ELECTION OF OFFICERS: This item was tabled until later in the meeting to allow time for Commissioner Bazil to arrive. AGENDA ITEMS TO BE CONTINUED OR WITHDRAWN: The Acting Secretary advised the Commission that the Staff requests that Zone Case No. 69-39 which was initiated by the City, be withdrawn because of a conflict caused between the requirements of the idle well provisions of the Oil Code and Non -Conforming provisions of the Planning Code, and that removal of the 110" designation in this area is infeasi- ble at this time due to the amount of time needed to amend the ordinance. Also, it is the consensus of the Staff, the proper procedure is to amend Chapter 23 of the Huntington Beach Ordinance Code. Jones f To permit construction of a 4 unit apartment on a 3,750 sq. ft. lot resulting in an increase in density from one unit per 950 sq. ft. of lot area to one unit per 937.5 sq. ft. of lot area. Also, to allow vehicular access to such lot from an arterial highway to two of the required parking spaces and/or garages as shown on the plot plan in lieu of the requirement that access to such lot be from the abutting local street only and not the arterial highway. Mr. Jones, applicant, addressed the Commission and explained his request. lie stated that at the time he purchased the lots, Olive Avenue was not master planned as an arterial highway; therefore, the present problem for access to on -site parking did not exist. Mr. Jones stated that he preferred that the plan have vehicular access from both 15th Street and Olive Avenue as said plan provided more off-street parking. COMMISSIONER BAZIL: Commissioner Bazil arrived at 7:12 P.M. and assumed his duties. The Acting Secretary advised that the staff recommends approval subject to condi- tions as stated in the staff report. There being no further comment, the hearing was closed. A MOTION WAS MADE BY BOKOR AND SECONDED BY MILLER TO APPROVE THAT PORTION OF CONDITIONAL EXCEPTION NO. 70-34 FOR ONE ADDITIONAL UNIT ONLY, SUBJECT TO THE FOLLOWING CONDITIONS: 1. All applicable requirements of the Huntington Beach Ordinance Code shall be complied with. 2. The Board of Zoning Adjustments shall review the final plan to establish such conditions of approval as deemed necessary. The Commission reviewed the Subdivision Committee report and recommendation on the subject tract. A MOTION WAS MADE BY BOKOR AND SECONDED BY PORTER TO APPROVE TENTATIVE TRACT MAP NO. 6954 SUBJECT TO THE FOLLOWING CONDITIONS: 1`. The -tentative map received June 1, 1970, shall be the approved layout. 2. The flood control channel shall be fenced to Flood Control District Standards. 3. A permit shall be obtained from the Orange County Flood Control District for any work within the Talbert Channel Tight -of -way. 4. The Acting Secretary advised the Commission that the staff requests a continuance of this item to allow time for further study. Commission discussion was held. PRECISE PLAN NO. 70-6 Access & Circulation - Huntington Center Said plan will establish access to and circulation within that property bounded by Beach Blvd., on the east, Edinger Avenue on the south-, Gothard St. on the west and McFadden Avenue and the San Diego Freeway on the north. Ken Reynolds, Planning Director, made a presentation on the proposed plan and explained that -the Planning Department contacted the State Division of Highways regarding widening of the bridge on McFadden Avenue. He further stated that copies of answers to questions asked at the June 30 Study Session were available for their review. Discussion was held regarding the access roads, how it affects the property which would front on the access road, and vehicle egress and ingress over the Hunting- ton Center property. Further discussion was held regarding the possibility of the property owners of Iuntington Center closing the road through the Center during non -business hours. The City Attorney's office felt the City could get an agreement from the property owners to keep the roads open at all times; however, we could not require them to enter into the agreement. Mr. Donald Frischer of Van Nuys, California, consulting engineer for Broadway Hale Department Store, felt that a street between Barker Bros. and the Broadway would create problems. lie stated that there is a committment by the State that if traffic conditions warrant, they would widen the bridge on McFadden Avenue and this would be beneficial as McFadden Avenue is a secondary highwayleading from Beach Blvd. to -the shopping center. There being no further comment, the hearing was closed. Discussion was held by the Commission. A MOTION WAS MADE BY DUKE AND SECONDED BY BOKOR TO APPROVE PRECISE PLAN OF STREET ALIGNMENT NO. 70-6 SUBJECT TO THE FOLLOWING CONDITIONS: 1. An agreement shall be reached with the property owner of Huntington Center to avoid the blocking of the road leading through the Center. 