RnLL CALL Councilmen Present: Shipley, Bartlett, McCracken, Matney, Coen, Green Councilmen Absent: Kaufman WELCOME EXTENDED - STUDENT VISITORS Mayor Green welcomed the student visitors from Mesa View School and their teacher and parents, and commended them for their interest in Municipal Government. CANVASS OF ELECTION BY CLERK PRESENTED - GENERAL MUNICIPAL The City Clerk read the "Notice of Appointment of Canvassing Board". 5" STATEMENT 6 THE CITY CLERK - CERTIFICATION OF CANVASS OF ELECTION The Clerk read the Statement of the City Clerk certifying the canvass of ballots of the General Municipal Election of April 14, 1970. The Council received the Statement of the City Clerk for canvass of the General Municipal Election held April 14, 1970. There bein no errors in the canvass of the General Municipal Election of April N, 1970, the Clerk read Resolution No. 3163 by title - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE 14TH DAY OF APRIL, 1970, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW." On motion by Coen, Resolution No. 3163 was passed and adopted and ordered spread in full in the minutes, by the following roll call vote: AYES: Councilmen: Shipley, Bartlett, McCracken, Matney, Coen, Green NOES: Councilmen: None ABSENT: Councilmen: Kaufman RESOLUTION NO. 3163 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE 14TH DAY OF APRIL, 1970, DE- CLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW." WHEREAS, a regular general municipal election was held and conducted in the City of Huntington Beach, County of Orange, State of California, on Tuesday, the loth day of April, 1970, as required by law, and Notice of said election was duly and -regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and Pursuant to Resolution No. 2967 adopted the 21st day of April, 1969, the City Clerk of the City of Huntington Beach canvassed. the returns of said election and has certified the results to this City Council;said results.are received, attached, and made a part thereof as "Exhibit A". 14 Page 2 - Council Minutes - 4/21/70) c NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH CALIFORNIA DOES RESOLVE AS FOLLOWS: SECTION 1. That there were seventy-four (74) voting precincts established for the purpose of holding said election consisting of consolidation of the regular election precincts in the City of Hunt- ington Beach as established for the holding of state and county elections. SECTION 2. That said regular general municipal election was held for the purpose of electing the following officers of said City as required by the Charter of the City of Huntington Beach, to wit: Four (4) Members of the City Council of said City for the full term of four (4) years; A City Attorney of said City for the full term of four (4) Years. SECTION 3. That the whole number of votes cast in said City (except absent voter ballots) was 60,609. That the whole number of absent voter votes cast in said City was 297, making a total of 60,906 votes cast in said City. SECTION 4. That the names of the persons voted for at said election for Member of the City Council of said City are as follows: TED W. BARTLETT ALVIN M. COEN N. J. (JACK) GREEN RONALD C. BAUER HENRY H. DUKE JOSEPH S. (JOE) FERM PHYLLIS J. GALKIN NORMA BRANDEL GIBBS WILLIAM N. (GIB) GIBSON KENNETH R. GOODWIN, SR. HOPE P. GREER GORDON R. HATCH RONALD B. KNAPP A. C. MARION MARCUS M. PORTER ROGER D. SLATES ROBERT C. TERRY ROBERT J. ZINNGRABE That the names of the persons voted for at said election for City Attorney of said City are as follows: DON P. BONFA That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said persons were candidates were as listed in Exhibit "A" attached: SECTION 5. The City Council does declare and determine that: TED W. BARTLETT was elected as Member of the City Council of said City for the full term of four years; ALVIN M. COEN was elected as Member of the City Council of said City for the full term of four years; N. J. (JACK) GREEN was elected as Member of the City Council of said City for the full term of four years. NORMA BRANDEL GIBBS was elected as Member of the City Council of said City for the full term of four years. Page 3 - Council Minutes - 4/21/70 DON P. BONFA was elected City Attorney of said City for the full term of four years. SECTION 6. The City Clerk shall enter on the records of the City Council of said City, a statement of the result of said election, showing: (1) The whole number of votes cast in the City. (2) The names of the persons voted for; (3) For what office each person was voted for; (4) The number of votes given at each precinct to each person; (5) The number of votes given in the city to each person. SECTION 7. That the City Clerk shall immediately make and, upon compliance by the persons elected, with the provision of Section 11565 and Section 11568 of the Elections Code of the State of California,, shall deliver to each of such persons so elected a, Certi- ficate of Election signed by him and duly authenticated; that he shall also administer to each person elected, the Oath of Office pre- scribed ' in the State Constitution of the State of California,, and shall have them subscribe thereto and file the same in his office. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said city; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. The City Clerk read Resolution No. 3164 by title - "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING SECTION 8 OF RESOLUTION NO. 2539 ENTITLED, OA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING RULES OF ORDER AND PROCEDURE IN THE CONDUCT OF COUNCIL MEETINGS AND RE- PEALING RESOLUTION NO. 2410". On motion by Coen, Council waived further reading of Resolution No. 3164, and passed and adopted same by the following roll call vote: AYES: Councilmen: Shipley, Bartlett, McCracken, Matney, Coen, Green NOES: Councilmen: Non ABSENT: Councilmen: Kau-fman OATH OF OFFICE - COUNCILMEN - ATTORNEY The City Clerk administered the Oath of Office to the newly elected officers, as follows: Ted W. Bartlett Councilman Alvin M. Coen Councilman N. J. (Jack) Green Councilman Norma, Brandel Gibbs Councilwoman Don P. Bonfa City Attorney The City Clerk then issued the Certificate of Election to each of the elected officers in accordance with the provisions of the Election Code of the State of California. COMMENTS FROM COUNCIL Mayor Green extended the privilege of the floor to each Councilman for any remarks they might wish to make. Councilwoman Gibbs thanked all the people who made her election to the City Council possible, and stated that it was her desire to participate in the many civic affairs of the City. Councilman Coen extended his appreciation to the many people who supported him for re-election and stated his desire to serve the citizens of the community by striving for progressive development of the City. Councilman Bartlett extended his thanks for the confidence expressed by the people in re-electing him to a new term on the Council. Mayor Green stated that he believed the progressive leadership of the past four years was recognized by the community as evidenced by the re-election to Council of all of the incumbent candidates who had filed for the office. ELECTION OF MAYOR - DR. DONALD SHIPLEY Mayor Green declared the positions of Mayor and Mayor Fro-tempore vacated at this time, and called a recess of the Council at 7:50 P.M. Council was reconvened at 7:51 P,M. with City Clerk Paul C. Jones, presiding. The City Clerk called for nominations for Mayor of the City of Huntington Beach. Councilman Bartlett nominated Councilman McCracken for the position of Mayor. Councilman Coen nominated Councilman Green for the position of Mayor. 14 Page 6 - Council Minutes - 4/21/70 There being no further nominations forthcoming, on motion by Shipley, nominations were closed by the Chair. Motion carried. Voting was done by secret ballot with the tallying of votes by the City Administrator and the Development Coordinator who Found that a tie vote had been cast, with one Councilman abstaining from the vote. A vote was again taken by secret ballot, with the tallying of vote by the City Administrator and Development Coordinator, who found that Council had a,ga,in cast a tie vote with one abstention. At the request of Council, the City Clerk called a, recess of the Council at 8:00 P.M. Council was reconvened at 8:15 P.M. by the Clerk. A vote was again taken on the nominations of Councilmen Green and McCracken for the position of Mayor and when a tally of the vote was completed it was found that a tie vote with one abstention had again been cast by the Council. A motion was made by Councilman Bartlett to reopen nominations for Mayor of the City of Huntington Beach. When put to a vote the motion carried. The City Clerk called for nominations for Mayor of the City of Huntington Beach. Councilman Bartlett nominated Councilman Shipley for the position of Mayor. Councilman Coen nominated Councilman Green for the position of Mayor. The City Attorney informed Council that as Councilman Bartlett had pre- viously nominated Councilman McCracken for the position of Mayor, his nomination of Councilman Shipley for same would not be in order. Councilman Bartlett then withdrew his nomination of Councilman Shipley for the position of Mayor and Councilman Matney nominated Councilman Shipley for said position. There being no further nominations forthcoming, on motion by Coen, nom- inations were closed by the Chair. Motion carried. A vote was taken by secret ballot with the tallying of vote by the City Administrator and the Development Coordinator, who found that three votes had been cast for Councilman Shipley, three votes had been cast for Councilman Green and one vote cast for Councilman McCracken. The Chair then called for a runoff vote to be taken between Councilman Green and Councilman Shipley for the position of Mayor, and upon tallying the votes it was round that Councilman Shipley had. received a majority of the votes cast. On motion by Coen, the Clerk was instructed to cast a, unanimous ballot for Councilman Shipley for Mayor. Motion carried. The City Clerk then turned the gavel over to the new Mayor, Councilman Shipley, to conduct the balance of the meeting. ELECTION OF MAYOR PRO-TEMPORE - JERRY MATNEY Mayor Shipley called for nominations for Mayor Pro-Tempore of the City of Huntington Beach. Councilman Matney nominated Councilman Green for the position of Mayor Pro-Tempore, but the nomination was declined by Councilman Green. Councilman Green then nominated Councilman Matney for the position of Mayor Pro-Tempore. There being no further nominations forthcoming, on motion by Coen, nominations were closed, and the Clerk was instructed to cast a unan- imous ballot for Councilman Matney for Mayor Pro-Tempore. RICHARD NEUTRA - ADDRESS TO COUNCIL Mrs. Richard Neutra spoke briefly regarding her late husband's plans for designing the Central City Library of Huntington Beach prior to his death while in Europe, and stated that she believed his plans and ideas for the library would be realized through the work of their son Dion Neutra, who will now head the architectural firm. Mayor Shipley expressed Council's sympathy at the passing of Mr. Neutra and thanked her for her presentation. Councilman Matney requested that a committee be appointed. for the purpose of establishing conditions which must be met in a contract for the design of the Central City Library. Mayor Ship ley appointed Councilwoman Gibbs, Councilman Matney and Councilman Coen to work with the City Librarian and a member of the Library Board, for the purpose of establishing criteria to be included in the contract for the design of the Central City Park.
