MINUTES: On motion by Miller and seconded by Duke, the Minutes of the Huntington Beach Plan- ning Commission of August 4, 1970, were accepted as transcribed and mailed by the Secretary. AGENDA ITEMS TO BE CONTINUED: CODE AMENDMENT NO. 70-14 Said amendment proposes to add Section 9730.26 to the Huntington Beach Ordinance Code. The intent of said amendment is to provide, create and maintain a home environment for the care of non -related persons. For the purpose of this section the definition of a family has been modified to eight from five. Care of non -related may be permitted in any residential district subject to the approval of an Administrative Review appli- cation by the Board of Zoning Adjustments. The Acting Secretary explained the proposed amendment. Doug Spickard, Assistant Fire Chief, suggested that this item be continued to a study session in order to further discuss said :proposal. The hearing was opened to the audience. Robert Dingwall, representing the Home Council, stated that they are interested in this amendment and requested that Home Council is furnished with all information available. Betty Sparks, 17101 La Madela Lane, requested continuance. Charles Ivy, a repre- sentative of the Foster Parents of Orange County, stated they did not have time to review the proposed amendment and requested a continuance. Lyon Development Co. 142 lots on �0.3 acres of land, located approximately 990.36 ft. north of Slater Ave. and west of Goldenwest St. Minutes: H.B. Planning Commission October 6, 1970 Page 2 John Spiak, represent- ing the developer, addressed the Commission and stated that there were no objections to the conditions as sug- gested by the staff. A MOTION WAS MADE BY KERINS AND SECONDED BY BAZIL TO APPROVE TENTATIVE TRACT MAP NO. 7290 UPON THE FOLLOWING CONDITIONS AS AMENDED. 1. Tentative tract consists of 142 residential lots and a 2.5 acre park site on 30.3 acres of land situated approximately 825 ft. south of Warner Ave. on the west side of Goldenwest St. 2. The property is master planned for low density resi- dential development and a zone change to rezone the property R1 is in the process"of being -adopted. 3. The Subdivision Committee recommends -approval of Tentative Tract Map No. 7290 upon the following conditions: a) The tentative map received September 28, 1970, shall be the approved layout. b) Grading of lot 143, the proposed park site shall be approved by the Department of Public Works. c) The drainage easements shown on the north property line shall be designed to Department of Public Works specifications to facilitate a pedestrian - walkway or a separate easement as approved by the Department of Public -Works and the Planning Depart- ment shall be provided. d) Wrenfield Dr. shall be 56-ft. wide. e) All "Standard -Conditions of Approval" for tentative tracts that are applicable shall be complied with. Lyon -Development Co. 16 lots on 8.1 acres'of land, located north of Warner Ave., 660 ft-. east of Edwards St. The Commission reviewed suggested conditions for said map. --- --A MOTION -WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE TENTATIVE TRACT MAP NO. 7289 UPON THE FOLLOWING CONDITIONS: - a) The tentative tract map received September 30, 1970, shall be the approved layout. b) Design of the knuckles at the intersections formed by the intersection of "D" St. with "A" St. and "C"-St. shall be approved by the Department of Public Works. c) The flood control channel shall be fenced to Flood Control District Standards and to City, Standards. d) A 6 inch wide, 6 ft. high masonry wall shall be constructed along the east property line. The height of said wall shall be measured from whichever side is higher at finished grade. e) Each owner of a condominium unit_ shall have an equal and undivided interest in the common area (lot "A"). f) Each lot which is to'be a"separate condominium project shall be a part of an overallAssociation for the purpose of maintaining the common areas and of maintaining each condominium project. -2- 10/6/70-PC Minutes: H.B. Planning Commission October 6, 1970 Page 3 g) The CC&R's Articles of Incorporation, By -Laws and Management Contract shall be submitted to the Planning Director and City Attorney for approval. h) The CC&R's shall contain at least the following provisions: 1) Recreation areas within the development shall be reserved for the exclusive use of residents within the project and their non-paying guests. 2) Owners and/or tenants shall,be required to abide by association rules and there shall: be penalties for violation of -said rules. 3) Any interest in the common area held by -the individual parcel or condominium unit owners can not be devised, conveyed or dedicated separate and apart from the devise conveyance, and/or dedication of the individual parcel or condominium unit for a life in being plus 21 years, excepting this may be accomplished under the same conditions or grounds as are available under judicial partition. 