TUESDAY, MAY 5, 1970 COMMISSIONERS PRESENT: Bazil, Bokor, Slates, Miller, Porter, Tom, Duke COMMISSIONERS ABSENT: None MINUTES: On motion by Miller and seconded by Tom, the Minutes of the Huntington Beach Planning Commission of January 20 and 27, February 17 and 24, March 10 and 31, April 21, 1970, were accepted as transcribed and mailed by the Secretary. AGENDA ITEMS TO BE CONTINUED: ZONE CASE NO. 69-36 (Continued) Applicant: Standard Pacific Corp. Change of zone to R5 Office - Professional District. Located between Garfield Ave. and Ellis Ave., east to the extension of Newland St. The Acting Secretary informed the Commission that the staff recommends continuance of Zone Case No. 69-36 to May -19, 1970, to allow time for the Commission to review the proposed standards for mobilehome parks. A MOTION WAS MADE BY TOM AND SECONDED BY PORTER TO CONTINUE ZONE CASE NO. 69-36 TO MAY 19, 1970, AS PER STAFF'S RECOMMENDATION. TENTATIVE TRACT MAP NO. 7019 198 lots on 40.01 acres, located at the northwest corner of Atlanta Ave. and Brookhurst Street. In Conjunction With CONDITIONAL EXCEPTION NO. 70-25 Subdivider: John D. Lusk and Son To allow lots within a subdivision to have: a) Panhandle (flag) lots with 16 ft. of frontage in lieu of the required 45 ft. of frontage for knuckle lots; and, b) Lots averaging less than 60 ft. in width over each six con- tiguous lots in lieu of the requirement that each six contiguous lots have 360 ft. of width. Located on the northwest corner of Atlanta Ave. and Brookhurst St. in the RA-0 Residential Agricul- tural District combined with oil production. The Commission received two telegrams opposing Conditional Exception No. 70-25. -1- 5/5/70-PC Minutes: H.B. Planning Commission May 5, 1970 Page 2 The hearing was opened on Conditional Exception No. 70-25. Tentative Tract Map No.7019 was also considered at same time. Bill Lusk, President, John D.Lusk and Son, addressed the Commission and explained the proposal. Mr. Lusk stated that only 3 panhandle lots will be created within the entire subdivision. He pointed out that the lots will be averaging 6,000 sq. ft. within the proposed subdivision and that the smallest lot is 58 ft. wide. The following property owners addressed the Commission and were concerned that this would result in parking problems and the small lot sizes would set a precedent for future developments: Richard McCoy, Mack Levias, Herbert Clark, James Coran, Wm. DeGovat, James Nelson, W.E. Lindley and Dave Smith. There being no other comment, the hearing was closed on Conditional Exception No. 70-25. The Commission held a discussion. A MOTION WAS MADE BY DUKE AND SECONDED BY PORTER TO DENY CONDITIONAL EXCEPTION NO. 70-25 FOR THE FOLLOWING REASONS: 1. The applicant has not demonstrated sufficient hardship. 2. The panhandled lots would be detrimental to the area. 3. The subdivision is below standards as to lot size and frontage. COMMISSIONER. DUKE WITHDREW HIS MOTION TO DENY CONDITIONAL EXCEPTION NO. 70-25 WITH AGREEMENT FROM MR. PORTER. A FURTHER MOTION WAS MADE BY BOKOR AND SECONDED BY PORTER TO CONTINUE CONDITIONAL EXCEPTION NO. 70-25 AND TENTATIVE TRACT MAP NO. 7019 TO MAY 19, 1970, IN ORDER FOR THE APPLICANT TO SUBMIT A REVISED'MAP TO BE CONSIDERED BY THE SUBDIVISION COMMITTEE MEMBERS ON MAY 14, 1970. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Miller, Porter, Duke, Tom NOES: None ABSENT: None THE MOTION CARRIED. ZONE CASE NO. 69-34 (Continued) Applicant: Huntington Beach Company Change of zone from Rl-0 Single Family Residence District combined with oil production to R1 Single Family Residence District and R1-02 Single Family residence District - Combining Oil District. Located north of Palm Ave. and west of Golden West St. Commissioner Bokor abstained from participation on this item. The hearing was opened to the audience. There being no comment, the hearing X-RELS closed. The Acting Secretary informed the Commission that this item was originally heard at the December 6, 1969, meeting, at which time it was pointed out that Article 968, the Oil Combining District, was in the process of being revised and that the revisions will not be consistent with the proposed rezoning inasmuch as the 11021, designation will undergo major changes. 