AGENDA ITEMS TO BE CONTINUED:
CONTRACT ZONING: The Acting Secretary informed the Commission
that tem , ontract Zoning, will be discussed at a later
date.
USE PERMIT NO. 70-37 (Referred by Board of Zoning Adjustments)
To permit the construction of a 48
unit apartment complex on a 1.32 acre parcel of land in the
R4 Multiple Family Residence District.
In Conjunction With
CONDITIONAL EXCEPTION NO. 70-48
Applicant: Tariq M. Shamma Assoc., Inc.
To permit carports within a 48 unit
apartment complex to be located along the side and rear pro-
perty l ries it .lieu of the required 5 ft. setback. Located
on Delaware Ave., between 17th St. and C1ay.Ave.
The hearing was opened to the
audience.
- Mr. Daniel, architect representing
the applicant, addressed the Commission and explained the
proposal, stating that the applicant is not asking for any
changes and would like to see 17th Street remain at its exist-
ing width and remain open. Edward Ernie, Pastor of First
Methodist Church, stated -that he is not opposed to the apart-
ment project but is concerned with a reduction in the right-of-
way width on-17th St. --and the possibility of closing -said
street, because-it.is a major street which.serves-several
churches in the area." Richard Brown, Bay*Port Financial Co.,
addressed the Commission and requested approval of the proposal.
There being no other comment, the
hearing was closed.
Commission discussion was field.
Chairman Slates stated that he
feels this zoning is wrong for this area. Commissioner Miller
stated that the people paid taxes based on the-R4 zoning and
the request should be granted. Commissioner Bazil stated
that he agreed with Chairman Slates' statement, but if -people
bought this property as R4, the Commission does not have the
right to deny this use permit.
A MOTION WAS MADE BY BAZIL AND
SECONDED BY PORTER TO APPROVE USE PERMIT NO. 70-37 UPON THE
FOLLOWING CONDITIONS:
1. Use Permit No. 70-37 stiall' be referred to the Board of
Zoning Adjustments to establish such conditions of appro-
val as deemed necessary.

2. The applicant shall submit an amended plot plan indicat-
ing that he will comply with the existing 75 ft. right-
of-way on 17th St.

PRECISE PLAN OF STREET ALIGNMENT NO. 70-7
Bill Hartge, City Engineer,
made a presentation and showed topographic maps of the Central
City Park and alternate routes for rerouting Talbert Ave.
between Gothard and Edwards.Streets. Mr. Hartge explained
the cost breakdown of rerouting Talbert Ave. on the different
alignments.
The Commission reviewed the
proposal.

AND SECONDED BY PORTER TO INSTRUCT THE SECRETARY TO SET PRE-
CISE PLAN OF STREET ALIGNMENT NO. 70-7 FOR PUBLIC HEARING ON
NOVEMBER 3, 1970.

DISCUSSION: Permitted densities in the R2 and R3 Zone
Interim Revisions to Master Plan
The Acting Secretary informed
the Commission that on October 5, 1970, the City Council re-
quested that the Planning Commission review the possibility of
lowering the density rate in the R2 and R3 zones. The Commission
reviewed a report which revealed past density standards and sub-
sequent changes made since 1964.in residential zones due to Plan-
ning Commission and City Council actions.
Ron Slade, Assistant Planner,
made a presentation on population and unit projections for the
various zones based on existing population densities.. Mr. Slade
reviewed with the Commission the existing Master Plan and exist-
ing Land Use which revealed a decline in the people per multiple
unit and a large reduction in the inventory of vacant land master
planned or zoned multiple family residential.
Commissioner Bazil stated
that he felt there should be more open space -provided in
multiple developments. Chairman Slates suggested that the
staff prepare a breakdown of the master plan of land use maps
into three areas.
COMMISSIONER PORTER: Commissioner Porter was excused from
further participation at 3:00 P.M.
DISCUSSION: Precise Plan of Street Ali nment - Warner Ave.,
east and west ot BeactiBlvd.
- Bill Hartge, City Engineer,
made a presentation on said proposal. Mr. Hartge stated that
this proposal will -move the existing southerly right-of-way
of Warner Ave. 20 ft. to the south for a distance of 500 ft.
west and 950 ft. east of Beach Blvd.
The Commission reviewed
the proposal.

ALIGNMENT FOR PUBLIC HEARING.

Jere Murphy, Associate Planner,
informed the Commission that -this matter is quite impor-
tant and it should be set for public hearing as soon as
possible.

SECONDED BY KERINS TO INSTRUCT THE SECRETARY TO SET PRE-
CISE PLAN NO. 70-4 FOR PUBLIC HEARING NOVEMBER 3, 1970.
