WEDNESDAY, OCTOBER 14, 1970 BOARD MEMBERS: McFarland, Spencer, Palin CONDITIONAL EXCEPTION NO. 70-49 - Continued Applicant: Lloyd A. Mannes To permit the following: 1) the construction of an automotive diagnostic center, 2) the construction of a drive-thru restaurant. In coniunction with USE PERMIT NO. 70-39 - Continued Applicant: Lloyd A. Mannes To permit a driveway to encroach 7-1/2 ft. into the required 25 ft. landscape area. The subject property is located at the northeast corner of Blaylock and Beach Blvd. This item was tabled until later in the meeting to allow the applicant time to arrive. USE PERMIT NO. 70-38 Applicant: George H. McCallum To permit a dog grooming salon in the C4 Highway Commercial District. The subject property is located on the east side of Beach Blvd., approximately 500 ft. south of Heil Avenue. The Chairman read the request and opened the hearing to the audience. Mr. McCallum, applicant, addressed the Board and stated that there had been a previous dog grooming salon on the same property. The Acting Secretary advised that this use is permitted by Ordinance 1602 which was effective September 8, 1970. The parking layout was discussed and it was found that the striped parking conforms to Article,979 of the Huntington Beach Ordinance Code. There being no other comment, the hearing was closed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 70-38 FOR THE FOLLOWING REASON: 1. CONDITIONAL EXCEPTION NO. 70-51 Applicant: J. H. Eggleston To permit the construction of a family room having a rear yard setback of 8 ft. in lieu of the required 10 ft. and causing a reduction in the required 900 sq. ft. of open space to 690-sq. ft. The subject property is located on the East side of Victoria Lane, approximately 80 ft. north of McFadden Avenue in the R1 Single Family Residence District. The Chairman read the request and opened the hearing to the audience. Mr. Eggleston, applicant, addressed the Board and stated that the property which backs onto the subject lot has a swimming pool and therefore probably would not ask for an additional setback. The Acting Secretary reviewed the Planning Commission's intent upon adopting the rear yard setback ordinance. The applicant stated he felt there was a hardship due to the configuration of the lot and the placement of the house on the lot. Discussion was held regarding the required open space on the lot. There being no further comment, the hearing was closed. Board discussion was held. The Board felt this variance would set a precedent. It was felt that additional information was needed on the plot plan. A MOTION WAS MADE BY MC FARLAND AND SECONDED BY PALIN TO CONTINUE CONDITIONAL EXCEPTION NO. 70-51 TO THE OCTOBER 21, 1970 MEETING TO ALLOW THE APPLICANT TIME TO PROVIDE FLOOR PLANS OF THE EXISTING STRUCTURE AND TO REVISE THE PLOT PLAN. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None ABSENT: None THE MOTION CARRIED. USE PERMIT NO. 70-37 - Referred back by Planning Commission for conditions. Applicant: Tariq M. Shamma Assoc. Inc. To permit the construction of a 48 unit apartment complex on a 1.32 acre parcel of land in the R4 - Multiple Family Residence District. The Acting Secretary informed the Board that these items were referrred back to the Board by the Planning Commission for conditions as deemed necessary. The hearing was opened to the audience. Mr. Richard Brown, property owner, and Mr. Daniels, representative of Tariq M. Shamma Assoc., Inc., architects, were present. Discussion was held pertaining to the parking layout, open space requirements, etc. The property owner requested a continuance to submit a revised plot plan. There being no other comment, the hearing was closed. A MOTION WAS MADE BY SPENCER AND SECONDED BY PALIN TO CONTINUE USE PERMIT NO. 70-37 AND CONDITIONAL EXCEPTION NO. 70-48 TO THE OCTOBER 21, 1970, MEETING TO ALLOW THE APPLICANT TIME TO SUBMIT REVISED PLOT PLANS. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None ABSENT:None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-49 - Continued Applicant: Lloyd A. The applicant was not present. THE CHAIR CAST A UNAMIOUS VOTE FOR CONTINUANCE OF CONDITIONAL EXCEPTION NO. 70-49 AND USE PERMIT NO. 70-39 TO THE OCTOBER 21, 1970, MEETING.