111r. Harlow pointed out that Article 968, Oil Combining District, has been adopted; however, the require- ments for each district have changed necessitating a revision of the requested zone designations. He further pointed out that the requirements of the 110" zone and the 1102" zone have reversed in that the 110" zone does not allow drilling new wells whereas the 1102" zone is a zone designated specifically for drilling in the Ml and M2 Districts. -2- 5/5/70-PC Minutes: H.B. TO THE CITY COUNCIL OF THAT PORTION OF THE REQUEST TO REZONE. ALL TENTATIVE TRACT NO. 6904 1.4ITH THE EXCEPTION OF LOTS 4, 5, 6, 21, 31, 32, 42, 46, 47, 64, 65, 66, 80 and 81 from Cl-0 to R1 and that portion of the request to rezone lots 4, 5, 6, 21, 31, 32, 42, 46, 47, 64, 65, 66, 80 and 81 from it-0 to R1-02 should be deleted from this request and the RI-0 designa- tion allowed to remain. CONDITIONAL EXCEPTION NO. 70-24 Applicant: Valley Tractor Service To permit renewal of the expired Conditional Exception No. 69-44 which will allow the sale of top soil, sand and gravel, and equipment rental in the RA Residential Agricultural District. Located approximately 520 ft. north of Talbert Ave., west of Goldenwest St. The hearing was opened to the audience. M r. Yoder, applicant, addressed the Commission and stated that he is in process of moving his business,. but will need more time than" -:suggested by the staff. There being no.other comment, the hearing was c.l_osed. The Commission held a discussion. A MOTION WAS MADE BY.SLATES AND SECONDED BY BAZIL TO APPROVE CONDITIONAL EXCEPTION NO. 70-24 UPON THE FOLLOWING CONDITIONS: 1. Conditional Exception No. 70-24 shall become null and void January 1, 1971, or at such time the City acquires subject property for expansion of the Central City Park, whichever is sooner. Lund To permit the construction of a fence within 10 ft. of the front property line in lieu of the required 15 ft. front yard setback. Located on the west side of Edgewater Lane, 100 ft. south of Morning Star Drive. lhe hearing was opened to the audience. Mr. Lund, applicant, stated that the fence is existing and that he would like to move it to within 10 ft. of the front property line. There being no other comnent, the hearing was closed. The subject property faces a side -on lot having a 6 ft. high grape stake fence located on property line. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Miller, Porter, Tom, Duke NOES: None ABSENT: None THE MOTION CARRIED. COMMUNICATION: The Acting Secretary read a communication sub- mittedy the Orange County Planning Commission regarding Use Variance No. 6433 requesting the continued use of a storage yard for impounded automobiles, campers, boats, etc., in the R4 "Suburban Residential", located north of Talbert Ave., approximately 315 ft. west of Newland St. The Commission reviewed the request. A MOTION WAS MADE BY SLATES AND SECONDED BY MILLER TO RECOMMEND TO THE ORANGE COUNTY PLANNING COMMISSION THAT USE VARIANCE NO. 6433 BE APPROVED ON THE CONDI- TION THAT SUCH APPROVAL EXPIRE ON JUNE 1, 1972. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Miller, Porter, Duke, Tom NOES: None ABSENT: None THE MOTION CARRIED. DISCUSSION: The Acting Secretary informed the Commission that they y were to review the Civic District design criteria to be submitted to the Design Review Board for discussion at a joint meeting. INFORMATION: The Acting Secretary informed the Commission that Conditional Exception No. 69-30, Applicant - Mr. Jake Stewart has not complied with conditions of approval and the use has not been established. He stated that pursuant to the conditions of approval, of the Conditional Exception, the Commission was to review the application within 6 months from the date of approval and if nothing was done steps would be taken to revoke the approval. It was the consensus of the Commission to bring this item back at the May 12, 1970, Study Session for further review, and to invite the applicant to discuss this matter. AMENDMENT TO SIGN ORDINANCE: The Acting Secretary distributed copies ot a proposed amen ment to the sign ordinance which was sdubmitteg b� the City Attorney's Office, pertaining to signs 1sp aye i , on or over public right-of-way. The Commission reviewed the proposed amendment, and it was their consensus to set said amendment for public hearing. INFORMATION: The Acting Secretary informed the Commission that Use Permit No. 69-9, Associated Southern Investment Co., was to have expired on March 12, 1969; however, an on -site investigation of the property was conducted by the Planning and Building Depart- ments' personnel and their report stated that construction has begun but was not proceeding without undue delay. The Commission requested that Use Permit No. 69-9, permitting construction of the 97 unit mobilehome park be set for review at their May 19th meeting, in order for the Commission to determine whether or not construc- tion on said property is proceeding without undue delay. -4- 5/5/70-PC Minutes: H.B.
