MINUTES: On motion by Miller and seconded by Porter, the
Fffni-utes of the Huntington Beach Planning Commission of April 7,
1970, were accepted as transcribed and mailed by the Secretary.
COMMISSIONER DUKE: Commissioner Duke arrived at 7:05 P.M. and
assumed his duties.
CONDITIONAL EXCEPTION NO. 69-41 (Continued)
Applicant: James Hodges
To permit: 1) Construction of a
10 unit apartment complex in lieu of the permitted maximum of
6 units; 2) Such units shall be three stories in height in lieu
of the permitted maximum two stories (such buildings are not
to exceed the permitted building height of 30 ft.); 3) Construc-
tion of carports at 110" side yard setback in lieu of the required
4 ft. setback; 4) Open unenclosed stairways to set back 18 inches
from the side property line in lieu of the required 3 ft. set-
back; 5) To permit the second story of such building to cantilever
over the required 600 sq. ft. of open space and to permit construc-
tion of an open stairway within such open space. Located on the
east side of 13th St., approximately 125 ft. north of Walnut Ave.
in the R4 Multiple Family Residence District.
The Acting Secretary informed the
Commission that a telephone call was received from the appli-
cant, requesting continuance of Conditional Exception No. 69-41
to allow time to consult with the staff and revise the plot
plan to more closely conform to the proposed standards for this
area of the city.

CODE AMENDMENT NO. 70-6
SIGN ORDINANCE
Said amendment proposes to amend
Section 9762.6 of the Huntington Beach Ordinance Code by re-
wording such section to prohibit all signs (including, but
not limited to political signs) from public rights -of -way
(city streets).
The hearing was opened to the
audience. There being no comment, the hearing was closed.
The Commission reviewed the pro-
posed Code Amendment. The Acting Secretary reviewed various
sections of the proposal. Mr. Harlow informed the Commission
that the code amendment does not allow any sign to project
over a city easement or rights -of -way.

CODE AMENDMENT NO. 70-4 (Continued)
MH - Mobilehome District
Said amendment proposes to add to
Division 9 of the Huntington Beach Ordinance Code Article 924
ME - Mobilehome District. Such district is established to
set forth minimum standards for mobilehome parks.
The Commission reviewed the pro-
posed amendment.
The Acting Secretary suggested that
the Commission consider item No. 6 - Definitions - at the same
time.
Mr. Shilling, representing the
Trailer Coach Assoc., addressed the Commission and commented
on items "H" Storage Space, "L" Parking Requirements and "A"
Intent and Purpose. Mr. Shilling asked if the required covered
parking space could'be provided within 30 days after occupancy
of each mobilehome. Mr. McIntosh, manager of the Mobilehome
Division for Signal Landmark, addressed the Commission and
opposed item "B" sub -paragraph 3, regarding the on -site sale
of mobilehomes and the wording thereof.
Three residents of the Driftwood
Trailer Park addressed the Commission and asked if they will
be required to remove their trailers if this ordinance is
approved. The Assistant City Attorney informed the people
that the City does not have any plans to remove the Drift-
wood Trailer Park and that existing parks could remain as
they are under the non -conforming provisions of the code.
The Planning Commission requested
that the staff submit a report on revenues generated by Mobile -
home Parks.

SECONDED BY MILLER TO REFER CODE AMENDMENT NO. 70-4 AND DEFI-
NITIONS TO THE CITY ATTORNEY'S OFFICE FOR PREPARATION IN FINAL
FORM TO BE SUBMITTED TO THE COMMISSION BY JULY 7, 1970, AND
TO DISCUSS ITEM "B" SUB. 3 REGARDING THE ON -SITE SALES OF
MOBILEHOMES AT THE NEXT STUDY SESSION ON JUNE 9, 1970.

ARTICLE 925 and 947
Said amendment proposes to amend
Article 925 - R5 Office -Professional District and Article 947-
C4 Highway Commercial District by removing trailer parks from
said districts.
The Commission reviewed the pro-
posed amendment.

