Located on the northwest corner of Beach Blvd. and Atlanta Ave. The Acting Secretary informed the Commission that the staff recommends continuance of Use Permit No. 70-6 to the April 7, 1970, meeting to allow time for a response from the State Division of Highways and for the Com- mission to review the proposed mobilehome park zone. Located on the southeast corner of Heil Ave. and Golden West Street. The hearing was opened to the audience. There being no comment, the hearing was closed. The Acting Secretary informed the;Commission that the staff had no objection to the waiver of the wall in this situation because units within the apartment building front on Golden West St. arid,exposure to Golden West St. is preferred. A MOTION WAS MADE BY MILLER AND SECONDED BY BOKOR TO APPROVE CONDITIONAL EXCEPTION NO 70-11 UPON THE FOLLOWING CONDITIONS: 1. The developer shall provide variation for such wall at location and to specifications of the Department of Public Works and the Planning Department. 2. COMMISSIONER PORTER: Commissioner Porter arrived at 7:20 P.M. and assume is uties. There were numerous people in the audience supporting the request. Mr. Yoskowitz, 5942 Langport Circle, submitted a petition signed by 238 property owners opposing the request. Three property owners in the immediate area also opposed the request. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO.70-12 UPON THE FOLLOWING CONDITIONS: 1. Approval of Conditional Exception No. 70-12 shall be limited to the use and general concept only and the Board of Zoning Adjustments shall review said plan to establish any conditions of approval as deemed necessary to assure compatibility with the surrounding neighbor- hood. 2. A plan for perimeter walls and landscaping shall be submitted to the Planning Department and Department of Public Works for review and approval. 3. Approval shall be limited to church use only. Planning Commission March 17, 1970 Page 4 1. The subject property is zoned RA, a holding zone, and master planned for medium density residential, which is comparable to an R2 and R3 zone. The R3 zone permits a church, subject to approval of a use permit. 2. The City has obviated the need for a church to show hard- ship because other conditional exceptions have been granted in the R1 and/or similar areas for church use. MINORITY REPORT: Commissioner Slates and Commissioner Bokor stated that t ey feel the applicant has not sufficiently justi- fied his request and the request, as approved, is poor planning. ZONE CASE NO. 69-39 RESOLUTION OF INTENT Resolution of Intent to remove the 110" Combining Oil District from property bounded by Palm Ave. on the northeast, 8th St. on the southeast, Ocean Ave. on the southwest and Golden West St. on the northwest. Except for property with producing wells, the change of zone will be from R2-0 Two Family Residence District combined with oil production to R2 Two Family Residence District, R3-0 Limited Multiple Family Residence District combined with oil produc tion to R3 Limited Multiple Family Residence District, R4-0 Multiple Family Residence District combined with oil produc- tion to R4 Multiple Family Residence District, C3-0 General Business District combined with oil production to C3 General Business District and M2-0 General Manufacturing Industrial District combined with oil production to M2 General Manufac- turing District. Commissioner Bokor abstained from this matter. A letter submitted by Ocean Front Oil Co., opposing the change of zone was submitted to the Commission. The hearing was opened to the audience. Mr. Brown, representing Standard Oil Co., opposed the request on'the grounds that his company owns two producing wells in the subject area. Commissioner Bazil suggested that any lots having producing wells be deleted from this zone change. Mr. Webster,, owner of pro- perty at 14th St. and Orange Ave., spoke in favor of the proposal. Mrs. Gardner, owner of lot at the northeast corner at 16th St. and Acacia Ave., also spoke in favor of the pro- posed zone change. Mr. Show, owner of 4 lots at 16th St. and Palm Ave. also endorsed the proposal. There being no other comment, the hearing was Closed. Commission discussion was held concerning the definitign of a producing well. Located 772 ft. north of Adams Ave., east of Bushard St. The Commission reviewed the sug- gested conditions of approval. A MOTION WAS MADE BY BOKOR AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO. 5613 UPON THE FOLLOWING CONDITIONS: 1. The tentative map received March 13, 1970, shall be the approved layout. -2.' A pedestrian walkway shall be provided to the school site at the northeast corner of the tract to the satisfaction of the Department of Public Works and Planning Department. Such walkway shall be 10 ft. wide and shall be dedicated and improved to the requirements set forth by the Depart- ment of Public Works. 