CONDITIONAL EXCEPTION NO. 70-43
Applicant: Kavanaugh/Beard Development Company
4 To permit a building to encroach onto
a 10 ft. sanitary sewer easement in lieu of the required 5 ft.
setback.

Applicant: Kavanaugh/Beard Development Company
To permit a division of land for a
lot line adjustment between parcels 2 and 3 on Parcel Map R.S.T.
4924 in the R3 Limited Multiple Family Residence District.
The subject property is located on
the west side of Gothard Street approximately 1,064 feet north
of Warner Avenue.
The hearing was opened to the audience.
No one was present to represent the
applicant; there being no other comment, the hearing was closed.
Board discussion was held.

SECONDED BY SPENCER TO APPROVE CONDITIONAL EXCEPTION NO. 70-43
WITH THE FOLLOWING CONDITION:
1. Conditions as deemed necessary by the Public.Works Department
shall be complied with.

To permit the construction of
a 221 unit apartment complex on a 7.5 acre parcel of land in the
R3 Limited Multiple Family Residence District.

A MOTION WAS MADE BY HARLOW
AND SECONDED BY LIPPS TO APPROVE USE PERMIT NO. 70-33 WITH THE
FOLLOWING CONDITIONS:
1. The plot plan received August 7, 1970, shall be the approved
layout.
2. Gothard Street and Warner Avenue shall be dedicated and fully
improved to City standards. Improvements shall include street
trees, street signs, street lights, fire hydrants, sewer and
water main extensions.
3. Water supply shall be through the City of Huntington Beach's
water system.
4. Sewage disposal shall be through the City of Huntington Beach's
sewage system.
5. The water, sewer, and fire hydrant system shall be approved
by the Department of Public Works and Fire Department.
6. Easements for utilities or walkways shall be provided to
Department of Public Works standards.
7. All buildings on lots abutting a City easement shall be set
back five (5) feet from the edge of such easement.
8. The flood control channel shall be fenced to Flood Control
District standards and City standards.
9. The property shall participate in the local drainage assess-
ment district.
10. Soil reports as required by the Building Department and the
Department of Public Works shall be submitted to the City
prior to issuance of building permits.

11. All utilities shall be installed underground.

12. There shall be no fence, structure or landscaping con-
structed or maintained over 3 1/2 ft. high within a 10 ft.
by 10 ft. triangular area at the intersection of driveways
and streets or within a 25 ft. by 25 ft. triangular area
.at the intersection of streets.
13. No structures, other than those shown on the approved
plot plan, shall be constructed within the project.
14. A lighting system shall be installed within the project
equal in -illumination to lighting on public streets. A
lighting plan shall be submitted to the Department of
Public Works for approval. Such lighting shall be directed
away from adjacent property.
15. The height of the wall along the west property line shall
be reduced to 42" within the front 10 ft. on Warner Avenue.
16. Driveway locations shall be approved by the Traffic Engineer.
17. All standard conditions for apartment projects shall be
complied with.
18. The entrance to the development shall be equipped to
facilitate. the installation of gate to restrict access
to such development.
19. If the Planning Commission amends the Standards for
Apartment Developments to require installation of gates
at the entrances to the development to restrict access or
if it is determined by the Board of Zoning Adjustments that
such gates are necessary, the developer shall install -the
gates prior to final inspection of apartment units.

To permit wholesale distribution and
sale of clams, frozen fish, poultry and seafoods in the M2-Q
Heavy Industrial District:
The subject property is located at
320 Yorktown Avenue.
_ Starlyn Young, applicant, addressed
the Board and explained his request.
A discussion was held informing
Mr. Young of the necessary street improvements and on -.site
improvements. It was also pointed out that retail sales are
not permitted in the industrial zones.

Dave Garrison and Andy Dennis,
representing the applicant, addressed the Board and explained
their request.
Board discussion was held.
A MOTION WAS MADE BY SPENCER
AND SECONDED BY HARLOW TO APPROVE ADMINISTRATIVE REVIEW NO. 70-40
WITH THE FOLLOWING CONDITIONS:
1. All applicable conditions of Division of Land No. 69-17
shall be complied with.
2. All applicable City Ordinances shall be complied with.

TENTATIVE TRACT NO. 6874 - Review location, design and material
of block wall.

AND SECONDED BY SPENCER TO REFER THIS MATTER TO THE PLANNING
COMMISSION FOR A DECISION AT THEIR SEPTEMBER 1, 1970, MEETING
TO BE HELD IN THE CIVIC CENTER COUNCIL CHAMBER AT 7:00 P.M.
FOR THE FOLLOWING REASON:
1. The Planning Commission will be reconsidering the tentative
tract at that meeting.
