AGENDA ITEMS TO BE CONTINUED: CONDITIONAL EXCEPTION NO. 70-11 Applicant: Covington Bros. To permit the waiver of a peri- meter wall along the exterior side yard of a lot siding on Golden West St.; and, to allow existing wall to satisfy said requirement in the R3 Limited Multiple Family District. Located on the southeast corner of Heil Ave. and Golden West St. The Acting Secretary informed the Commission that upon the City Engineer's recommendation, this case should be continued to March 17, 1970, to allow the staff time to work out a possible solution with the developer. Gindling 63 lots on 15.8 acres, located 772 ft. north of Adams Ave., east of Bushard St. A letter, submitted by Millet - King & Assoc., engineer for the applicant, requesting contin- uance to the next regular meeting,was received. USE PERMIT NO. 70-3 (Referred by the Board of Zoning Ad"ust- ments)(Continued for decision only Applicant: Beacon Bay Enterprises To permit the construction of a full service car wash and dispensing of gasoline. Located at the southeast intersection of Brookhurst St. and Adams Ave. in the C2 Community Business District. The Acting Secretary informed the Commission that this item was considered by them on February 17th. Mr. Harlow pointed out that a decision at that time was not reached due to a provision in the by-laws requir- ing that four affirmative votes be cast for either approval or denial; therefore, this matter was brought back at this meeting for decision. The Commission reviewed the proposal. Commissioner Porter stated that he was concerned that the car wash was dispensing gasoline in addition to the service station on the corner. Commissioner Bazil stated that he feels that the Planning Commission's responsibility is to see to it that the development is properly handled. Commissioner Duke stated that he does not consider a car wash as a prime commercial use. Commissioner Tom stated that he feels this proposal will be compatible with other commercial uses in the area. A MOTION WAS MADE BY SLATES AND SECONDED BY MILLER TO APPROVE USE PERMIT NO. 70-3 UPON THE FOLLOWING CONDITIONS: 1. The plot plan received January 8, 1970, shall be the approved layout. 2. All conditions of approval for Division of Land No.70-1 that are applicable shall be complied with. 3. Additional traffic circulation shall be provided across the south property line into the parcel owned by Handyman, Inc. 4. Driveway locations shall be approved by the Traffic Engi- neer. 5. All applicable city ordinances shall be complied with. 6. The Board of Zoning Adjustments shall review the design of the proposed structures to assure compatibility with other commercial buildings proposed on this corner. Planning Commission March 3, 1970 Page 3 MINORITY REPORT: Commissioner Duke stated that a use permit or service station and car wash causes duplication of service station in car wash, resulting in five service stations on one corner. USE PERMIT NO. 70-4 (Referred by the Board of Zoning Ad'ust- ments)(Continued for decision only] Applicant: Atlantic Richfield Co. To permit the construction of a gasoline service station at the southeast corner of Brook- hurst St. and Adams Ave. in the C2 Community Business District. The Commission reviewed the request. Commissioner Porter stated that he feels the appli- cant could improve the design of the proposed service station. A MOTION WAS MADE BY MILLER AND SECONDED BY BOKOR TO APPROVE USE PERMIT NO. 70-4 UPON THE FOLLOWING CONDITIONS: 1. The plot plan received January 15, 1970, shall be the approved layout. 2. All conditions of approval for Division of Land No.70-1 that are applicable shall be complied with. 3. Driveway locations shall be approved by the Traffic Engineer. 4. The Board of Zoning Adjustments shall review the design of the building to assure compatibility with other commer- cial buildings proposed on this corner. 5. A driveway shall be provided parallel to Adams Ave. pro- viding access to the parcel to the east to facilitate traffic circulation. 