AGENDA ITEMS TO BE CONTINUED: ZONE CASE NO. 69-39 (Continued) RESOLUTION OF INTENT RESOLUTION OF INTENT to remove the 110" Combining Oil District from property bounded by Palm Ave. on the northeast, 8th St. on the southeast, Ocean Ave. on the southwest and Golden West St. on the northwest. Except for property with producing wells, the change of zone will be from R2-0 Two Family Residence District combined with oil production to R2 Two Family Residence District, R3-0 Limited Multiple Family Residence District combined with oil production to R3 Limited Multiple Family Residence District, R4-0 Multiple Family Residence District combined with oil production to R4 Multiple Family Residence District, C3-0 General Business Dis- trict combined with oil production to C3 General Business District and M2-0 General Manufacturing Industrial District combined with oil production to M2 General Manufacturing District. CONDITIONAL EXCEPTION NO. 69-41 (Continued) Applicant: James Hodges To permit: 1) Construction of a 10 unit apartment complex in lieu of the permitted maximum of 6 units; 2) Such units shall be three stories in height in lieu of the permitted maximum two stories (such buildings are not to exceed the permitted building height of 30 ft.); 3) Construction of carports at 110" side yard setback in lieu of the required 4 ft. setback; 4) Open unenclosed stairways set back 18 inches from the side property line in lieu of the required 3 ft. setback; 5) To permit the second story of such building to cantilever over the required 600 sq. ft. of open space and to permit construction of an open stairway within such open space. USE PERMIT NO. 70-9 (Referred by the Board of Zoning Adjust- ments) Applicant: Shell Oil Company To permit the construction of a service station in the C4 Highway Commercial District. Loca- ted on the southwest corner of Brookhurst St. and Adams Ave. The Acting Secretary informed the Commission that this item was considered by the Commis- sion at the March 17th meeting, at which time this matter was continued to the April 7th meeting to allow time for the applicant to submit revised drawings of their structure so as to be compatible with proposed structures in the area. The hearing was opened to the audience. Mr. Martin Zaldo,, representa- tive for Shell Oil Co., addressed the Commission and sub- mitted new drawings of the proposed structure. Commissioner Porter stated that the Commission should strive for more pleasing and natural architectural features. A MOTION WAS MADE BY TOM AND SECONDED BY BAZIL TO APPROVE USE PERMIT NO. 70-9 UPON THE FOLLOW- ING CONDITIONS: 1. The plot plan received April 7, 1970, shall be the approved layout. 2. Revised drawings showing a pitch of 3 to 12 ft. shall be submitted to the Planning Commission for approval. 3. The identification sign shall have a maximum height of 24 ft. 4. Easements for utilities or walkways shall be provided to Department of Public Works standards. 5. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 6. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 7. Fire alarm system conduit and appurtenances shall be in- stalled by the developer at locations and to specifications provided by the Fire Department. 8. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department. 9. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 10. All applicable City Ordinances shall be complied with. 11. All applicable conditions of Division of Land No. 70-2 shall be complied with. 12. All landscaping within 5 ft. of a public right-of-way shall be subject to the Department of Public Works approval. MINORITY REPORT: Commissioner Porter stated that the Commission is relaxing its previously announced intent to apply increasingly stringent requirements to service station development. He stated that the Commission should continue to strive for more pleasing and natural architectural features. CONDITIONAL EXCEPTION NO. 70-19 Applicant: State -Wide Investors, Inc. To permit a four -unit apartment complex on a parcel of land having 7,762.5 sq. ft. of area in lieu of a maximum of 3 units permitted by ordinance. Located on the north side of Glencoe Ave., approximately 600 ft. west of Beach Blvd. in the R2 Two Family Residence District. The hearing was opened to the audience. C. W. Planning Commission April 7, 1970 Page 5 the applicant, stated that the proposed development will be very attractive and compatible with the surrounding area. There being no other comment, the hearing was closed. The Commission held a discussion. Commissioner Duke stated that he feels the Planning Commission should not grant a variance for an increase in density based on economics. Commissioner Bazil stated that this request will not be detrimental to the surrounding neighborhood.. Commissioner Porter stated that it is a mistake to reduce the square footage requirement per unit. Commissioner Tom suggested that the staff prepare a code amend- ment to allow additional unit to be granted in multiple family areas when 75% of the requirement for the additional unit has been met. A MOTION WAS MADE BY BOKOR AND SECONDED BY BAZIL TO APPROVE CONDITIONAL EXCEPTION NO. 70-19 UPON THE FOLLOWING CONDITION: 1. All applicable provisions of the Huntington Beach Ordinance Code shall be complied with. AND FOR THE FOLLOWING REASONS: 1. The request is very close to the required land area and the exception is warranted. 