ZONE CASE NO. 70-6 (Continued) Applicant: Russell S. Penniman & Co., Inc. Change of Zone from R5 Office -Pro- fessional District, C2 Community Business District and RA Residential Agricultural District to MH Mobilehome District. Located west of Brookhurst St., 800 ft. south of Garfield Ave. The hearing was opened to the audience. Russ Watson, manager of the adjacent mobilehome park to the south, sp6ke in favor of the request. There being no other comment, the hearing was closed. Commission discussion was held. A MOTION WAS MADE BY KERINS AND SECONDED BY BAZIL TO RECOMMEND APPROVAL OF ZONE CASE NO. 70-6 FOR MH ZONE RATHER THAN R5 TO THE CITY COUNCIL FOR THE FOLLOW- ING REASONS: 1. Soil conditions are such that residential uses other than mobilehomes will be difficult to develop.__-_, 2. The subject property abuts a mobilehome park to the south. 3. This is unique property to develop, because it is divided by the Edison easement, and will prevent strip zoning south of the Edison right-of-way. ROLL CALL VOTE: AYES: Kerins, Bazil, Higgins, Slates, Miller - NOES: None ABSENT: Porter, Duke THE MOTION CARRIED. TENTATIVE TRACT MAP NO. 7286 Subdivider: Shappell Industries, Inc. 94 lots on 20 acres of land located at the northeast corner of Indianapolis Ave. and Bushard St. The Commission reviewed the suggested conditions for said tract. Commission discussion followed. A MOT ION- WAS MADE BY MILLER` AND - SECONDED BY BAZIL TO APPROVE TENTATIVE TRACT MAP NO. 7286 UPON THE FOLLOWING CONDITIONS: 1. The tentative map received October 7, 1970 shall be the approved layout. 2. A petition for rezoning to R1 shall be filed prior to submitting a final map to the City Council for acceptance. 3. A division of land application separating the proposed school and park site from -the property shown on this tentative map shall be filed with the City and approved and the conditions of approval complied with; or, such property shall be included as a numbered lot on the final tract. Verdant Drive shall be extended westerly and 2 of the street shall be improved to provide vehicular access to the east. 6. TENTATIVE TRACT MAP NO. 6151 In Conjunction With USE PERMIT NO. 70-41 Applicant: Palos Verdes Developers 150 unit planned residen- tial development on 10 acres of land, located on the south side of Heil Ave., 1300 ft. west of Bolsa Chica St. The hearing was opened to the audience. There beingno comment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY KERINS AND SECONDED BY BAZIL TO APPROVE USE PERMIT NO. 70-41 UPON THE FOLLOWING CONDITIONS: 1. The tentative tract and development plan received October 27, 1970 shall be the approved layout. 2. All streets within the project shall be private streets. 3. The design of the intersection of the private streets with public streets shall be approved by the Department of Public Works. 4. If the sewer and water facilities are to be dedicated to the city, a 10 ft. wide easement shall be dedicated to the city for access and maintenance of such sewer and water facilities. 5. Tree planting equivalent to one 30 in. box tree .per unit shall be provided. A plan showing such tree planting shall be approved by the Planning Department: 6. Le Grand Lane shall be extended southerly to Prairie Drive as a public street and shall be designed and constructed according to Department of Public Works requirements. 7. Facilities for storing equipment and materials re- quired by the association for maintenance of the pro- ject shall be provided. Such areas shall -be shown .on the plot plan prior to issuance of building permits. 8. All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. Construction Co. To permit the construction of a 400 unit apartment complex on approximately 17.45 acre parcel of land in the R3 Multiple Family Residence District. Located on Terry Drive, 530 ft. west of -the centerline of Beach Blvd., and 735.25 ft. north of the centerline of Warner Ave. ' . The Acting Secretary made a presenta- tion of said request. Mr. Harlow stated that this application was referred to the Commission by the Board of Zoning Adjust- ments at the Commission's request. Mr. Harlow informed the Commission that the proposed apartment complex will be oriented to the east and front on a proposed street which had been reviewed by the Commission at the September 29, 19.70 study session. Mr. Harlow stated that the Department of Public Works is pre- pared to present additional information on said precise plan of street alignment for this area at this meeting. Mr. Harlow informed the Commission that the Ocean View School District has expressed a desire to have a pedestrian bridge over the 100 ft. flood control channel on the northwest side of this project to provide access for children from this project to get to Sun View School on the north side of Heil Ave. COMMISSIONER PORTER: Commissioner Porter arrived at 7:20 P.M. and assume his -du -ties. The hearing was opened to the audience. Al Fiddler, W.B. Construction Co., reviewed the plan with the Commission and informed them that some guest parking is available in front of the