3. Tentative Tract No. 5860 shall be reviewed so as to eliminate Elmsford Circle and to continue the frontage road on Brookhurst St. southerly into this subdivision. 4. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. -5. TENTATIVE TRACT MAP NO. 6948 Subdivider: John D. Lusk & Son 239 lots on 351.7 acres, located south of Bolsa Ave., west of Springdale St. Bill Lusk, representing the applicant, addressed the Commission and offered to answer any questions. The Commission reviewed the suggested conditions of approval. A MOTION WAS MADE BY MILLER AND SECONDED BY PORTER TO APPROVE TENTATIVE TRACT MAP NO. 6948 UPON THE FOLLOWING CONDITIONS: 1. The tentative map received February 26, 1970, shall be the approved layout. 2. The minimum rear yard setback for the lots backing on the R1 to the west shall be 45 ft. 3. The minimum front yard setback on local streets shall be 10 ft. Such area shall be landscaped and irrigation facilities installed. 4. An 8 ft. high masonry wall shall be constructed along the south and west boundary of the tract. If, however, the R3 zoning request is denied, such wall need not be in- stalled along the south boundary line. -5- 3/17/70-PC Minutes: H.B. Planning Commission March 17, 1970 Page 6 5_. Sidewalks along the local streets shall be installed at the time each parcel is developed and not during the time of construction of street improvements. This condition - shall not apply to arterial highways in which case instal- lation of sidewalks along the arterial highways shall be installed with all other street improvements. Sidewalks along local streets and arterial highways shall conform to Department of Public Works requirements. 6. A street tree planting plan shall be submitted to the Planning Department and the Department of Public Works .for approval. Such plan shall provide for 30 inch box trees planted 80 to 100 ft. on center along arterial highways and 20 inch box trees planted along local streets. Street trees along the arterial highways shall be installed along with other street improvements. Street trees along the local streets may be planted at the time each parcel --is developed and such trees shall be planted on -site rather than within the public right-of-way. In order to provide for coordinated street tree planting, a tree planting plan shall be submitted as a part of the improvement plan spe- cifying the specie to be planted along with soils tests. Placement of such trees on local streets shall be as follows: a) Lots with less than 120 ft. of frontage shall provide one tree Dpr lot. b) Lots wider than 120 ft. of frontage shall pro- vide one tree for each 75 to 100 ft. of frontage. Corner -lots shall provide one additional tree per 75 to 100 ft. of frontage on the exterior side. Final placement of the tree shall be determined by the Board of Zoning Adjustments when reviewing the administrative review applications for each proposed industrial use. Street trees along arterial highways shall be installed at the time of construction of the street improvements. The specie, the soils tests and layout shall be sub- mitted' -with -improvement plans. 7. Graham St. and McFadden Ave. shall be 94 ft. wide and a median constructed to Department of Public Works require- ments. Such median shall be landscaped to Department of Public Works requirements. 8. ."A" Street shall be stubbed into the area designated "Proposed Garden Apartments" if such area is developed industrially. 9. If the area designated "Proposed Garden Apartments" is - rezoned for multiple family residential purposes, then 10 ft. wide walkways shall be provided between the school area and apartment project to facilitate the movement of the school children to and from school. The location of such walkway shall be worked out to the satisfaction of the Ocean View School District and the Planning Depart- ment prior to submitting a final map to the City Council for acceptance. 10. Sidewalks shall be provided on public streets from the school site to the apartment area to the satisfaction of the Ocean View School District and Department of Public Works. 11. Vehicular access to the lots fronting on the arterial highways shall be approved by the Traffic Engineer. 