Council Chambers, Civic Center Huntington Beach, California Slates, Miller, Porter, Kerins Bazil, Duke, Tom Beach Planning Commission Minutes were accepted as transcribed and ZONE CASE NO. 69-36 - Continued Applicant: Standard Pacific Corp. Change of zone from RI Single Family Residence District to RS Office -Professional District. Located between Garfield Ave. and Ellis Ave., east to the extension of Newland St. The Acting Secretary informed the Commission that this zone case is before them for decision only. Mr. Harlow stated that this item was originally heard by the Planning Commission on January 6, 1970, at which time the matter was continued to allow time for the applicant to submit additional information to substantiate the soil engi- neer's statement that the property cannot economically be developed for single family homes. Soils report submitted by soils engineers pertaining to the subject property were reviewed by the Commission. Bill Hartge, City Engineer, concurred with the soils report and recommended to the Commission that public streets should not be constructed within the proposed development, nor should the sewer and water lines, which have to be placed in the streets, be dedicated to the City due to the high risk of damage. A MOTION WAS MADE BY PORTER AND SECONDED BY KERINS TO RECOMMEND APPROVAL OF ZONE CASE NO. 69-36 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The subject property has marginal soil conditions. 2. Engineering consultants for the property owners submi-t�o, information showing that the property was not suited or` development of single family homes. COMMISSIONER PORTER: Commissioner Porter suggested that the staff study areas in the City where topography and soil con- ditions tend to make property suited for the MH zone. ZONE CASE NO. 70-13 - Continued Applicant: Gulf Oil Corp. A change of zone from Rl Single Family Residence District and C4 Highway Commercial District to R1 Single Family Residence District, R3 Limited Multiple Family Residence'District, R4 Multiple Family Residence Dis- trict and C4 Highway Commercial District with a SO ft. setback from the ultimate right-of-way line. Located at the north- westerly corner of Pacific Coast Highway and Admiralty Drive. In Conjunction With Minutes: H.B. Planning Commission September 1, 1970 Page 2 CONDITIONAL EXCEPTION NO. 70-44 - Continued Applicant: Real Property Management, Inc. To permit the following: 1) Approximately 23 single family residences on 60 ft. by 100 ft. lots with frontage on a 54 ft. wide street and 150 ft. wide channel on a 3.88 acre parcel of land; 2) ap- proximately 75 town -house type apartment units with access to a 54 ft. public street and 20 ft. public alley on a 4.15 acre parcel of land; 3) approximately 280 one to three bedroom apartment units within 4 three-story buildings and one eleven -story building with 75 boat slips on a 5.79 acre penninsula of land obtaining access from Pacific Coast Highway by way of a 60 ft. strip of land; 4) approximately 260 commercial boat slips and a commercial fuel dock on 7.9 acres of land; 5) commercial buildings as follows: a) single story retail shops and restaurant; b) four-story office buildings; and c) eleven -story 160 room hotel. Such commercial buildings are to be located on a 13.97 ac. parcel of land. A plot plan depicting the location of the proposed uses is on file in the Planning Department Office. Located on the northeast side of Pacific Coast Highway between Anderson St. and Admiralty Dr. in the R1 Single Family Resi- dence District and C4 Highway Commercial District. The Acting Secretary informed the Planning Commission that this item was continued from the August 18, 1970 meeting to allow time for the applicant and interested persons to further investigate the request. He further stated that the information was transmitted for Com- mission review. The hearing was opened to the audience on Zone Case No. 70-13 and Conditional Excep- tion No. 70-44. A. M. Lurie, President, Real Property Manangement, Inc., submitted a petition signed by 109 property owners of Island 1 and 2 in Huntington Harbour, supporting the proposal. There being no other comment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY MILLER AND SECONDED BY PORTER TO APPROVE CONDITIONAL EXCEPTION NO. 70-44 UPON THE FOLLOWING CONDITIONS: 1. The final plans shall be submitted to the Board of Zoning Adjustments for review and to establish such conditions of approval as deemed necessary. Said plan shall be for- warded on to the Planning Commission for final approval. 2. An access road to provide adequate internal circulation and to limit access to Pacific Coast Highway shall be provided to Department of Public Works requirements. 3. A detailed plan depicting the docking facilities shall be approved by the Department of Public Works. 4. Prior to issuance of building permits for any construc- tion, a deed restriction shall be recorded restricting construction on 23 RI lots for single family residences. 5. Prior to framing inspection on any structure, other than single family residences, a minimum three (3) single family residences shall be constructed within the area designated for single family development. The remaining 20 lots shall be landscaped with permanent trees at the corner of all lots with temporary landscaping provided on the remaining R1 area. Change of zone from R3 Limited Mul- tiple Family Residence District to C4 Highway Commercial District -with a 50 ft.