USE PERMIT NO. 70-10 - Continued
Applicant: W. E. Marcus
To permit the sale of automobiles
and mobile homes combined with a small service facility in
the C4 Highway Commercial District.
Located on the west side of
Beach Blvd., approximately 100 ft. north of the centerline
of Aldrich St.

SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 70-10 WITH THE
FOLLOWING CONDITIONS:
1. Beach Blvd. shall be fully improved to City and/or State
standards. Improvements shall include street trees,
street lights, street signs, fire hydrants, sewer and
water main extensions.
2. Water supply shall be through the City of Huntington
Beach's water system.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
4. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
5. Easements for utilities or walkways shall be provided to
Department of Public Works standards.
6. All buildings on lots abutting a City easement shall be
set back five (5) feet from the edge of such easement.
7. The property shall participate in the local drainage
assessment district.
8. Soil reports as required by the Building Department and
the Department of Public Works shall be submitted to the
City prior to issuance of building permits.
9. All utilities shall be installed underground.
10. No structures, other than those shown on the approved plot

Applicant: Charles A. Walker
To permit the construction
of a carport in lieu of the required garage in the Rl Single
Family Residence District.
Located at 6072 Shelly
Drive, corner of Bolsa Park Lane.
These items were tabled
until later in the meeting to be reviewed in conjunction with
Mrs. Walker's home occupation.
CONDITIONAL EXCEPTION NO. 70-13
Applicant: Richard L. Zylstra
To permit the second
story portion of the dwelling to cantilever three feet over
a: garage to within seven feet of the rear property line in
lieu of the required ten foot setback in the R2 Two Family
Residence District.
Located on the west side
of California Street, approximately 54 feet north of Knoxville
Avenue.
The Chairman read the
request and opened the hearing to the audience.
Mr. Zylstra, applicant,
addressed the Board and stated he felt the development would
be an asset to the City.
Mr. DeGuelle spoke in
opposition, stating there were presently only single story
structures in the area and this exception would be setting a
precedent.
Mr. McFarland advised
that the existing zoning in the area permitted two-story
dwellings.
Mr. DeGuelle advised he
was thinking of a different location, and=had no objection to
the property in question.

AND SECONDED BY PALIN'_TO APPROVE CONDITIONAL EXCEPTION
NO. 70-13 WITH THE FOLLOWING CONDITIONS:
1. The plot plan received March 18, 1970, shall be the
approved layout.
2. All applicable City ordinances shall be complied with.
FOR THE REASONS:
1. Encroachments of this type are permitted in the R3 zone.
2. The easement over the front of subject property requiring
a 20 ft. front yard setback has created a hardship on
the development.

Beach Blvd., approximately 800 ft. south of Ellis Avenue.
The Chairman read the request
and opened the hearing to the audience.
The Board advised the applicant
that the plot plan was not complete as parking, setbacks,
landscaping, arrangement of display, and driveways were not
shown.
There being no further comment,
the hearing was closed.

AND SECONDED BY PALIN TO CONTINUE USE PERMIT NO. 70-14 AND
ADMINISTRATIVE REVIEW NO. 70-4 TO THE NEXT REGULAR MEETING

Located on the west side
of Edwards Street, 135 ft. north of McFadden Avenue.
The Chairman read the
request and opened the hearing to the audience.
Mr. Gerald Edwards,
representing the applicant, addressed the Board.
The Acting Secretary
advised Mr. Edwards that the existing parking does not
conform to code or the existing plot plan on subject property.
The conditions of approval
for Use Permit No. 65-17, being the original use permit on
subject property, were discussed.
There being no further
comment, the hearing was closed.
A MOTION WAS MADE BY PALIN
AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 70-11
WITH THE FOLLOWING CONDITIONS:
1. All conditions of Use Permit No. 65-17 shall be complied
with prior to issuance of a Certificate of Occupancy.
2.=_The revised plot plan approved for Use Permit No. 65-17
shall remain the approved layout.

