AGENDA ITEMS TO BE CONTINUED: ZONE CASE NO. 69-36 (Continued) Applicant: Standard -Pacific Corp. Change of zone to R5 Office -Pro- fessional District. Located between Garfield Ave. and Ellis Ave., east to the extension of Newland St. The Acting Secretary informed the Commission that the above referenced zone change was continued from a _,prior Planning Commission meeting to allow time for the Planning Commission to adopt a zone specifically for mobilehome parks. Mr. Harlow stated that. at the June 2nd meeting the MH zone was approved by the Com- mission and referred the matter to the City Attorney's office to be prepared in ordinance form. He stated that final action was continued to the July 7, 1970, meeting to allow time for preparation of the ordinance. _ A MOTION WAS MADE BY MILLER AND SECONDED BY DUKE TO CONTINUE ZONE CASE NO. 69-36 TO JULY 21, 1970, FOR THE AFOREMENTIONED REASONS. Change of zone from R2 Two Family Residence District to R5 Office -Professional District. Located between Slater and Speer Avenues, 282 ft. west of Beach Blvd., in the R2 Two Family Residence.District. The Acting Secretary informed the Commission that this zone change was continued from a prior meeting to allow time for the Commission to adopt a zone specifically for mobilehome parks. Mr. Harlow stated that at the June 2, 1970, meeting the MH zone was approved and referred to the Attorney's office to prepare said zone in ordinance form. Mr. Harlow recommended that Zone Case No. 70-4 should be continued to July 21, 1970, and -that this action should allow time for the Commission to conduct a final.review of the proposed ordinance and for the City Council to hold a public hearing on the matter. USE PERMIT NO. 69-9 (For Review) Applicant: Associated Southern Investment Co. To permit a 97 unit mobilehome park on approximately 10 acres and customary accessory buildings in.the R5 Office -Professional District. Located on the east side of Ward St., north of Yorktown Ave. Mr. Harlow pointed out that a hearing was held on May 19, 1970, to consider whether or not the use permit for such mobilehome park should be declared null and void due to the provisions of Section 9816.1.1 requiring that actual construction of the project be underway within one year. Mr. Harlow stated that in this case, there was a question as to whether or not the project was proceeding without undue delay. A video tape of the sub- ject property was shown. Mr. Leonard Price, representing the applicant, stated that when permits are issued, they will start construction immediately. COMMISSIONER PORTER: Commissioner Porter arrived at 7:18 P.M. and assume is duties. Commissioner Bazil re- quested that the Secretary read the conditions of approval for Use Permit 69-9. Mr. Bazil stated that he would be agreeable to allow the developer additional time to obtain building permits and to review this project again in 45 days. A MOTION WAS MADE BY BAZIL AND SECONDED BY DUKE TO REVIEW THIS ITEM AT THE JULY 28, 1970, MEETING TO SEE THAT SUBSTANTIAL PROGRESS IS BEING MADE. ROLL CALL VOTE: AYES: Bazil, Bokor, Miller, Porter, Tom, Duke NOES: None ABSENT: Slates THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-31 Applicant: Wm. Lyon Development Co. To permit the following: 1) 72 ft. front yard setback at ,,garage front with automatic door opener on all single -story (Plan 1) houses and option ,to provide same on cul-de-sac lots for two stories as per- mitted under Section 9106.2.1.1; 2).Reduce front setback to 10 ft. instead of 15 ft. where house adjoins garage on 72 ft. setback; 3) Allow for 6" wide metal gutter to project across property line onto adjacent lot where 110" side yard setback is used. If this cannot be granted, we request reduction of 10 ft. side yard to 916" but maintain 10 ft. between dwellings; 4) Waiver of masonry wall located at the zero side yard setback for substitution of 1 hour wood and plaster construction. (With 4 ft. maintenance easement); and 5) Request two adjoining houses be built on common lot line with 1 hour firewall between them. Mr. Robert Witt, 6731 Calpe Circle, Huntington Beach, asked why the builder is requesting exceptions to the code. Mr. Harlow read the applicant's request. Mr.Witt stated that he was interested in knowing the reasons given by the applicant for the request. CHAIRMAN SLATES: Chairman Slates arrived at 7:30 P.M. and assumed his duties. Commissioner Bazil stated that he feels that the request is reasonable since these lots are legal building sites as approved by the City Council. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE THE FOLLOWING: 1. A 72 ft. front yard setback shall be maintained at garage front -with automatic door opener on all single story (Plan 1) houses and option to provide same on cul-de-sac lots for two stories as permitted under Section 9106.2.1.1. 2. The front setback may be reduced to 10 ft. instead of 15 ft. where the house adjoins the garage on a 72 ft. setback. 3. The 10 ft. side yard may be reduced to 9161, provided a 10 ft. separation is maintained between dwellings. 4. Two adjoining houses may be built on a common lot line with one wall constructed of one -hour frame and stucco provided the other wall is constructed of masonry. AND DISAPPROVAL OF the request for waiver of a masonry wall located at the zero side yard setback for substitution of one -hour wood or plaster con- struction (with 4 ft. maintenance easement). AND FOR THE FOLLOWING REASONS: 1. The lots are substandard to ordinance requirements. 2. Approval of these conditional exceptions will allow the developer to build a better house. The applicant was aware of the substandard nature of these lots and additional conditions to alleviate self- imposed problems are not warranted. ~- 2. Any adjacent walls should be of masonry construction (C.E. item #5) to insure permanence of both structures. Any destructive occurrence would require that the proposed frame and stucco wall would have to be rebuilt of masonry materials. MINORITY REPORT: Commissioner Duke stated that problem could e alleviated by resubmitting for standard lots on a new tentative map. -3- 6/16/70-PC Minutes: H.B. Planning Commission Tuesday, June 16, 1970 Page 4 CONDITIONAL EXCEPTION NO.-70-29 Applicant: Stanley-Fann To permit the construc- tion of a 50 ft. high identification sign having a center mast of 75 ft. behind the 50 ft. setback in lieu -of the 35 ft. maximum height'as permitted at this location. Located north of Warner Ave. and west of Springdale St. in the C4 Highway Commercial District. The hearing was opened to the audience. A video tape of the subject property was shown. A petition signed by 102 property owners opposing the request was submitted to the Secretary. Five adjacent property owners addressed the Commission and opposed the request. Stanley Fann, owner, addressed the Commission and explained his request. Eric Wright, architect for the applicant, explained the reasons for the request and reviewed the landscaping within the shopping center. Mr. Summerfield,_representing the Sign Company explained the design -of the proposed.sign structure. = There being no -other comment, the hearing was closed. Commission discussion was held. The 75 ft. center mast shall be deleted.`, AND FOR THE FOLLOWING REASON: 1. This request would be permitted within the 50 ft..�setback. Certain features of this sign, as approved, propose the use of spotlight type bulbs. _ 4. The applicant was aware of this height restriction on this property prior,to development. COMMISSIONER DUKE: Commissioner Duke stated the following: 1. By allowing this use,�the Commission -is discriminating against others. 2. This request will be an imposition on surrounding uses. 3. This request is not within community planning acceptance. Located at the southeasterly part of Orange Ave. and llth St. The hearing was opened to the audience. Mrs. Hazel West, 218 - 13th St., addressed the Commission and spoke in favor of the request. - There being no.other comment, - the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY BOKOR AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO. 70-28 UPON THE FOLLOWING CONDITIONS: 1: Off-street parking shall be provided according to the requirements of Article 979. 20 The structure shall be made to conform to the require- ments of the Uniform Building Code. 3. The existing planter in front of the building shall be refurbished with new plant material which shall be maintained in a healthy state. 4. The area south of the existing building exclusive of the area required for parking shall be landscaped and permanently maintained. 5. A six (6) foot high masonry wall shall be constructed along the southeast property line except that such wall shall be reduced to 42 inches within the front 10 feet. Channell To permit the following: 1) Two units on a 3308 sq. ft. lot, resulting in a density of one unit per 1654 sq. ft. of lot area in lieu of one unit per 2000 sq. ft. of lot area; 2) Open balcony to extend 5� ft. into the required rear yard setback; 3) Construction of garage at 110" side yard setback in lieu of the required 3 ft. side yard setback; and, 4) The required open space to be -provided within the front 1/3 of lot in lieu of the requirement that such open space be provided"within the rear 2/3 of said lot. Located at the northeast corner of Knoxville Ave. and