4) If the development is constructed in increments or several final maps reciprocal CC&R's and reci- procal management agreement shall be established that will cause a merging of increments as they are completed. The end result shall be one home association with common areas common to all and one management for the entire project. i) All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. A change of zone from RA Residential Agricultural District to R3 Limited Multiple Family Residence District. Located on the north side of Warner Ave. 660 ft. east of the center line intersection of Warner Ave. and Edwards St. The Acting Secretary informed the Commission that this item was originally set for public hearing at the September 15, 1970 metting; however, at the request of the staff the matter was continued to the October 6, 1970 meeting to allow time for Tentative Tract Map No. 7289 to be considered at the same time. The hearing was opened to the audience. John Spiak, representing the applicant, explained the proposal. Mr. Spiak stated that the applicant is in agreement with staff's recom- mendation except item "d" of conditions of approval on Tentative Tract Map No. 7289, requiring a 6 inch wide, 6 ft. high masonry wall shall be constructed along the east property line. Mr. Spiak stated that burden lies on the Post Office portion for said construction. There being no other comment, the hearing was closed. Commissioner Higgins abstained from voting on this item due to conflict of interest. -3- 10/6/70-PC Minutes: H.B. Planning Commission October 6,�1970 Page 4 Commissioner Duke stated that he would prefer that the applicant submits an application for a conditional exception instead of a zone change application, thereby giving the Commission better control of the proposed.development. Video tape was shown of the subject property. Commissioner Duke stated that he was concerned about the appearance and setbacks of the pro- posed development. The Commission held a discussion. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO RECOMMEND APPROVAL OF ZONE CASE NO. 70-16 TO THE CITY COUNCIL FOR THE FOLLOWING REASON: 1. A condition of approval of Tentative Tract Map No. 7019 required that the property be rezoned to R1 Single Family District. Blurock To permit the follow- ing: 1) Construction of a church and related facilities as follows: a) drive-in church to accommodate approximately 95 cars. b) religious education structure. c 950 seat sanctuary.-2) A 17 story -retirement tower having 287 resi- dential units. 3) Off-street parking for the 17 story resi- dential tower to be provided at a ratio of one space for each three residential units in lieu of the required 2 spaces per unit in the RI zone (one space per unit plus z guest parkin space per unit is required in the multiple family zones. 4) 131 off-street parking spaces for the 950 seat sanctuary in lieu of the 317 spaces required by ordinance by allowin5 credit.for the remaining required spaces as follows: a joint use of 48 parking spaces pro- vided for the residential tower. b) joint use of 54 parking spaces provided on adjacent school property. c) 83 on - street parking spaces, Located on the south side of Adams Ave. between 17th and Main Streets, in the R1-0 Single Family Residence District combined with oil production. -4- 10/6/70-PC Minutes: H.B. Planning Commission October 6, 1970 Page 5 Commissioner Bazil stated that he would like to have the answer pertaining to pro- posed construction as the tower is in an earthquake area. William Blurock stated that their consultant analyzed the area for earthquake fault and -they will design the building to avoid such problem. Commissioner Bazil pointed out that an industrial zone exists from Ocean Ave. to Palm Ave. along 17th St. which may be rezoned commercial in the future and that the oil site on the northwest corner of 17th St. and Palm Ave. is zoned commercial. Mr. Bazil felt that the proposed tower would be better for this area than to have detached, low cost housing at some other location in the City. Commissioner Miller agreed with Mr. Bazil's statement. Commissioner Duke stated that this proposal was not good planning at this loca- tion. Commissioner Kerins stated that the applicant is not providing sufficient parking as required by ordinance. Commissioner Bazil stated that he has never voted or agreed to reduced parking -and requested that a use permit appli- cation be submitted to the Board of Zoning Adjustments to indicate all the parking requirements. Vice -Chairman Porter informed the Commission that Commissioner Higgins will abstain from voting due to conflict of interest. Mr. Porter sug- gested that the Commission take separate votes, first on the proposed sanctuary, drive-in church and educational religious structure. Second vote be directed to the 17 story retirement, the off-street parking spaces and joint parking spaces on adjacent school property and on -street parking spaces. COMMISSION RECONVENED: Vice -Chairman called the meeting to order at P. USE PERMIT NO. 70-26 (Referred by Board of Zoning Adjust- ments) Applicant: Donald P. Jones To -permit the con- struction of a service station on a 22,500 sq. ft.-parcel of land in the C4 Highway Commercial District. In Conjunction With DIVISION OF LAND NO.