HomeMy WebLinkAbout1970-05-06MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Administrative Annex 523 Main Street Huntington Beach, California WEDNESDAY, MAY 6, 1970 BOARD MEMBERS PRESENT: Lipps, Spencer, Palin ON MOTION BY PALIN AND SECOND BY LIPPS, THE MINUTES FOR FEBRUARY 4, 11, 18, and 25, 1970, AND MARCH 4, 1970, WERE ACCEPTED AS TRANSCRIBED. ADMINISTRATIVE REVIEW NO. 70-15 - Continued Applicant: Bill H. Schultz To permit the outside display and/or storage of U-Haul utility trailers and trucks at a service station in the C2 - Community Business District. Subject property is located on the southeast corner of Adams Avenue and Magnolia Street. The Acting Chairman read the request. Mr. Schultz, applicant, and Mr. Russell Maxwell, U-Haul representative, were present and answered various questions. The Acting Chairman advised the applicant that the Board could not act on any provision otherthan the use itself by this application and that a Conditional Exception would be necessary for approval of an encroachment into the required setback, etc. Discussion was held pertaining to the screen- ing of the U-Haul equipment. The Acting Chairman advised that the Planning Commission is currently preparing standards for service stations and that the feeling of the Commission is that no rental trucks should be allowed and to limit the number of utility trailers to ten on said service station sites. He also advised that the Planning Commission is having a study session on May 26, 1970, regarding service station standards, and Mr. Schultz and Mr. Maxwell expressed their desire to attend this meeting. It was felt by the Board and Mr. Schultz that this hearing should be continued until after the Planning Commission's study session to be held on May 26, 1970. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE ADMINISTRATIVE REVIEW NO. 70-15 TO THE MEETJNG TO BE HELD ON JUNE 3, 1970, TO ALLOW THE APPLICANT TIME TO ATTEND THE PLANNING CODMISSION STUDY SESSION ON MAY 26, 1970. ROLL CALL VOTE: AYES: Lipps, Spencer, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 70-17 Applicant: Richard L. Smith DBA Ajax Rents To permit the outside storage and/or display of rental equipment in the C4 - Highway Commercial District. -1- 5/6/70 - BZA Minutes: H.B. Board of Zoning Adjustments Wednesday, May 6, 1970 Page No. 2 Subject property is located on the west side of Beach Blvd., 300 ft. north of Garfield Avenue. The Acting Chairman read the request. Mr. Smith, applicant, was present and answered various questions. The Acting Chariman advised the applicant that by the administrative review application, the Board can approve the use subject to the provisions of the code, and gave a summary of the code regarding this use. The applicant stated that because of the uses on either side of him having encroachments into the 50 ft. setback causing subject property to be unseen from the street, that if he could not display his merchandise within the 50 ft. front yard setback, he would be put out of business. He also advised the Board that the majority of his customers do not park in the provided striped parking spaces but drive onto the premises to attach a trailer onto their vehicle or drive a low -boy trailer and truck onto the property for the purpose of loading tractors and equipment. Mr. Smith also advised that when he originally applied to do business on this lot that the Planning Commission advised him that there would be no encroachment into the 50 ft. front yard setback allowed along Beach Blvd., and if his adjoining neighbors were setback 50 ft., then he would gladly move his business behind the setback. The Acting Chairman advised that since that time, further study had been made by the Planning Commission, and some uses were permitted to encroach into the 50 ft. front yard setback. It was felt by the Board and the applicant that this application should be continued to the May 27, 1970, meeting to allow time for the applicant to file a conditional exception on such display. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE ADMINISTRATIVE REVIEW NO. 70-17 TO MAY 27, 1970, TO ALLOW THE APPLICANT TIME TO SUBMIT A CONDITIONAL EXCEPTION APPLICATION FOR THE ENCROACHMENT INTO THE FRONT YARD SETBACK. ROLL CALL VOTE: AYES: Lipps, Spencer, Palin NOES: None THE MOTION CARRIED. MISCELLANEOUS: Consideration of minor revision on the plot plan for H,.B..Holding Corporation's Use Permit No. 70-8. This revision proposes to move the main structure 65 ft. easterly. It was the consensus of the Board that the move is beneficial as it provides more permanent parking than as shown on the original plot plan. _ THERE BEING NO ]7URTHER BUSINESS, THE MEETING ADJOURNED.
