ACCEPTANCE OF MINUTES: A motion was made by Patin and seconded by Spencer
to.accept the minutes as transcribed for September 30,
1970, October 7 and 14, 1970.
USE PERMIT NO. 70-60 - Continued
Applicant: Reginald de La Cuesta
To permit the construction of a 16 unit apart-
ment complex on a 32,000 square foot parcel of land within the R2 Two Family
Residence District.
In Conjunction With
CONDITIONAL EXCEPTION NO. 70-58 - Continued
Applicant: Reginald de la Cuesta
To permit the construction of carports at
"0" setback along the southerly property line in lieu of the required five
(5) foot side yard setback within a 16 unit apartment complex.
The subject property is located on the east
side of Jefferson Lane, approximately 200 feet south of Slater Avenue.
The Chairman read the requests.
This item was tabled until later in the
meeting as the applicant was not present to discuss such items with the Board:
DIVISION OF LAND NO. 70-32 - Continued
Applicant: City of Huntington Beach
To allow the division of a legal parcel -of
land into two separate parcels.of land.
The subject,property is located on the west
side of Magnolia Street, 250 feet north of Hamilton Avenue.
The Chairman read the request.
The Board discussed the merits of the
division of land creating the land -locked parcel of property. It was
determined that this was -an acceptable division of land with conditions..
A MOTION WAS MADE BY PALIN AND SECONDED BY'
SPENCER TO APPROVE DIVISION OF LAND NO. 70-32 WITH THE FOLLOWING CONDITIONS:
1. Magnolia Street shall be dedicated and fully improved to City standards
at the time each parcel is developed. Improvements shall include street
trees, street signs, street lights, fire hydrants, sewer and water main
extensions.
2. Water supply shall be through the City of Huntington Beach's water
system at the time each parcel is developed.

3. Sewage disposal shall be through the City of Huntington Beach's sewage
system at the time each parcel is developed.
4. The property shall participate in the local drainage assessment district
at the time each parcel is developed.
5. All utilities shall be installed underground at the time each parcel
is developed.
6. Parcel #1 shall only be conveyed as fee simple defeasible upon the,con-
dition that, if said property is used for any purpose other than the
operation of a public park, playground, and recreation facility, the
parcel and all improvements thereon, shall automatically revert to the
City of Huntington Beach without any further action necessary on th6-
part of the City.
7. A Parcel Map shall be filed and recorded prior to framing inspection of
any structures on any parcel.
8. The Division of Land shall not be effective until an agreement is signed
and recorded agreeing to the conditions listed above.

To permit the operation of a re-
tail plant nursery on approximately 1 acre of land in the C4 Highway
Commercial District.
The subject property is located on
the east side of Goldenwest Street, approximately 150 ft. south of Slater
Avenue.
The Chairman read the request.
The applicant was not present.
The Acting Secretary informed the
Board members that Mr. Wampler had been in to discuss the layout of pro-
posed development and that the Planning Department had informed Mr. Wampler
that the Board of Zoning Adjustment would prefer seeing an overall develop-
ment plan on this corner pursuant to.the City Council's request before any
action can be made on Use Permit No. 70-61.

To permit the division of a legal parcel of
land into three separate parcels.
The subject property is located on the
southwest corner of Slater Avenue and Goldenwest Street.
The Acting Secretary informed the Board that
this item was on the same property as Use Permit No. 70-61 and therefore
should be heard in conjunction. It was the consensus of the Board that this
Item should be continued to'the January 6, 1971 meeting.

The Chairman read the request.
The applicant, Mr. Bolee, was present at
the meeting and informed the Board that the construction of the proposed
storage building would be of the same material as the existing office structure.
Board discussion followed.

MCFARLAND TO APPROVE ADMINISTRATIVE REVIEW NO. 70-67 SUBJECT"TO THE FOLLOWING
CONDITIONSs
1. -The applicant shall comply with all applicable conditions of the pre-
viously approved Administrative Review No. 70-20.
2. The north wall shall be of the same material and of similar color to the
existing office.

This review was to determine if the
applicant was proceeding with construction as previously determined by the
Board of Zoning Adjustments.
Mr. McFarland advised the Board of
the progress of the job and submitted photographs of the construction.
It was the consensus of the Board
that construction of the carport was progressing satisfactorily.
USE PERMIT NO. 70-51 - Reconsideration
Applicant: Signal Oil and Gas Company
This was a reconsideration by the
Board of Zoning Adjustments of their action taken December 16, 1970, at the
request of the applicant.
Mr. Woods was present and addressed
the Board. He explained that there was a strip of property which abuts
upon Goldenwest and which is not legally large enough to constitute an oil
operation site.
The Board reviewed the plot plan.
It was the consensus of the Board
that in fact this was a separate parcel as there was a 20 ft. roadway easement
across subject property leading to Pacific Coast Highway which creates this
parcel of land.
A MOTION WAS MADE BY PALIN AND
SECONDED BY MCFARLAND TO EXCLUDE THAT PORTION OF THE PROPERTY WHICH LIES
BETWEEN THE 20 FT, EASEMENT ON THE SOUTHWEST CORNER OF THE PLOT PLAN AND
GOLDENWEST STREET FROM THE PREVIOUS CONDITIONS OF APPROVAL.

The Chairman read the request and
as the applicant was now present, opened the hearing to the audience.
The applicant addressed the Board
and discussed the request with the Board. It was noted that the applicant
had submitted a revised plot plan with required dimensions, setbacks and
number of units as permitted by ordinance for review.
As there were no additional comments,
the hearing was closed.
Board discussion followed.

SECONDED BY SPENCER TO APPROVE USE PERMIT NO. 70-60 SUBJECT TO THE
FOLLOWING CONDITIONS:

1. The plot plan received December 1, 1970, shall be the approved layout,
with a maximum of 15 units.
2. Jefferson Street shall be dedicated and fully improved to City standards
at the time said parcel is developed. Improvements shall include street
trees, street signs, street lights, fire hydrants, sewer and water
main extensions.
3. Water supply shall be through the City of Huntington Beach's water system.
4. Sewage disposal shall be through the City of Huntington Beach's sewage system.
5. The water, sewer, and fire hydrant system shall be approved by the Depart-
ment of Public Works and Fire Department.
6. All buildings on lots abutting a City easement shall be set back five (5)
feet from the edge of such easement.
7. The flood control channel shall be dedicated and fenced to Flood Control
District standards and City standards.
8. The property shall participate in the local drainage assessment district.
9. Soil reports as required by the Building Department and the Department
of Public Works shall be submitted to the City prior to issuance of
building permits.
10. All utilities shall be installed underground.
11. Off-street parking facilities shall conform to Article 979.
12. No structures, other than those shown on the approved plot plan, shall
be constructed within the project.
13. All applicable City Ordinances shall be complied with.

A MOTION WAS MADE BY MCFARLAND AND SECONDED
BY PALIN TO APPROVE CONDITIONAL EXCEPTION N0. 70-58 SUBJECT TO THE FOLLOWING
CONDITION:
1. The wall of all garages constructed at "0" setback, shall be of maintenance
free masonry construction.
FOR THE FOLLOWING REASON:
1. This type of construction eliminates a 5 ft. trash collection area and
an area which may be used for vandalism.
