Munson To permit the construction of a detached accessory structure with the following exceptions to the Huntington Beach Ordinance Code: 1) A 3 ft. setback from the rear property line in lieu of the required 5 ft. setback; 2) A 3 ft. setback from the side property line in lieu of the required 5 ft. setback; and, 3) A 7 ft. setback from the main dwelling in lieu of the required 10 ft. setback. The subject property is located on the north side of Stonybrook Dr., approximately 400 ft. west of Craimer Lane. The Chairman read the request and opened the hearing to the audience. Mr. Munson, applicant, addressed the Board and explained the request. He stated that he had contacted his nearby neighbors and they had expressed no objection to his request. He read a letter from a neighbor in favor of the variance. Wanda Evans, abutting property owner on the rear, addressed the Board stating that she opposed the request. She felt that the required setback should be maintained for the safety of children or other persons walking between the lots. There being no further comment, the hearing was closed. Board discussion was held. The Acting Secretary gave reasons the code was adopted requiring the subject setbacks. These included fire safety, and aesthetics. It is felt that a person buying into a tract is buying a complete concept and not just a particular lot. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 70-31 WITH THE FOLLOWING CONDITIONS: 1. The Portion for the existing structure within the required rear and side yard setback shall be removed and made to comply with the required setbacks. FOR TlE FOLLOWING REASONf. 1. CONDITIONAL EXCEPTION NO. 70-32 Applicant: George Hanna To allow the 2nd story portion of the main dwelling to be constructed within 11 ft. of the front property line in lieu of the required 15 ft. The subject property is located on the south side of Aracena Drive, approximately 85 ft. east of Carranza Lane in the R1 - Single Family Residence District. The Chairman read the request and opened the hearing to the audience. Mr. Hanna, applicant, addressed the Board and stated that he felt the Planning Commis- sion has a favorable outlook on this type of request. There being no further comment, the hearing was closed. f Board discussion was held. The Acting Secretary advised that the Planning Commission i had been consulted and it was a consensus that there were no objections to this type of construction. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 70-32 FOR THE FOLLOWING REASON: 1. USE PERMIT NO. 70-23 Applicant: Norval Crai To permit a small grocery market including the off -sale of liquor and a small store to be used as a barber shop or other similar use in the C4 - Highway Commercial District. The subject property is located on the east side of Brookhurst Street, approximately 350 ft. south of Hamilton Avenue. The Chairman read the request and opened the hearing to the audience. There being no further comment, Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 70-23 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received June 3, 1970, shall be the approved layout. 2. Brookhurst Street shall be dedicated and fully improved to City standards at the time each parcel is developed. Improve- ments shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Easements for utilities or walkways shall be provided to Department of Public Works standards. 7. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 8. The flood control channel shall be fenced to Flood Control District standards and City standards. 9. The property shall participate in the local drainage assess- ment district. 10. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 11. All utilities shall be installed underground. 12. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided I by the Fire Department. 13. Off-street parking facilities shall conform to Article 979. 14. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department. 15. A masonry wall shall be constructed along the south property line. The height of said wall shall be determined by the Planning Department. 16. A common driveway with reciprocal easements shall be pro- vided over the northerly 15 ft. of the subject property to afford vehicular access to the adjacent parcel to the north. USE PERMIT NO. 70-24 Applicant: Anthony Marinelli To permit the retail sales of arts and crafts in the C4 - Highway Commercial District. The subject property is located on the north side of Pacific Coast Highway, approximately 1320 ft. northwest of Anderson Street. j The Chairman read the request and opened the hearing to the audience. i Mr. Marinelli, applicant, addressed the Board and answered various questions. The suggested conditions of approval were reviewed by the applicant. There being no further comment, the hearing was closed. Board discussion was held. The Acting Secretary advised that the plans which were submitted did not show the parking layout. The applicant was informed he must comply with Article 979 of the Huntington Beach Ordinance Code. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 70-24 WITH THE FOLLOWING CONDITONS: 1. Pacific Coast Highway shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. USE PERMIT NO. 70-25 Applicant: John Roccio To permit the sales and service of motorcycles in the C4 Highway Commercial District. Also, to permit the construction of a 750 sq. ft. building to be used for service of the motorcycles. In Conjunction With DIVISION OF LAND NO. 70-1 Applicant: John Roccio To permit a lot line adjustment between two existing legal lots. In Conjunction With ADMINISTRATIVE REVIEW NO. 70-26 Applicant: John Roccio To permit the outside storage and/or display of motorcycles in the C4 Highway Commercial District. The Chairman read the request and opened the hearing to the audience. Mr. Roccio, applicant, addressed the Board and answered various questions. Mr. Joe Evans, was also present accompanying Mr. Roccio. The suggested conditions of approval were reviewed and modified. An easement on the division of land was discussed. the hearing was closed. Beach Blvd. shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 3. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 4. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is developed. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. The property shall participate in the local drainage assess- ment district at the time each parcel is developed. 6. A Parcel Map shall be filed with the City and recorded prior to framing inspection of any structures on any parcel. 10. The Division of Land shall not be effective until an agree- ment is signed and recorded agreeing to the conditions listed above. ADMINISTRATIVE REVIEW NO. 70-27 Applicant: Slater & Ruiz Farms To permit the operation of a temporary agriculature stand in the RA -Residential Agricultural District. The subject property is located on the east side of Goldenwest Street, approximately 400 ft. south of Warner Avenue. The Chairman read the request. Mr. Bill Slater, representing the applicant, addressed the Board and answered various questions. The suggested conditions of approval were reviewed. $ A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 70-27 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall comply with Section 9730.25.1 of the Huntington Beach Ordinance Code. 2. All signs used on the building and site shall be approved by the Building Department. The Chairman read the request. Applicants Jim Russell and Bill Ruiz addressed the Board and answered various questions. The suggested conditions of approval were reviewed and the business signs were discussed. The Board advised that stacking of crates outside the stand is not permitted. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW 70-28 WITH THE FOLLOWING CONDITIONS: 1. The applicant shall comply with Section 9730.25.1 of the Huntington Beach Ordinance Code. 2. All on -site signs shall be approved by the Building Department. ADMINISTRATIVE REVIEW NO. 70-29 Applicant: American Learning Corporation To allow a variation in the required 32 inch high masonry screening wall. The subject property is located on the south side of Main Street, 200 ft. southwest of Delaware Street. Gene Johnson, representing the owner, addressed the Board and answered various questions. Types of fencing were discussed. Board discussion was held. It was noted that the Planning Commission had'requested the Board to encourage variation in screening walls to be aesthetically pleasing and compatible with the surrounding buildings. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 70-29 WITH THE FOLLOWING CONDITION: 1. The 32 inch high screening wall shall setback 3 ft. from the ultimate right-of-way. FOR THE FOLLOWING REASON: 1. The wall will be of the same material and design as the building within this complex. The Chairman read the request. Mr. Windham, representing the applicant, addressed the Board and answered various questions. The advisability of a division of land on subject property was discussed, and the conditions of approval were reviewed including street lighting problems. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 70-30 WITH THE FOLLOWING CONDITIONS: 1. Goldenwest Street and Edinger Avenue shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3.
