It was noted that the City Council approved the addition of Article 924 MH - Mobilehome District to Division 9 at their August 17, 1970 meeting. Planning Commission August 18, 1970 Page 2 CONDITIONAL EXCEPTION N0. 70-42 Applicant: Benny Capocsiama To permit the relocation of a non -conforming residence from the front of a commer- cial parcel to the rear of such parcel and to allow ex- terior alteration (additional 1202 sq. ft. of floor space) to be made upon relocation of said dwelling. This reloca- tion will allow commercial. -development on the front portion of said parcel in the C4 Highway Commercial District. Located 1100 ft. southfof Garfield Ave. and east of Beach Blvd. The Chairman read the request. A video tape was shown of the subject property. '- The hearing was opened to the audience. Mr. Capocciama addressed the Commission and explained his request. There being no further comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY DUKE AND SECONDED BY PORTER TO APPROVE CONDITIONAL EXCEPTION NO. 70-42 SUBJECT TO THE FOLLOWING CONDITIONS: 1. The existing parking for the restaurant and tavern shall be made to conform to Article 979 when the com- mercial frontage develops. 2. The commercial development shall be subject to an approved use permit by the Board of Zoning Adjustments. 3. Reciprocal easements for vehicular access over subject property and the parcel to the south shall be filed with the City and recorded prior to issuance of building permits, for any construction on the residential units on subject property. Located on the north side of Portsmouth Dr., approximately 510 ft. west of Bushard St. and legally described as Lot No. 73, Tract No. 4350. The Chairman read the request and opened the hearing to the audience. Mr. Miguel P. de Cruz, La Puente, inquired as to the conditions of approval. There being no further com- ment, the hearing was closed. ZONE CASE NO. 70-11 (Continued) Applicant: Wm. Lyon Development Co., Inc. i _ To permit a change of zone from C4 Highway Commercial District to R3 Limited Multiple Family Residence District. Located on the north side of Holland Dr., approximately 180 ft. east of Beach Blvd. The Chairman read the request. A video tape was shown of the subject area. Mr. Robert Farrell, representing the applicant, addressed the Commission and stated their company feels they have too much commercial property as the topography of the property is not suited to commercial development so they would like to rezone a portion for apartment development. They feel this would be compatible with the surrounding neighborhood and should be allowed because the traffic congestion would be 2z times greater if left as commercial property. Also, other property in the area with similar depth have apartment developments and after contacting many potential commercial tenants,the property was found undesirable for commercial development. Mr. Mike Harrison, Wm. Lyon De- velopment Co., stated that they.tried to procure tenants for the parcel but got poor response due to the depth of the parcel. Mrs. Robert Oswald, resident in the area, spoke in opposition to the request, stating that the development would create an even greater overcrowded condition in the schools. Mr. Art Delvaux, nearby resident, stated he felt the apartment development would create greater traffic congestion through the residential streets than the commercial development because the commercial traffic would use the main arterial streets rather than the several access roads. Mrs. Weber and Mr. Ben Hadley, nearby residents, spoke in opposition due to their concern over traffic conjestion. Mr. Harrison, Wm. Lyon Development Company, felt certain -streets could be designed as cul-de- sacs to eliminate traffic flow created by the proposed development from the existing single family development. Mr. Farrell, Wm. Lyon Development Co., stated that Ocean View School District indicated that the subject schools are not in the overcrowded condition as are many other schools in Huntington Beach. Commissioner Porter stated he felt there were many property owners along Beach Blvd. with similar sized parcels and that in time the area would develop so that these deep lots would become commercial developments. Commissioner Duke also felt that in time these parcels