Matheus To permit the construction of a 5 ft. high slumpstone block wall within 13 ft. of the front property line in lieu of the required 15 ft. front yard setback. The subject property is located on the east side of Courtney Lane, approximately 60 ft. south of the intersection of Westport Drive and Courtney Lane at 17186 Courtney Lane. The Chairman read the request and opened the hearing to the audience. Mrs. Matheus addressed the Board and answered various questions regarding open space, etc. There being no further comment, the hearing was closed. Board discussion was held. The Acting Secretary noted that a previous request of similar nature had been denied; however, the Planning Commission approved the appeal as it was located across the street from property with a fence constructed on the property line of the exterior side yard. A MOTION WAS MADE BY PALIN AND SECONDED BY LOVEJOY TO APPROVE CONDITIONAL EXCEPTION NO. 70-45 FOR THE FOLLOWING REASONS: 1. Construction of the wall at this location will afford entry into the front yard behind said wall. 2. The subject property faces directly on the exterior side lot across the street with a fence constructed on the exterior property line. ADMINISTRATIVE REVIEW NO. 70-42 Applicant: Kaufman & Broad To permit the construction of three model homes in the Rl - Single Family Residence District. -1- 9/2/70 - BZA Minutes: H.B. Board of Zoning Adjustments Wednesday, September 2, 1970 Page No. 2 The subject property is located on the south side of Erskine, east of Bushard Street. The Chairman read the request. The applicant was not present. The Acting Secretary advised that a formal request had been made by the Planning Commission to refer this item to the Planning Commission for their consider- ation. A MOTION WAS MADE BY PALIN AND SECONDED BY LOVEJOY TO REFER ADMINISTRATIVE REVIEW NO. 70-42 TO THE PLANNING COMMISSION MEETING TO BE HELD SEPTEMBER 15, 1970, IN THE COUNCIL CHAMBERS AT 7:00 P.M. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 70-43 Applicant: Signal Landmark Inc. dba Capital Sales Co. To permit the placement of a temporary portable sales office for mobile homes during con- struction of the permanent structure and complex for mobile home sales and service organization. The subject property is located on the northwest corner of Beach Blvd. and Atlanta Avenue. The Chairman read the request. Mr. Ma¢Intosh, representing the applicant, addressed the Board and answered various question. He stated that the temporary sales office would be used for approx- imately six months. The Acting Secretary advised that City ordinance requires the Planning Director's approval for any request within the Top -Of -Pier Development Plan area. He advised that the Planning Director had reviewed this request and approved same as subject property is within the future free- way right-of-way portion of the Top -Of -Pier Plan and because said request is for a temporary use. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 70-43 SUBJECT TO THE FOLLOWING CONDITION: 1. The applicant shall comply with Section 9730.25.3 of the Huntington Beach Ordinance Code. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None THE MOTION CARRIED. MISCELLANEOUS: CONDITIONAL EXCEPTION NO. 70-36 - Referred by the Planning Commission Applicant: Leasing Enterprises, Inc. Referred by the Planning Commission for review of plot plan and to establish conditions of approval as deemed necessary. -2- 9/2/70 - BZA Mindtea: H. B. Board of Zoning Adjustments Weddesday, September 2, 1970 Page No. 3 The subject property is located on the southwest corner of Nichols Street and Warner Avenue. Messrs. Heffley, Bjorna, and Humm represented the applicant, Discussion was held regarding the type of equipment, amoutt of traffic flow, outside storage for equipment, parking, and location of driveways. The representatives advised that the low -boy trucks would enter the property from Nichols Street on the driveway located furthest from the intersection of Warner Avenue and that the heavy traffic would not use the driveway on Warner Avenue when exiting from the property. The suggested conditions of approval were discussed. The Board felt a revised plot plan delineating the parking, storage, drives, etc. is necessary. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO CONTINUE CONDITIONAL EXCEPTION NO. 70-36 TO THE SEPTEMBER 9, 19703, MEETING TO ALLOW TIME FOR THE APPLICANT TO SUBMIT A REVISED PLOT PLAN TO THE BOARD FOR REVIEW. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None THE MOTION CARRIED. TRACT NO.- 6874 Engineer: James W. Nachazel Review wall design and materials. The Board reviewed submitted photo- graphhL and discussed types of materials for tract 6874. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE THE DESIGN AND MATERIALS FOR THE WALL AS SHOWN ON THE SUBMITTED PHOTOGRAPHS WITH THE FOLLOWING CONDITION: 1. Design and materials shall be similar and compatible with materials used on Final Tract 6404, (Tiburon Bay). ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None THE MOTION CARRIED.