-70-17 Applicant: Donald P. Jones To allow the division of a 5.5 acre parcel of land into four separate parcels. Located on the southeast corner of Slater Ave. and Golden - west St. Commissioner Higgins abstained from voting on Use Permit No. 70-26 and Division=- of Land No. 70-17 due to conflict of interest. - _ The hearing was opened to the audience. Don Jones-, applicant explained the proposal. Mr. Jones stated that the subject property has been zoned -commercial and it should be de- veloped to its highest.and best use, Mr. Jones stated that this property has a great -potential to be developed commercial at this intersection. He suggested that the City review ordinances every so often to see that said ordinances protect the health, safety and welfare of the public. Robert Dingwall, re- presenting the Homeowners Assoc., opposed the request on grounds that it will lead to more problems in the commu- nity if this intersection is developed commercial. There -being no other comment, the hearing was closed. Mr. Tom Severns, De- velopment Coordinator, addressed the Commission -and stated that there is no money available at this time to purchase this property for a park site. The Acting Secretary informed the Commission that Division of Land No. 70-17 does not comply with present ordinances for minimum build- ing site. Discussion was held by the Commission. Commissioner Duke stated that there are 3•existing service stations at Warner and Goldenwest St. because it is a 2 mile inter- section. Commissioner Bazil stated that if this use permit is denied, the valid reason should state that service stations are not allowed at a 2 mile intersec- tion. Also, that this property is zoned commercial because of an old proposed -freeway route. A MOTION WAS MADE BY MILLER TO APPROVE USE PERMIT NO. 70-26 FOR -THE FOLLOWING_ REASON: 1. A MOTION WAS MADE BY BAZIL AND SECONDED BY KERINS TO APPROVE DIVISION OF LAND NO. 70-17 UPON THE FOLLOWING CONDITIONS: 1. Goldenwest St. and Slater Ave. shall be dedicated and fully improved to City standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 2. Water supply shall be through the City of Huntington Beach's water system at the time each parcel is developed. 3. Sewage disposal shall be through the City of Huntington Beach's sewage system at the time each parcel is de- veloped. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 5. Easements for utilities or walkways shall be provided to Department of Public Works standards. 6. All buildings on lots abutting a City easement shall be set back five (5) feet from the edge of such easement. 7. The property shall participate in the local drainage assessment district at the time each parcel is developed. 8. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 9. All utilities shall be installed underground at the time each parcel is developed. 10. Fire alarm system conduit and appurtenances shall be installed by the developer at locations and to speci- fications provided by the Fire Department. 11. A Parcel Map shall be filed with the City and recorded prior to framing inspection of any structures on any parcel. 12. The Division of Land shall not be effective until an agreement is signed and recorded agreeing to the con- ditions listed above. 13. Planning Commission October 6, 1970 Page 8 c CONDITIONAL EXCEPTION NO. 70-46 Applicant: Zehnder and Bovy.-= To permit the construction,,, of a 28 unit apartment complex on_a 17,625 sq. ft. parcel of land in lieu of the maximum 18 units permitted by ordinance in the R4 Multiple Family Residence District. Located on the northwest corner of 15th St. and Walnut Ave. The hearing was opened to the audience. Mr. Zehnder, applicant, addressed the Commis- sion and explained the proposal. Mrs. Bauer, owner of an apart- ment complex on 13th St., -.opposed the request and asked that. the Commission not lower development standards for apartments within this area of the City. Mrs. Bauer stated that the applicant is not providing sufficient -off-street parking and recreational area. There being no other comment, the hearing was closed.. Commission discussion was held. Commissioner Bazil suggested that this application be continued in.order for the Commission to develop standards for the town lot area of the City. Mr. Zehnder did not agree with continuance and requested a decision. It was the consensus that this conditional exception, if approved, would seriously effect implementation of the proposed apartment standards presently being disuussed within the town lot area. A MOTION WAS MADE BY_BAZIL AND SECONDED BY DUKE TO DENY CONDITIONAL EXCEPTION NO.70-46 FOR THE FOLLOWING REASONS: 1. This request does not comply with existing ordinance or the proposed apartment standards for the -town lot area. 2. As of this date, the proposed apartment standards for' this area are not adopted. Sherwood To permit the construction of a 6 ft. high fence to within 1 ft. of the front property line in lieu of the required 15 ft. setback. Located at.10232 Cutty Sark Dr., south side -of Cutty Sark Dr., approximately 250.,ft. east of Matsonia Lane in the Rl Single Family Residence District. The Assistant City Attorney advised the Planning Commission that they could find there was sufficient hardbhip for justification of approval, but that the Planning Commission is not required to do so.1 Video tape of the subject property was shown. The hearing was opened . to the audience. . Michael Meade, representing the applicant addressed the Commission and stated that the applicant is not seeking amendments to the ordinance. Mr. Meade informed the Commission that this is an individual request and the applicant would like to proceed with construction of the pool.' He further pointed out that the applicant has acted in good faith and was not properly informed by'a certain department and a permit has been -issued to construct the pool. -8- 10/6/70-PC } Minutes: H.B. Discussion followed. Commissioner Bazil stated that he feels this request is not setting a precedent for future requests since the Building Department has issued a permit. