Inc. To allow a division of land of a 6.5 ac. parcel of land into three legal parcels. Located on the southwest corner of Golden West St. and Warner Ave. This item was tabled as the applicant had not arrived. USE PERMIT NO. 70-14 - Continued Applicant: Joe Evans To permit the sale of us -id cars in the C4 Highway Commercial District. In Conjunction With ADMINISTRATIVE REVIEW NO. 70-4 - Continued Applicant: Joe Evans To permit the sale of used cars within the 50 ft. front yard setback in the C4 Highway Commercial District. The applicant was not present. This item was continued on April 1, 1970, to allow time for a revised plot plan to be submitted. Mr. Palin advised that the revised plot plan had not been received. This item was tabled to allow time for the applicant to arrive. CONDITIONAL EXCEPTION NO. 70-14 Applicanc: Macco Corporation To permit the construction of an 8 ft. high fence contiguous with the laundry facility structure to enclose present trash area and a prefab storage snit. Located on the south side of Warner Ave. aprroximately 660 ft. west of Edwards St. The hearing was opened to the audience. Mr. Sidney Paul, repres(;nting the applicant, addressed the Board and answered various questions. -1- 4/8/70 - BZA Minutes: H.B. Board of Zoning Adjustments Wednesday, April 8, 1970 Page No. 2 Mr. Paul discussed the plans and advised the Board that the color of the prefab storage unit would be compatible with the existing structures within this complex. Mrs. Dale, nearby property owner, reviewed the plans and stated she was not in opposition of the request. There being no further comment, the hearing was closed. A MOTION WAS MADE BY COOK AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 70-14 FOR THE FOLLOWING REASONS: 1. The fence and building will be constructed so as to be compatible with the existing structures. 2. The trash area will not be detrimental to the area. 3. The storage unit of this nature is needed for fertilizer and garden equipment used within this development. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-15 Applicant: HGS Corporation To permit: 1) Carports to be con- structed on the side and rear property line in lieu of the required 5 ft. setback. 2) Construction of unenclosed car- ports within the interior of the apartment complex in lieu of the requirement that such carports be enclosed on three sides. 3) An increase in the height of an accessory building to 16.5 ft. in lieu of the 15 ft. maximum height. In Conjunction With USE PERMIT NO. 70-15 Applicant: HGS Corporation To permit the construction of a 210 apartment complex on a 7.5 acre parcel of land in the R3 - Limited Multiple Family Residence District. `- The hearing was opened to the audience Mr. Garrett Smith, Architect, Mr. Gleason and Mr. Howard of HGS, Corporation, representing the applicant, addressed the Board. Mr. Smith was informed that said 6' high block wall would only be at location between the carports constructed at 110" set back on the north PL. Mr. Smith informed the Board that the applicant was agreeable to all the conditions of approval. Mr. Julius Tuchler, Pacific Drive -In Theatres, requested that a condition be made to prevent lighting in the development from interfering with the viewing of the theatre screen. Mr. Tuchler was informed that cond. No. 18 requires that the Department of P.W. approve the lighting plan for this development. There being no further comments, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY COOK TO APPROVE CONDITIONAL EXCEPTION NO. 70-15 WITH THE FOLLOWING CONDITIONS: 1. The carports constructed on the north and west sides shall be of maintenance free material. 2. A plot plan delineating the screening of the carports on three sides shall be submitted to the Board of Zoning Adjustments for approval. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. A MOTION WAS MADE BY COOK AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 70-15 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received March 20, 1970, shall be the approved layout. 2. Gothard Street and Warner Avenue shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street treEs, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrants system shall be approved by the Department of Public Works and Fire Department. 6. All buildings on lots abutting a City easement 'shall be set back five (5) feet from the edge of such easement. 8. The flood control channel shall be fenced to Flood Control District standards and City standards. 9. The property shall participate in the local drainage assessment district. 10. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 11. All utilities shall be installed underground. 12. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 13. Off-street parking facilities shall conform to Article 979. 14. Parking compounds and enclosed carports shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Board of Zoning Adjustments. 15. A masonry wall shall be constructed along the north and west property lines. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. 16. There shall be no fence, structure or landscaping con- structed or maintained over 32 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. 17. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 18. A lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works for approval. 19. All private streets shall meet the minimum standards for planned residential developments as adopted by the Planning Commission. 20. The structural street section of all private drives shall be approved by the Department of Public Works. 21. All applicable City Ordinances shall be complied with. 22. All applicable conditions of Apartment Standards adopted by the Planning Commission shall be complied with. Board of Zoning Adjustments Wednesday, April 8, 1970 Page No. 5 CONDITIONAL EXCEPTION NO. 70-17 Applicant: Saddleback Development Corporation To permit a 3 ft. interior side yard setback in lieu of the required 4 ft. setback and to allow a portion of the required 600 sq. ft. of open space to be within the front 1/3 of the lot in lieu of the requirement that such open space be provided within the rear 2/3 of such lot. Located on the west side of 16th St., 50 ft. north of Walnut Ave. in the R4 - Multiple Family Residence District. The hearing was opened to the audience. Mr. Frey, representing the applicant, addressed the Board. The plot plans were discussed. The acting secretary informed the applicant that 2 2 ft. of aid ition al open space could be obtained by dedication of 2h ft. from the parcel for alley R/W. The Board informed Mr. Frey that a revised plot plan would have to be submitted with this application before formal action could be taken. The hearing was closed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE CONDITIONAL EXCEPTION NO. 70-17 TO THE APRIL 15, 1970, MEETING, TO ALLOW TIME FOR A REVISED PLOT PLAN TO BE SUBMITTED. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None, THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 70-8 Applicant: Kavanaugh/Beard Development Co. To permit a subdivision sales office and model apartment complbx within Tract 6650. Located on the west side of Gothard St., 500 ft. north of Warner Avenue. The Chairfnan read the request. There was no one present to represent the applicant. There was no one present to speak in favor or opposition of the request. Board discussion was held. A MOTION WAS MADE BY MCFARLA.ND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 70-8 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall comply with Section 9730.25.4 of the Huntington Beach Ordinance Code. 2. To permit construction of a family restaurant (Pizza Hut) in the C2 - Community Business District, located on the west side of Brookhurst St., 300 ft. south of Garfield Ave. The Chairman read the request. Mr. David Kirshner, representing the applicant, addressed the Board and answered various questions. The suggested conditions of approval were discussed. Board discussion followed. Billon To permit a temporary agricultural stand in the C2 - Community Business District. Located on the west side of Magnolia St., approximately 150 ft. north of Warner Avenue. Mr. Billon, Applicant, addresses the Board and answered various questions. Mr. Joe Watson, Checkerboard Properties, owner of the subject property, felt it would be possible for Mr. Billon to obtain a lease agreement authorizing the growing and cultivation of crops on subject property. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE ADMINISTRATIVE REVIEW NO. 70-10 TO THE APRIL 15, 1970, MEETING, TO ALLOW TIME FOR THE APPLICANT TO OBTAIN A GROWER'S LEASE. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. DIVISION OF LAND NO. 70-9 - Continued from earlier in the Applicant: S.D.C. Inc. meeting to allow time for the applicant to arrive at the meeting. The hearing was reopened. Mr. Dick Broadway, representing the applicant, addressed the Board and explained the plan. He requested that the lots use a reciprocal parking agreement The loop system for the water supply was discussed. Board discussion followed.
