AGENDA ITEMS TO BE CONTINUED: ZONE CASE NO. 69-36 (Continued) Applicant: Standard -Pacific Corp. Change of zone to R5 Office -Profes- sional District. Located between Garfield Ave. and Ellis Ave., east to the extension of Newland St. The Acting Secretary informed the Commission that the City Council has not taken action on the MH - Mobilehome Zone; therefore, this zone case should be continued until such time the City Council takes action on such zone. The Acting Secretary informed the Commission that this zone case was filed because of a con- dition of the Tentative Tract Map. Mr. Harlow stated that construction on the subject property has not started, there- fore continuance of Zone Case No. 70-12 to November 3, 1970, be in order.. A change of zone -:from R1 Single Family Residence District and C4 Highway Commercial District to R1 Single Family Residence District, R3 Limited Multiple Family Residence District, R4 Multiple Family Residence District and C4 Highway Commercial District with a 50 ft. setback from the ultimate right-of-way line. Located on the northwesterly corner of Pacific Coast Highway and Admiralty Drive. The Acting Secretary stated that a conditional exception has been filed stating speci- fically the -uses proposed by the applicant, which will be heard by the Planning Commission at the August 18, 1970 meet- ing. Mr. Harlow suggested that Zone Case No. 70-13 be con- tinued to August 18, 1970 meeting to allow the Planning Commission to consider the zone change request along with -2- 8/4/70-PC Minutes: H.B. ROLL CALL VOTE: AYES: Bazil, 'Slates, Miller, Porter, Duke NOES: None ABSENT: Tom THE MOTION CARRIED. USE PERMIT NO. 70-26 (Referred by the Board of Zoning Applicant: Donald P. Jones Adjustments) To permit the construction of a service station on a 22,500 sq. ft. parcel of land in the C4 Highway Commercial District. Located at the southeast corner of Slater Ave. and Goldenwest St. A video tape of the subject pro- perty was shown. The hearing was opened to the audience. Don Jones, realtor, representing Mrs. Slater, owner of the subject property, addressed the Commission, explained the proposal and stated why the request was filed. Lair. Jones also stated that the property was zoned C4 four years ago and the property has been listed for the past 3 years, but did not sell. L. M. Martin, representing Rich- field Oil Co., spoke in favor of the request. Mr. Martin stated that they will comply with architectural control and that the proposed sign will not disturb adjacent property owners, because there will be no glare. Bob Healy, 6871 Vista Del Sol, representing Franciscan Fountains Homeowners Association, submitted a petition signed by'496 property owners objecting the proposal. Mr. Healy stated that there are too many service stations within the immediate area. There being no other comment, the hearing was closed. The Commission held a discussion relative to ultimate uses of the subject property. Com- missioner Bazil stated that the applicant has a legitimate reason to ask for this request because the City Council zoned the property commercial before the single family homes were constructed. A MOTION WAS MADE BY DUKE AND SECONDED BY PORTER TO DENY USE PERMIT NO. 70-26 FOR THE FOLLOWING REASONS: 1. The proposed service station is in close proximity to the Central City Park. 2. The applicant is violating the proposed standards for service stations by locating at the 2 mile inter- section. ROLL CALL VOTE: AYES: Duke, Porter, Bazil NOES: Slates, Miller ABSENT: Tom THE MOTION DID NOT CARRY. Further discussion followed rela- tive to whether or not the corner was properly zoned. It was the consensus that the Planning Commission should review an -application for development of the entire corner before action is taken on any one part.- And, that any applications submitted to the Board of Zoning Adjustments be referred to the Planning Commission for consideration. -3- 8/4/70-PC Minutes: H.B. Williams To permit riding stables and associated uses. Located on the north side of Ernest St. approximately 320 ft. east of Goldenwest St. in the Ml-0 Light Industrial District combined with oil production. the audience. The hearing was opened to Bill Wren, representing Huntington Beach Co., offered to answer questions. The Acting Secretary in- formed the Commission that this application was originally heard on July 21, 1970 but failed to receive four affirma- tive votes; therefore, it was automatically continued to this meeting. George Shibata, representing owners in the area, vigorously opposed the request. Mr. Shibata stated that construction of the freeway will not start.until the late 1970's and the applicant is request- ing approval for 10 years. He further pointed out that there is no water facility for this area, fire protection is not available, nor are restroom facilities available- Mr. Shibata stated that the Health Department stated that this use should not be allowed. He also submitted photographs of.the area to show that it is not suitable for riding stables. Mr.Shibata stated that this property should be developed industrial and if said request is approved, it will be detrimental to the public welfare and health. informed the Commission ,that be required at this time. addressed the Commission and Bruce Greer and Mr. Talbert. the hearing was closed. A MOTION -WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO. 70-33 UPON THE FOLLOWING CONDITIONS: 1. Ernest St. shall be dedicated to City Standards. Improve- ments of Ernest St. shall be to Department of Public Works requirements. 2. The riding stable and accessory uses shall be kept in a neat and clean manner at all times and properly sprayed to keep down the fly hazard. 3. Water shall be through the City of Huntington Beach's water system. 4. The property shall participate in the local drainage assessment district. 5. Parking shall be provided at a ratio as determined by the Planning Department with proper oiling for dust control and a standard parking layout. -4- 8/4/70- PC Minutes: H.B. Section 4243.1 of the Huntington Beach Ordinance Code shall be complied with. 7. 50 per cent of the adjacent 52 acres owned by the owner of subject property shall be made available for riding to persons using the riding stables. 