HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS
Administrative Annex

BOARD MEMBERS PRESENT: McFarland, Cook, Harlow
The meeting was called to order
by the Chairman, Daniel McFarland.
DIVISION OF LAND NO. 70-6 - Continued
Applicant: Diversified Shopping Centers, Inc.
To allow a division of land into
two separate parcels.
Located on the northeast corner
of Atlanta Avenue and Magnolia Street.
There was no one present to
represent the applicant.
The Board held discussion regarding
conditions of approval, reciprocal driveway easements, and a
water line easement.
A MOTION WAS MADE BY MCFARLAND AND
SECONDED BY HARLOW TO APPROVE DIVISION OF LAND NO. 70-6 WITH
THE FOLLOWING CONDITIONS:
1. The plot plan received February 24, 1970, shall be the
approved layout.
2. Magnolia Street and Atlanta Avenue shall be dedicated and
fully improved to City standards at the time each parcel
is developed.
3. Water supply shall be through the City of Huntington Beach's
water system at the time each parcel is developed.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time each parcel is developed.
5. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
6. Easements for utilities or walkways shall be provided to
Department of Public Works standards.
7. All buildings on lots abutting a City easement shall be
set back five (5) feet from the edge of such easement.
8. The property shall participate in the local drainage assess-
ment district at the time each parcel is developed.
9. Soil reports as required by the Building Department and the
Department of Public Works shall be submitted to the City
prior to issuance of building permits.

10. All utilities shall be installed underground.
11. Fire alarm system conduit and appurtenances shall be in-
stalled by the developer at locations and to specifications
provided by the Fire Department.
12. A Parcel Map shall be filed with the City and recorded
prior to occupancy of any structures on any parcel.
13. A 10 ft. waterline easement shall be provided on the west
side of Parcel 2 to the Department of Public Works and
Fire Department standards.
14. The Division of Land shall not be effective until an
agreement is signed and recorded agreeing to the condi-
tions listed above.

THE MOTION CARRIED.
USE PERMIT NO. 70-10
Applicant: W. E. Marcus
To permit the sale of
automobiles and mobile homes combined with a small service
facility in the C4 Highway Commercial District.
Located on the west side
of Beach Blvd., approximately 100 ft. north of the centerline
of Aldrich St.
The Chairman read the
request and opened the hearing to the audience.
W. E. Marcus, applicant,
and Roland Hall, property owner, addressed the Board and
explained the request.
The distribution of the
landscaping was discussed. It was felt by the Board that the
landscaping should be distributed more evenly throughout the
lot.
Mr. Rosenson of Beach
Edinger Co., and Mr. Wiley Blair, of Second-Orla Properties,
both adjacent property owners, spoke in opposition to the
request as they felt it would be unsightly and depreciate the
value of surrounding property.
Mr. Harlow advised that
this is a permitted use in the existing zone and that the
Board's action would be only on the layout of the use.
Mr. Harlow also advised them of their right to appeal the
Board's decision to the Planning Commission.

TIME FOR THE APPLICANT TO SUBMIT REVISED PLOT PLANS PERTAINING
TO THE LANDSCAPING.

Applicant: Photo -Disc Corporation
To permit the retail sales of
car tapes, film and film supplies in the C2 - Community
Business District.
Located at the northwest corner
of Warner Avenue and Golden West Street.
The Chairman read the request
and opened the hearing to the audience.
David Jones, representing the
applicant, addressed the Board and explained the request.
As there were no further comments,
the hearing was closed.
Board discussion was held.

DIVISION OF LAND NO. 70-8
Applicant: Jimmie D. Cormier
To permit a division of land of
a -97 ac. parcel of land into two separate parcels.
Located on the west side of Beach
Blvd., 812 ft. south of Ellis Ave.
Raymond Mercado, representing
the applicant, explained the request.
It was noted that the proposed
use was shown on Parcel 1 and that Parcel 2 exceeds the 100 ft.
frontage limitation.
A MOTION WAS MADE BY MCFARLAND
AND SECONDED BY HARLOW TO APPROVE DIVISION OF LAND NO. 70-8
WITH THE FOLLOWING CONDITIONS:
1. Beach Blvd, shall be fully improved to City and/or State
standards. Improvements shall include street trees, street
signs, street lights, fire hydrants, sewer and water main
extensions.
2. Water supply shall be through the City of Huntington Beach's
water system.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
4. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
5. Easements for utilities or walkways shall be provided to
Department of Public Works standards.
6. All buildings on lots abutting a City easement shall be set
back five (5) feet from the edge of such easement.

7. The property shall participate in the local drainage assess-
ment district.
8. A masonry wall shall be constructed along the west property
line. The hei ht of said wall shall be such that the top
will be six (6� feet above the highest ground surface
within twenty (20) feet of the common property line.
9. A Parcel Map shall be filed with the City and recorded prior
to framing inspection of any structures on any parcel.
10. The Division of Land shall not be effective until an agree-
ment is signed and recorded agreeing to the conditions
listed above.

Dick Broadway, Lander
Engineering, represented the applicant and explained the request.
The Board advised that
parking and landscaping should be shown on the plot plan.
Mr. Broadway advised that
a Use Permit would be filed.
A MOTION WAS MADE BY
MCFARLAND AND SECONDED BY HARLOW TO CONTINUE DIVISION OF LAND
NO. 70-9 TO THE APRIL 8, 1970, MEETING TO ALLOW TIME FOR A
USE PERMIT TO BE FILED ON SUBJECT PROPERTY.

CONDITIONAL EXCEPTION NO. 70-11 - Continued
Applicant: Robert H. Lund
To permit the construction
of a fence within 10 ft. of the front property line in lieu of
the required 15 ft. front yard setback.
Located on the west side
of Edgewater Lane, 100 ft. south of Morning Star Drive.
The Chairman read the
request and opened the hearing to the audience.
There was no one present
to represent the applicant.
As there was no one to speak
in favor or opposition, the hearing was closed.

ADMINISTRATIVE REVIEW NO. 70-6
Applicant: PBS Corporation
To permit the sales facility and
model homes in RA-0 Residential Agricultural, Combining Oil
District.
Located on the west side of Bushard
St. between Atlanta Ave. and Indianapolis Ave.
Ralph Van Buskirk, V.T.N., and
Bob Jones, Architect, P.B.S., were present to represent the
applicant.
Mr. Jones, explained the request
and plot plans.
Mr. Cook stated the driveways
should be 25 ft. in width.
A MOTION WAS MADE BY HARLOW AND
SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO.
70-6 WITH THE FOLLOWING CONDITIONS:
1. The driveways shall be 25 ft. in width.
2. Section 9730.25.4 of the Huntington Beach Ordinance Code
shall be complied with.

The Board reviewed an illustra-
tion of the proposed identification sign for the Huntington
Capri apartment development.
A MOTION WAS MADE BY HARLOW AND
SECONDED BY COOK TO APPROVE THE SIGN AS ILLUSTRATED WITH THE
FOLLOWING CONDITION:
1. The words "Where living is fun" shall be deleted.
FOR THE REASON:
1. Such additional wording does not comply with Section
9764.1.1 of the Huntington Beach Ordinance Code.
