO. 70-3
Applicant - St. Francis School To permit the construction of
a metal storage building 30 feet by 102 feet, in conjunction
with an existing school in the R1 Single Family Residence Dis-
trict, located northeast corner of Indianapolis Avenue and Mag-
nolia Street.
A video tape of the subject property and
proposed location of the building was shown.
The hearing was opened to the audience.
Mrs. Wanda Dugan, 20385 Fee Lane, and Mr.
P.C. McMahan, 9191 Strathcona Drive, addressed the Commission.
and opposed the request because of .the. type of,proposed..struc-
ture.
Father Ronald, representing the St. Francis
School, addressed the Commission and stated that the church needs
this storage building, as two classrooms are beipg used for stor-
age. Father Ronald further stated that the proposed structure
will be compatible in color with the existing buildings.

A MOTION WAS MADE BY BAZIL AND SECONDED BY
TOM TO APPROVE CONDITIONAL EXCEPTION NO. 70-3 UPON THE FOLLOW-
ING CONDITIONS:
1. The structure shall be similar in type and design to
the existing church and school facility.
2, The structure shall be designed and landscaped so as
to be compatible with other buildings within the church
facility.
3. A 30 ft. setback shall be provided from the abutting
single family area.
4. A Division of Land application, separating the subject
property from the property to the south to make such
area a permanent part of the church and school property,
shall be filed with the City and recorded prior to fram-
ing inspection of the structure.
5. -Final determination as to compliance with conditions 1
through 3 shall be made by the Board of Zoning Adjust-
ments prior to issuance of building permits.

USEPERMIT NO. 69-69 - (Referred by Board of Zoning Adjustments)
Applicant - American Mobile Home Corp. To permit the construc-
tion ot a 255 space mobile home park on approximately 31,34 acres
of land, located southwest corner of Atlanta Avenue and Beach
Boulevard in the R5 Office -Professional District and the R5 Of-
fice -Professional District combined with oil production.
The Acting Secretary informed the Commission
that the staff recommends continuance until May 19, 1970, be-
cause it will be approximately 5 months before a report outlin-
ing an economic analysis of this area is available. If the con-
tintuance is not agreed to, the staff recommends denial.
The -hearing was opened to the audience.
Clark Leonard, Civil Engineer, addressed the
Commission and stated that he feels the proposed plan conforms
with existing zoning requirements and the proposed trailer park
will solve a drainage problem and upgrade the area. Mr. Leonard
also stated that a denial will be discriminatory and will deprive
them of a right granted to abutting property owners. Phil Walsh,
representing the American Mobile Home Corp., esplained the re-
quest. Mr. Walsh reviewed statistics pertaining to the number of
people per trailer, cost of the average home and average income
of persons who will live within the subject park. He also stated
that in addition to providing a place for people to live, a mo-
bile home.park:serves as a land bank until the highest and best
use of the property can be realized. To accomplish this, Mr.
Walsh stated that their company would submit to architectural

TION TO BE SUBMITTED.
THIS MOTION WAS WITHDRAWN BECAUSE THE APPLI-
CANT REQUESTED THAT A DECISION FOR APPROVAL OR DENIAL BE MADE.

1. The Planning Commission had originally suggested contin-
uance of the matter until May 19, 1970; however, the ap-
plicant has requested that a decision be made at this
time,
2. Additional time was necessary, so as to review the data
to be supplied by Economic Research Associates, as to
the economic potential of the area and inasmuch as a
decision has been requested, the Planning Commission has
insufficient data upon which to base their decision,
3. Mobilehome Park is inconsistent with the "Top -of -the -
Pier" Development Plan because mobilehome parks have not
been included as proposed uses within such are,4.'