Delaware St. in the R2 Two Family Resi- dence District:' A letter of opposition was sub- mitted to the Secretary. The hearing was opened to the audience. - Four adjacent property owners add- ressed the Commission and opposed the request. Thomas Channel, applicant, stated his reasons for the request. The architect for the proposed 2 unit apartment complex explained the design of the structure. There being no other comment, the hearing was closed. Located on the north side of Ernest St., approximately 320 ft. east of Goldenwest St. . The hearing was opened to the audience. Commissioner Bokor abstained from this item., Bruce Greer, 18792 Stewart Street, and J. F. Greer, 18831 Crystal Ave., opposed the request. Wm. Wren, representing the Huntington Beach Co., spoke in favor and asked_ if the Commission could grant a five year limitation. Robert Johnson, applicant, offered to answer questions. _There being no other com- ment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY PORTER AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEP- TION NO. 70-33 UPON THE FOLLOWING CONDITIONS: 1. The riding stable and accessory uses shall be kept in a neat and clean manner at all times and properly sprayed to keep down the fly hazard. 2. Water shall be through the City of Huntington Beach's water system. 3. The property shall participate in the local drainage - assessment district. 4. Parking shall be -provided at a ratio as determined by the Planning Department with proper oiling for dust control and a standard parking layout. 5. Conditional Exception No. 70-33 shall become null and void on July 1, 1975, or when the freeway is precise planned or whichever is sooner. AND FOR THE FOLLOWING REASONS: 1. This type of use is not allowed in any zone and it is a limited use. 2. A portion of the subject property is within the loca- tion of future freeway right-of-way. Located approximately.250 ft. south of Edinger Ave. and 900 ft. east of Beach Blvd. The Acting Secretary read a letter submitted by Millet & King, engineers for the developer, requesting a one-year extension of time for Tentative Tract Map No. 6147. A MOTION WAS MADE BY BOKOR AND SECONDED BY MILLER TO GRANT THE APPLICANT A ONE YEAR EX- TENSION OF TIME FOR TENTATIVE TRACT MAP NO. 6147 UPON THE FOLLOWING CONDITIONS: 1. The tentative map received June 10, 1969, shall be the approved layout. 2- A 6 ft. high masonry wall shall be constructed along the south line of the alley situated at the south boundary of the subdivision. Such wall shall not be constructed across the end of Teri St. and the height of said wall shall be reduced to 42 inches within the front 10 ft. of the east and west sides of Teri St. 3. USE PERMIT NO. 70-22 Agiicant: A. J. Hall Corp. To allow the construction of a 450 unit planned residential development on approximately 70.2 acres of land in the R1=O-Single Family Residence Dis- trict combined with oil production. Located between 17th St. and Goldenwest St., just north of Palm Ave. Commissioner Bokor"abstained from this item. The hearing was opened to the audience. The applicant, A.-J. Hall, addressed the Commission and explained the development. Mr. Hall submitted plot plans and renderings of the pro- posed planned residential development and gave a detailed breakdown on the type, height and design of the homes to be constructed. John Balou, planner with W. Richardson, architect, explained the landscaping, pedestrian and vehicular circulation, street lighting and open space provided in the development. Phillis Galkin, 616 - 16th St., addressed the Commission and spoke in favor of the pro- posed planned residential development. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY MILLER AND SECONDED BY BAZIL TO APPROVE USE PERMIT NO. 70-22UPON THE FOLLOWING CONDITIONS: 1. The tentative map and development plan received May 15, 1970,- shall be the approved layout. 2. An oil equipment proposed for removal shall be abandoned and rem6ved according t6 Division of Oil and Gas and -7- 6/16/70-PC City regulations. 3. All streets within the project shall be private streets. 4. The design of the intersection of private streets with public streets shall be approved by the Department of Public Works. 5, Drainage of the property shall be approved by the Depart- ment of Public Works. 6. If the sewer or water facilities are to be dedicated to the City, a 10 ft. wide easement shall be dedicated to the City for access and maintenance of such sewer and water facilities. 7. A Division of Land application shall be submitted separa- ting this property from the abutting property held under the same ownership prior to submitting a final map to the City Council for acceptance or the property held under the same ownership but not included in this plan shall be included as numbered lots in the subdivision. 