Applicant: S & M Glass, Inc.
To permit the manufacturing of
pressed glassware in the Ml Light Industrial District.
The subject property is located
on the west side of Nichols, approximately 400 ft. south of
Warner Avenue.

Walter Straud, representing the
applicant, addressed the Board and explained the request.
Board discussion was held. It was
pointed out to Mr. Straud that installation of street improve-
ments on Nichols Street is required by ordinance. Mr. Straud-
indicated that he may be requesting temporary waiver of such
improvements.
A MOTION WAS MADE BY MCFARLAND AND
SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 70-36
WITH THE FOLLOWING CONDITIONS:
1. The plot plan received July 27, 1970, shall be the
approved layout.

2. Nichols Street shall be dedicated and fully improved to
a City standards at the time each parcel is developed.
Improvements shall include street trees, street signs,
street lights, fire hydrants, sewer and water main extensions.
3. Water supply shall be through the City of Huntington Beach's
water system.
? 4. Sewage disposal shall be through the City of Huntington
Beach's sewage system.
` 5. The water•, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
6. The property shall participate in the local drainage assess-
ment district.
7. Soil reports as required by the Building Department and the
Department of Public Works shall be submitted to the City
prior to issuance of building permits.
8. All utilities shall be installed underground.
9. The driveway width and location shall be approved by the
Traffic Engineer.

To permit the division
of a legal parcel of land into two separate parcels.

Applicant: The Handyman of California, Inc.
To permit a retail hardware
store in the C4 Highway Commercial District in accordance with
Section 9472 of the Huntington Beach Ordinance Code.
The subject property is
located on Edinger Avenue, approximately 200 ft. west of
Gothard Street.
The hearing was opened to
the audience on Use Permit No. 70-30.

AND SECONDED BY SPENCER TO APPROVE DIVISION OF LAND NO. 70-20
WITH THE FOLLOWING CONDITIONS:
1. The plot plan received July 13, 1970, shall be the approved
layout.
2. Edinger Avenue and Gothard Street shall be fully improved
to City Standards at the time each parcel is developed.
Improvements shall include street trees, street signs,
street lights, fire hydrants, sewer and water main extensions.
3. Water supply shall be through the City of Huntington Beach's
water system at the time each parcel is developed.
4. Sewage disposal shall be through the City of Huntington
Beach's sewage system at the time each parcel is developed.
5. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
6. Easements for utilities or walkways shall be provided to
Department of Public Works standards.
7. All buildings on lots abutting a City easement shall be
set back 5 feet from the edge of such easement.

8. The property shall participate in the local drainage
assessment district at the time each parcel is developed.
9. Soil reports as required by the Building Department and the
Department of Public Works shall be submitted to the City
prior to issuance of building permits.
10. All utilities shall be installed underground at the time
each parcel is developed.
11. Fire alarm system conduit and appurtenances shall be
installed by the developer at locations and to specifi-
cations provided by the Fire Department.
12. A Parcel Map shall be filed with the City and recorded
prior to framing inspection of any structures on any parcel.
13. The Division of Land shall not be effective until an agree-
ment is signed and recorded agreeing to the conditions
listed above.
14. An agreement to allow vehicular access between parcels
1 and 2 shall be approved by the Planning Department
and recorded.

A MOTION WAS MADE BY HARLOW AND
SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 70-30 WITH THE
FOLLOWING CONDITIONS:
1. The plot plan received July 21, 1970, shall be the
approved layout.
2. All conditions of Division of Land No. 70-20 shall be
complied with.
3. A masonary wall shall be constructed along the north and
west property line. The height of said wall shall be such
that the top will be 6 feet above the highest ground surface
within 20 feet of the common property line, except within
the front 30 feet of Edinger Avenue in which case the height
of said wall shall be reduced to 32 inches.
4. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
5. All applicable City Ordinances shall be complied with.
6. Vehicular access shall be provided to the parcel to the east.
Such access shall be approved by the Planning Department
as shown on a revised plot plan prior to issuance of a
building permit.
7. Driveway locations shall be approved by the Traffic Engineer.
8. The method of screening the roof top mechanical equipment
shall be submitted to the Board of Zoning Adjustments for
approval prior to issuance of a building permit.

CONDITIONAL EXCEPTION NO. 70-40
Applicant: James A. Munson
To permit the reduction
of the side yard setback to within 2 ft. of the property line
in lieu of the required 5 ft. setback.
The subject property
is located on the north side of Stonybrook Drive, approximately
400 ft.. west of Craimer Lane.
The hearing was opened
to the audience.
Mr. Munson addressed the
Board and explained his request.
Mr. Code Evans spoke in
opposition to the request stating that the proposed patio
cover would obstruct his line of vision -from his home.
Mr. Munson asked that his
application be continued until such time as his adjacent neigh-
bor could attend the meeting to speak in favor of this request.
It was the consensus of
the Board that, because Mr. Evans attended the meeting and a
letter had been received from the adjacent property owner,
expressing his favorable opinion of Mr. Munson's request, nothing
would be gained by a continuance.

AND SECONDED BY MCFARLAND TO DENY CONDITIONAL EXCEPTION NO. 70-40
FOR THE FOLLOWING REASONS:
1. The applicant has sufficient area in the rear yard to con-
form to the Ordinance.
2. The Board of Zoning Adjustments had already granted one
setback variance by allowing a 7 1/2 ft. setback from the
house.
3. Although the adjacent property owner expressed an opinion,
by letter, to be in favor of this request, another adjacent
property owner expressed his opinion as being opposed.
4. The applicant did not sufficiently justify the request.

appears necessary.

Board to present photographs and explain their progress in
construction of the carport which was required as a condition
of their home occupation.

Mr. Nelson addressed the Board
and explained his future plans for the wrecking yard. He
stated that he would be filing a conditional exception to
permit a wrecking yard and for waiver of street improvements
within 30 days.