2. The area is essentially developed multiple residences, and there is a definite hardship on the property. Vice -Chairman Tom took over as a Chairman. CONDITIONAL EXCEPTION NO. 70-17 ADDlicant: Geo. Betar & Elliot Fried To permit 14 of the required 18 off-street parking spaces to be provided on a parking lot within 300 ft.,'and not held under the same ownership. Located on the west side of Main St., approximately 100 ft. north of Olive Ave. and legally described as Lot No. 7, Block 304, Huntington Beach Tract, in the C3 General Business District. A video tape of the subject property was shown. The hearing was opened to the audience. George Betar, applicant, ex- plained his reasons for the request. Mr. Miller asked what was meant by legitimate theatre. Mr. Fried, applicant, answered Mr. Miller's question and spoke in favor of the proposed com- munity playhouse. Dr. Kowitt, owner of the property, stated that the type of plays shall be specified in the lease, and if obscene, the lease will be cancelled immediately. Mr.Regan, realtor and adjacent property owner, stated that he was concerned with the type of plays that will be presented to the public. Mr. Regan stated that he wants the area upgraded. Mrs.Shandrick, property owner, objected to the request, stating this type of use should be investigated. Mr. Ed Farber, "Lewis TV" stated that this use should meet with the Huntington Beach Ordinance Code. -5- 4/7/70-PC Minutes: H.B. A MOTION WAS MADE BY PORTER AND SECONDED BY BOKOR TO APPROVE CONDITIONAL EXCEPTION NO. 70-17 UPON THE FOLLOWING CONDITIONS: 1. The applicant shall provide lease agreements to substantiate the fact that parking shall be available to this use for as long as the theater is in existence and that upon termination of such lease agreements, Conditional Exception No. 70-17 shall become null and void. 2. The agreements for the use of the parking lot shall be appro- ved by the City Attorney's Office and the Planning Department to see that the above condition has been satisfactorily com- plied with and to impose any additional conditions as deemed necessary for the enforcement of such condition. AND FOR THE FOLLOWING REASON: 1. The applicant is substantially complying with parking re- quirements. CONDITIONAL EXCEPTION NO. 70-18 Applicant: Huntinzton Auto Service To permit a renewal of an ex- pired Use Variance No. 66-4 for an auto storage yard. Located 272 ft. north of Garfield Ave., west of Crystal St. in the M1-0 Light Industrial District combined with oil production. Legally described as Lot No. 23, Block E, Garfield Street Addition. The hearing was opened to the audience. A video tape was shown of the subject property. Elmer Goetch, applicant, addressed the Commission and stated his reasons for the request. There being no other comment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO.70-18 UPON THE FOLLOWING CONDITIONS: 1. The applicant shall enter into an agreement with the City and shall agree to install all street improvements within six (6) months after being requested to do so by the Depart- ment of Public Works. 2. There shall be no stacking of vehicles. 3. The property shall be enclosed with a six (6) ft. high chain link fence. 4. If water is made available to the site, the storage yard shall be screened with adequate planting within 30 days after requested to do so. 5. Conditional Exception No. 70-18 shall become null and void on March 31, 1974. Located on the west side of Algonquin St., north of Boardwalk Dr. A video tape was shown of the subject and surrounding property. The hearing was opened to the audience. Mr. Hunt, representing the applicant, stated that he feels the request is moving the pro- perty to a more restrictive use and, when purchased, the property was master planned for apartments. There being no other comment, the hearing was closed. Commission discussion followed. Commissioner Tom stated that there will be too much multiple family zoning in the area and this request should be continued for a study on such zoning. Commissioner Porter stated that the density should not be increased. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE ZONE CASE NO. 70-7 FOR THE FOLLOW- ING REASONS: 1. The commercial property to the south has been separated from this parcel by Boardwalk St. and the property south of Boardwalk is developed. 2. The subject parcel relates to the apartment project. 