CONDITIONAL EXCEPTION NO. 70-5 - Continued Applicant: Jan Allan Nagel To permit a reduction of one off- street parking space required for a room addition to an exist- ing structure and a reduced side yard setback to 3 ft. in lieu of the required 5 ft. Located at 7837 Newman Avenue, in the R2 Two Family Residence District. The Chairman read the request and opened the hearing to the audience. The Acting Secretary advised the Board that this request had been improperly advertised and that a new legal has been mailed to all abutting property owners. The Chairman advised the applicant that the Board had inspected the property and garage in question and had noted that several homes in the area were built similar to the applicant's residence. It was also noted that the garage is a single car garage and was originally constructed as such. hearing was closed. There being no further comment, the Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 70-5 FOR THE REASONS: 1. The applicant is proposing to add additional bedrooms and not an additional dwelling unit. 2. The garage is existing with the 3 ft. side yard setback and such setback is similar to others in the area. In Conjunction With USE PERMIT NO. 70-5 - Continued Applicant: Richard Bracken To permit the construction of an eleven (11) unit apartment complex on approximately .52 acres of land. Located on the east side of Van Buren Street approximately 150 feet south of Slater Avenue in the R2 Two Family Residence District. The Chairman read the request and opened the hearing to the audience. The Acting Secretary informed the Board that a new plan had been submitted to the Planning Department for review and that such plan was in conformance with the Board's requests. and answered various questions. the hearing was closed. The applicant was present There being no further comment, Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO DENY CONDITIONAL EXCEPTION NO. 70-5A FOR THE FOLLOWING REASON: 1. The revised plot plan conforms with the required setbacks; therefore, the conditional exception is no longer needed. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. A MOTION WAS MADE BY PALIN AND SECONDED BY COOK TO APPROVE USE PERMIT NO. 70-5 WITH THE FOLLOW- ING CONDITIONS: 1. Van Buren Street shall be dedicated and fully improved to City standards. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3, Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assessment district. 6. USE PERMIT NO. 70-6 - Continued Applicant: Capital Development Co. To permit the construction of a 266 space mobile home park on approximately 27.5 acre parcel of land in the R5 Office -Professional District. Located at the northwest corner of Beach Blvd. and Atlanta Avenue. The Chairman read the request and opened the hearing to the audience. Mr. Art Sellery, representing the applicant, addressed the Board and answered various questions. The Acting Secretary advised the applicant that the Planning Department is requesting a continuance on this application until May 19, 1970, to allow sufficient time for Economic Research Associates to submit an economic analysis of this area within the Top -of -Pier plan or that the request be denied. Mr. Sellery inquired if it would be possible to resubmit plans eliminating property within the Top -of -Pier plan. Mr. Palin advised that the Planning Department could accept the revision as requested and refer such plan to the Planning Commission for decision. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO REFER USE PERMIT NO. 70-6 TO THE PLANNING COMMISSION MEETING ON MARCH 17, 1970, AT 7:00 P.M. IN THE COUNCIL CHAMBERS, WITH THE CONDITION: 1. The applicant shall revise the plot plan to eliminate that portion within the Top -of -Pier plan. Grace To permit construction of a garage with a 20 ft. setback from street in lieu of the required 22 ft. setback. Located on the east side of Eagle Lane, approximately 70 ft. north of Middlecoff Drive in the Rl Single Family Residence District. The Chairman read the request and opened the hearing to the audience. Michael Grace, applicant, was present and addressed the Board. Discussion was held. It was determined that the applicant would have to increase the width of the attachment an additional 3 ft. to meet the requirements of the City ordinance. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 70-6 WITH THE FOLLOWING CONDITION: 1. The attachment between the existing dwelling and proposed garage shall be a minimum of 10 ft. in width. FOR THE REASON: 1. Garages in the same tract are constructed with a similar setback. ROLL CALL VOTE: AYES: McFarland, Cook, Patin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-7 Applicant: David G. Hartke To permit --an addition of a bedroom within 5 ft. 6 in. of exterior property line in lieu of the required 10 ft. exterior side -yard setback. Located at the southeast corner of Malibu Lane and Banning Avenue in the Rl Single Family Residence District. The Chairman read the request and opened the hearing to the audience. Mr. Hartke, applicant, was present and addressed the Board. Mr. Hartke stated that other homes within this tract are constructed with a similar setback. -4- 2/11/70 - BZA H.B. Board of Zoning Adjustments Wednesday, February 11, 1970 Page No. 5 The Acting Secretary advised the applicant that the Planning Commission has requested that the Building Department treat lots siding onto an arterial highway as exterior lots having the required 10 ft. exterior side -yard setback. This item was tabled to later in the meeting in order that a plot plan of the tract could be brought to the meeting for the Board's review. USE PERMIT NO. 70-7 Applicant: Jack H. Bennett To permit the construction