project on the proposed street. Commissioner Higgins asked Mr.Fiddler about vehicular access within the project. Mr. Fiddler stated -3- 11/3/70-PC Minutes: H.B. Planning Commission November 3, 1970 Page 4 that access would be from the proposed street and parking will be provided approximately 200 ft. away from the units for the safety of children. Commissioner Higgins then asked about recreational area. Mr. Fiddler stated that they want to provide small recreational areas next to the laundry facilities. Commissioner Kerins stated that the Planning Commission should come up with appearance standards for apartment projects and suggested that elevations should be submitted for review. Discussion was held re- garding recreational facilities for children. Mr. Miller, Area Manager for the project, discussed the proposed re- creational facilities. -There being no other com- ment, the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY KERINS AND SECONDED BY PORTER TO DENY USE PERMIT NO.70-40 FOR THE FOLLOWING REASONS: 1. No renderings were submitted regarding the layout and design of the project. 2. Parking should be distributed better. 3. More usable open space and play area should be provided. Commissioner Bazil stated that if this application is denied, no other application for an apartment project can be filed for one year. Commissioner Kerins then amended his motion to continue Use Permit No. 70-40 to December 1, 1970. Commissioner'Porter seconded the amendment for continuance of Use Permit No. 70-40 with the applicant's consent for the following reasons: 1. Renderings shall be submitted to determine appearance and design of the buildings. 2. A revised plot plan shall be submitted indicating more usable open space which relates better to the units. 3. Guest parking shall be relocated to better relate to the units. ROLL CALL VOTE: AYES: Bazil, Higgins, Slates, Miller, Porter, Kerins NOES: None ABSENT: Duke THE MOTION CARRIED. ZONE CASE NO. 70-19 Applicant: Wilson W. Phelps & Arthur D. Phelps - -Change of zone from R2 Two Family Residence District to MH - Mobilehome District. Located on the north side of Heil Ave., between Saybrook Ln. and Algonquin St. The hearing was opened to the audience. Mr. McCall,'general contrac- tor and developer explained the proposal.- Mr. McCall stated that a soil report will be submitted to the Department of Public Works for approval. John Phelps, representing Wilson and Arthur Phelps, owners of the subject property, stated that the proposed mobilehome park will be compatible with surrounding development. Harry Berford,- representing Huntington Harbour Homeowners Assoc:, addressed the Commission and stated that the applicant has not demonstrated sufficient hardship. Commissioner Slates informed Mr. Beford that a -4- 11/3/70-PC Minutes: H.B. Planning Commission Page 5 November 3, 1970 hardship is not required. - Mr.-Berford stated that an R2 zone would be more suitable for the area. Mr. McCall stated that they are proposing a 125 unit 5 star mobile - home park on the subject property. There being -no other comment, the hearing was closed. - Commission discussion was held. A MOTION WAS MADE BY HIGGINS-AND SECONDED BY KERINS TO RECOMMEND APPROVAL OF ZONE CASE NO. 70-19 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. Under present zoning, the property could be developed into a multiple family development having 336 units and the applicant proposes only a 125 space mobilehome park, which will generate less population density. 2. The applicant has complied with the criteria for a MH zone. 3. Property to the north is developed as a mobilehome park. 4. The proposed mobilehome park will be compatible with surrounding development. ROLL CALL VOTE: AYES: Bazil, Higgins, Slates, Miller, Porter, Kerins, Duke NOES: None ABSENT: None THE MOTION CARRIED. - PRECISE,PLAN OF STREET ALIGNMENT NO. 70-4 Said plan proposes to precise plan the street alignment for Orange Ave. east (Olive Ave.), Orange Ave. west, Lake St. and Atlanta Ave. at their inter- section._ The hearing was opened to the audience. - Elsie Smith, owner of property loca- ted at the southwest corner of Lake St. and Olive Ave., stated that her property was in escrow to be sold when she learned of the city's intent to adopt a new street alignment. Mrs. Smith stated that"she was concerned with the Commission's decision on said alignment. ' Bill Hartge, City Engineer, informed Mrs. Smith that it will be some time before the property is acquired for street right-of-way. COMMISSIONER DUKE: Commissioner Duke arrived at 8:00 P.M. and assume is uties. Mrs. Smith stated that this proposed street will discourage potential buyers. Commissioner Bazil stated that he feels 2nd Street should be terminated at Lake St. Mr. Hartge agreed with Mr. Bazil's suggestion but stated that it should not be shown on a map. , Commissioner Higgins asked Mr. Hartge if Olive Ave. will remain 60 ft. wide. Mr. Hartge informed Mr. Higgins that Olive Ave. will remain 60 ft. wide and Orange Avenue, 75 ft. wide. There being no other comment, the hearing was closed. A MOTION