Located between Garfield Ave. and Ellis Avenue, east to the extension of Newland St. The Acting Secretary informed the Commission that the City Council did not take action on the MH - Mobilehome District, Article 924, at their July 20, 1970 meeting, therefore the staff recommends continuance of Zone Case No. 69-36 until the City Council takes action on such District. Planning Commission July 21, 1970 Page 2 The Acting Secretary read a Jetter submitted by the applicant, requesting continuance of Zone Case No. 70-11 so that the applicant may have an oppor- tunity to make a formal presentation and discuss further the situation with members of the Planning Commission. Commissioner Duke stated that the applicant does not have a valid reason for continuance. A video tape of the subject The Acting Secretary informed the Commission that the public hearing on this application was reset for this date because one property owner did not receive legal notice of the first public hearing. The hearing was opened to the audience. Bill Wren, representing the Huntington Beach Company, addressed the Commission and explained the request. Bruce Greer, property owner at the southeast corner of Ernest and Stewart St., addressed the Commission and opposed the request. Mr. Greer submitted a petition signed by six property owners, opposing the request. George Shibata, speaking on behalf of Mr. Greer, stated that if approved, the use will cause a traffic hazard in the area; also, this is hot a proper location for a riding stable. Mr.-Shibata, attorney;for Mr. Greer, stated that the Commission is required to find a definite hardship before this request can.be granted. -2- 7/21/70-PC Minutes: H.B. Planning Commission July 21, 1970 Page 3 Mr. Johnson, applicant, addressed the Commission and stated his reasons for the request. He stated that there are about 60 to 70 acres of land on Hunting- ton Beach Company property for riding trails without cross- ing a street. There being no other comment, the hearing was closed. Commission discussion was held. Commissioner Porter stated that he was not aware that single family homes were close to the subject property. A MOTION WAS MADE BY BAZIL AND SECONDED BY SLATES TO APPROVE CONDITIONAL EXCEPTION NO.70-33 WITH CONDITIONS AS SUGGESTED BY THE STAFF AND FOR THE FOLLOW- ING REASONS: CONDITIONS: 1. Ernest St. shall be dedicated to City Standards. Improvements of Ernest St. shall be to Department of Public Works requirements. 2. The riding stable and accessory uses shall be kept in a neat and clean manner at all times and properly sprayed to keep down the fly hazard. 3. Water shall be through the City of Huntington Beach's water system. 4. The property shall participate in the local drainage assessment district. 5. Parking shall be provided at a ratio:as determined by the Planning Department with proper oiling for dust control and a standard parking layout. 6. Section 4243.1 of the Huntington Beach Ordinance Code shall be complied with. 7. 50 per cent of the adjacent 52 acres owned by the owner of subject property shall be made available for riding to persons using the riding stables. 8. A Conditional Exception No. 70-33 shall become null and void on July 1, 1975 or when any portion of the property is acquired.for freeway purposes. FOLLOWING REASONS: 1.The request is a good interim use due to the -future freeway. 2.There is a definite need for said use. 3.This location will create less disturbing factors in�the City. ROLL CALL VOTE: AYES: Bazil; Slates, Duke NOES: Porter ABSENT: Tom, Miller THE MOTION -DID -NOT CARRY. A,FURTHER MOTION WAS MADE BY PORTER TO DENY CONDITIONAL EXCEPTION NO. 70-23 FOR THE REASON: 1. The applicant has not shown a hardship. THE MOTION FAILED FOR LACK OF A SECOND. THE PLANNING COMMISSION BY-LAWS REQUIRE FOUR AFFIRMATIVE VOTES; THEREFORE, CONDITIONAL EXCEPTION NO. 70-33 WAS AUTOMATICALLY CONTINUED TO AUGUST 4, 1970. -3- 7/21/70-PC Minutes: H.B. Located on the east side of Delaware St., approximately 630 ft. north -of Clay" Ave. iri -the` R2 Two Family Residence District. The hearing was opened to the audience. Harold Phelps, Minister, explained the proposal. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY BAZIL AND SECONDED BY DUKE TO APPROVE CONDITIONAL EXCEP- TION NO. 70-38 UPON THE FOLLOWING CONDITIONS: 1. All provisions of Section 9201.3.6 of the Huntington Beach Ordinance Code shall be complied with. 2. The plan shall be referred to -the Board of Zoning Adjust- ments -for -review and to establish conditions of approval as deemed necessary. . AND FOR THE FOLLOWING REASONS: 1. The proposed church will not be detrimental to the sur- rounding property. 2. Said church will be adjacent to medium residential developments and an existing church. ROLL CALL VOTE:" AYES: Bazil, Porter, Slates, Duke NOES: None, - ABSENT: Tom, Miller THE MOTION CARRIED. ADOPTION OF PROPOSED SERVICE STATION STANDARDS: The Commission reviewed proposed standards for service stations. Mr. Russell Maxwell, Union Oil Co., addressed the Commission and opposed to item #2 sub -paragraph c) "Nothing herein shall permit any major repairs or sale or rental of new or used motor vehicles requiring licensing for operation on the public streets." Mr. Maxwell was informed that this requirement will apply to new service stations only. Bill Schultz, Union Service operator, questioned if existing service stations hav- ing utility trailer rentals would be subject to these stan- dards. Mr. Schultz was informed that these- standards would not apply to existing service stations. Commission discussion followed. A MOTION WAS MADE BY PORTER AND SECONDED BY BAZIL TO ADOPT SERVICE STATION STAN- DARDS FOR NEW SERVICE STATIONS ONLY. Planning Commission July 21, 1970 Page 5 The Commission instructed the staff to prepare a study on miscellaneous rentals at exist- ing service stations and bring back at the next Study Session on September :8, 1970. PRECISE PLAN NO. 70-5 Parkside Lane, between Edinger Ave. and Aldrich St. Said plan proposes to precise plan the street alignment for Parkside Lane between Edinger Avenue and Aldrich St. The Planning Director suggested that Precise Plan No. 70-5 be continued until new signals are installed at the intersection of Edinger Ave. and Beach Blvd. A MOTION WAS MADE BY BAZIL AND SECONDED BY PORTER TO CONTINUE PRECISE PLAN NO. 70-5 TO AUGUST 5, 1970 FOR THE AFOREMENTIONED REASON. The Planning Commission further instructed the staff to inform any potential builder on subject property that the City is studying a precise plan of street alignment over said property. CODE AMENDMENT -NO. 70-10 COMMERCIAL ZONES Said amendment proposes to amend Article 981 Board of Zoning Adjustments, 942 C2 Community Business District and r945 C3 General Business District to: 1) Require a public hearing on a complaint for Home Occupation by the Board of Zoning Adjustments; 2) Add hardware stores, animal grooming, car wash and mortuary to the uses within the C2 District. Also, adding a provision for other retail uses or services not specifically provided for, may be permitted subject to approval of a Use Permit application; and 3) Require approval of Administrative Review by the Board of Zoning Adjust- ments for all uses in the C3 zone which do not require use permit approval. The hearing was opened to the audience. There being no comment, the hearing was closed. Commission discussion followed. CODE AMENDMENT NO. 70-11 Said amendment proposes to amend Article 976 (Sign Code) as follows: 1) Amend Section 9763.4.1 Determination of Amortization Period for Non -conforming Signs, to read as follows: All signs made nonconforming by the provisions set forth in other articles of this code now existing or heretofore repealed shall remain nonconforming notwithstanding the provisions of this article, and shall be completely removed or changed to a conforming use within five (5) years of the time said use became nonconforming. The five year period for their amortization shall be determined from the effective date of Ordinance No. 1105 (January 6, 1965). -5- 7/21/70-PC Minutes: H.B. Amend Section 9764.7 to -require a $100 cash bond for all temporary off -site signs for which a permit is not re--. quired. _- The' hearing was ' opened to the audience.