would develop as commercial pro- perty and that there is already enough high density zoning in Huntington Beach". Commissioner Kerins stated he felt that R3 zoning should not be used as a buffer between R1 and com- mercial property. Commissioner Slates felt this property could not be used for commercial development. It was the consensus of the Commission that conditions have not substantially changed during the past year since denial of the previous applica- tion. A MOTION WAS MADE BY DUKE AND SECONDED BY KERINS TO DENY ZONE CASE NO. 70-11 FOR THE FOLLOWING REASONS: 1. Not all commercial property in the city is suited for development at this time and this parcel may be one of them. I 2. Although the applicant has indicated that several of the companies found the site undesirable, there are many other uses not mentioned. 3. The use will result in a traffic problem on Holland Dr. and it is unlikely that a traffic signal will be installed. 4. The property is master planned for commercial development. CONDITIONAL EXCEPTION NO. 70-40 - Applicant: --William E.-Blurock' , Readvertised To permit the construction of a 287 unit '- 17 story retirement tower and a 950 seat sanc- tuary on approximately 5-acres.of land in the R1-0 Single Family Residence District combined with oil production. Located on the south side of Adams Ave. between 17th and Main Streets. The Chairman read the request and opened the hearing to the audience. Mr. Blurock addressed the Commission and stated they were not expecting a final deci- sion at this time, but would like'to present the concept . and receive comments from the Commissioners and'the audience. Mr. Rollo West, First Chris- tian Church, spoke of the growth of their church and the need for housing for the elderly. He stated they estimate a church attendance of 1500 within 15 years-. - Mr. Blurock stated he feels the high rise tower would be compatible with the surrounding area because of -plans -for -the civic center, the schools, golf course, etc. "Mrs. Lorraine Faber and Mr. Dingwall of the Home Council, requested a continuance to allow time for more public comment as they did not have complete information prior to the meeting. Commissioner Kerins ques- tioned Mr. West as to whether the church would contribute -4- 8/18/70-PC Minutes: H.B. Planning Commission August 18, 1970 Page 5 towards the cost of certain services provided by the City for this project since -the project is tax exempt. Mr.West replied they would follow FHA requirements. There being no further comment, the hearing wasclosed. Commission discussion was held. A MOTION WAS MADE BY DUKE AND SECONDED BY PORTER TO CONTINUE CONDITIONAL EXCEPTION NO. 70-40 TO THE SEPTEMBER 15, 1970 MEETING TO ALLOW"TIME FOR PUBLIC TO SECURE ADDITIONAL INFORMATION ON THE PROPOSED PROJECT. ZONE CASE-Nb. 70-13 (Continued) Applicant: Gulf Oil Corp. A change of zone from R1 Single Family Residence District and C4 Highway Commercial District to R1 Single Family Residence District, R3 Limited Multiple Family Residence District, R4 Multiple Family Residence Dis- trict and C4 Highway Commercial District with a 50 ft. set- back from the ultimate right-of-way line.Located on northwesterly corner Of Pgcifir, Coast Hwy. & Admiralty Dr. In Conjunction With CONDITIONAL•EXCEPTION NO. 70-44 = Applicant: Real Property Management; Inc. To permit the. following: 1) Approxi- mately 23 single family residences on 60 ft. by 100 ft. lots with frontage on a 54 ft. wide street and 150 ft. wide chan- nel on a 3.88'ac. parcel of land; 2) approximately 75 town- house type apartment units with access to a-54 ft.-public street and 20 ft. public alley on a 4.15:ac. parcel of land; 3) approximately 280 one to three bedroom apartment units within 4 three-story buildings and one eleven -story building with 75 boat slips on a 5.79 ac. penninsula of land obtain- ing access from -Pacific Coast Highway by way of a 60 ft. strip of land; 4) approximately 260 commercial boat slips and a commercial fuel dock on 7.9 ac. of land; 5) commercial buildings as follows: a) single story retail shops and restaurant; b) four-story office buildings; and, c) eleven - story 160 room hotel. Such commercial buildings are to be located on a 13.97 ac. parcel of land. A plot plan depict- ing the location of the proposed uses