8. Conditional Exception No. 70-33 shall become null and void on July 1, 1975 or when any portion of the pro- perty is acquired for freeway purposes. AND FOR THE FOLLOWING REASON: 1. This is a temporary use of the property that will termi- nate July, 1975, or when the State acquires any portion of the property for freeway development. Animal use is objectionable to all but one adjacent property owner. 2. Conditions are such that this use may pose a detriment to health and general welfare. A requirement necessary to satisfy the dictates of the ordinance code." 3. No conditions exist that make this property different from adjacent parcels in the same area under identical zoning. A principal requirement in showing hardship, which has not been demonstrated. USE PERMIT NO. 70-29 - Referred by the Board of Zoning Adjust - Applicant: Tavaglione Construction Co. ments. To permit free standing self-service gasoline pumps as an adjunct to a convenience market in the C2 Community Business District. Located at the southeast corner of Atlanta Ave. and Brookhurst St. The hearing was opened to the audience. Edward Kerins, representing property owners in this area spoke in opposition. He stated the following: 1. The proposed free standing gasoline pumps would tie dangerous due to fire and fumes in the area. 2. Additional gasoline service stations are not needed. 3. It would be hazardous to children using crosswalks on the way to school. -Dwight Berg, District Manager for 7/Eleven food stores, explained the proposal and stated that the pumps will have safety features and explained: how the pumps will be operated. Mr. Berg submitted photographs of the proposal. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY BAZIL AND SECONDED BY PORTER TO DENY USE PERMIT NO. 70-29 FOR THE FOLL014ING REASONS: 1. Although this is the intersection of two arterial high- ways (a major and primary) and the proposed service station standards will allow a service station site at this kind of intersection, a free standing self-service pump is not compatible with a small 7-Eleven Market. -5- 8/4/70-PC Minutes: H.B. Concern has been expressed over the excessive number of service stations within the City and having difficulty in staying in business and.many stations are closing. The type -of operation proposed in this application will only add to the.problem and if used to any great extent, it could result in the closing of stations that other- wise would have prospered. Ewing To permit a golf driving range and sales of food, equipment and lessons in the R5 Office -Professional District. Located approximately 400 ft. south of -Adams Ave. on the east side of Delaware St. The hearing was opened to the audience. There being no comment, the hearing was closed. The Acting Secretary stated that the staff recommends approval of the request. A MOTION WAS MADE BY PORTER AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTIONONO. 70= 39TUPONC-THE`:.FCiLLOWING7CONDITIONS : 1. Conditional Exception No'. 70-39 shall become null and void on July 1, 1973. 2. The surrounding fence shall be kept in -good repair at all times. 3. Lights used to -illuminate the driving range shall be reflected towards the driving range and away.from . adjoining properties. 4. Located on the north side of Defiance Dr., approximately 21 ft. west of the intersection of -Defiance Dr. and Hobart Lane. In Conjunction With DIVISION OF LAND NO. 70-19 Applicant: S & S Construction Co. The hearing was opened to the audience. Mr. Dick Roper, owner of Lot No. 143, spoke in favor of the lot adjustment. Mr. Roper stated that this will allow better utilization of the side yards. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY PORTER AND SECONDED BY DUKE TO APPROVE CODE AMENDMENT NO. 70-12 AND TO REFER SAID AMENDMENT TO THE CITY ATTORNEY'S OFFICE TO BE PREPARED IN FINAL FORM AND BROUGHT BACK FOR FINAL APPROVAL. CODE AMENDMENT NO. 70-13 Said amendment proposes to amend Sections 9162.6.1.1 of the R2 Two Family_Residence District and 9202.6.1.1 of the R3 Limited Multiple Family Residence District to require three-story structures to set back 100 ft. from any Single Family Residential Development. The hearing was opened to the audience. There being no comment, the hearing was closed. Located southwest of Channel Lane, between Admiralty Dr. and Broadway.. The Acting Secretary received a letter submitted by Mr. James Nachazel, engi- neer for the developer, requesting extension of time for one year. Mr. Harlow informed the Commission that a conditional exception pertaining to the Tentative Tract also expired and the applicant will refile a new application. Therefore, the staff recommends con- tinuance of Tentative Tract No. 6874 to September 15, 1970 to allow the Tentative Tract and -Conditional Exception to be heard at the same time. MEMO: FROM THE DESIGN REVIEW BOARD Y The Planning Commission received a memo from the Design Review Board regarding a joint meeting to review Civic District Criteria and the Civic District Configuration. It was the consensus of the Commission to discuss this item at the study session on August 11, 1970, at 2:00 P.M. CHAIRMAN SLATES: Chairman Slates requested that the staff review Me Sectional District Maps to show school sites, freeways and the Edison right-of-ways. Chairman Slates further suggested that the Planning Staff investigate and take photographs of the service station across from the Orange County Airport to show how service stations can be designed as a part of a development. COMMISSIONER PORTER: Commissioner Porter suggested that the staff investigate existing service stations to deter- mine how many of them operated rental truck businesses. The Commission further instructed the staff to study that portion of -the sign code pertaining to separation of signs within the setback as it relates to signs behind setbacks. - INFORMATION: The Planning Director informed the Commission of the o owing: 1. Action taken by the -City Council at their August 3rd meeting, pertaining to requests for continuance of a public hearing by an individual should be supported by reasons and should not be considered an automatic action. 2.