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO. 70-47 UPON THE FOLLOWING CONDITIONS: 1. A 10 x 10 ft. corner cutoff shall be provided at both corners of the front wall. 2. A detailed plan of the masonry block wall shall be submitted to the Board of Zoning Adjustments for approval. 3. The fence shall be set back 18 inches from the front property line. ROLL CALL VOTE: AYES: Bazil, Higgins, Miller, Duke, Kerins NOES: Porter ABSENT: Slates THE MOTION CARRIED. MINORITY REPORT: Commissioner Porter stated the following: 1. A precedent is being set in this matter, not by a variance to zoning regulations, but by the use of the procedure of granting an exception because of an allegated act of error or omission on the part of a City employee. If the City is truly liable, the correct direction to approach this problem is through the City's Liability Insurance Carrier, and possibly a negotiated settlement. 2. With this variance granted, the applicant can still make claim for damages to the City for its alleged acts because of expenses, delay, etc., that the applicant has had to incur. 3. This is clearly the case of "two wrongs not making - a right." By granting a variance, the problem is compounded instead of alleviated. A swimming pool located in as close proximity to a sidewalk as this one is, may very well be an attractive nuisance if not a target for pranksters and other elements. 4. At present, the applicant's pool project is less than 25% complete, so abatement of the use is realistic. 5. It is also possible, in the future, that City employees might be "lured" into acts of error or omission in order that a claim for variance to zoning regulations might be made. USE PERMIT NO. 70-37 (Referred by Board of Zoning Adjustments Applicant: Tariq M. Shamma Assoc., Inc. To permit the construction of a 48 unit apartment complex on a 1.32 acre parcel of land in the R4 Multiple Family Residence District. In Conjunction With -9- 10/6/70-PC Minutes: H.B. Planning Commission October 6, 1970 Page 10 CONDITIONAL EXCEPTION NO. 70-48 Applicant: Tariq M. Shamma Assoc., Inc. To permit carports within a 48 unit apartment complex to be located along the side and rear property lines in lieu of the required 5 ft. setback. Located at Delaware Ave. between 17th St. and Clay Ave. The Acting Secretary made a presentation of the proposal. Mr. Palin stated that two church groups were concerned with circulation in the area because of the proposed reduction on 17th St. Mr. Palin informed the Commission that the applicant complies with all parking requirements, has a reduction in the number of units permitted on this parcel and that the applicant.has complied with all ordinances -and adopted apartment standards. Bill•Hartge, City Engineer, informed the Commission that his department has reviewed the proposed reduction on 17th St. and can find no need to retain the existing width of 75 ft., as 17th St. was removed from the Master Plan of Arterial Streets and Highways on November 7, 1967. The hearing was opened to the audience. Richard Brown, architect, explained the proposal. It was the consensus of the Commission to continue Use Permit No. 70-37 and Conditional Exception No. 70-48 to the Study Session on October 13, 1970, for a staff report -on said items. Mr. Brown objected to the continuance, stating that'the applicant has complied with all City requirements. A MOTION WAS MADE BY KERINS AND SECONDED BY BAZIL TO CONTINUE USE PERMIT.NO. 70-37 AND CONDI- TIONAL EXCEPTION NO. 70-48 TO A STUDY SESSION ON OCTOBER 13, 1970, TO ALLOW TIME FOR A WRITTEN STAFF REPORT ON SAID APPLICA- TIONS TO BE SUBMITTED TO THE PLANNING COMMISSION. The subject pro- perty is located on the south side of Heil Ave., approximately 230 ft. east of Bolsa Chica St. The Acting Secretary informed the Commission that the staff, including -Police Department have no objections to this request. INFORMATION: Jere Murphy,.Associate Planner, informed the Commission that at the October-13, 1970, Study Session, a presentation will be made regarding an apartment study as it relates to the Master Plan of Land Use and existing zoning. DISCUSSION: Robert Dingwall addressed the Commission and stated t the Commission should pay special attention to vertical structures in the area of the Meadowlark Air- port. Mr. Dingwall -suggested that the Commission meet with the airport committee regarding a future expansion of said facility.