The hearing was opened to
the audience.
John Mandrell, representing the
applicant, addressed the Board and explained the requests.
The Acting Secretary advised
that this project was originally approved by Use Permit
No. 69-4 in February, 1969, and the present application is
for reapproval as a result of the new Apartment Standards
which has been adopted by the Planning Commission requiring
a revision of the plans.
Discussion was held pertaining
to the driveway widths. Mr. Mandrell informed the Board
that the drives had been revised to conform with the code,
Public street dedication will be made a condition of the
division of land application.
There being no further comment,
the hearing was closed.
A MOTION WAS MADE BY MCFARLAND
AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION
NO. 70 -16' WITH THE FOLLOWING CONDITION:
1. The carports along the lot line shall be constructed of
maintenance free masonry material.
FOR THE FOLLOWING REASONS:
1. The ordinance requiring a 50-ft. setback was not intended
to cover this situation, therefore it is impractical.
2. The carports constructed along the side property line
will serve as a physical separation from the adjacent
commercial property.

WITH THE FOLLOWING CONDITIONS:
1. Pacific Coast Highway and the proposed street shall be
dedicated and fully improved to City, County and/or
State Standards. Improvements shall include street trees,
street signs, street lights, fire hydrants, sewer and
water main extensions.
2. Water supply shall be through the City of Huntington
Beach's water system.
3. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
4. The water, sewer, and fire hydrant system shall be
approved by the Department of Public Works and Fire
Department.

9. All utilities shall be installed underground.
10. Fire alarm system conduit and appurtenances shall be
installed by the developer at locations and to specifi-
cations provided by the Fire Department.
11. Off-street parking facilities shall conform to Article 979•
12. There shall be no fence, structure, or landscaping
constructed or maintained over 3/z ft. high within a
10 ft.-X 10 ft. triangular area at the intersection of
driveways and streets or within a 25 ft. X 25 ft. tri-
angular area at the intersection of streets.
13. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
14. All applicable City Ordinances shall be complied with.
15. All required setbacks shall be complied with or
'a- - conditional exception shall be filed with the
Board of Zoning Adjustments and approved.
16. Driveway widths shall conform to the amended widths shown
on the plot plan.
17. A Division of Land application, separating this parcel
from the remaining property held under the same ownership,
shall be filed with the City, approved and recorded,
prior to framing inspection.
18. Plot plan received March 24, 1970, shall be the approved
layout.

MCFARLAND AND SECONDED BY SPENCER TO APPROVE DIVISION OF
LAND NO. 70-10 WITH THE FOLLOWING CONDITIONS:

7. The property shall participate in the local drainage

10. A Parcel Map shall be filed with the City and recorded

Conditional Exception
No. 70-12 and Use Permit No. 70-13 had been continued from
earlier in the meeting to be heard in conjunction with
Mrs. Walker's home occupation.
The hearing was opened
to the audience.
Mr. and Mrs. Walker
addressed the Board and answered various questions. Mr.
Walker stated that the garage is presently being used as a
room in which Mrs. Walker has her home occupation. Also,
that the final electrical inspection has been made on the
remodeling. The plans for the proposed carport were dis-
cussed and Mr. Walker presented snapshots taken of the
garage as it exists after remodeling.
The Board advised Mrs.
Walker that the carport should have been constructed prior
to utilizing the garage for the home occupation.

Discussion was held pertaining
to the design and the length of time necessary to complete
construction of the carport.
Mrs. Walker stated that she has
approximately five customers per week who are neighbors who
walk to her residence; thus, no vehicular traffic problem.
She has two chairs so as to handle more than one customer
at a time. There are no signs on the property.

NO. 70-12 WITH THE FOLLOWING CONDITIONS:

approved layout.
2. The portion of the new driveway within public right-
of-way shall be to Department of Public Works specifi-
cations.
FOR THE REASON:
1. The applicant proposed to construct a carport with a
similar setback as other carports and garages in the area.

AND SECONDED BY SPENCER TO APPROVE THE HOME OCCUPATION USE
WITH THE FOLLOWING CONDITION:
1. Review will be made within 90 days to insure construction
of the carport is proceeding without undue delay.
FOR THE REASONS:
1. The home occupation involves five or six persons per
week who are neighbors that walk to her home causing
no vehicular traffic.
2. The use appears to comply with all conditions of the
home occupation permit with the exception of the
required parking stalls; however, the applicant has
applied for a permit to construct a carport.
