BOARD MEMBERS PRESENT: Lipps, Spencer, Palin
CONDITIONAL EXCEPTION NO. 70-44 - Continued
Applicant: Richard D. Parry
To permit the following: 1) two
(2), 24 sq. ft. in area, secondary pole signs on front and exterior
side property lines located at a distance less than 100 ft. from the
corner pole sign; 2) two (2) tire displays having more than ten
(10) tires permitted by the Huntington Beach Ordinance Code;
(3) a number of pennants to be used as a permanent display from
light standards to main structure in lieu of such signs being
used as temporary signs for special events such as grand opening,
change of ownership, etc.
The subject property is located at
the northwest corner of Beach Blvd. and Warner Ave.
The hearing was opened to the
audience.
Mr. Parry, applicant, addressed the
Board and answered various questions.
The Acting Secretary advised that
the Planning Commission had reviewed tire storage structures at
their September 29, 1970 study session and instructed the Board of
Zoning Adjustments to review such structures subject to the following
criteria: The structure shall be of compatible material and color
to the existing service station structure. There shall be a maximum
of 1 storage unit per site, which shall not exceed 24 ft. in length
and 8 ft. in height and all sign proposed with said structures shall
be included in the request.
Mr. Parry stated he has no preference
as to the north or south location as shown on the plot plan for the
tire structure. Mr. Parry stated that the service station is of
metal construction.
There being no further comment, the
hearing was closed.
Board discussion followed.
A MOTION WAS MADE BY PALIN A11D
SECONDED BY LIPPS TO APPROVE A PORTION OF C.E. 70-44 for ONE TIRE
STORAGE STRUCTURE AND TO DENY THAT PORTION OF THE REQUEST FOR TWO
SECONDARY POLE SIGNS AND PENNANTS, SUBJECT TO THE FOLLOWING CONDITIONS:
1. Said tire structure shall be located at the southern ext:eme
of the existing building.
2. The strucutre is to be of materials and colors similar to and
compatible with the existing building.
3. The tire structure shall not exceed 24 ft. in length ane_ 8 ft. in
height.

For the following -reasons:
1. The proposed tire -storage structure is not outside display
and/or storage as provided for by Sec. 9432 of the Huntington
Beach Ordinance Code, therefore, this method of tire storage
would be acceptable if treated as a permanent structure on the
site and of type and color of material compatible with existing
structures.
2. The sign ordinance provides sufficient area to properly identify
the service station.

addressed the Board and requested a decision on this application in its
entirety.
There being no other comment, the
hearing was closed.
The Acting Secretary again advised
the Board of the Planning Commission action and criteria of approval
for said storage strucutres.
Board discussion was held. The Board
asked Mr. Parry if he was opposed to a continuance of one week for
decision as the Board felt there was not sufficient information
such as:
Location of existing landscaping, type and color of materials used on
existing building and parking provided on the plot plan for a decision to
be made at that time. Mr. Parry stated he was opposed to a
continuance and that the service station is a ranch style building.
A MOTION WAS MADE BY PALIN AND SECONDED
BY SPENCER TO DENY CONDITIONAL EXCEPTION NO, 70-46, FOR THE REASONS:
1. The plot plan sumbitted with the application has not shown land-
scaping, driveways, parking, etc.
2. Said plans did not show type or color of materials used on
existing building.
3. The applicant would not indicate his preference as'to a location
for the tire storage structure.
4. The applicant requested a decision on this application in its
entirety and expressed his unwillingness to work with the
Board on design and materials to be used in a tire storage
structure.

