MINUTES: On motion by Porter and seconded by Kerins, the
Minutes of the Huntington Beach Planning -Commission
of September 15, 1970 were accepted as transcribed and mailed
by the Secretary.
ZONE CASE NO. 70-23
Applicant: La Cuesta
A change of zone from RA-0 Residen-
tial Agricultural District combined with oil production to R5
Office -Professional District. Located on the northwest corner
of Brookhurst St. and Atlanta Ave.
The hearing was opened to the
audience.
Herbert Crawford, 10102 John Day Dr.,
Huntington Beach, addressed the Commission and stated that he
was concerned with the future use of said parcel and whether
it will be designed to blend in with the area.
COMMISSIONER DUKE: Commissioner Duke arrived at 7:10 P.M.
and assumed his 11ties.
There being no other comment, the
hearing was closed.
Commission discussion was held.
Commissioner Porter stated that he is opposed to commercial
zoning because there is existing commercial property to the
east across Brookhurst St. and that the parcel is too small
to properly develop.
A MOTION WAS MADE BY KERINS AND
SECONDED BY BAZIL TO RECOMMEND DENIAL OF ZONE'CASE NO. 70-23
TO THE CITY COUNCIL FOR THE FOLLOWING REASONS:
1. The proposed zone change violates the Master Plan of
Land Use for low density residential.
2. Applicant has not given any substantive reasons for
granting the zone change.

192 'ft. north of Heil 'Ave.
Chairman Slates excused himself

The hearing was opened to
Roger Slates, representing
the applicant, offered to answer questions. Mr. Slates in-
formed the Commission that the church will retain ownership
of the rear 170 ft. of this parcel to be used for church park-
ing. He also stated that the church is willing to reduce the
depth of the commercial zoning to 150 ft.
Mr. Edward Schaad, 16542
Los Verdes Lane, Huntington Beach, informed the Commission
that he is interested in purchasing the south 100 ft. of
the property and requested approval of the zone change.
There being no other comment,
the hearing was closed.
Commissioner Bazil stated
that he is concerned with strip zoning if this request is ap-
proved. Commissioner Duke stated that he is opposed to addi-
tional commercial zoning at this location, because t1jere is
no need for commercial at the � mile intersection; also, if
approved, it would allow a commercial use across the street
from school property. Commissioner Porter stated that he feels
the request is reasonable, because the subject parcel is too
large for a church facility. Commissioner Kerins stated that
the church knew the property was zoned R1 when they purchased
the land.
A MOTION WAS MADE BY BAZIL
AND SECONDED BY KERINS TO RECOMMEND DENIAL OF ZONE CHANGE NO.
70-24 TO -THE CITY COUNCIL FOR THE FOLLOWING REASONS:
1. The proposed zone change does not conform to the Master
Plan of Land Use.
2. There is no need for additional commercial zoning at this
location.

ZONE CASE NO. 70-25
Applicant: Robert Taube
A change of zone: Parcel I:
From C4 Highway Commercial District to R2 Two Family Rer since
District. Parcel II: From R2 Two Family Residence District
to C4 Highway Commercial District with a 50 ft. setback from
the ultimate right-of-way line. This zone change represents
a minor adjustment between the R2 and C4 zones. Located on
the south side of Hamilton Ave., approximately 500 ft. east
of Bushard St.
The hearing was opened to
the audience.
Mr. Shearer, 9662 Clearbrook
Drive, addressed the Commission and opposed the request
because the subject property backs onto his property; :also,
he would prefer the area to be developed with single story
structures. Mr. Schuman, 21521 Archer Circle,'stated that
he is concerned with multi -story structures abutting the
existing R1 development.