of a 48 unit apartment house project on approximately 2.49 acres of land. Located on the northwest corner of Yorktown Avenue and Florida Street in the R3 Limited Multiple Family Residence District. The Acting Secretary advised that two letters had been received from nearby property owners recommending approval of this request. The Chairman read the request and opened the hearing to the audience. Mr. Gersten representing the applicant, addressed the Board and explained the request. Mr. Gersten asked the Board if the State of California Division of Highways had received notice of this hearing and was informed by the Board that a notice of this hearing was mailed to the State Division of Highways. hearing was closed. There being no further comment, the Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 70-7 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received January 23, 1970, shall be the approved layout. 2. England Street, Yorktown Avenue and Florida Street shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 8. The property shall participate in the local drainage assess- ment district. 9. Soil reports as required by the Building Department and the Department of Public:Works shall be submitted to the City prior to issuance of building permits. 10. All utilities shall be installed underground. 11. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 12. Off-street parking facilities shall conform to Article 979• 13. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 14. All private streets shall meet the minimum standards for planned residential developments as adopted by the Planning Commission. 15. The structural street section of all private drives shall be approved by the Department of Public Works. 16. All applicable City Ordinances shall be complied with. 17. USE PERMIT NO. 70-8 Applicant: Huntington Beach Holding Corporation To permit the construction of a 14 acre shopping center.with a major department store, a bank, restaurants and miscellaneous shops. In Conjunction With DIVISION OF LAND NO. 70-2 Applicant: Huntington Beach Holding Corporation To allow a division of land into five separate parcels of a 14 acre commercial property. Located at the southwest corner of Brookhurst street and Adams Avenue in the C4 Highway Commer- cial District. The Chairman read the request and opened the hearing on Use Permit No. 70-8 to the audience. Present to represent the applicant and future tennants in the shopping development were Messrs. James N. Ries, Anthony R. Buccola, Ted Moore, Nat Abrahms, Norman N. Rosen, and Doug Warren. Mr. Ries explained the -6- 2/11/70 - BZA Minutes: H.B. Board of Zoning Adjustments Wednesday, February 11, 1970 Page No. 7 requests of this Use Permit and was advised by the Board that the previous Use Permit on subject property would be null and void at the time of approval of Use Permit No. 70-8. Mr. Ries was informed that this new use permit was necessary due to revised location of the proposed structures and because the property was being divided into separate parcels. Architectural design and types of building materials were discussed with the applicant. Nat Abrahms, Ardhitect for Two Guys, submitted photographs of renderings and assured the Board there would be compatibility between the uses proposed for construction on subject property. There being no further comment, the hearing was closed for Use Permit No. 70-8. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 70-8 WITH THE ASSURANCE OF COMPATIBILITY OF ARCHITECTURAL DESIGN AND TYPES OF BUILDING MATERIALS BETWEEN USES ON THIS PROPERTY AND WITH THE FOLLOWING CONDITIONS: 1. The plot plan received January 28, 1970, shall be the approved layout. 2. Adams Avenue and Brookhurst Street shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Easements for utilities or walkways shall be provided to Department of Public Works standards. 7. All buildings on lots abutting a City easement shall be set back five '(5) feet from the edge of such easement. 8. The property shall participate in the local drainage assessment district at the time each parcel is developed. 9. A masonry wall shall be constructed along south and west property lines. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. 15. There shall be no fence, structure or landscaping con- structed or maintained over 3y2 feet high within a 10 ft. by 10 ft. triangular area at the intersection of drive- ways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. 16. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 17. A lighting system shall be installed within the project equal in illumination to lighting on.public streets. A lighting plan shall be submitted to the Department of Public Works for approval. 18. All applicable City Ordinances shall be complied with. 19. A Division of Land application, separating this parcel from the remaining property held under the same ownership, shall be filed with the City, approved and recorded. The plot plan received January 28, 1970, shall be the approved layout. 2. Adams Avenue and Brookhurst Street shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 5. Hartke The hearing was reopened. The Board was informed that the plot plan of subject tract was not available. There being no further comment, the hearing was closed. Board discussion was held. It was felt that a field trip should be made to review other exterior side -yard setback within subject tract. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE CONDITIONAL EXCEPTION NO. 70-7 TO THE NEXT REGULAR MEETING TO BE HELD ON FEBRUARY 18, 1970, AT 1:15 P.M. TO ALLOW SUFFICIENT TIME FOR THE BOARD MEMBERS TO INSPECT SUBJECT PROPERTY AND OTHER EXTERIOR SIDE -YARD SETBACKS WITHIN SUBJECT TRACT.
