To permit model mobile homes to encroach into the required sight angle for merchandise displayed within the front 50 ft. setback. In Conjunction With ADMINISTRATIVE REVIEW NO. 70-11 (Continued) Applicant: Johnnie L. McElroy To permit the sale of mobile homes in the C2 - Community Business District. The hearing was opened to the audience. It was noted by the Acting Secretary that this item was continued for a revised plot plan to be submitted. Fred Hampton and John Hampton, representing the applicants, addressed the Board and answered various questions. They submitted a revised plot plan to the Board for review. It was noted by the Board that the revised plot plan conforms to the suggestions by the Board at the April 22, 1970, meeting. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY COOK AND SECONDED BY PALIN TO DENY CONDITIONAL EXCEPTION NO. 70-20 FOR THE FOLLOWING REASONS: 1. There was no justification demonstrated. 2. Coaches can be laid out to be saleable and conform to ordinance. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 70-11 WITH THE FOLLOWING CONDITIONS: 1. Beach Blvd., Owen and Clay Avenues, shall be dedicated and fully improved to City and/or State standards at the time the parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Easements for utilities or walkways shall be provided to Department of Public Works standards. 7. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 8. The property shall participate in the local drainage assess- ment district. 9. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 10. All utilities shall be installed underground. 11. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 12. Off-street parking facilities shall conform to Article 979. 13. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department and Department of Public Works. 14. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 15. All applicable City Ordinances shall be complied with. Pearson To allow a reduction of the minimum dimension required for open space from 20 ft. to 18 ft. Subject property is located on the south side of Audrey Drive, 240 ft. east of Thomas Lane in the R1 - Single Family Residence District. to the audience. to represent the applir ant. the hearing was closed. The applicant is providing open space in excess of that required by code. 2. The request is for a two foot reduction in the minimum dimension and is sufficiently off set by an existing 12 ft. side yard. ADMINISTRATIVE REVIEW NO. 70-14 Applicant: Ada Equipment Rentals To permit the outside display and/or storage of rental equipment in the C4 Highway Commercial District. Subject property is located on the west side of Beach Blvd., 207 ft. south of Cypress St. Mr. Fite, the applicant, addressed the Board explaining his request. The Board informed the applicant that the display area would have to conform to Section 9432.4 of the Huntington Beach Ordinance Code for rental equipment or a variance would be required for such display as shown on the plot plan. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE ADMINISTRATIVE REVIEW NO. 70-14 TO MAY 13, 1970, TO ALLOW THE APPLICANT TIME TO SUBMIT AN APPLICATION FOR A VARIANCE. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 70-15 Applicant: Bill H. Schultz To permit the outside display and/or storage of U-Haul utility trailers and trucks at a service station in the C2 - Community Business District. Subject property is located on the southeast corner of Adams Avenue and Magnolia Street. It was noted by the Acting Secretary that the applicant had requested that this item be continued to May 6, 1970. Subject property is located on the west side of Beach Blvd., 147 ft. north of Warner Avenue. Mr. Avery addressed the Board and answered various questions. It was noted by the Board that only ten new tires would be permitted and that a variance would be required for the amount of display as shown on the plot plan. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE ADMINISTRATIVE REVIEW NO. 70-16 TO MAY 13, 1970, TO ALLOW TIME FOR THE APPLI- CANT TO SUBMIT A VARIANCE APPLICATION. MISCELLANEOUS: DIVISION OF LAND NO. 70-11 Applicant: Bartoli & Stellrecht To allow a division of a 4.45 ac. parcel of land into four separate parcels. Subject property is located on the north side of Heil Avenue, 700 ft. west of Bolsa Chica Street in the R2 - Two Family Residence District. It was noted by the Acting Secretary that this item had been referred back from the Planning Commission to the Board of Zoning Adjustments for review for conditions as the Board deems necessary. The Chairman reopened the hearing on Use Permit No. 70-17 in conjunction with Division of Land No. 70-11. A MOTION WAS MADE BY COOK AND SECONDED BY MCFARLAND TO AMEND CONDITION #1 OF APPROVAL FOR USE PERMIT NO. 70-17 TO READ,THE PLOT PLAN RECEIVED APRIL 9, 1970, SHALL BE THE APPROVED LAYOUT. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE THE FOLLOWING CONDITIONS FOR DIVISION OF LAND NO. 70-11: -4- 4/29/70 - BZA Minutes: H.B. Board of Zoning Adjustments Wednesday, April 29, 1970 Page No. 5 1, Heil Avenue shall be dedicated and fully improved to City standards across the entire frontage of all parcels prior to development of any parcel. Improvements shall include street trees, street lights, fire hydrants, sewer and water main extensions. 2. Mutual driveway easements over abutting lots shall be to the requirements of the Board of Zoning Adjustments. 3. Water supply shall be through the City of Huntington Beach's sewage system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district. 7. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 8. All utilities shall be installed underground. 9. A parcel map shall be filed with the City and recorded. Such recordation shall not occur until the developer requests a framing inspection on the project. 10. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the conditions listed above. 11. A deed restriction shall be placed upon subject property to preclude each parcel from being sold separately. 12. The deed restriction shall be approved by the City Attorney's office. 13. If said deed restriction is not accomplished, Division of Land No. 70-11 shall be null and void. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED.