Meredith Gardens Homeowners Association, Inc., requesting that
all four items be considered together and that all parties con-
cerned be allowed to speak in favor or against. Mr. Slates sta-
ted that the applicants will present their cases individually.
The hearing was opened to the audience on Use Permit No.
69-70, Division of Land No. 69-43, Use Permit No. 70-3 and Use
Permit No. 70-4.
James DeChaine, Asst. City Manager, Newport
Beach, addressed the Commission and introduced each of the ap-
plicants or their representative on these five items. Mr.
DeChaine commended the City of Huntington Beach on their action
for controlled commercial development.
P.D. Lippert, representing the Atlantic
Richfield Corp., on Use Permit No. 70-4, addressed the Commis-
sion and submitted a photograph of the proposed service station.
Mr. Lippert stated that he was advised by the Design Review
Board that the type of service station shown on the photograph
would be acceptable at any location in the city other than along
the beach.
J.M. Shea, representing Beacon Bay Enterprises, Inc.,
explained the design of the structure and materials to be used
for the proposed car wash required by Use Permit No. 70-3. Mr.
Shea stated that this structure will be compatible in both de-
sign and materials used within the overall project. He also
stated that this structure is the same as the car wash proposed
for construction within the Newport Shopping Center.
Bill Hartge, City Engineer, addressed the
Commission and discussed curb cuts, future median brakes and
the traffic flow within the proposed development.
J.P. Pollock, representing the Handyman
Company, stated that all merchandise will be stored inside of
the building except the nursery stock. Mr. Pollock also stated
that the trash collection will be screened from view by a 6 ft.
high wall. He further added that the elevation of the sides and
rear of the building will be essentially the same as the front
elevation:
Dean Royce, realtor, representing Mr. Sakioka,
presented plans showing a possible building layout for Parcel #2,
stating that his client is looking for compatible uses. Mr. Royce
stated that this plan depicted one of many possibilities for de-
velopment.
Owen Kupfer, representing Mr. Sakioka, infor-
med the Commission that the applicant does not have plans for
Parcel #2 at this time. Mr. Kupfer stated that Mr. Sakioka is a
farmer, not a developer, and that he is open to suggestions on
the configuration of the parcels if it will result in a better
development.
Persons speaking in opposition of Use Permit
No. 69-70, Division of Land No. 69-43, Use Permit No. 70-3, Di-
vision of Land No. 70-1 and Use Permit No. 70-4 were as follows:
Edward Kerins, representing the Meredith Gardens Homeowners As-
sociation, stated that the proposed use would be detrimental to
the surrounding area and to the City as a whole. He discussed
commercial development in the area and pointed out situations
that have developed when property is divided without regard to
future use of the vacant parcels. He specifically-poirited out
the commercial development,_on the northwest corner- of Adams Ave-
nue and Magnolia Street.. Mr., Kerins 'fiirther stated that if a
division of land is granted to Mr. Sakioka, it will form an odd
piece of land which would be hard to develop with commercial

structures. Mr. Kerins suggested that the Commission take their
time so as to have the city develop in a proper manner. He stat-
ed that the Commission has three alternatives with regard to de-
velopMent of this corner.
1. The Commission can deny all applications before them.
2. The Commission can inform Mr. Sakioka that they will not
accept any development on this property less than total de-
velopment so as to provide a totally coordinated development.
3. The Commission may, by resolution of intent rezone this pro-
perty R1 because the master plan of land use only calls for
commercial development on three corners of this intersection
and the city recently rezoned the soughwest corner C4 caus-
ing a surplus of commercial zoning.

Bay Homeowners Association, stated that he was concerned with
traffic problems. He felt that there were too many curb cuts and
that a better traffic circulation plan should be established.
Dave Shulte, past president of Meredith Gardens Homeowners Asso-
ciation, stated that if this project is approved it will cause a
hodge podge development and potential blight. Ted Denney, Tan-
bark, was opposed to the fact that development of Parcel #2 was
unknown.
CHAIRMAN SLATES: Chairman Slates excused himself from further
participation at 10:30 P.M.
Vice -Chairman Tom assumed duties as Chair-
man.
Each applicant then made a rebuttal to the:
opposition.
Robert Lawson, Architect, representing Beacon
Bay Enterprises, Inc., stated that the proposed car wash facili-
ty will only have one point of access to Adams Avenue.
Mr. Phil Anshultz, Coldwell Banker Company,
stated that this is an existing commercial corner and as such
they must seek commercial uses. He further stated that the car
wash will be properly handled.
Mr. Pollock, representing the Handyman of Cal-
ifornia, stated that their business is based on the amount of
homes in the area to be properly served and they will not rent
equipment.
There being no other comment the hearing was
closed.
Commissioner Bazil stated that he feels that
the configuration of Parcel 2 on the property owned by Mr. Saki-
oka will be difficult to develop commercially in the future.
Commission discussion followed.

OIL OEDINANCE Said Code Amendment proposes to amend
Article - - Combining Oil District) by renumbering, reword-
ing and adding various sections within such Article. Also, said
amendment proposes to reword Section 9700 (n) Definitions.
The Acting Secretary informed the Commission
that the porposed revision to the oil ordinance will be referred
to the Oil Committee for further discussion; therefore, a contin-
uance of said item to March 17, 1970, is recommended.

INFORMATION: The Acting Secretary informed the Commission that
a joint meeting will be held with the City Council on February
19, 1970, at 7:00 P.M. in the Council Chambers, concerning a dis-
cussion on two proposed ordinances:
1) Community Facility Zone; and, 2) Civic District Suffix.
COMMISSIONER B'AZIL: Commissioner Bazil stated that he was con-
cerned with t e a undance of mobilehome parks in areas of the
city, specifically the area south of Indianapolis Avenue, along
Beach Boulevard. Mr. Bazil suggested that a letter be sent to
the City Council opposing mobilehome parks in this area. It was
the consensus of the Commission that steps be taken to eliminate
this possibility.