- John Anderson, stated that he is
concerned with the proposal, because the area is already
crowded with multiple development. Mr. Anderson stated
that he would like to see what the developer is proposing.
Chairman Slates informed Mr. Anderson that the Commission
cannot consider plans at this time, because it is a zone
change application, but that a use permit application would
have to be approved for the apartment development and resi-
dents in the area would be informed when the application
is heard. Chairman Slates instructed the staff to notify
property owners on both sides of Clearbrook and Archer at
the time a proposed development is set for public hearing
before -the Board of Zoning Adjustments.
A MOTION WAS MADE BY BAZIL AND
SECONDED BY MILLER TO RECOMMEND APPROVAL OF ZONE CASE NO.
70-25 TO.THE_CITY COUNCIL FOR THE FOLLOWING REASONS:
1. Parcel I has an unusual shape and,should be developed
in conjunction with the R2 property.
2. The additional commercial property -will not create an
excessive amount of commercial property for this area.
3. This zone change will create better and more usable
parcels.
4. This zone change will reduce the number of apartments
allowed under the present zone classification because
the amount of R2 acreage will be reduced.

USE PERMIT NO. 70-46 (Continued - Referred by Board of Zoning
Adjustments) -
AppEicant: W.B. Construction Co.- -- - - -
To permit the construction of a
400 unit apartment complex on approximately 17.45 acre parcel
of land in the R3 Multiple Family Residence District. Located
on Terry Drive, 530 ft. west of the centerline of Beach Blvd.,
and`735.25 ft. north of the centerline of Warner Ave.
The Chairman re -opened the hearing
to the audience.
Roger Howell, representing the -
applicant, explained the proposal. The applicant submitted
revised plot plans and renderings to the Commission. -
-- , - - There being. no_ other comment, the
hearing was,closed.
Commission discussion was held.
Commissioner Kerins questioned -
what provisions were made for a pedestrian bridge. Mr.Kerins
stated that he feels the present means of access to school
is undesirable.
The Acting Secretary informed
Mr. Kerins that the only way to acquire the property for
pedestrian bridge would be for the City to purchase said
property. Mr. Hartge, City Engineer, stated that he was
concerned about acquiring this property for pedestrian
bridge because it is only a 10-ft.,easement and would not
be sufficient for construction of said bridge.
Allen Fiddler, architect, informed
the Commission that children in the proposed development
will have sufficient green area and beams will be installed
to slow down the traffic within the complex.

Commissioner Duke stated
that he was -concerned with open carports because of vandalism.

` - Doug Spickard, Assistant
Fire Chief, stated that the Fire Department would prefer
that the developer construct a street across the center of
the project to connect the east -west drives along the north
and south property lines.
Commissioner Kerins further
stated that he was concerned with all elevations and details
regarding all sides of the exterior on said project. , ,
Bill Carlson, Attorney,
representing the applicant, stated that the property has
been zoned R3 several years ago, and requested approval.
Mr. Carlson further pointed out Section 9847 -' Application
After Denial: "If a use permit has been denied, no fur-
ther application covering the same or similar use or plan,
whichever is applicable, shall be filed or considered within
the period of one year from the date the determination thereof
became final"- He stated that this section concerned'him
because of the difficulties it could impose on the property
owner.
There being no other com-
ment, the hearing was closed.
Commission discussion was
held.
Commissioner Kerins stated
that he feels approval will be detrimental to the health,
safety and general welfare of persons living in'the area.
Commissioner Duke stated that additional study should be
given regarding a pedestrian bridge to provide access to
the school.
A MOTION[WAS MADE BY SLATES
AND SECONDED BY BAZIL TO APPROVE USE PERMIT NO. 70-40 UPON
THE FOLLOWING CONDITIONS:
1. The developer shall post a bond with the Department of
Public Works to cover the cost of a pedestrian bridge
across the flood control channel. The percentage of
the bond shall be determined by the Board of Zoning Adjust-
ments. - 1
2. Use Permit No. 70-40 shall be referred,to the Board of
Zoning Adjustments to establish such conditions as
deemed necessary.
3. Green area shall be provided at the center of the*pro-
j ect.
AND FOR THE FOLLOWING REASON:
1. The subject property is zoned R3 and the developer is
complying with all ordinances of the Huntington Beach
Ordinance Code.

Applicant: Mr. & Mrs. David Meredith
A change of zone from M1
Light Industrial District to MH - Mobilehome District.
To permit the construction
of a 137 space iobilehome park on a 20 acre parcel of land
in the M1 Light Industrial'District. Located on the south
side of Slater Ave., approximately 660 ft. east of Gothard St.