8. Tree planting, equivalent to one 30 inch box tree per unit, shall be provided. A plan showing such tree planting shall be approved by the Planning Department. 9. 17th St. and Palm Ave. shall be improved according to the requirements of the Department of Public Works as stated in the memorandum dated June 12, 1970,,regarding such improvements. 10. A plan showing the wall design and landscape plan along Goldenwest St., Palm Ave. and 17th St. shall be submitted to the Planning Commission for approval. Such plan shall be approved prior to issuance of building permits. 11. A plan showing the treatment of the wall design and -screen- ing of the off -island wells shallebe approved by the Plan- ning Department prior to issuance of a building permit. 12. When the off -island well sites are no longer required for oil production purposes, ownership of such sites shall revert to the Community Association and shall be incorporated as a part of the open space within the project. 13. Provisions shall be made to provide facilities for storage of equipment and materials required by the association for maintenance of the project. Such areas shall be shown on the plot plan prior to issuance of building permits. 14. All Standard Conditions of Approval for Tentative Tracts that are applicable shall be complied with. A MOTION WAS MADE BY PORTER AND SECONDED BY BAZIL TO APPROVE TENTATIVE TRACT MAP NO.7155 UPON THE FOLLOWING CONDITIONS: 1. CODE AMENDMENT NO. 70-7 Said amendment proposes to amend Articles 974 and 998 to: a) To establish by Resolution of the City Council population densities within said articles; b) To allow the Board of Zoning Adjustments to review plans for which there is a question regarding the number of bed- rooms within a development and to render a decision on such matters. Also, the general re -organization of both articles by renumbering and rewording to establish similarity between said articles. -9- 6/16/70-PC Minutes: H.B. A MOTION -WAS MADE BY -SLATES AND SECONDED BY BOKOR TO RECOMMEND APPROVAL OF CODE AMENDMENT NO. 70-7 TO THE CITY COUNCIL. ROLL CALL VOTE: AYES: Bazil, Bokor, Slates, Miller, Porter, Tom, Duke NOES: None ABSENT: None THE MOTION CARRIED. CODE AMENDMENT NO. 70-6 SIGN ORDINANCE Said amendment proposes to amend Section 9762.6 of the Huntington Beach Ordinance Code by rewording such section to prohibit all signs (including, but not limited to political signs) from public rights -of -way (City streets). The hearing -was opened to the audience. Mr. Bob Sutake addressed the Commission and stated that he agrees with the proposed code amendment - sign ordinance, but suggested that the Com- mission amend the sign ordinance to allow only 35 ft. high signs. There being no other com- ment, the hearing -was closed. NOES: None ABSENT: None THE MOTION CARRIED. CHAIRMAN SLATES: Chairman Slates requested that the staff study the 35 f-t-7176-i"ght limitation for signs and to contact Mr. Bob Sutake for his comments. DISCUSSION: The Commission discussed a proposed code amend- ment pertaining to non -conforming signs. Said amendment proposes to amend Article 976 (Sign Code)'as follows: 1)Amend Section 9763.4.1 Determination of Amortization Period for Non- conforming Signs, to reas as follows: All signs made noncon- forming by the provisions set forth in other articles of this code now existing or heretofore repealed shall remain noncon- forming notwithstanding the provisions of this article, and shall be completely removed or changed to a conforming use within five (5) years of the time said use became nonconforming. The five year period for their amortization -shall be determined from the effective date of Ordinance No. 1105 (January 6, 1965) 2) Amend Section 9764.7 to require a $100 cash bond for all temporary off -site signs for which a permit is not required. Planning Commission June 16, 1970 Page 11 COMMUNICATION: The Commission received a letter submitted y Jerome Bame, attorney for Macco Corporation, informing them that his client wishes to resubmit to the Commission its request for and plans pertaining to the development of an apartment project to be constructed on the south side of Warner Ave. between Edwards St. and Goldenwest St. It was the consensus of the Commission to discuss this request at the next study session. DISCUSSION: The Acting Secretary requested that the P anning ommission discuss at the next study session, what size an apartment development should be before the adopted standards are applied by staff and/or Board of Zoning Adjustments.