To permit the outside storage and/or
display of tires within storage structures at three locations.
Subject property located at the north-
east corner of Brookhurst Street and Adams Avenue.
As the applicant was not present,
this item was tabled until later in the meeting.
ADMINISTRATIVE REVIEW NO. 70-15 Continued
Applicant: Bill H. Schultz
To permit the outside display and/or
storage of U-Haul utility trailers and trucks at a service station in
the C2-Community Business District.
The subject property is located at
the southeast corner of Adams Avenue and Magnolia Street.
Mr. Schultz, applicant, addressed
the Board.
The Acting Secretary reviewed with the
Board of Zoning Adjustments the Planning Commission's action taken on
truck and trailer rentals at their study session of September 29, 1970
at which time the Commission stated that such rentals shall be on
an area in addition to the areas for parking, driveways and land-
scaping.
Discussion was held.
A MOTION WAS MADE BY PALIN AND
SECONDED BY SPENCER TO APPROVE ADMINISTRATIVE REVIEW NO. 70-15
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The applicant shall display and store utility trailer rentals
only in the area as outlined on the approved plot plan.
2. The number of utility rentals shall be limited to that number
of trailers which can be stored within area delineated on plot
plan.

southwest corner of Brookhurst Street and Hamilton Avenue.
The applicant was not preseut.
It was the consensus of the Board to table this item until later in
the meeting to allow the applicant time to arrive.

DIVISION OF LAND NO. 70-24 - Continued
Applicant: Lowell D. Zehnder
To permit the division of five, 25'
X 117 1/2 ' lots into two legal building sites.
The subject property located on the
east side of 15th Street approximately 100 ft. north of Walnut Ave.
Mr. Zehnder, applicant, addressed
the Board and answered various questions.
Suggested conditions of approval
were discussed with the applicant.
A MOTION WAS MADE BY PALIN AND
SECONDED BY LIPPS TO APPROVE DIVISION OF LAND NO. 70-24 SUBJECT
TO THE FOLLOWING CONDITIONS:
1. The plot plan received September 16, 1970 shall be the approved
layout.
2. 15th Street and the alley shall be dedicated and fully improved
to City standards at the time each parcel is developed. Improve-
ments shall include street trees, street signs, street lights,
fire hydrants, sewer and water main extensions.
3. Water supply shall be through the City of Huntington Beach's water
system at the time each parcel is developed.
4. Sewage disposal shall be through the City of Huntington Beach's
sewage system at the time each parcel is developed.
5. The water, sewer, and fire hydrant system shall be approved by
the Department of Public Works and Fire Department.
6. The property shall participate in the local drainage assessment
district at the time each parcel is developed.
7. Soil reports as required by the Building Department and the
Department of Public Works shall be submitted to the City prior
to issuance -of building permits.
8. All utilities shall be installed underground at the time each
parcel is developed.
9. Fire alarm system conduit and appurtenances shall be installed

10. A Parcel Map shall be filed with the City and recorded prior to
framing inspection of any structures on any parcel.
11. The Division of Land shall not be effective until an agreement
is signed and recorded agreeing to the conditions liste6 above.
12. A 6 ft. high block wall shall be constructed between parcels
one and two at the time the first parcel is developed.

apartment complex to be located along the side and rear property lines
in lieu of the required 5 ft. setback.

To permit the construction of a 48
unit apartment complex on a 1.32 acre parcel of land in the R4 -
Multiple Family Residence District.

The Acting Secretary advised that the
Planning Commission has requested these items be referred to them for
action as the Planning Commission has received numerous comments from
concerned citizens regarding this development. The applicant stated
they were pressed for time and would like to be heard at the first
possible Planning Commission meeting. Representatives from the United
Methodist Church and the Church of the Latter Day Saints addressed the
Board and stated they were opposed to the vacating of 17th Street or
narrowing the street due to traffic circulation problems near the
churches.

CONDITIONAL EXCEPTION NO. 70-49
Applicant: Leslie G. Williams, Jr.
To permit the enclosure of existing
carports causing a reduction of 1 ft. in the required 25 ft. turning
radius, and a 4 ft. rear yard setback in lieu of the required 5 ft.
The property is located 160 ft. east
of Malaga Lane, on the south side of La Paz Drive, in the R-3 -
Limited Multiple Family Residence District.

The Acting Secretary advised that the
Police Department had reported to the Planning Commission that garage
doors generally cut theft problems.
Discussion was held on the type of
construction. The applicant stated that the exterior walls will be
stucco.
