Applicant: Robert D. Dawson
To permit light manufacturing
and metal fabricating in the Ml-Light Industrial District.
The subject property is located
on the. west side of Golden West Street, and 660 ft. north of
Garfield Street.
The Acting Chairman read the request
and advised the Board that the applicant has requested a
continuance until, July 22, 1970.

Applicant: Robert L. Stellrecht/Anthony Bartoli
To permit the construction of a
28 unit apartment complex in the R3 Limited Multiple Family
Residence District.
The subject property is located
on the north side of Memphis Street, approximately 234 ft. east
of Huntington Avenue.
The Acting Chairman read the request
and informed the Board that a revised plot plan had been sub-
mitted July 15, 1970, showing two areas for open space as
requested by the Board. Mr. Palin also informed the Board that
-the previous plot plan had shown no open space. The hearing
was opened to the audience.
As the applicant had not yet
arrived, this item was tabled until later in the meeting.
CONDITIONAL EXCEPTION NO. 70-37
Applicant: Kenneth E. Friess
To permit the construction of a 5 ft.
high grapestake fence at the front property line in lieu of the
required 10 ft. front yard setback.

The subject property is
located on the east side of Queens Lane, approximately 100 ft.
north of Slater Avenue in the R3 Limited Multiple Family
Residence District.
Dorothy Lewis, repre-
senting the applicant, addressed the Board and answered various
questions. The Acting Chairman advised that it has been the
policy of the Board not to allow this type of construction within
developed residential areas. Mrs. Lewis advised that there is
no area other than the alley for the children to play at present,
and there have been children hit by cars in the vicinity. She
also advised that the fence is already constructed and is con-
structed in such a way that it would have to be torn down and
reconstructed if this exception were not allowed.
There being no further
comment, the hearing was closed.
Board discussion was held.
It was the consensus of the Board that a field trip should be
made to subject property to review such fence construction and
site for open space.
A MOTION WAS MADE BY
PALIN A14D SECONDED BY LIPPS TO CONTINUE CONDITIONAL EXCEPTION
NO. 70-37 TO THE JULY 22, 1970, MEETING TO ALLOW THE BOARD TIME
TO REVIEW THE FENCE ON -SITE AND TO MEASURE THE HEIGHT OF SAID
FENCE.

CONDITIONAL EXCEPTION NO. 70-38
Applicant: Thomas Casenza (Beach City Const. Co.)
To permit an existing
13 ft. wide driveway to serve as access to required parking in
lieu of the required 20 ft. width for driveways exceeding 100 ft.
in length.
The subject property is
located at 7832 Newman Avenue approximately 500 feet west of
Beach Blvd., in the R2 Two Family Residence District.
The Acting Chairman read
the request and opened the hearing to the audience.
Mr. Casenza, applicant,
addressed the Board and explained the request.
Discussion was held.
There being no further comment, the hearing was closed.

PALIN AND SECONDED BY LIPPS TO APPROVE CONDITIONAL EXCEPTION
NO. 70-38 WITH THE FOLLOWING CONDITIONS:
1. The archway shall be removed to afford 13 ft. clear width
on the driveway.

2. Newman Avenue shall be dedicated and fully improved to
Department of Public Works Standards.
FOR THE FOLLOWING REASONS:
1. The existing- structure is within 13 ft. of the side
property line. -
2. The driveway exists.
3. The driveway only exceeds the maximum length permitted
by the Huntington Beach Ordinance Code by 14 ft. for
driveways 10 ft. in width.

Applicant: Tavaglione Construction Comnan
To permit free standing self-
service gasoline pumps as an adjunct to a convenience market
in the C2 Community Business District.
The subject property is located
on the southeast corner of Brookhurst Street and Atlanta Avenue.
The Acting Chairman read the request
and opened the hearing to the audience.
Lewis Tavaglione, applicant,
addressed the Board and answered various questions.
The Acting Chairman advised that
the Fire Code required an attendant at all times whose sole
duty is to attend the pump islands. The applicant advised that
all controls and meters for the pump -are inside where there is
an attendant.
The Acting Chairman advised that
the Planning Commission has requested that all.applicat;ons for
service stations or similar uses be referred to their body for
action.
Dr. Adams, nearby property owner
and Dr. Rosellini, spoke in opposition of the request. They
were concerned with maintenance and felt this use would degrade
the area.
There being no further comment, the
hearing was closed.

SECONDED BY LOVEJOY TO REFER USE PERMIT NO. 70-29 TO THE
PLANNING COMMISSION MEETING TO BE HELD ON AUGUST 4, 1970, AT
7:00 P.M. IN THE COUNCIL CHAMBERS, CIVIC CENTER, PER THE REQUEST
OF THE PLANNING COMMISSION.

