BOARD MEMBERS PRESENT: McFarland, Cook, Palin
Chairman Dan McFarland called the
meeting to order.
CONDITIONAL EXCEPTION NO. 70-17 - Continued
Applicant: Saddleback Development
To permit a 3 ft. interior side yard
setback in lieu of the required 4 ft. setback and to allow a
portion of the required 600 sq. ft. of open space to be within
the front 1/3 of the lot in lieu of the requirement that such
open space be provided within the rear 2/3 of such lot.
Located on the west side of 16th St.,
50 ft. north of Walnut Ave. in the R4 - Multiple Family Residence
District.
The hearing was opened to the audience.
Mr. Frey, representing the applicant,
addressed the Board. The Board discussed the revised plot plan
received April 21, 1970, and explained the City's requests for
amendments to the plan. Mr. Frey felt the City's requests were
acceptable.

A MOTION WAS MADE BY PALIN AND SECONDED
BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 70-17 WITH
THE FOLLOWING CONDITIONS:
1. The applicant shall dedicate 22 ft. from the rear of subject
property for additional alley right-of-way.
2. The sideyard setback shall be 4 ft. for the side -on
entry garage.
3. All applicable City Ordinances shall be complied with.

The Acting Secretary advised
that an oral request had been made by Commissioner Bokor to
refer these items to the Planning Commission for decision.
Mr. Palin explained the concern of the Commissioner was the
Division of Land creating lots which could later be sold
separately.

REFER CONDITIONAL EXCEPTION NO. 70-19, USE PERMIT NO. 70-17,
AND DIVISION OF LAND NO. 70-11 TO THE PLANNING COMMISSION
MEETING TO BE HELD APRIL 28, 1970, AT 7:00 P.M. IN THE
COUNCIL CHAMBERS, CIVIC CENTER. THE MOTION DIED FOR LACK
OF SECOND.
Mr. Stellrecht submitted
letters from Mercury Savings and Loan Association, First
American Title Insurance Company, and 1st Southern
California First National Bank, pertaining to the sale
of Parcel 34, and confirming the requirement that the
property had to be divided into four parcels for financing
purposes. He also stated that 4 separate loans would be
recorded, each with a note and deed of trust, and that
the parcels would not be sold separately.
There being no further
comment, the hearing was closed.
Board discussion was held.
The acting secretary asked
Mr. Stellrecht if he would withdraw DV 70-11. Mr. Stellrecht
informed the Board that without DV 70-11, he would have no
project.

A MOTION WAS MADE BY MCFARLAND AND
SECONDED BY COOK TO APPROVE CONDITIONAL EXCEPTION NO. 70-19
WITH THE FOLLOWING CONDITION:
1. The carports constructed on the property line shall be of
maintenance free masonry material.

A MOTION WAS MADE BY MCFARLAND AND
SECONDED BY COOK TO APPROVE USE PERMIT NO. 70-17 WITH THE
FOLLOWING CONDITIONS:
1. The plot plan received April 22, 1970, shall be the approved
layout.
2. Heil Avenue shall be dedicated and fully improved to City
standards at the time each parcel is developed.
Improvements shall include street trees, street signs,
street lights, fire hydrants, sewer and water main
extensions.
3. Water supply shall be through the City of Huntington
Beach's water system at the time each parcel is developed.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time each parcel is developed.
5. The water, sewer, and fire hydrant system shall be
approved by the Department of Public Works and Fire
Department.
6. Easements -for utilities or walkways shall be provided to
Department of Public Works standards.
7. All buildings on lots abutting a City easement shall be
set back five (5) feet from the edge of such easement.
8. The flood control channel shall be fenced to Flood Control
District standards and City standards at the time each
parcel is developed.
9. The property shall participate in the local drainage
assessment district at the time each (said) parcel is
deve Loped.
10. Soil reports as required by the Building Department and
the Department of Public Works shall be submitted to the
City prior to issuance of building permits.
11. All -utilities shall be installed underground at the time
each parcel is developed.
12. Fire alarm system conduit and appurtenances Ehall be
installed by the developer at locations and to specifications
provided by the Fire Department.
13. Off-street parking facilities shall conform to Article 979.

14. A masonry wall shall be constructed along the
north, east, and west property lines. The height
of said wall shall be such that the top will be
six (6) feet above the highest ground surface
within twenty (20) feet of the common property
line.
15. There shall be no fence, structure or landscaping
constructed or maintained over 32 feet high
within a 10 ft. by 10 ft. triangular area at the
intersection of driveways and streets or within
a 25 ft. by 25 ft. triangular area at the
intersection of streets.
16. No structures, other than those shown on the
approved plot plan, shall be constructed within
the project.
17. A lighting system shall be installed within the
project equal in illumination to lighting on
public streets. A lighting plan shall be submitted
to the Department of Public Works for approval.
18. All private streets shall meet the minimum
standards for apartment developments as adopted by
the Planning Commission.
19. The structural street section of all private drives
shall be approved by the Department of Public Works.
20. Access to Heil Avenue shall be approved by the
Traffic Engineer.
21. Landscaping and a screening wall shall be provided
along Heil Avenue and approved by the Board of
Zoning Adjustments.
22. All applicable City Ordinances shall be complied with.
23. All of the above conditions shall be complied with
prior to issuance of a Certificate of Occupancy
by the Building Department.
24. The Standards for Apartment Developments adopted by
the Planning Commission on October 21, 1969, shall
be complied with.

Applicant: Jomicra Inc.
To permit model mobile homes to
encroach into the required sight angle for merchandise
displayed within the front 50 ft. setback.
In Conjunction With
ADMINISTRATIVE REVIEW NO. 70-11
Applicant: Johnnie L. McElroy
To permit the sale of mobile homes
in the C2 - Community Business District.
The hearing was opened to the
audience on Conditional Exception No. 70-20.
Messrs. John Hampton and Fred
Hampton, representing the applicant, addressed the Board and
answered various questions.
The suggested conditions of approval
were reviewed by the applicant. Discussion was held pertaining
to the landscaping, parking requirements, sight angle, and
setbacks.
There being no further comments,
the hearing was closed on Conditional Exception No. 70-20.
Board discussion was held.
It was felt that revised plot
plans were necessary.

SECONDED BY PALIN TO CONTINUE CONDITIONAL EXCEPTION NO. 70-20
AND ADMINISTRATIVE REVIEW NO. 70-11 TO THE NEXT REGULAR MEETING
ON APRIL.29,, 1970, TO ALLOW TIME FOR THE APPLICANT TO SUBMIT
REVISED PLOT PLANS.

ADMINISTRATIVE REVIEW NO. 70-13
Applicant: Capital Development Company
To permit a trailer to be used as a
temporary office in the R5 - Office -Professional District.
Located on the west side of Beach Blvd.,
approximately 720 ft. south of Indianapolis Avenue.
Messrs. Bob MacIntosh and Jerry Gibbons
representing the applicant, addressed the Board and answered
various questions. Mr. MacIntosh advised the temporary office
would be used for a period of approximately eight weeks.
Board discussion was held.
