HomeMy WebLinkAbout1971-01-13MINUTES HUNTINGTON BEACH BOARD OF ZONING ADJUSTMENTS Administrative Annex 523 Main Street Huntington Beach, California WEDNESDAY, JANUARY 13, 1971 BOARD MEMBERS: McFarland, Spencer, Palin USE PERMIT NO. 70-63 - Continued Applicant: Paul Jones Realty To permit the construction of a pizza restaurant and a chicken take-out restaurant in the C4 Highway Commercial District. The subject property is located on the east side of Beach Blvd., north of Holland Street. The Chairman read the request and opened the hearing to the audience. Mr. Dave Kirschner, representing the applicant, addressed the Board and answered various questions. The Acting Secretary advised that a revised plot plan had been submitted as requested by the Board. The plot plans were reviewed and discussion was held pertaining to landscaping, parking, perimeter wall, signs, and drives. hearing was closed. There being no further comment, the Board discussion was held. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO APPROVE USE PERMIT NO. 70-63 SUBJECT TO THE FOLLOWING CONDITIONS: 1. The plot plan receive January 13, 1971, shall be the approved layout. 2. Beach Blvd. and Holland Street shall be dedicated and fully improved to City and/or State standards at the time each parcel is developed. Improvements shall include street trees, street signs, street lights, fire hydrants, sewer and water main extensions. 3. Water supply shall be through the City of Huntington Beach's water system. 4. Sewage disposal shall be through the City of Huntington Beach's sewage system. 5. The water, sewer, and fire hydrant system shall be approved by the Department of Public Works and Fire Department. 6. The property shall participate in the local drainage assessment district. 7. Soil reports as required by the Building Department and the Department of Public Works shall be submitted to the City prior to issuance of building permits. -1- 1/13/71 - BZA Minutes: Board of Zoning Adjustments January 13, 1971 Page No. 2 8. All utilities shall be installed underground. 9. Fire alarm system conduit and appurtenances shall be installed by developer at locations and to specifications provided by the Fire Department. 10. Off-street parking facilities shall conform to Article 979. 11. Parking compounds shall be screened with a combination of fencing and landscaping. Said plan shall be approved by the Planning Dept. 12. A masonry wall shall be constructed along the east property line. The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common property line. Except within ten (10) ft. of the south property line in which case the height of said wall shall be reduced to 42 inches. 13. No structures, other than those shown on the approved plot plan, shall be constructed within the project. 14. All applicable City Ordinances shall be complied with. 15. A Division of Land application, separating this parcel from the remaining property held under the same ownership, shall be filed with the City, approved and recorded. To permit the following: 1) The use of five portable tire racks for outside display; 2) The use of a 40 ft. long van trailer for the storage of merchandise. The subject property is located on the west side of Beach Blvd., approximately 147 ft. north of Warner Avenue in the C4 Highway Commercial District. The Chairman read the request and opened the hearing to the audience. Mr. Avery, applicant, addressed the Board. The Acting Secretary advised that an Administrative Review application had previously been approved by the Board permitting outside storage within the front 50 ft. setback. The applicant advised that due to drainage problems, it is not feasible, cost wise, at this time to expand the existing building, and he would like this request approved for a_period of two years. He explained that at that time he wishes to tear down the existing building and rebuild to accomodate his needs. He also stated that there is not sufficient space on the improved parcel due to parking, etc.; therefore, he prpposes to park the trailer on the unimproved adjoining parcel. -2- 1/13/71 - BZA Minutes: Board of Zoning Adjustments January 13, 1971 Page No. 3 Discussion was held. It was the consensus that a Division of Land application should be filed for a lot line adjustment. There being no further comment, the hearing was closed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO CONTINUE CONDITIONAL EXCEPTION NO. 70-64 TO THE JANUARY 20, 1971, MEETING TO ALLOW THE APPLICANT TIME TO FILE A DIVISION OF LAND APPLICATION. CONDITIONAL EXCEPTION NO. 70-65 Applicant: Randall McCardle DBA The