is on file in the Planning Department Office. Located on the northeast side of Pacific Coast Highway between Anderson St.'and Admiralty Dr. in the R1 Single Family Residence District and C4 Highway Commercial District. The Chairman read the request and opened the hearing to the audience. Mr. Abe Lurie, Real Property Management, addressed the Commission and explained the request. Mr. Houps, architect of the development, pre- sented slides of -the proposed development and answered various questions. Mr. Houps also explained amendments to the original request. He stated that the requested R3 zon- ing could be R2 Two Family Residential District -and the -5- 8/18/70-PC Minutes: H.B. Planning Commission August 18, 1970 Page 6 requested C4 zoning could be C3 General Business District. He also stated -that the_maximum�280_units-shown for the high rise apartment building is the -maximum they could build and that the building would more than likely have from 225 to 250 units. -The hotel would have approximately 150 rooms. - Mr. Burford, resident of Huntington.Harbour, questioned parking space on the island, and if all'details as presented to the Commission would be adhered to. Mr. Burford informed the Commission there had been a meeting of residents in the area and there was a vote 4 to 1 in favor of the development if developed as shown on plan. Mr. Jim Marten, -resident of Huntington Harbour, felt the high rise buildings would block view from the residences. Mr. Jim,Depnee stated he was in favor of the proposal. Mr. Jim Martin stated he was in favor of the proposal. Mr. Bert Beria questioned if the proposed RI residences would be developed immediately upon approval of the request and opposed any delay in construc- tion of this portion of the request. Mrs. Strain, Sunset Beach, requested a continuance of the proposal to allow time for the people bf Sunset Beach to obtain further in- formation. Mr. Buddy Conlest spoke in opposition to the live -on -board boats which may pollute the waters. Mr. Bob James, Huntington Harbour resident, requested a continuance for investigation of possible pro- blems which may arise in heavily populated area such as sanitation,.crime, parking, etc. Mr. Amel Durant asked what provisions and requirements would be made for sanita- tion, etc.,oftthe boat slips. Mr. Robert Helfer opposed the reduction of the area zoned -RI. He requested a con- tinuance for further study. Mr. Howel asked for'insurance that the R1 zone would be developed and felt there should be a restriction set on the height of buildings. He re- quested a continuance -for further study. There being no further comment, the hearing was closed. Commission discussion was held. Commissioner Porter felt a time -table would be advisable for construction of the,low density area, and that an additional -study should be made of the location of the gas dock, parking, etc. He also felt that the C3 zone requested should be C4. Commissioner Duke felt fur- ther study should be -made with regards to traffic flow. The Commission was ad= vised that the gas dock has-been moved to the commercial area and it is no longer required by Gulf Oil Corporation. A MOTION WAS MADE BY PORTER AND,SECONDED BY DUKE TO CONTINUE ZONE CASE NO.70-13 AND CONDITIONAL EXCEPTION NO. 70-44 TO THE SEPTEMBER 1, 1970 MEETING TO ALLOW TIME FOR THE APPLICANT AND INTERESTED PERSONS TO CONDUCT FURTHER INVESTIGATION ON THE DEVELOPMENT. Margaret Brady inquired whether the plan would take a portion of her property. Mr.Douglas recommended approval due to drainage problems in the area. Mr. Hoflegger, Parkside Lane resident, advised that traffic is very heavy through this area and should be diverted to Edinger Ave. Commission discussion was held. CODE AMENDMENT NO. 70-12 Said amendment proposes to amend Section 9106.5 of the R1 Single Family Residence District to allow boats, boat trailers, single axle travel trail-ers and campers to be parked or stored in front of a dwelling. MISCELLANEOUS: Central Industrial Sub -Committee Airport Study The Chairman appointed Commissioner Duke to replace Michael Bokor on the Airport Study. MISCELLANEOUS: Commissioner Porter requested the Building Department to investigate the outside storage and/or display of U-Haul trailers located at 1901 Beach Blvd., Huntington Beach.