WAS MADE BY SLATES AND SECONDED BY PORTER TO RECOMMEND APPROVAL OF PRECISE PLAN OF STREET ALIGNMENT NO. 70-4 ALTERNATE #1 TO THE CITY COUNCIL. Planning Commission November 3, 1970 Page 6 PRECISE PLAN OF STREET ALIGNMENT NO. 70-7 -Said plan proposes to pre- cise plan the alignment of Talbert Ave. between Gothard and Edwards Streets. __ The hearing was opened to the audience. There being no comment, the hearing,was closed. The Commission held a dis- cussion. Commissioner Porter stated that he would like to see a rendering showing the proposed tunneling of Talbert Ave. and treatment of landscaping in the park. Commissioner Slates stated that the Commission should -have -a joint meeting with City Council to discuss this alignment. Commissioner Higgins requested that Department of Public Works include in their report the land -acquisition cost for these various street alignments. It was noted that HUD finan- cing could not be used to purchase street right-of-way within the Central City Park. Commissioner Duke stated that he feels a continuance is meaningless unless the City Council will meet with the Commission to discuss said align- ment. The Planning Director informed the Commission that the City Council will be discussing the Library Master Plan on November 19th; therefore, the Planning Commission should meet prior to November 19th or request the City Council not to make a decision until after a joint meeting is held. Chairman Slates appointed Commissioner Porter.and Commissioner Higgins to a Sub -Com- mittee to present said proposal to the City Council.. Bill Hartge, City Engineer, suggested that the Library Committee be invited to participate. A MOTION WAS MADE BY SLATES AND SECONDED BY KERINS TO CONTINUE PRECISE PLAN OF STREET ALIGNMENT NO. 70-7"FOR DECISION ONLY -TO ALLOW TIMETO DIS- CUSS SAID -PLAN WITH THE CITY COUNCIL. - ROLL CALL VOTE: AYES: Bazil, Higgins, Slates, Miller, Porter, Kerins, Duke NOES: None ABSENT: None THE MOTION CARRIED. PRECISE PLAN NO. 70-8 Said plan proposes to move the existing southerly right-of-way of Warner Ave. 20 ft. to the south for a distance of 500 ft. west and 950 ft. east of Beach Blvd. The hearing was opened to the audience. There being no comment, the hearing was closed. Commission discussion was held. A°MOTION WAS MADE BY PORTER AND SECONDED BY MILLER TO RECOMMEND APPROVAL OF PRECISE PLAN NO. 70-8 TO THE CITY COUNCIL. ROLL CALL VOTE: AYES: Bazil, Higgins, Slates, Miller, Porter, Kerins, Duke NOES: None ABSENT: None THE MOTION CARRIED. INFORMATION: The Planning Director reviewed with the Commis- sion a memo submitted by the City Attorney's office to the City Council, regarding a suggestion to remove arbitrary re- strictions on height, setbacks, use, etc.-, from the planning -6- 11/3/70-PC Minutes: H.B. Planning Commission November 3, 1970 Page 7 ordinances. Mr. Reynolds stated that this memo was referred to the Commission by the Council with instructions to pro- ceed on said proposal. INFORMATION: The Acting Secretary informed the Commission that the sty Council at their September 28, 1970 meeting, directed the City Attorney's office to prepare a code amend- ment that will require administrative approval of applica- tions filed with the Planning Department. The Acting Secre- tary read the following amendment as submitted by the Attorney's office: "The Planning Director or his representa- tives shall refuse to accept for filing any applications required to be filed with the Planning Department, which said application does not contain information required to be provided or improperly filled out". The Planning Commission instructed the City Attorney to prepare said amendment. PROGRESS REPORT: The Planning Director submitted a progress report on w at has been done in this area pertaining to use permits, contract zoning, MH zones, planned residential, town center, destination resort, high rise ordinance and floating zone or overlay. Mr. Reynolds suggested that this report should be transmitted to the City Council. INFORMATION: Jim Palin, Associate Planner, informed the ommission that an application has been submitted to the Board of Zoning Adjustments for a car wash within an exist- ing service station at the corner of Edinger Ave. and Sher Lane, and asked if it is the Commission's desire to review said application. Commissioner Kerins requested that said application be reviewed by the Planning Commission. DISCUSSION: Commissioner Bazil suggested that a committee of one s ould be appointed to study block walls, bumpers, etc., in landscaped area along front property line. Chairman Slates appointed Commis- sioner Bazil to committee of one. Commissioner Kerins questioned the status of progress being made regarding removal of subdivi- sionr.directional signs. Willis Mevis, Assistant City Attorney, informed Mr. Kerins that he will have a definite answer in 30 days. Also, that the Building Department is making all efforts to remove non -conforming directional signs. Commissioner Porter asked Mr. Hartge if a traffic signal at Beach Blvd. and Edinger Ave. would be changed before Christmas.