3. The Master Plan of Land Use is not specific in delineating the precise boundary between the commercial property and the medium density property to the north. ROLL CALL VOTE: AYES: Duke, Porter, Tom, Bokor NOES: Miller, Bazil ABSENT: Slates THE MOTION CARRIED. It was the Commission's con- sensus that the staff should prepare a study of the areas pro- posed for multiple family development to be submitted to the Commission for their review. ZONE CASE NO. 70-8 Applicant: Pacific Lighting Service Co. Change of zone from RA-0 Resi- dential Agricultural District to M1 Light Industrial District. Located west of Golden West St., 660 ft. north of Garfield Ave. The Acting Secretary informed the Commission that the applicant will use the existing faci- lities on the parcel. The hearing was opened to the audience. A MOTION WAS MADE BY BOKOR AND SECONDED BY MILLER TO RECOMMEND APPROVAL OF ZONE CASE NO. 70-8 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The area is adequately suited for industrial development. 2. The existing facility will be used. 3. The proposed use will not be detrimental to surrounding property since the area is manufacturing in nature. 4. A portion of this property will be acquired by the State Division of Highways to provide an interchange at Golden West St. and the proposed Pacific Coast Freeway. ROLL CALL VOTE: AYES: Bazil, Bokor, Miller, Porter, Tom, Duke NOES: None ABSENT: Slates THE MOTION CARRIED. PRECISE PLAN OF STREET ALIGNMENT NO. 70-3 Said plan proposes to precise plan the alignment of the southerly extension of Delaware St. between Atlanta Ave. and Pacific Coast Highway. The hearing was opened to the audience. There being no comment, the hearing was closed. A MOTION WAS MADE BY PORTER AND SECONDED BY DUKE TO RECOMMEND APPROVAL OF PRECISE PLAN OF STREET ALIGNMENT NO. 70-3 TO THE CITY COUNCIL. ROLL CALL VOTE: AYES: Bazil, Bokor, Miller, Porter, Tom, Duke NOES: None ABSENT: Slates THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-8 (Plot Plan Approval Continued) Applicant: Macco Corp. To permit 1) Averaging the density on a 12 acre parcel of land to permit a 304 unit apartment development in the R2 Two Family Residence District and R3 Limited Multiple Family Residence District; 2) Construc- tion of carports with zero side and rear yard setback; and, 3) Such carports to be constructed within 20 ft. of the front property line in lieu of the required 50 ft. setback. Located on the south side of Warner Ave., 660 ft. east of Edwards St. in the R2 Two Family Residence District and R3 Limited Multiple Family Residence District. The Acting Secretary informed the Commission that this item is back before them because all Commissioners were not in attendance when acted on at the last meeting. Mr. Harlow stated that the only item to be considered is the plot plan and the distribution of open space. Syd Paul, representing the applicant, explained the proposed layout. Jim Palin, Assistant Planner, pointed out the required open space and reviewed the changes made to the plot plan. Commissioner Duke requested that the applicant submit a new plan indicating more open space. Commissioner Porter stated that the open space between units should be expanded. Commissioner Bazil stated that he would like to see 20 or more units in one structure, thereby creating more open space for green belts between the main structures. -8- 4/7/70-PC Minutes: 11.B. A MOTION WAS MADE BY DUKE AND SECONDED BY PORTER TO CONTINUE CONDITIONAL EXCEPTION NO. 70-8 TO ALLOW THE APPLICANT TIME TO SUBMIT A NEW PLOT PLAN PROVIDING MORE OPEN SPACE WITHIN THE DEVELOPMENT. ROLL CALL VOTE: AYES: Bazil, Bokor, Miller, Porter, Tom, Duke NOES: None ABSENT: Slates THE MOTION CARRIED. AND FOR THE FOLLOWING REASONS: 1. The applicant did not comply with the Commission's desires with respect to the open space requirement. 2. There is a problem in this area caused by the excessive number of apartment developments. EXTENSION OF TIME - TENTATIVE TRACT MAP NO. 6954 Subdivider: PBS Corporation 247 lots on 61.5 acres, located at the northwest corner of Atlanta Ave. and Bushard St. The Commission reviewed the suggested conditions. A MOTION WAS MADE BY BAZIL AND SECONDED BY PORTER TO APPROVE THE EXTENSION OF TIME FOR ONE YEAR ON TENTATIVE TRACT MAP NO. 6954 UPON THE FOLLOWING CONDITION: 1. All applicable provisions of the original approval shall be complied with. COMMISSIONER PORTER: Commissioner Porter requested that any items which are not regularly scheduled on the agenda be placed at the end of such agenda. COMMISSIONER TOM: Commissioner Tom requested that re-evaluation e made on future apartments and open space requirements. INFORMATION: The Acting Secretary informed the Commission of Counci 'r s request that the Commission make a study of Master Plan at Springdale St. and Heil Ave. Also, that the City Council denied all use permits pertaining to the property on the south- east corner of Brookhurst and Adams Ave. and referred the divisions of land for Sakioka and Beacon Bay back to the Com- mission for findings and determination as to whether or not the code had been complied with.
