G. Robinson To permit construction of a 21 ft. X 27 ft. 8 in. classroom addition to an existing church in the R3 Limited Multiple Family Residence District. The subject property is located on the west side of Lake Street and north of Palm Avenue. The hearing was opened to the audience. There was no one present to repre- sent the applicant and there being no other comment, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE USE PERMIT NO. 70-31 WITH THE FOLLOWING CONDITION: 1. All applicable provisions of Article 979 shall be complied with. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-42 Applicant: Continental Fabrication Inc. To permit construction of a 73 unit garden apartment complex with zero side yard setback for carports and a reduc__t_ion in minimum distance between buildings from 15 ft. to 5 ft. In Conjunction With USE PERMIT NO. 70-32 Applicant: Continental Fabrication Inc. To permit construction of a 73 unit garden apartment complex with zero side yard setback for carports, and a reduction in minimum distance between buildings from 15 ft. to 5 ft. The subject property is located 330 ft. west of Beach Blvd., between Warner and Slater Avenues in the R3 Limited Multiple Family District. -1- 8/12/70 - BZA Minutes: It. B. Jerry Brown and Joe Davis, representing the applicant, addressed the Board and explained their request. Mr. Brown stated the variation in setback between structures was to afford more privacy and add interest to the development. comment, the hearing was closed. There being no further Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 70-32 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received August 10, 1970, shall be the approved layout. 2. Elm Street -and Keelson Lane shall be dedicated and fully improved to City standards at the time said parcel is developed. Improvements shall include street trees, street lights, street signs, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. S. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. Easements for utilities or walkways shall be provided to Department of Public Works standards. 7. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 8. The property shall participate in the local drainage assess- ment district. 9. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 10. All utilities shall be installed underground. 11. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to sYrecifica- tions provided by the Fire Department. 12. Off-street parking facilities shall conform to Article 979. 13. A masonry wall shall be constructed along the ea,>terly property line. The height of said wall shall be such that the top will be six (6) feet above the highest ground sur- face within twenty (20) feet of the common property line. Except within the front 15 ft. off Elm St. in which case the height of said wall shall be reduced to 42 inches. -2- 8/12/70 - BZA Minutes: H. There shall be no fence, structure or landscaping constructed or maintained over 3 1/2 ft. high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft.' triangular area at the intersection of streets. 15. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 16. A lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works for approval. 1T. All private streets shall meet the minimum standards for planned residential developments as adopted by the Planning Commission. 18. The structural street section of all private drives shall be approved by.the Department of Public Works. 19. All applicable City Ordinances shall be complied with. 20. All applicable conditions of the Apartment Standards adopted by the Planning Commission shall be complied with. 21. A curbed radiusshall be provided at the northerly end of the westerly drive. FOR THE FOLLOWING REASONS: 1. The setback will be a minimum of 8 ft. and will be at the widest portion which averages over 1S ft. between buildings. 2. The averaged setback allows for a better arrangement of buildings. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 70-42 WITH THE FOLLOWING CONDITION: 1'. Carports constructed on property line shall be of mainten- ance free masonry material. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. REVIEW - Home Occupation Ismael A. Ballesteros 10031 Kukui Drive Mr. McFarland informed the Board that said home occupation was set for review pursuant to Section 9730.20 (m) which requires a hearing by the Board after a complaint has been filed with the Building Department. -3- 8/12/70 - BZA N1iM11es: 11. I.. lioar-d of* Zoiiin}, Ad.iuti1me0s August 12, 1970 Page No. 4 Dan stated that an investi- gation had been made and that there was evidence to believe that the business was being conducted in violation of the agree- ment and conditions for operating such home occupation. Mrs. Ballesteros was present and addressed the Board. Mrs. Ballesteros stated that the pneumatic tools and equipment were only hand tools and were not used in conjunction with the home occupation. Board discussion followed. In was the consensus of the Board that a violation did not exist but said occupation should be reviewed again on October 14, 1970. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO EXTEND THE AUTHORIZATION FOR SAID HOME OCCUPATION UNTIL OCTOBER 14, 1970.