2. Gothard Street shall be a part of the plan. AND FOR THE FOLLOWING REASON: 1. This plan would improve traffic flow through the center and help develop vacant property to the north. The hearing was opened to the audience. Mr. Bill Woods, Signal Oil and Gas Company, explained why the drilling area along Pacific Coast Highway is so wide. Mr. Baxter Brown, Standard Oil Company, explained that their two sites (Sites No. 26 and 27) which are close together, were designed to allow them to redrill existing wells. CODE AMENDMENT NO. 70-9 Alley Access Said amendment proposes to amend Sections 9166.6 (R2 District), 9206.6 (R3 District) - and 9236.6 (R4 District) to require all residential lots and/or parcels within the area bounded by Pacific Coast Highway on the southwest, 23rd Street on the northwest, Palm Avenue on the north and northeast and Lake and lst.Streets on the east and southeast, which abut upon an alley to take access to all garages, carports and open parking from such abutting alley only. This area is the subject of a study to allow•increased densities which will result in higher visitor off-street parking needs. The proposed methods of construction pre- clude the possibility of providing sufficient accessible on -site guest parking. -.2. Vehicular access is presently restricted to all arterial highways throughout the City. 3. If vehicular access is allowed to all local streets, an overall reduction of on -street guest parking spaces will result. 4. CODE AMENDMENT NO. 70-10 Commercial Zones Said amendment proposes to amend Article 981 Board of Zoning Adjustments, 942 C2 Community Business District and 945 C3 General Business District to: 1) Require a public hearing on a complaint for Home Occupation by the Board of Zoning Adjustments; 2) Add hardware stores, animal grooming, car wash and mortuary to the uses within the C2 District. Also, adding a provision for other retail uses or services not specifically provided for, may be permitted subject to approval of a Use Permit application; and, 3) Require approval of administrative review by the Board of Zoning Adjustments for all uses in the C3 zone which do not require use permit approval. The hearing was opened to the audience. Mr. Jerry Shea, 2110 Main Street, Huntington Beach opposed the use of the administrative review application as he feels it hinders development. The Chairman stated that the application is a usefull tool in advising developers and that the City is more concerned with the plot plan than with the use. It was the consensus of the Commission to discuss the wording of the ordinances requiring administrative review by the Board of Zoning Adjustments at the July 14, 1970, study session. MISCELLANEOUS: Administrative Review No. 70-25 (Referred by the Board of Zoning Adjustments) Applicant: Gerald Sparks Mr. Palin, Planning Department, explained the proposal, and gave a history of the proposed commercial development. He advised the Commission that the Board of Zoning Adjustments felt the trees that were requested along the rear property line were not necessary as the commercial structure was only 20 ft. high, and the trees reduced the clear width of the alley to 17 ft. Gerald Sparks, applicant, addressed the Commission and stated that all rooftop equipment would be screened. 1 A MOTION WAS MADE BY SLATES AND SECONDED BY BAZIL TO APPROVE ADMINISTRATIVE REVIEW NO. 70-25 AS PRESENTED WITHOUT THE TREES AND WITH THE FOLLOWING CONDITIONS: 1. The plot plan received June 4, 1970, shall be the approved layout. 2. Warner Avenue and Springdale Street shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5: The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assess- ment district. 7. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to -issuance of building permits. 8. All utilities shall be installed underground. 9. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 10. Off-street parking facilities shall conform to Article 979. 11. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Department. 12. A masonry wall shall be constructed along the south and east property line. The height of said wall shall,be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. 13. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 14. A lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works for approval. 15.