CONDITIONAI, EXCEPTION NO. 70-39
Applicant: Stanley Fann
To permit waiver of the
requirements that one foot of landscaping be provided for each
foot of building encroachment into the required setback as
stated in Section 9432.6.5 of the Huntington Beach Ordinance Code.
The subject property is
located on the northwest corner of Springdale Street and Warner
Avenue in the C4 - Highway Commercial District.
The Acting Chairman
read the request and opened the hearing to the audience.
Mr. Fann, applicant,
addressed the Board and advised he has fully landscaped the
site and has contacted a contractor to clean up the subject
area and then will have the City maintain the street curb.
Mrs. Hiltune questioned
maintenance and what type of building is proposed on the vacant
portion of property within the shopping center.
Mr. Fann advised that a
restaurant would be constructed on this vacant property.

held. It was felt this particular parcel was difficult to
develop and the total landscaping in front for the vacant
property should be reviewed when said area is developed to
insure adequate landscaping for this request.

NO. 70-39 SUBJECT TO THE FOLLOWING CONDITIONS:
1. Any future application for building as shown on the plot
plan shall incorporate a landscape plan to be reviewed by
the Board of Zoning Adjustments.
FOR THE FOLLOWING REASON:
1. It would be an economic hardship upon the developer to
require relocation of the driveway after being approved at
present location by the City.

A MOTION WAS MADE BY PALIN
AND SECONDED BY LOVEJOY TO APPROVE USE PERMIT NO. 70-28 SUBJECT
TO THE FOLLOWING CONDITIONS:
1. The plot plan received July 15, 1970, shall be the approved
layout.
2. Memphis and Nashville Avenues shall be dedicated and fully
improved to City standards at the time each parcel is developed.
Improvements shall include street trees, street signs, street
lights, fire hydrants, sewer and water main extensions.
3. Water supply shall be through the City of Huntington Beach's
water system.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
S. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
6. The property shall participate in the local drainage assess-
ment district.
7. Soil reports as required by the Building Department and the
Department of Public Works shall be submitted to the City
prior to issuance of building permits.
8. All utilities shall be installed underground.
9. Fire alarm system conduit and appurtenances shall be installed
by the developer at locations and to specifications provided
by the Fire Department.
10. Off-street parking facilities shall conform to Article 979.
11. Parking compounds shall be screened with a combination of
fencing and landscaping. Said plan shall be approved by the
Planning Department.
12. No structures, other than those shown on the approved plot
plan, shall be constructed within the project.
13. All applicable City Ordinances and Standards for Apartment
Developments shall be complied with.
' 14. Division of Land No. 218 shall become null and void upon
approval of Use Permit No. 70-28.
15. An agreement between owners of subject property and lot 13
of the Watson Tract shall be signed and filed with the City
prior to Certificate of Occupancy by the Building Department
on subject property.

USE PERMIT NO. 70-21
Applicant: H. H. Hansen
This application was
referred back to the Board by the Planning Commission for condi-
tions of approval to be established.
Mr. Hansen, applicant, was
present and advised the Board that the identification sign will
be attached to the existing Enco identification sign.
The Acting Chairman
informed the Board that the proposed landscaping exceeds that
required by code.
Board discussion followed.
A MOTION WAS MADE BY PALIN
AND SECONDED BY LIPPS TO APPROVE THE PLAN AS SUBMITTED FOR USE
PERMIT NO. 70-21 SUBJECT TO THE FOLLOWING CONDITIONS:
1. There shall be two 15 gallon trees planted on the rear pro-
perty line. These trees may be planted in tree wells.
2. Parking shall comply with Article 979 of the Huntington Beach
Ordinance Code.
3. All applicable service station standards as imposed by the
Planning Commission shall be complied with.

PALIN AND SECONDED BY LOVEJOY TO APPROVE DIVISION OF LAND NO.
70-18 SUBJECT TO THE FOLLOWING CONDITIONS:
1. Hamilton Avenue and Newland Street shall be dedicated and
fully improved to City standards at the time each parcel is
developed. Improvements shall include street trees, street
signs, street lights, fire hydrants, sewer and water main
extensions.
2. Water supply shall be through the City of Huntington Beach's
water system at the time each parcel is developed.

each parcel is developed.
8. All applicable City Ordinances shall be complied with.
9. A Parcel Map shall be filed with the City and recorded
prior to framing inspection of any structures on any parcel.
10. The Division of Land shall not be effective until an agree-
ment is signed and recorded agreeing to the conditions
listed above.
