Mannes To permit a driveway to encroach 72 ff. into the required 25 ft. landscape area. In Conjunction With USE PERMIT NO. 70-39 - Continued Applicant: Lloyd A. Mannes To permit the following: 1) the construction of an automotive diagnostic center, 2) the construction of a drive-thru restaurant. The subject property is located on the northeast corner of Blaylock and Beach Blvd. The hearing was opened to the audience. Lloyd Mannes, applicant, addressed the Board and explained the revised plans which had been sub- mitted to the Planning Department. He explained that the use permit request had been changed to omit the drive-thru restaurant. The Acting Secretary advised that the use permit request has been substantially changed to the extent that readvertising of the request would be necessary before action could be taken. He explained that the prior re- quest had been for encroachment of a driveway, whereas, the present request is for encroachment of a permanent structure. There being no further comment, the hearing was closed. Board discussion was held. The suggested conditions of approval were reviewed and amended. CONDITIONAL EXCEPTION NO. 70-50 Applicant: Lloyd A. Mannes To allow 4 tandem parking spaces to be used as a portion of the required parking for an office and dental building in the C4 - Highway Commercial District. In Conjunction With ADMINISTRATIVE REVIEW NO. 70-50 Applicant: Lloyd A. Mannes To permit the construction of an office and dental building in the C4 - Highway Com- mercial District. The subject property is located on the west side of "A" Street approximately 170 ft. south of Warner Avenue. The Chairman read the request and opened the hearing to the audience. Mr. Mannes, applicant, addressed the Board. Discussion was held re- garding the curb break on A Street, and backing of traffic onto the street instead of a turning radius. It was felt by the Board that there was insufficient justification for such a variance. The applicant felt he would like to revise his plans and requested a two week continuance. There being no further comment; the hearing was closed. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-51 - Continued Applicant: J.H. Eggleston To permit the construction of a family room having a rear yard setback of 8 ft. in lieu of the required 10 ft. and causing a reduction in the required 900 sq. ft. of open space to 690 sq. ft-. The subject property is located on the east side of Victoria Lane, approximately 80-ft. north of McFadden Avenue in the R1 Single Family Residence District. The Acting Secretary advised that this item had been continued from the previous meeting to allow --the applicant -time to submit a revised plot plan and floor plans. Mr. Palin stated that the applicant has submitted the revised plans. The hearing was opened to the audience. Mr. Eggleston, applicant, addressed the Board and explained the revised plans. He showed that the open space was now reduced to 785 s_q.,..ft.; whereap, the previous request had been for 690 sq. ft. There being no further comment, the hearing was closed. Board discussion was held. The Acting Secretary advised there must be a finding of fact before granting a variance. He stated that he feels a reduction of the rear yard setback in this case would set a precedent and that there is not sufficient justifi- cation to grant the variance. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE THAT PORTION OF THE REQUEST FOR 785 SQ. FT. OF OPEN SPACE AND TO DENY THE PORTION_OF SAID RE- QUEST FOR AN 8 FT. REAR YARD SETBACK, FOR THE REASONS: 1. The,reduction of open space allows for alignment of the room addition with the interior walls of.the.home. 2. The applicant is providing 250 sq. ft. of open space in the side yard, which compensates for the smaller rear yard open- space. Board of Zoning Adjustments Wednesday, October 21, 1970 Page No. 4 CONDITIONAL EXCEPTION NO. 70-52 Applicant: Pacifica Hospital and Huntington Beach Convalescent Hospital To allow a 32 inch high masonry screen wall to be located at 110" setback at the edge of the driveways in lieu of the required 5 ft. setback for sight clearance. The subject property is located on the west side of Florida Street, 900 ft. north of Garfield Avenue in the R5 Office -Professional District. The Chairman read the request and opened the hearing to the audience. .. L - . _ t Bob Zingrabe, represent- ing the applicant, stated that the contractor, when con- structing the masonry wall, had inadvertently built the wall at a 110" setback instead of the required 5 ft. setback. He also stated that the landscaping, etc. is already in, in- cluding wheel stops in all the parking stalls which are 900 spaces abutting the masonry wall. He stated that he feels the layout is aesthetically pleasing. There being no further comment, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEP- TION NO. 70-52 FOR THE FOLLOWING REASONS: 1. 900 parking stalls abut the wall which adds a margin of protection for the wall. 2. To permit the construction of a 400 unit apartment complex on approximately 17.45 acre - parcel of land in the R3 Limited Multiple Family Residence District. The subject property is located on Terry Drive, 530 ft. west of the centerline of Beach Blvd., and 735.25 ft. north of the centerline of Warner Avenue. - , •• The Chairman read the request and opened the hearing to the audience. -4- 10/21/70 - BZA Minutes: H.B. He also notified Raymond Miller, present to represent the applicant, that a conditional exception is required for the requested 110" sideyard setback on the carport construction. There being no further comment, the hearing was closed. A MOTION.WAS MADE,BY SPENCER AND SECONDED BY MCFARLAND TO REFER USE PERMIT NO. 70-40 TO THE PLANNING COMMISSION MEETING TO BE HELD ON NOVEMBER 3, 19709 AT 7:00 P.M. IN THE COUNCIL CHAMBERS, CIVIC CENTER. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-53 Applicant: Donald W. Sternberz To permit the construction of a two car front entry garage to set back 1716" in lieu of the required 221. The subject property is located on the west side of Lexington Lane, approximately 265 ft. from Cutty Sark Street. The Chairman read the request and opened the hearing to the audience. Mr. and Mrs. Lindsey, owners of subject property, addressed the Board and explained the request. They stated that they felt the proposed location of the family room is the best suited for view, air circulation, etc. Mr. McFarland advised that the City code required either 22 ft. or 72 ft. setback due to cars parking,in the driveway and overhanging onto the sidewalk. He explained that with a 72 ft. setback, cars could not park in the driveway without overhanging the street. Right-of-way also, such 72 ft. setback was for new construction only. Discussion was held. There being no further comment, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO DENY CONDITIONAL EXCEPTION NO. 70-53 FOR THE FOLLOWING REASONS: 1. There appears to be sufficient area in the rear yard for the room addition. 2. The subject property is located on Delaware Avenue between 17th Street and Clay Avenue. the audience. 'A MOTION WAS MADE -BY PALIN' AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 70-37 WITH THE FOLLOWING CONDITIONS: 1. The plot plan received October 21, 1970 shall be the approved layout. 2. Delaware and Seventeenth Street and Clay Avenue shall be deditated and -fully -improved to City standards at the time said parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district. 7. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. 8. All utilities shall be installed underground. 9. Fire alarm system conduit and appurtenances shall be in- stalled by the developer at locations and to specifications provided by the Fire Dept. 10. Off-street parking facilities shall conform to Article 979. 11. A masonry wall shall be constructed along the east and south property lines. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. Except within the required front yard setback in which case the height of said wall shall be reduced to 42 inches. 12. There shall be no fence, structure or landscaping constructed or maintained over 32 feet high within a 10 ft. by 10 ft. triangular area at the intersection of driveways and streets or within a 25 ft. by 25 ft. triangular area at the intersection of streets. 13. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 14. A lighting system shall be installed within the project equal in illumination to lighting on public streets. A lighting plan shall be submitted to the Department of Public Works for approval. 15. The structural street section of all private drives shall be approved by the Department of Public Works. 16. All applicable City Ordinances shall be complied with. 17. A 10 ft. easement shall be provided along the south property line for drainage with encroachment of one unit, carports and miscellaneous patios to be constructed over said easement.
