To allow the construction of a 168 unit planned residential development on 10 acres of land in the R-2 Two Family Residence District. Located west of Newland Street, 660 feet south of Slater Avenue. The Commission received a communication submitted by J. K. Mandrell, engineer for the developer requesting continuance of Tentative Tract Map No 7338 and Use permit No 70-59 to the February 2, 1971, meeting because during finalization of various details in the proposed development, it was felt that the subdivider - should incorporate certain modifications which would improve the development. Located at the northeast corner of Bushard Street and the extension of Indianapolis Avenue in the R-A Residential Agricultural District. The acting Secretary read a letter submitted by Bernard McCune, S & S Construction Company, requesting a continuance of Conditional Exception No 70-62 to the February 2, 1971, meeting. Section 9730.17 - required separa- tion wall between industrial and any property zoned or used for residential purposes. Said request is in conjuntion with an oil operation site (Including drilling and redrilling). Located southwest corner of Garfield Avenue and Goldenwest Street in the M-2-02 Heavy Industrial District combined with oil production. The Acting Secretary informed the Commission that the staff is recommending continuance to the January 12, 1971, Study Session in order to discuss problems related to oil operations in general before a decision is rendered on this case. The Acting Secretary requested that this item be continued to the January 12, 1971, Study Session meeting for the same reasons as Conditional Exception No 70-63. Bounded by Clay Street on the north, Mansion Avenue on the south, Southern -Pacific -right-of-way on the east and by Main Street on the west; 3. South side -of Palm Avenue,-1/4 mile west of-Goldenwest Street. Mr. Harlow suggested that this matter -be continued to the January 12, 1971 Study Session for further discussion and decision. Change of Zone from R-A Residential Agricultural District to C-4 Highway -Commercial District with a 50 foot setback from the ultimate right-of-way line. Located at northwest corner of Yorktown and Brookhurst Street in the R-A Residential Agricultural District. To permit the construction of a medical -dental complex and a small convenience type shopping center on a 3.09 acre parcel of land. The hearing was opened to the audience on Zone -Case No 70-26 and Conditional Exception 70-65. Larry Shields, applicant, explained the proposal. Mr. Shields stated that they are proposing to construct a barber shop, convenience market, laundry service and dentalcomplex on subject property. Ray Watson, manager of a mobilehome park to the north of the subject property spoke in favor of the request. There being no other comment the hearing was closed. The Commission held a discussion. A MOTION WAS MADE BY BAZIL AND SECONDED BY HIGGINS TO RECOMMEND APPROVAL OF ZONE CASE NO 70-26 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. Soil conditions in the area are such that pilings are required to support all structures and said pilings have been placed on site. 2. The proposed construction will back up to an existing trailer park. 3. The parcel is not suitable for R-1 construction because of its size. The application shall -be referred to the Board of Zoning Adjustments to establish conditions of approval as deemed necessary. 2. The Board of Zoning Adjustments in their review shall pay close attention to architectural design to assure continuity between phase one and two of this development. Brown and Robert J. Zinngrabe Change of Zone from R-2 Two Family Residence District to R-5 Office -Professional District. Located west side of Florida Street, 600 feet north of Garfield Avenue. To permit construction of a parking lot for the purpose of providing additional parking to serve the Pacifica Hospital. The hearing was opened to the audience, there being no comment the hearing was closed. Commission discussion was held. The Acting Secretary in- formed the Commission of an error that was made in the staff report regarding the zone boundary. He also advised the Commission that a condi- tional exception requesting permission to construct a 140 bed rest home on this 2 acre parcel of land is on file in the Planning Department Office. A MOTION WAS MADE BY HIGGINS AND SECONDED BY DUKE TO RECOMMEND APPROVAL OF ZONE CASE NO 70-27 FOR THE FOLLOWING REASONS: 1. This general area is in the process of being developed as a medical complex; therefore, this R-5 Zone will be compatible. 2. The existing Pacifica Hospital is presently zoned R-5 Office -Professional. Conditional Exception No 70-66 shall be referred to the Board of Zoning Adjustments to establish such conditions of approval as deemed necessary. REASON: AND FOR THE FOLLOWING 1. The parking lot will be adjacent to an existing hospital and will -be used for needed additional parking. To permit construction, operation and maintenance of an electric distribution station on a parcel of land in excess of one acre in size in the RA-0 Residential Agricultural District combined with oil production. Located west side of Edwards Street, approximately 600 feet south of Ellis Avenue. To allow the division of a legal parcel of land into two separate parcels. Chairman Slates abstained from participating on these items due to a possible conflict of interest. The hearing was -opened to the audience. Bob Burbank, district representa- tive for Southern California Edison Company, stated that the substation would be located on the east side of the property, which is 23 feet below the existing grade on Edwards Street. Mr. Burbank stated that the electric lines for this distribution station will be placed on existing poles. Bill Hartge, City Engineer, informed the Commission that Edwards Street may be re -aligned along the west of the subject parcel instead of on the east as it presently exists. the hearing was closed. There being no other comment The commission discussion followed. Commissioner Kerins stated that the City should study a master plan for this area. A MOTION WAS FADE BY KERINS AND SECONDED BY DUKE TO APPROVE CONDITIONAL EXCEPTION NO 70-60 UPON THE FOLLOWING CONDITIONS: 1. An 8 foot high decorative masonry wall shall be constructed around the proposed facility when requested to do so by the Planning Commission. 