Real Estaters To permit the construction of two (2) pole signs within the required setback for business identification purposes having a total sign area of approximately 163 sq. ft. in lieu of the one (1) sign having 100 sq. ft. of sign area permitted by ordinance. Also to allow one of said signs to be located 916" from the side property line in lieu of the required 20 ft. setback. The subject property is located on the west side of Beach Blvd., approximately 224 ft. north of Talbert Avenue in the C4 Highway Commercial District. The Chairman read the request and opened the hearing'to the audience. Mr. McCardle, applicant, addressed the Board along with a representative from Federal Signs Co. Mr. McCardle advised that one of the existing signs would be replaced with a new 127 sq. ft. sign in addition to a second sign. He stated their hardship is that the architecture of the building is such that it blends with the landscape and does not attract attention; therefore, the additional signing is needed. Also, the second proposed sign is a trademark type sign for their busi=.ass. Discussion was held. It was the consensus that a revised plan should be submitted, decreasing the square ft. of sign area and all on one sign structure. There being no further business, the hearing was closed. Nelson To permit the construction of a kiosk structure for the sale of film, film processing and stereo tapes in the C4 Highway Commercial District. The subject property is located on the west side of Springdale Street, approximately 325 ft. north of Warner Avenue. The Acting Secretary advised that the applicant will be submitting revised plans and has requested a continuance. The subject property is located on the northwest corner of Atlanta Ave. and Brookhurst Street. The Chairman read the request. The applicant was not present. It was the consensus of the Board that there was sufficient infor- mation for the Board to act., Discussion was held. The subject property is located on the west side of Brookhurst Street, 800 feet south of Garfield Avenue. The Chairman opened the hearing to the audience. The Acting Secretary advised that two exhibits were submitted for review by the Planning Department. Exhibit B conforms to code; however, the applicant has stated that it cannot be financed. Exhibit A does not conform with the MH District, therefore, a Conditional Ex- ception application would have to be filed before the Planning Commission if the applicant wishes to pursue said exhibit. The applicant requested a continuance to allow time for a Conditional Exception application to be filed before the Planning Commission. It was noted that the property owner may submit an additional exhibit to the Board for review. There being no further comment, the hearing was closed. It was the consensus of the Board that there was sufficient information available to act. It was noted that the applicant had not been properly notified of the meeting and was not present. There being no further comment, the hearing was closed. A MOTION WAS MADE BY PALIN AND SECONDED BY MCFARLAND TO CONTINUE DIVISION OF LAND NO. 70-34 AND CONDITIONAL EXCEPTION NO. 70-60 TO THE JANUARY 27, 1971 MEETING TO ALLOW THE APPLICANT TO BE PROPERLY NOTIFIED. ROLL CALL VOTE: AYES: McFarland, Spencer, Palin NOES: None THE MOTION CARRIED. MISCELLANEOUS: USE PERMIT NO. 70-61a In Conjunct -ion With CONDITIONAL EXCEPTION NO. 70-59 Applicant: Ponderosa Homes Review of elevations for recommendation to the Planning Commission. It was noted that the elevation were not available at the time the Board referred these items to the Planning Commission. The applicant submitted the elevations and explained various details. Mr. Neil Thomas, Acting Secretary of the Homeowners' Associatecn, addressed the Board and discussed land- scaping and the wall behind the carports. The applicant explained their proposal for preventing visual intrusion upon the single family homes from the second story apartment units. They proposed 24" box eucalyptus trees, 16 feet on center which are approximately 16 feet in height, and will be located directly opposite windows on the rear of the building. Discussion was held pertaining to the height of the wall behind the carports. It was the consensus that if the height exceeds 1 ft. above the existing fence, the height of said wall should be maintained the entire length of the property line. -7- 1/13/71 - BZA Minutes: Board of Zoning Adjustments Page No. 8 January 13, 1971 It was a consensus of the Board to recommend approval of Use Permit 70-61a and Conditional Exception No. 70-59 to the Planning Commission.