The hearing was opened to the
audience.
Joe Evans, representing the ap-
plicant, explained the"proposal. Mr. Evans informed the
Commission that there was a definite peat problem in which
fires have been set and the property owners are quite
elderly and in poor health and would like to put the pro-
perty to some use.
Del Boyer, engineer, represent-
ing the applicant, discussed topography and soil conditions.
Mr. Boyer discussed problems related to the property and
stated that it would require considerable amoutrt of dirt
to fill the property for a regular subdivision.
An adjacent property owner was
concerned with the requirement that any industrial building
must set back 45 ft. from property zoned for residential use.
Jerry Shea, Huntington Beach Co.,
stated that he feels this is an industrial area and, if
approved, the Planning Commission would create a residential
use surrounded by industrial zoning. Mr. Shea suggested
that the Planning Commission deny zone change application
and consider this same property under the variance procedure.
Commissioner Higgins stated that
the subject property is surrounded by M1 zone and it would
set a precedent if approved for MH zone. Also, that the
Master Plan should be revised to avoid piecemeal zoning.
An adjacent property owner opposed
the request on grounds that the M1 uses must set back 45 ft.
from residential property and if approved for an MH zone,
the required setback for houses would be 150 ft. from the
mobilehome park. He also stated that if said request is
approved, it should be limited to adults only.
There being no'other comment, the
hearing was closed.
Commission discussion was held.

SECONDED BY,SLATES TO -APPROVE ZONE -CHANGE NO. 70-20 FOR THE
FOLLOWING REASONS:
1. Soil conditions on the subject property are not good
enough for industrial development.
2. The property owner has been paying high taxes for a
number of years and should be allowed to develop it
to its best use.

a letter submitted by L.B. Brown, Standard Oil Co., request-
ing a favorable consideration regarding existing fencing
and landscaping on. oil operation site no. 1, located at
the southwest corner of Garfield Ave. and Goldenwest St.;
oil operation site no. 2, bounded by Clay St. on the north,
Mansion Ave. on the south, Pacific Railroad right-of-way
on the east and Main St. on the west; oil operation site
no. 3, located.on the south side of Palm Ave.; 1/4 mile
west of Goldenwest St.
Mr. Brown asked for permis-
sion to have existing fencing serve as an adequate substi-
tute for required masonry wall around operation sites.-
The Commission reviewed the
request.'

SITE #3 ALLOWING THE EXISTING FENCING AND LANDSCAPING -TO
REMAIN FOR A 3 YEAR PERIOD, WITH THE POSSIBILITY OF SUCCES=
SIVE RENEWAL.

PROPOSED CODE AMENDMENT: The Commission reviewed a proposed
code amendment pertaining to the subdivision ordinance code.
Said amendment proposes to amend Section 9921.8 regarding
Planning Commission action to determine whether the tenta-
tive map is in conformity with provisions of law and of this
ordinance.
It was the consensus of the Commission
to approve said amendment and submit same to the City Coun-
cil and if a public hearing is required, then set said
amendment for a public hearing.
DISCUSSION: Non -conforming Service Stations. The Commission
discussed the requirements tor reactivation of non -conform-
ing service stations.
It was the consensus of the Commission
that use permits for such reactivation need not be referred
to the Planning Commission for approval, but the Board of
Zoning Adjustments should require compliance with the Ser-
vice Station Standards.
PRECISE PLAN OF STREET ALIGNMENT - Talbert Avenue
The Commission reviewed Precise Plan
of Street Alignment for Talbert Ave.
A MOTION WAS MADE BY SLATES AND
SECONDED BY BAZIL TO ADOPT THE FOLLOWING: "IF THE CITY
COUNCIL DOES NOT TERMINATE TALBERT AVENUE AT GOTHARD
STREET, ALIGNMENT "D" IS RECOMMENDED FOR ADOPTION."

PROGRESS REPORT: The Planning Commission reviewed a
Progress Report prepared by the Planning Department re-

SECONDED BY PORTER TO ADOPT SAID PROGRESS REPORT AND
TRANSMIT SAME TO THE CITY COUNCIL.
