HomeMy WebLinkAbout1970-12-30MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Administrative Annex 523 Main Street Huntington Beach, California WEDNESDAY, DECEMBER 30, 1970 BOARD MEMBERS PRESENT: McFarland, Lovejoy, Palin BOARD MEMBERS ABSENT: None ACCEPTANCE OF MINUTES: A motion was made by Palin and seconded Lovejoy to accept the minutes as trans- cribed for the October 28, November 4, and 12, 1970, meetings. USE PERMIT NO. 70-61a Applicant: Ponderosa Homes To permit the construction of a 66 unit apartment complex on a 3.43 acre parcel of land in the R2 - Two Family Residential District. In Conjunction With CONDITIONAL EXCEPTION NO. 70-59 Applicant: Ponderosa Homes by To permit the construction of carports at zero setback along the side and rear property lines within a 66 unit apartment complex in lieu of the required 5 ft. setbacks. The subject property is located on the south side of Hamilton Avenue, approximately 600 feet east of Bushard. The Vice Chairman read the requests, opened the hearing to the audience, and requested that Mr. Simpson and Mr. Combs make a presentation on their proposed development and review the plot plan with the audience to expedite the proceedings of the hearing. _ A lengthy presentation followed at which time the,,type of units, the location of the single story units, two story units, carports, and open space were reviewed with the audience and the Board of Zoning Adjustments. The Acting_Secretary informed the Board and the audience that the Planning Department is in receipt of a request by the abutting property owners in the area that there be a public hearing after 7:00 p.m. with the developer and such home owners on this proposed---dev-elopment. The Vice Chairman, at this point, informed the property owners that this item must be heard by the Board of Zoning Adjustments as it had been properly advertised for a regular scheduled public hearing by the Board of Zoning_ Adjust_m_e_n_t_s on this date, December 30, 1970, and that the Board;of Zoning Adjustments' Bylaws are such that the Board only meets on Wednesday afternoons at 1:15 p.m. Mr. McFarland also informed the audience that the Board would not hear testimony on the zone change on su'U ect property and that all comments would pertain to the proposed apartment development.- - - The Acting Secretary informed the audience and property owners that their request for an evening meeting on this item had been referred up to the Planning Commission and should`' the Planning Commission deem necessary, they could request that this item be referred to them for action at a regularly schedu ed evening meeting. MINUTES: H. B. BOARD OF ZONING ADJUSTMENTS DECEMBER 30, 1970 Page 2 At this point, a number of home owners in the area addressed the Board and asked numerous -ques- tions. Mr. Sam Steer questioned the difference in grade from the existing R1 homes and the elevation for proposed development. He was informed by Mr. Simpson that their preliminary grading plan indicate that the grades will be the same. Mr. Anderson addressed the Board and requested a continuance of this item as he indicated they did not have sufficient time to circulate a petition opposing this request. Mr. Anderson was informed that this item had been duly advertised and that all required legal notices and those notices requested by the Planning Commission on both sides of Archer Circle and Clearbrook Drive had been mailed. Mr. John Fernley opposed the request on the grounds that he felt this development would affect his prop- erty values. Mr. Sholey indicated that he would like to see elevations of the proposed single and two-story structures on the east and south portions of the development. Mr. Sher addressed the Board and opposed the request on the grounds that the 10 ft. rear yard set- back as shown at the southwest portion of the proposed develop- ment was not sufficient and would eliminate the privacy o—the Rl homes at that location. He also indicated that he felt that this proposed development would have a great affect upon over- loading of the schools and further requested that this item be referred to the Planning Commission. Mr. Sher stated that he felt the carports should be moved from 110" setback at the common property line across the main driveways. Mr. Armstrong indicated that he felt there should be no two-story construction at the southwest corner and that these two-story structures should be replaced by single story at a 10 ft. rear yard setback and such two story _ _____ buildings be relocated within the front portion of the development along Hamilton Avenue. the hearing was closed. There being no further comment, Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO CONTINUE USE PERMIT NO. 70-61a AND CONDI-_ TIONAL EXCEPTION NO. 70-59 TO THE JANUARY 6, 1971, MEETING IN ORDER THAT THE PLANNING COMMISSION MAY RENDER A DECISION ON THE REQUEST THAT THIS APPLICATION BE REFERRED TO THEM FOR.FINAL ACTION. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-60 Applicant: Ed Beavers To permit a reduction in the re- quired open space for a single family residence from,900_sq._f t. -2- 12130/70 BZA MINUTES: H. B. BOARD OF ZONING ADJUSTMENTS DECEMBER-3D, 1970 Page 3 with a 20 ft. minimum dimension to 680 sq. ft and 256 sq. ft. with a 16 ft. minimum dimension. The subject property is -located on the south side of Brown Circle, 1 block east of Columbia Street. The Vice Chairman read the request and opened the hearing to the audience. Mr. Beavers, applicant, addressed the Board and reviewed his request on the reduced open space. Mr. Beavers informed the Board that he has additional open space areas which may be used to satisfy this requirement, one such area having a minimum dimension of 13 ft. which is off the kitchen and a second_ area which has been improved as a patio with a minimum dimen- sion of 16 ft. There being no further comment, the, hearing was closed. Board discussion followed. It was the consensus of the Board that as these areas are being used as open space, that'-a-reauction could be allowed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 70-60 Fil THE FOLLOWING REASONS 1. It was determined_by the Board that the applicant had well over the minimum required 900 sq. ft. of open space. 2. There are two additional areas which are being used as open space. ROLL CALL VOTE: AYES: McFarland, Lovejoy, Palin NOES: None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 70-61 Applicant: Richard L. Zylstra To permit the second story of a dwelling to cantilever 3 ft. into the rear causing a�T *;rear yard set- back in lieu of the required 10 ft. The subject property is located on the east side of California Street, approximately 54 ft. north of Joliet Avenue in the R2 Two Family Residence District. The Vice Chairman read the request and opened the hearing to the audience. Mr. Zylstra, applicant, addressed the Board and explained the request. He indicated_that.there is a deed restriction upon the front 20 ft. of his property,, thereby, creating this unusual situation. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY LOVEJOY AND SECONDED BY PALIN TO APPROVE CONDITIONAL EXCEPTION NO. 70-61 WITH THE CONDITION: -3- 12/30/70 BZA MINUTES: H. B. BOARD OF ZONING ADJUSTMENTS DECEMBER 30, 1970 Page 4 1. The applicant shall dedicate 2 1/2 ft. off the alley for additional alley right=of-way. FOR THE FOLLOWING REASONS: 1. There is a deed restriction upon such property creating an unusual hardship upon the required setback. 2. Similar construction within this area of the City has taken place within the R3 and R4 districts. Don Hartfelder, AIA To permit the construction of a bedroom over a side -on entry garage having a 10 ft. front yard set- back causing the dwelling portion of the house --to be within 10 ft. of the front property line in lieu of the required:l5 ft. set- back. The subject property is^ rocated ____ on the east side of Ensign Ci_rcle_,_ approximately 314 ft. southeast of the centerline of Hum'bolt Drive 'in the R1 Single Family Resi- dence District. The Vice Chairman read the request and opened the hearing to the audience. Mr. Hartfelder, applicant, addressed the Board and explained the request. Mr. Hartfelder was questioned by the Board as to percentage of lot coverage, open space, and a minimum turning radius for the proposed garage structure. Mr. _ Hartfelder informed the Board that he has maintained his minimum - 25 ft. turning radius by setting his proposed garage structure diagonally to the front wall of the main dwelling. Also that he does have the required open space for this are of the City. The applicant also informed the Board that his coverage had been checked by the Building Department and that he had met the re- quirements. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY MCFARLAND AND SECONDED BY LOVEJOY TO APPROVE CONDITIONAL EXCEPTION NO. 70-62 FOR THE FOLLOWING REASONS: 1. The subject property is a cul-de-sac lot: which creates an unusual situation. 2. The second story portion of the proposed structure over the garage is setting behind the existing setback of the struc- ture on the adjacent lot. To permit plot plan amendment to Conditional Exception No. 70-8 which allowed a 304 unit apartment project on an 11.6 acre parcel of land. Plot plan amendment to permit the relocation of the recreation building,in an apartment com- plex. The subject property is located on the -- south side of Warner Avenue, between Edwards and Goldenwest-__ Streets, in the R3 Limited Multiple Family Residence District. The Vice Chairman read the request and opened the hearing to the audience. Mr. Chuck Beck, representing the applicant, addressed the Board and reviewed the request. He informed the Board that by relocating the proposed recreational structure -,-- they would in fact increase the usable open space. There being no further comment, the hearing was closed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE PLOT PLAN AMENDMENT NO. 70-7 WITH THE CONDITION: 1. Said amendment to the plot plan shall be for the relocation of the recreation building and associated uses only. FOR THE REASONS: 1. By relocating such recreational building, the usable open -- space area and minimum dimensions are increased which would result in an improved plan. 2. This amendment does not constitute a substantial change. ROLL CALL VOTE: AYES: McFarland, NOES: ABSENT: None None THE MOTION CARRIED. - MISCELLANEOUS: Lovejoy, Palin Review: USE PERMIT NO. 68-23 Applicant: Nelson Auto Service For the purpose of reviewing the use per- mit for compliance with all applicable conditions of approval. A finding of fact to determine whether the Board shall cause revocation of said use permit and immediate cessation of said use. The Vice Secretary informed the Board that a letter notifying the applicant of this scheduled meeting had been returned to the Planning Department office and was not claimed by Mr. Nelson. It was therefore, recommended that this item be continued to allow a new legal notice to be sent, noti- fying the applicant of the pending meeting January 6, 1971. - 5 - 12/. 30/ 7&? BZA MINUTES: H.