12. Trees shall be planted along the west property line to provide additional separation and screening. A plan show- ing the specie and spacing along with soils tests shall be submitted to the Planning Commission for approval. Such trees shall be planted prior to issuance of building per- mits on lots backing onto the west property line. 14. The front and side yard along arterial highways shall be appropriately landscaped, which may include automobile -parking, however, not less than 25% of such area shall be landscaped, and which shall include adequately main- tained lawns, shrubs, trees, flowers, ground cover. -15. Change of zone from R2 Two Family Residence District to R5 Office -Professional District. Located between Slater Ave. and Speer Ave., 282 ft-. west of Beach Blvd. The hearing was opened to the audience. Del Boyer, representing the appli- cant, addressed the Commission and stated that he was in accord with the staff's recommendation to continue Conditional Exception No. 70-7 and Zone Case No. 70-4 in order to allow the staff time to prepare standards on mobilehome parks. Located west of Brookhurst St., 800 ft. south of Garfield Ave. In Conjunction With CONDITIONAL EXCEPTION NO. 70-16 Applicant: Russell S. Penniman & Co., Inc. To permit the construction of a mobilehome park in the C2 Community Business District, R5 Office Professional District and RA Residential Agricultural District. Located west of Brookhurst St., 800 ft. south of Garfield Ave. CHAIRMAN SLATES: Chairman Slates was excused from further participation at 9:15 P.M. Vice -Chairman Tom assumed the Chairman's duties. The hearing was opened to the audience. Russell Penniman, applicant, addressed the Commission and stated his reasons for the request. Mr. Penniman stated that the subject property is very low and the peat condition is very severe. Also, there are existing mobilehome parks on both sides of the subject property. Mr. Penniman further stated that they will develop the property in a harmonious manner including the commercial portion. Mr. Rusty Watson, representing the Rancho Huntington Mobilehome Park to the south, stated that he was in favor of the proposal. Mr. Watson stated that due to soil conditions, this property is suited for development of a mobilehome park. There being no other comment, the hearing was closed. Commissioner Bazil stated that he was in favor of the proposed mobilehome park; except he disagreed with the commercial zone south of the Edison ease- ment because it would create a long strip of commercial pro- perty on the west side of Brookhurst St. The Chairman re -opened the hear - ing. Commissioner Duke stated that he agreed with -Commissioner Bazil's statement. Bill Hartge, City Engineer, informed the Commission that there is a definite soil problem on the subject property. Charles Schlegel, attorney, representing the applicant, stated that he feels this proposal is a,good plan for the area and the applicant should get some consideration from the Planning Commission. The hearing was closed to the audience. Commission discussion was held. Commissioner Bokor stated that the continuance of the Zone Case, as suggested by the staff, should be less than six months. Mr. Harlow stated that he feels there is a hardship on the subject property and recommends approval of the conditional exception but continue the zone case as suggested in the staff report. This action will allow the property to be developed and still allow time for the MH-Zone to be prepared. -8- 3/17/70-PC Minutes: H.B. The area south of the Edison Easement shall be incorporated as a part of the mobilehome park. 2. The applicant shall comply with standards of the new MH Mobilehome Zone and the final layout and design of the mobilehome park shall be approved by the Board of Zoning Adjustments. AND FOR THE FOLLOWING REASONS: 1. This is unique property to develop because it is divided by the Edison easement. 2. Soil conditions are such that residential uses other than mobilehomes will be difficult to develop. 3. The applicant has demonstrated a hardship. To permit the construction of a service station in the C4 Highway Commercial District. Located at the southwest corner of Brookhurst St. and Adams Ave. The hearing was opened to the audience. Various photographs were shown of the proposed service station. A representative for Shell Oil Co., displayed renderings and explained the plot plan. He further pointed out that there will be 4 bays open to the street. There being no other comment, the hearing was closed. The Acting Secretary discussed the possibility of having two of the bays open onto the front of the building and two open bays to the back. The Commission reviewed the pro- posal. DISCUSSION: The Commission discussed the possibility of revis- ing the present ordinance to allow churches and similar uses in all zones subject to an approved conditional use permit.