2. Landscaping around the site shall be provided at such time as water is available on Edwards Street or when requested to do so by the Planning Commission. 3. The Board of Zoning Adjustments shall establish such additional conditions of approval as deemed necessary. AND FOR THE FOLLOWING REASONS: 1. This is an appropriate area to locate the substation. 2. The proposed substation will adjoin an area being considered for industrial use. 3. There is no master plan for this area at this time. C. Marion To permit the operation of a boarding stable with approximately 30 stalls and associated uses on a 4.5 acre parcel of land. Located at northwest corner of Goldenwest Street and Ellis Avenue in the RA-0 Residential Agricultural District combined with oil production. The hearing was opened to the audience. A. C. Marion, applicant, stated that he spent approximately $2,000 to get this operation under way. Mr. Marion atated that this use will be limited to 30 stalls and only 20 stalls will be rented to other people, ten stalls would be for his own use. There being no other comment the hearing was closed. Commission discussion was held. Commissioner Bazil stated that he feels this will be a clean operation. Commissioner Duke suggested that Mr. Marion submit the exact acreage for this use. A MOTION WAS MADE BY SLATES AND SECONDED BY MILLER TO APPROVE CONDITIONAL EXCEPTION NO 70-61 UPON THE FOLLOWING CONDITIONS: 1. Conditional Exception No 70-61 shall become null and voil on January 1, 1976. 2. Horse rentals shall not be allowed. 3. Goldenwest Street and Ellis Avenue shall be dedicated to City Standards. 4. A landscaped strip shall be provided along Goldenwest Street and Ellis Avenue. S. The plot plan and a landscape plan shall be reviewed by the Board of Zoning Adjustments for conditions of approval as deemed necessary. ROLL CALL VOTE: AYES: Bazil, Higgins, Porter, Slates, Miller, Duke, Kerins NOES: None ABSENT: None ABSTAINED: None THE MOTION CARRIED PROPOSED CODE AMENDMENT NO 71-1 ADOPTION OF SETBACK LINES The Commission reviewed the proposed code amendment pertaining to Section 9783 to allow the Commission to make a recommendation to the City Council for the setback with four affirmative votes the same as required for zoning. PROPOSED CODE AMENDMENT NO 71-2 NONCONFORMING BUILDING The Commission reviwed the proposed code amendment that would eliminate the need for Planning Commission to review commercial uses in the city which are non -conforming because of parking, landscaping and setback requirements. Also, said amendment would eliminate the conflict between Section 9716.and Section 9719 which exists at this time. PLANNING COMMISSION JANUARY 5, 1971 PAGE 7 ROLL CALL VOTE: AYES: Bazil, Higgins, Porter, Slates, Miller, Duke, Kerins NOES: None ABSENT: NONE THE MOTION CARRIED AMENDMENT TO SEPTEMBER 1, 19709 MINUTES RE: CONDITIONAL EXCEPTION NO 70-44 The Acting Secretary informed the Commission of an error in the September 1, 1970, minutes pertaining to Conditional Exception No 70-44,wherein the minutes stated that the hearing was opened to the audience, when in fact the hearing was not opened. ON MOTION BY SLATES AND SECONDED BY PORTER, THE MINUTES OF SEPTEMBER 1, 1970, WERE AMENDED TO REFLECT THE CHANGE POINTED OUT BY THE ACTING SECRETARY. ROLL CALL VOTE: AYES: Bazil, Higgins, Porter, Slates, Miller, Duke, Kerins NOES: None ABSENT: None THE MOTION CARRIED USE PERMIT NO 70-61 (a) in conjunction with CONDITIONAL EXCEPTION NO 70-59 Applicant - Ponderosa Homes Commissioner Kerins requested that Use Permit No 70-61 (a) and Conditional Exception No 70-59 pertaining to the construction of a 66 unit apartment complex in the R2 district be referred to the Planning Commission for a decision. The Acting Secretary informed the Commission that these two items will be discussed on the agenda on January 19, 1971. CITY COUNCIL ACTION: Ken Reynolds, Planning Director, reported on action by the City Council at their January 4, 1971, meeting that are of interest to the Planning Commission. The Commission requested that the Planning Director ask for approval for five commissioners and two staff members to attend a seminar on factory built housing on March 13, 1971, from the City Administrator. DISCUSSION: Commissioner Bazil requested that the staff prepare an alternate plan for street closure in the town lot section of the city; to serve as an interim measure until a final plan can be prepared. The Acting Secretary informed Mr Bazil that the staff would present a plan at the Study Session on January 12. ORAL COMMUNICATION: Robert Dingwall, Home Council, addresssed the Commission and stated that he was concerned that mobilehome parks may not be paying their fair share of taxes to the City. Mr. Dingwall spoke on financial forecast for mobilehome parks as compared to single family homes. It was the consensus of the Commission that the staff investigate said matter.