SERVICE STATION STANDARDS
DISCUSSION:
The Planning Commission reviewed
a proposed standards for service stations.
Gerald Buck, representing Stan-
dard Oil Co., stated that he agreed with the proposed service
station standards.
Bill Schultz, operator of a Union
Statio4 questioned the requirement on utility trailers limiting
them to 10 and the requirement that said trailers be screened
from the street and adjacent property by a 6 ft. high masonry
wall.
It was the consensus of the Com-
mission to discuss this item further at the June 23, 1970,
Study Session and instructed the staff to have plot plan of
existing service station which may be used to make a recom-
mendation on a percent of such sites, to be used for trailer
rentals.
TALBERT AVENUE AS IT RELATES TO HUNTINGTON CENTRAL PARK
DISCUSSION:
The Planning Director informed
the Commission that the City Council is contemplating the
closure of Talbert Ave. between Goldenwest St. and Edwards St.
Mr. Reynolds pointed out that Talbert Ave. now dead -ends at
Goldenwest St., but the Master Plan of Arterial Streets and
Highways has for a number of years, shown Talbert Ave. going
through to Edwards St. Mr. Reynolds reviewed the proposal
with the Commission and suggested that the Commission direct
a transmittal to the City Council with findings and recom -
mendation as the Council wants to move ahead on this issue.
COMMISSIONER MILLER: Commissioner Miller was excused from

SECONDED BY BOKOR TO RECOMMEND THAT TALBERT AVE., ELLIS AVE.
AND EDWARDS ST. REMAIN PART OF THE MASTER PLAN OF ARTERIAL
STREETS AND HIGHWAYS AND THAT THE ENGINEERING DEPARTMENT BE
ASSIGNED TO A STUDY OF THE RE -ALIGNMENT OF ELLIS AVE.,
EDWARDS ST. AND TALBERT AVE. SO THAT IT WILL CAUSE THE LEAST
DISRUPTION TO THE CENTRAL CITY PARK:

The Acting Secretary distributed
copies of the Parks and Recreation Ordinance - Articles 974
and 998 - to the Commission. Mr. Harlow informed them that
the only change from prior drafts was organization. He
stated that a public hearing will be held on these amendments
at the June 16th meeting.

It was the consensus that the
Chairman and the Planning Director meet with the City
Administrator and the Mayor to discuss this change.
PROPOSED CODE AMENDMENT NO. 70-10
COMMERCIAL ZONES
Said amendment proposes to amend
Article 981 Board of Zoning Adjustments, 942 C2 Community
Business District and 945 C3 General Business District to:
1) Require a public hearing on a complaint for Home Occupa-
tion'by the Board of Zoning Adjustments; 2) Add hardware
stores, animal grooming, car wash and mortuary to the uses
within the C2 District. Also, adding a provision for other
retail uses or services not specifically provided for, may '
be permitted subject to approval of a Use Permit application;
and, 3) Require approval of administrative review by the
Board of Zoning Adjustments for all uses in the C3 zone which
do not require use permit approval.
The Commission reviewed proposed
Code Amendment pertaining to certain changes in the C2 and
C3 commercial zones and Article 981 Board of Zoning Adjust-
ments.

AMENDMENT NO. 70-10 FOR A PUBLIC HEARING ON JULY 7, 1970.

MEMO: The Commission received a memo submitted by the City
Tttorney pertaining to proposed amendment to the Sign Code
Section 9764.7. Said amendment proposes to amend Section
9764.7 of the Huntington Beach Ordinance Code to require the
filing of a bond for all temporary signs.
It was the consensus of the Com-
mission to further review said amendment at the next study
session on June 9, 1970.
DISCUSSION: Commissioner Bazil suggested that the staff
prepare a code amendment to the R2, R3 and R4 Districts
to require all residential lots and/or parcels in the down-
town area, which abut upon an alley to take access to all
garages, carports and open parking from such abutting alley
only.
It was the consensus of the
Commission to instruct the Secretary to set this proposed
code amendment for public hearing.
DISCUSSION: The Acting Secretary informed the Commission
that t e oard of Zoning Adjustments has received a request
to allow construction of a dwelling addition over an exist-
ing garage having a 10 ft.. setback. He pointed out that
this would mean the dwelling would only be setback 10 ft.
in lieu of the required 15 ft. setback.
It was the consensus of the
Commission that the room addition over the existing garage
with side entry should be permitted but future applications
should be discussed in more detail.
