HomeMy WebLinkAbout1970-05-20MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Administrative Annex 523 Main Street Huntington Beach, California WEDNESDAY, MAY 20, 1970 BOARD MEMBERS PRESENT: McFarland, Cook, Palin CONDITIONAL EXCEPTION NO. 70-2 3 - Continued Applicant: Ada Equipment Rentals To permit: 1) the storage and/or display of rental equipment within the 50 ft. front yard setback, and 2) a chain link fence at the front property line in lieu of the required 50 ft. setback. In Conjunction With ADMINISTRATIVE REVIEW NO. 70-14 - Continued Applicant: Ada Equipment Rentals To permit the outside display and/or storage of rental equipment in the C4 Highway Commercial District. Subject property is located on the west side of Bea-c h Blvd., 207 ft. south of Cypress St. The hearing was opened to the audience. The Acting Secretary read a letter from American Glass Co., nearby property owner, which requested that the code requiring the 50 ft. front yard setback be complied with. Messrs. Fite, applicant, and Duarte, property owner, addressed the Board and answered various questions. The Board reviewed Conditional Exception No. 68-15, on subject property which requested the storage and display of equipment rental merchandise within the front 50 ft. setback area in the C4 Highway Commercial District. It was advised that this application was approved on May 8, 1968, with the condition, "The property :;hall be made to conform to the Ordinance by Octob er 31, 1968", and that this condition of approval had not been complied with. Mr. Fite staged that he was not aware of the previous conditional exception. The Acting Secretary also advised that th,; City does not have record of the issuance of a building permit for coistruction of subject fence. The applicant felt that the fence could not be set back the required distance due to the necessity of traffic circulation within the yard in order to load, unload and hook up trailers. There being no further comment, the hearing was closed. Board discussion was held. Mr. Palin fe_1t that these items should be referred to the Planning Commission for decision as this application is the first of many such applicat',ons on nort-conforming outside display and/or storage and the Board should have direction from the Planning Commission on such application. A MOTION WAS MADE BY COOK AND SEG)NDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 70-23 WITH THE 0)NDITION: -1- 5120170 - BZA Minutes - Board of Zoning Adjustments Wednesday, May 20, 1970 Page 2 1. Conditional Exception No. 70-23 shall become null and void on May 20, 1972. FOR THE REASONS: 1. The type of business and size of the lot would preclude the applicant from conducting his business properly if the fence were set back the required amount. 2. The chain link fence is necessary to protect his merchandise. ROLL CALL VOTE: AYES: Cook, McFarland NOES: Palin THE MOTION CARRIED. A MOTION WAS MADE BY COOK AND SECONDED BY MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 70-14 WITH THE FOLLOWING CONDITIONS: 1. The display of equipment shall be as shown on plot plan submitted on April 1, 1970. 2. All rental equipment within the 50 ft. setback shall not exceed the height of the 6 ft. chain link fence. 3. Administrative Review No. 70-14 shall become null and void on May 20, 1972. ROLL CALL VOTE: AYES: McFarland, Cook NOES: Palin THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 70-16 - Continued Applicant: Avery General Tire Service To permit the outside display of tire racks in the C4 Highway Commercial District. Subject property is located on the west side of Beach Blvd., 147 ft. north of Warner Avenue. It was noted that this item had been continued to this date to allow time for the applicant to submit a conditional exception application. The applicant could not file in time for this meeting so requested the Board to proceed with the administrative review application. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 70-16 WITH THE FOLLOWINS CONDITIONS: 1. The display of tires shall be limited to one tire rack. 2. The tire rack if located along the front property line shall set back a minimum of 10 ft. from said property line. 3. The tire rack shall display no more than ten tires. ROLL CALL VOTE: AYES: Cook, McFarland, Palin NOES: None THE MOTION CARRIED. -2- 5/20/70 - BZA Minutes - Board of Zoning Adjustments Wednesday, May 20, 1970 Page No. 3 ADMINISTRATIVE REVIEW NO. 70-19 Applicant: Jay Mastroianni dba Jay's Catering; To permit four to six mobile catering trucks to operate adjacent to the service road in the C1 Neighborhood Commercial District. Subject property is located on the south westerly side of Pacific Coast Highway between loth Street and the Bolsa Chica State Beach. Paul Cook asked the Acting Secretary why the Board was acting on this use under Administrative Review application. The Acting Secretary informed the Board that Mr. Mastroianni had been informed by the Planning Department that this type of use would require Planning Commission approval under conditional exception application but that the City Attorney had submitted an opinion stating that "Catering truck appears to be a permitted use in the C1 District under 9411.1 Huntington Beach Ordinance Code, subject to administrative review by the Board of Zoning Adjustments under section 9411 of the Huntington Beach Ordinance Code". Therefore the Board had been instructed by Mr. Miller, City Administrator, to place this item on the agenda for discussion this date. Mr. Mastroianni, applicant, addressed the Board and explained the routine of the catering trucks. Mr. Bill Wren, representing the Huntington Pacific Corporation, addressed the Board and advised that they have requested the applicant's location so as not to interfere with Standard Oil facilities. Trash control was discussed. The applicant advised that each of the trucks carry trash cans which are placed nearby the truck for the use of the customers. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 70-19 WITH THE FOLLOWING CONDITIONS: 1. Administrative Review No. 70-19 shall become null and void February 20, 1971; however, an extension of time may be granted by the Board of Zoning Adjustments by annual review of said application. 2. The operation of the vehicles shall be limited to the paved service road only as shown on the approved plot plan. 3. Every effort must be made by the truck operator to keep the area around the truck free of trash. ROLL CALL VOTE: AYES: McFarland, Cook, Palin NOES: None THE MOTION CARRIED.