6. All applicable city ordinances shall be complied with. A FURTHER MOTION WAS MADE BY PORTER AND SECONDED BY DUKE TO DENY USE PERMIT NO. 70-4 FOR THE FOLLOWING REASON: 1. The applicant failed to coordinate efforts in continuity of design with other proposed developments at this corner. PRECISE PLAN OF STREET ALIGNMENT NO. 70-2 Said plan proposes to precise plan the alignment of the southerly extension of Delaware St. between Frankfort Ave. and Atlanta Ave. Bill Hartge, City Engineer, submitted two alternates for the alignment of the southerly extension of Delaware St. to the Commission for their review. The hearing was opened to the audience. Mark Botich, VTN Orange County, representing the property owner, addressed the Commission and stated that he was in accord with the proposed street align- ment which will serve as the easterly boundary of the project. -3- 3/3/70-PC Minutes: March 3, Page 4 H.B. A MOTION WAS MADE 13Y BOKOR AND SECONDED BY PORTER TO RECOMMEND APPROVAL OF PRECISE PLAN ALIGNMENT NO. 70-2 DESIGNATED AS PLAN "A" TO THE CITY COUNCIL. ROLL CALL -VOTE: AYES: -Bazil, Bokor, Slates, Miller, Porter, Tom, Duke NOES: None ABSENT: None THE MOTION CARRIED. It was the consensus of the Commission to set balance of the southerly extension of Delaware St. for a public hearing on April 7, 1970. ZONE CASE NO. 69-35 - Continued Applicant: John MacLeod Change of zone from R5 Office - Professional and R2 Two'Family Residence District to R3 Limited Multiple Family Residence -District. Located on the south side of Detroit St. and west side of the new extension of Delaware St. The hearing was opened to the audience. The Acting Secretary informed the Commission that the reason for continuance of this case was to precise -plan the alignment of Delaware St. which will serve as the easterly boundary of the project. Mark Botich, representing the applicant, presented plan showing the proposed development. There being no other comment, the hearing was closed. Commission discussion was held. A MOTIO14 WAS MADE BY TOM AND SECONDED BY BOKOR TO RECOMMEND APPROVAL OF ZONE CASE NO.69-35 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The southerly extension of Delaware St. will -provide a separation between uses. 2. The proposed use is consistent with the "Top -of -Pier" Plan. Change of zone to R5 Office -Pro- fessional District. Located between Garfield Ave. and Ellis Avenue, east to the extension of Newland St. The hearing was reopened to the audience. Tom Shelton, engineer for the applicant, submitted soil reports on the subject property. Mr. Shelton stated that there would be definite problems if the subject property were developed other than as a mobilehome park. Chairman Slates informed Mr. Shelton of City's desire to eliminate mobilehome parks from the R5 zone and that a new zone for such use will be created -in the near future. hearing was closed. The applicant agreed to -the continuance. A MOTION WAS MADE BY SLATES AND SECONDED BY BOKOR TO CONTINUE ZONE CASE NO. 69-36 TO MAY 5,1970, IN ORDER TO DEVELOP STANDARDS FOR MOBILEHOME PARKS. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Miller, Porter, Duke, Tom NOES: None ABSENT: None THE MOTION CARRIED. ZONE CASE NO. 70-5 Applicant: Fredericks Development Corp. Change of zone from C2 Commu- nity Business District to C4 Highway Commercial. Located on the southwest corner of Warner Ave. and Bolsa Chica St. The hearing was opened to the audience. Donald Severa, architect, repre- senting the applicant, stated that they are planning to build a motor hotel with kitchens in all units. There being no other comment, the hearing was closed. The Acting Secretary pointed out to the Commission that under Section 9700(m) "Definitions" only allows 25% of the total number of sleeping units to have kitchens or kitchenettes. Mr. Harlow stated that this definition was intended to eliminate the possibility of a developer con- structing an apartment complex under the pretext of having a motel or motor hotel. Commission discussion was held. Commissioner Bazil stated that he is voting on the basis of zoning and not the proposed use. Commissioner Duke concurred with Mr. Bazil's statement. The Commission advised the applicant that approval of the zone case should not be taken as an approval for a motor hotel with kitchens for all units. A MOTION WAS MADE BY DUKE AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF ZONE CASE NO.70-5 TO THE,CITY COUNCIL FOR THE FOLLOWING REASON: 1. This location is acceptable for the proposed use and zone because of 'its orientation to -the future -freeway, freeway off -ramp and the Bolsa Chica State Park. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Miller, Porter, Duke NOES: Tom ABSENT: None THE MOTION CARRIED. TENTATIVE TRACT MAP NO. 6651 Applicant: Derby Land Co. 140 lots on 29.7 acres of land, located at the southeast corner of Indianapolis Ave. and Bushard St. The Commission reviewed the suggested conditions of approval. A MOTION WAS MADE BY BOKOR AND SECONDED BY PORTER TO APPROVE TENTATIVE TRACT MAP NO. 6651 UPON THE FOLLOWING CONDITIONS: 1. All applicable conditions of the previously approved ten- tative map shall be complied with. 3. A sewer and drainage easement shall be provided between lots 11 and 12 and lots 27 and 28 to Department of Public Works requirements. 4. Provisions shall be made for dedication of the park site within tract 6755 prior to submitting a final tract map to the City Council for approval. 5. CONDITIONAL EXCEPTION NO. 70-13 Applicant: Charles Poss To permit a mobilehome trailer to be used as an office for a period of two years in the MI Light Industrial District. Located on the west side of Nichols St., 640 ft. north of Slater Ave. The hearing was opened to the audience. A representative for the appli- cant pointed out that the building was constructed as a pre- fabricated office, but due to a misunderstanding it could not be moved on a lot as a permanent building. He stated that the applicant would like to use this building until such time exact needs are determined. There being no other comment, the hearing was closed. i Commission discussion was held. Commissioner Tod stated that if this application is approved, a precedent could be set for other applications. Commissioner Bokor stated that 12 years should be sufficient time for approval. A MOTION WAS MADE BY BOKOR AND SECONDED BY BAZIL TO APPROVE CONDITIONAL EXCEPTION NO. 70-13 UPON THE FOLLOWING CONDITIONS: 1. Conditional Exception No. 70-13 shall become null and void on September 1, 1971; except that the Board of Zon- ing Adjustments may grant a 6 months continuance if it is determined that construction on a permanent building is proceeding without undue delay. 2. CONDITIONAL EXCEPTION NO. 70-14 Applicant: George W. Easterday To permit retail building (i.e. builders supplies rock, etc.). Located on the south side of the P.E. Planning Commission March 3, 1970 Page 7 The hearing was opened to the audience. Mr. Julius Tutler, Pacific Drive - In Theatre, stated that he was not technically opposed to the request, the only concern was over the texture of the build- ing and that the lighting be directed so it would not inter- fere with night-time operation of the drive-in theatre. Mr. Easterday, applicant, informed Mr. Tutler that there will be no outside lights in- stalled. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY MILLER AND SECONDED BY DUKE TO APPROVE CONDITIONAL EXCEPTION NO.70-14 UPON THE FOLLOWING CONDITIONS: 1. All provisions of Division of Land No. 70-4 shall be complied with. 2. All applicable City Ordinances shall be complied with. 3. A plot plan shall be submitted to the Board of Zoning Adjustments for final approval. CONDITIONAL EXCEPTION NO. 70-15 Applicant: Huntinzton Intercommunitv Hospital To permit two 10 ft. x 55 ft. trailers to be used as offices for approximately 17 to 18 months. Located on the east side of Beach Blvd., south of Newman Ave. in the R3 Limited Multiple Family Residence District. The hearing was opened to the audience. Mr. Grundy, American Medicorps Assoc., -stated that they, as new owners, have every inten- tion of constructing a four-story tower but are requesting the use of trailers as temporary quarters. There being no further comment, the hearing was closed. Commission discussion was held. Commissioner Tom stated that this case is not any different than the previous case - Conditional Exception No. 70-13, per- taining to a trailer to be used as an office and precedent could be set. A MOTION WAS MADE BY MILLER AND SECONDED BY BOKOR TO APPROVE CONDITIONAL EXCEPTION NO.70-15 UPON THE FOLLOWING CONDITIONS AS AMENDED: 1. All applicable provisions of Section 9730.25.3 shall be complied with. 2. Conditional Exception No. 70-15 shall become null and void September 1, 1971, except that the Board of Zoning Adjustments may grant continuance of the use for a specified period if the Board determines that construction is proceeding without undue delay. -7- 3/3/70-PC Minutes: H.B. Chairman Slates suggested that the staff initiate a zone change on the subject property from R3 to RS . DISCUSSION: Commissioner Bazil suggested that the Commission should inform future applicants for service stations exactly what the Commission wants as to architectural features and design. The Acting Secretary informed the Commission -that this item will be scheduled at the next study session at which time service station standards will be discussed.