-setback from the ultimate right-of- way line. Located on the north side of Chrysler Dr. begin- ning approximately 500 ft. west of Beach Blvd. The hearing was opened to the audience. Four adjacent property owners' addressed the Commission and stated that they were con- cerned with noise generated from the existing facility, because of loud speakers. Mr. Landors, 7852 Rhine Dr., asked about separation from the R1 development to the rear and requested that a sufficient buffer be provided between the commercial and the residential area. John Leary, 'representing the appli- cant, offered to answer questions and suggested that problems dealing with physical separation would be handled at the Board of Zoning Adjustments level. .- There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY PORTER AND SECONDED BY KERINS TO RECOMMEND APPROVAL OF ZONE CASE NO. 70-14 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. Configuration of this parcel is such that it is not ideally suited for multiple family development. 2. Expansion of the existing Dodge dealership onto this property would be a better use for said property. Planning Commission September 1, 1970 Page 4 TENTATIVE TRACT MAP NO. 6874 - EXTENSION OF TIME Subdivider: Aetna Savings & Loan Assoc. 30 lots on 5.2 acres, located at the southwest of Channel Lane, between Admiralty Dr. and Broadway. A letter submitted by James Nachazel, engineer for the developer, requesting a one year extension of time within which to record the final map was received by the Secretary. A MOTION WAS -MADE BY PORTER AND SECONDED BY MILLER TO.APPROVE_ONE YEAR EXTENSION OF TIME FOR TENTATIVE TRACT MAP NO. 6874 UPON THE FOLLOWING CONDITION: 1. All conditions of approval of the previously approved tentative tract map and conditional exception except Condition No. 7 shall -be complied with. (Condition No. 7 has been deleted because the petition to"rezone the property has been filed. ROLL CALL VOTE: AYES: Slates, Miller, Porter, Kerins NOES: None ABSENT: Bazil, Duke, Tom THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-45 Applicant: Nachazel-Leonard, Inc. To,, ,permit the subdivision of a -parcel of land into lots having an --average frontage of 40 ft. and an area of 3560-sq., ft.-in lieu of the re- quired .60 ft. lot width and 6000 sq. ft. of lot area. Also, to permit a public street having a width of 43 ft. in lieu of the 52 ft. width required by the Huntington Beach Ordi- nance Code. Located southwest of Channel Lane, between Admiralty Dr. -and Broadway in the R1 Single Family Residen- , tial District. _1 _ - _ _ _ _ _ _ _ The hearing was opened to the audience. Art Knox, 3322 Easter Circle, questioned the minimum lot size. William Stephenson, 16782 Bayview Dr., stated that he was not notified as to the settle- ment of the encroachment into the 30 ft. street. Gerald Jones, 16711 Bayview'Dr., representing the Board of Directors of Sunset Island Assoc., asked questions regarding encroach- ment into the right-of-way.- Mr.'Jones stated that this point should be cleared up before this request is granted. Don Miller, 4062 Aladdin Dr., President of Huntington Harbour Homeowners Assoc., supported Mr. Jones' comments and stated that there is no need for R2-zoning in this area. George Wood, 6788 Bayview Dr., was concerned if a potential traffic problem which could be created on Bayview Dr., stating that this is only a 30 ft. street which cannot adequately handle two-way traffic. Jim Nachazel,- engineer for the developer stated that the encroachment has been worked out which will eliminate this problem. Mr. Nevin R. Shade, submitted a petition opposing this project. There being no further comment, hearing was closed. Commission discussion was held. A MOTION WAS MADE BY PORTER AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO. 70-45 UPON THE FOLLOWING CONDITIONS: I. `Approval of Tentative Tract.Map No. 6874 shall not be -4- 9/l/70-PC Minutes: H.B. All conditions of approval of the previously approved Tentative Map and Conditional Exception except condi- tion no. 7 shall be complied with. A FURTHER MOTION WAS MADE BY SLATES AND SECONDED BY PORTER TO REFUND THE FILING FEE FOR ZONE CASE NO. 70-12 FILED BY THE APPLICANT WHICH WAS REQUIRED AS A CONDITION OF APPROVAL OF THE ORIGINAL CON- DITIONAL EXCEPTION BECAUSE THIS CONDITION WAS DROPPED AFTER THE ZONE CASE WAS FILED. PROPOSED CODE AMENDMENT CARE OF NON -RELATED PERSONS: The Commission reviewed a pro- posed code amendment pertaining to the care of non -related persons in any residential district subject to the approval of an Administrative Review application by the Board of Zoning Adjustments. A MOTION WAS MADE BY MILLER AND SECONDED BY PORTER TO INSTRUCT THE SECRETARY TO SET SAID AMENDMENT FOR PUBLIC HEARING. MEMO: Bill Hartge, City Engineer, submitted a memo to the commission -regarding installation of a 66 KV overhead line along McFadden Ave. from Springdale St. to Bolsa Chica St. Mr. Hartge stated that because this type of installation is allowable per ordinance, the Public Works Department is attempting to convince the Edison Co. and Lusk Co. that they should provide for the undergrounding of this power line. Mr. Hartge stated that the purpose of this memorandum is to acquaint the Planning Commission Uith the situation so they will not be alarmed if they see an overhead line being installed. DISCUSSION: Bill Hartge, City Engineer, discussed a pro- pose precise plan of street alignment in the vicinity of Beach Blvd. and Terry Dr. Mr. Hartge stated that his de- partment will be studying said alignment further and submit a proposal to the Commission at a later date. COMMISSIONER PORTER: Commissioner Porter requested that Administrative Review No. 70-12 pertaining to the construc- tion of three model homes on the south side of Erskine and east of Bushard St. be referred to them by the Board of Zon- ing Adjustments for review.
