Schultz To permit the outside display and/or storage of U-Haul utility trailers and trucks at a service station in the C-2 Community Business District. The subject property is located at the southeast corner of Adams Avenue and Magnolia Street. The Vice -Chairman read the request. The Acting Secretary advised that the Planning Commission will discuss the outside display and/or storage of rental equipment at service stations on September 22, 1970, at their Study Session. This meeting will be held at 2:00 P.M. in the Council Chambers. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE ADMINISTRATIVE REVIEW NO. 70-15 TO THE SEPTEMBER 23, 1970, MEETING. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None ABSENT: None THE MOTION .CARRIED. The applicant was present and was encouraged to attend the Planning Commission Study Session on September 22, 1970. ADMINISTRATIVE REVIEW NO. 70-18 - Continued Applicant: Thompson's Texaco To permit the outside storage and/or display of rental equipment in the C4 - Highway Commercial District. The subject property is located at the southwest corner of Brookhurst Street and Hamilton Avenue. The Vice -Chairman read the request and noted the Planning Commission's Study Session to be held September 22, 1970, at which time the outside storage and/or display of rental equipment would be discussed. CONDITIONAL EXCEPTION NO. 70-47 Applicant: Ernest'J. Sherwood To permit the construction of a 6 ft. high fence to within 1 ft. of the front property line in lieu of the required 15 ft. setback. The subject property is located on the south side of Cutty Sark Drive, approximately 250 ft. east of Matsonia Lane in the R1 Single Family Residence District. ` The Vice -Chairman read the request and opened the hearing to the audience. Mr. and Mrs. Lareau, abutting property owners, addressed the'Board and stated they feel there could be a traffic hazard and they are opposed to the request. The Vice -Chairman asked if there were any other persons in the audience to speak for or against the request. There being no other comment, the hearing was closed. Board discussion followed. The Acting Secretary advised there had been a stop work order issued to the applicant by the Building Department. Mr. Palin stated that he felt the wall at the location request would set a precedent, also, the Planning Commission had made a decision on August 5, 1969 not`to amend the ordinance to allow a reduction in front yard setback within developed areas. A MOTION WAS MADE BY PALIN AND SECONDED BY MC FARLAND TO DENY CONDITIONAL EXCEPTION NO. 70-47 FOR THE REASONS: 1. The applicant has not demonstrated sufficient hardship. 1 2. It has been the consensus of the Planning Commission not to allow a reduction in front yard setbacks for fence or wall construction in developed residential subdivisions. 3. This request would set a precedent for future requests pertaining to fence construction within front yard setback. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None ABSENT: None THE MOTION CARRIED. The applicants at this point addressed the Board. They stated that the permit had been issued by the Building Department and they had dug the hole for the pool, put the filters in, and rearranged the sprinkler system. They also advised that the Building Inspector had been to their home and advised that the sewer and water lines were in a location which would nog; be in the way when digging the hole for the pool; however, in the process of digging the pool, the sewer and water lines were hit and broken causi;ig them to be without sewer and water and the expense of having the lines re- routed. The lines were rerouted without --a building permit }paving been issued because it was a weekend and the City Hall was closet'. They also explained that when they originally applied for a building permit, they submitted complete plans for the pool which had the fence shown and they were not advised that the fence was in violation of th,; Building Code. -2- 9/16/70 - BZA Minutes Board of Zoning Adjustments Page 3 The Board advised the applicant that Anthony Pools was aware that certain permits must be obtained before proceeding with various stages of construction. The applicant advised that Anthony Pools did not advise them of the required permits and had proceeded with the construction. The Board advised the applicant of their right to appeal the Board's decision to the Planning Commission. USE PERMIT NO. 70-36 Applicant: Dike $ Colegrove, Inc. To permit the construction of a 14 ft. X 64 ft. fully enclosed storage area in addition to an existing building in the C4 - Highway Commercial District. The subject property is located at the southeast corner of Brookhurst St. and Garfield Ave. The Vice -Chairman read the request and opened the hearing to the audience. Mr. Leon Hayes, representing the applicant, addressed the Board and answered various questions. There being no further comment, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY MC FARLAND AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 70-36 SUBJECT TO THE FOLLOWING CONDITION: 1. The parking spaces at the rear of the building shall be re - striped as shown on the plot plan submitted September 11, 1970. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None ABSENT: None THE MOTION CARRIED. ADMINISTRATIVE REVIEW NO. 70-47 Applicant: Evangelical Free Church of Huntington Beach To permit the construction of ten additional classrooms to an existing facility in the C4-Highway Commercial District. The subject property is located on the east side of Florida Avenue, approximately 654 ft. north of Adams Avenue. The Vice -Chairman read the request. Mr. Lauter, representing the church, addressed the Board. The suggested conditions of approval were discussed. A MOTION WAS MADE BY MC FARIAND AND SECONDED BY PALIN TO APPROVE ADMINISTRATIVE REVIEW NO. 70-47 SUBJECT TO THE FOLLOWING CONDITIONS: -3- 9/16/70 -- BZA Minutes Board of Zoning Adjustments Page 4 1. Florida Street shall be dedicated and fully improved to City standards at the time said parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system.. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. S. The property shall participate in the local drainage assessment district. 6. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 7. All utilities shall be installed underground. 8. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to specifications provided by the Fire Department. 9. Off-street parking facilities shall conform to Article 979. 10. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 11. MISCELLANEOUS: CONDITIuNAL EXCEPTION NO. 70-38 - Continued Applicant: Congregation of Jehovah's Witnesses, Corp. Referred by the Planning Commission for review of plot plan to establish conditions of approval as deemed necessary. The Vice -Chairman read the request. Board Discussion was held. A MOTION WAS MADE BY PALIN AIdD SECONDED BY MCFARLAND TO APPROVE CONDITIONAL EXCEPTION NO. 70-38 SUBJECT TO THE FOLLOWING CONDITIONS: 1. The plot plan received September 4, 1970, shall be the approved layout. 2. Delaware Street shall be dedicated and fully improved to City standards at the time the parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. -4- 9/16/70 - BZA Minutes Board of Zoning Adjustments Page 5 3. Water supply shall be thru the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer and fire hydrant system shall be approved by the Department of Public Works and the Fire Department. 6. The property shall participate in the local drainage assessment district. 7. Soil reports as required by the Building Department and the Depart- ment of Public Works shall be submitted to the City prior to issuance of building permits. 8. All utilities shall be installed underground. 9. Off-street parking facilities shall conform to Article 979. 10. A masonry wall shall be constructed along the north and east property lines. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20 ) feet of the common property line. Except within the front 15 ft. in which case the height of said wall shall be reduced to 42 inches. 11. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 12. All applicable City Ordinances shall be complied with. Referred by the Planning Commission for review of plot plan and to establish conditions of approval as deemed necessary. The Vice -Chairman read the request. The applicant was present to answer questions. The Acting Secretary advised that a revised plot plan had been submitted. Landscaping was discussed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE CONDITIONAL EXCEPTION SUBJECT TO THE FOLLOWING CONDITIONS: 1. The plot plan received September 16, 1970, shall be the approved layout. 2. Warner Avenue and Nichols Street shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3.
