Loeffler To permit the following: a) 14 ft. between exterior walls of main dwellings in lieu of the required 15 feet; b) a minimum dimension of 17 feet for the required open space in lieu of the required 20 feet. Located on the northwest corner of California Street and Joliet Avenue. The hearing was opened to the audience. The Acting Secretary noted that there had been a conditional exception before the Planning Commission on April 16, 1969, requesting a variance on this same property. Mr. Palin advised the applicant where a Conditional Exception has been denied, no application shall be considered for the same or similar use within a period of one year. Mr. Loeffler agreed to a contin- uance to April 15, 1970, at which time a year will have lapsed. A MOTION WAS MADE BY COOK AND SECONDED BY MCFARLAND TO CONTINUE CONDITIONAL EXCEPTION NO. 70-9 TO APRIL 15, 1970, TO ALLOW FOR THE LEGAL TIME LAPSE. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. DIVISION OF LAND NO.— 70-6 Applicant: Diversified Shopping Centers, Inc. To allow a division of land into two separate parcels. Located at the northeast corner of Atlanta Avenue and Magnolia Street. represent the applicant. There was no one present to Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE DIVISION OF LAND NO. 70-6 WITH THE FOLLOWING CONDITIONS: 1. Magnolia Street and Atlanta Avenue shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Easements for utilities or walkways shall be provided to Department of Public Works standards. 7. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 8. The property shall participate in the local drainage assess- ment district at the time each parcel is developed. 9. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 10. All utilities shall be installed underground. 11. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 12. A Parcel Map shall be filed with the City and recorded prior to occupancy of any structures on any parcel. 13. The Division of Land shall not be effective until an agree- ment is signed and recorded agreeing to the conditions listed above. A FURTHER MOTION WAS MADE BY COOK AND SECONDED BY PALIN TO RECONSIDER THE MOTION FOR APPROVAL. There was further Board discussion. Commission for conditions as the Board deems necessary) Located on the south side of Warner Ave., 660 ft. east of Edwards Street. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE THE CONDITIONS AS OUTLINED FOR CONDITIONAL EXCEPTION NO. 70-8 AND REFER BACK TO THE PLANNING COMMISSION STUDY SESSION, MARCH 10, 1970, AT 2:00 P.M. TO BE HELD IN THE COUNCIL CHAMBERS FOR FINAL DECISION. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-2 (Review) Applicant: Wilkes & Steinbrueck To review the masonry material of the carports for compatibility with the existing block wall on adjacent property. Located on the southeast corner of Garfield Ave. and Magnolia St. No one was present to represent the applicant. Board discussion was held. It was noted that an inspection was held February 27, 1970, and the sample presented to the Building Department was found to be compatible with the existing wall on the adjacent property. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE THE USE OF THE SAMPLE PRESENTED FOR CONSTRUCTION OF THE CARPORTS AT "0" SETBACK. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE ACTION - S & S CONSTRUCTION - TRACT 7005 To permit temporary on -site feature signs. Referred to the Board by the Building Director. The Board reviewed the request and found that the criteria for such approval (Section 9761.9.1 of the Huntington Beach Ordinance Code) had been complied with. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE THE ON -SITE FEATURE SIGNS AS SHOWN ON THE PLOT PLAN SUBMITTED.
