ZONE CASE NO 70-20 (Continued) in conjunction with CONDITIONAL EXCEPTION NO 70-52 (Continued) Applicant - Mr and Mrs David Meredith Change of zone from M1 Light Industrial District to MH - Mobilehome District. Located south side of Slater Avenue, approximately 660 feet east of Gothard Street. To permit the construction of a 137 space mobilehome park on a 20 acre parcel of land in the M1 Light Industrial District. Commissioner Bazil abstained. Ron Brown, Planning Aide, made a presentation on the MH Zoning request within the industrial area. His report dealt with physical conditions, master zoning and the potential for an industrial subdivision for subject property. The report concluded that in light of the facts and information gathered, the staff recommends that this area remain industrially zoned. Commissioner Miller stated that this was a good study, but better industrial land than this parcel has been rezoned for other uses. Commissioner Kerins stated that he feels this was a good study. Chairman Slates disagreed with the presentation. Acting Secretary read a letter submitted by the property owner's son requesting approval of Zone Case No 70-20 and Conditional Exception No 70-52. Commissioner Duke asked about the cost of subject property when being considered for a corporation yard by the city. Bill Hartge, City Engineer, informed Mr. Duke that the cost of said land was approximately $20,000 an acre, but that this was third hand information. Commissioner Duke stated that he will abstain from voting because he needs additional information relative to the price this parcel of land was at the time subject property was offered to the City. A MOTION WAS MADE BY MILLER AND SECONDED BY SLATES TO APPROVE CONDITIONAL EXCEPTION NO 70-52 UPON THE FOLLOWING CONDITION: 1. Conditional Exception No 70-52 shall be referred to the Board of Zoning Adjustments for conditions as deemed necessary. AND FOR THE FOLLOWING REASON 1. Existing peat problem on the property makes it difficult to develop with industry. MUNUTES: H. B. If this area and the parcel to the south are rezoned, the existing industrial property to the east will be separated from the central industrial corridor. Goodman To permit the construc- tion of a child day care nursery school in the C2 Neighborhood Commercial District. Located approx- imately 800 feet west of Magnolia Street and approximately 350 feet north of Adams Avenue. Chairman Slates reopened the public hearing. Mr. Slatee stated that no further continuance will be granted as per the last vote of the Commission. C. R. Goodman, applicant, addressed the Commission and stated that his company has constructed 35 such schools. Mr. Goodman stated that there is a great need for day care nurseries and felt this was a good location. He further informed the Commission that the playground will be fenced. Mr. Goodman submitted photographs of typical facilities stating that a 3,500 square foot building will be provided. Ron Moeller, represent- ing the applicant, stated that the R4 zone is the only zone where this use is permitted and there is a need for a day care nursery, as there are only five full time nurseries in the city. Irving Snyder, owner of the subject property, stated that this parcel does not have good exposure to the street for other uses and -this is a good use for the subject parcel. -2- 1/19/71 PC MINUTES: H. B. PLANNING COMMISSION PAGE 3 JANUARY 19, 1971 Bob Dingwall, Home Council, reviewed the plot plan. Mr. Dingwall opposed the request on grounds that there will be a traffic problem. Also, that the proposed building is not large enough to accommodate as many children as has been proposed by the applicant. Mr. Dingwall submitted a petition signed by 79 property owners opposing the request. There being no other comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY KERINS AND SECONDED BY PORTER TO DENY CONDITIONAL EXCEPTION NO 70-58 FOR THE FOLLOWING REASONS: 1. Said request does not conform to the ordinance code for day care nurseries. 2. Said proposal is not suitable at this location. 3. The applicant failed to show sufficient hardship. ROLL CALL VOTE: AYES: Bazil, Higgins, Porter, Slates, Miller, Duke, Kerins NOES: None ABSENT: None THE MOTION CARRIED TENTATIVE TRACT MAP NO 7349 Subdivider: Wm Lyon Development Co. 43 lots on 9.2 acres, located on the south side of Slater Avenue, west of Edwards Street. The Commission reviewed the Subdivision Committee report and the suggested conditions of approval. Commission discussion followed. A MOTION WAS MADE BY MILLER AND SECONDED BY HIGGINS TO APPROVE TENTATIVE TRACT MAP NO 7349 UPON THE FOLLOWING CONDITIONS: 1) The tentative map received December 21, 1970, shall be the approved layout. 2) A petition to rezone the property to R1 shall be filed prior to submitting a final map to the City Council for acceptance. 3) The flood control channel shall be fenced to Flood Control District and City standards. 4) All "Standard Conditions of Approval" for tentative tracts that are applicable shall be complied with. -3- 1/19/71 PC MINTES: H. Commission discussion followed. A MOTION WAS MADE BY MILLER AND SECONDED BY PORTER TO APPROVE TENTATIVE TRACT MAP NO 5972 UPON THE FOLLOWING CONDITIONS: 1. The tentative map received December 14, 1970, shall be the approved map. 2. All applicable conditions of approval of the previously approved tentative map shall be complied with. The Commission reviewed the Subdivision Committee report and suggested conditions of approval. Commission discussion followed. A MOTION WAS MADE BY PORTER AND SECONDED BY HIGGINS TO APPROVE TENTATIVE TRACT MAP NOS. 6807, 7004 AND 7005 UPON THE FOLLOWING CONDITION: 1. All conditions of approval of the previously approved tentative tract map that are applicable shall be complied with. PLANNING COMMISSION PAGE 5 JANUARY 19, 1971 USE PERMIT NO 70-61 (a) (Referred by the Board of Zoning Adjustments) in conjunction with CONDITIONAL EXCEPTION NO 70-59 Applicant - Ponderosa Homes To permit the construction of a 66 unit apartment complex on a 3.43 acre parcel of land in the R2 Two Family Residential District. Located south side of Hamilton Avenue approximately 600 feet east of Bushard Street. To permit -the construction of carports along the side and rear property lines within a 66 unit apartment complex in lieu of the required five foot setbacks. Chairman Slates stated that the City Attorney had advised him that the Planning Commission can hear only items of discussion which are relative to Use Permit No 70-61 (a) and Conditional Exception No70-59. Commissioner Duke asked what action the City Council had taken regarding the zone case on subject property. The Planning Director informed Mr. Duke that Zone Case No 70-25 was adopted and that the City Council was asked later to reconsider said action but refused to do so; however, in response to this request, the City Council asked the Planning Commission to study the possibility of rezoning this entire parcel R1. The hearing was opened to the audience on Use Permit No 70-61 (a) and Conditional Exception No 70-59. Doug Simpson, Ponderosa Homes, asked the Commission why these items were before them. Mr. Simpson stated they had two meetings before the Board of Zoning Adjustments and they have attempted to work out all problems with the plan. He further informed the Commission that they are proposing to construct 22 units per acre with 62% of the area to be in open space. Commissioner Bazil stated that he would like to see more detailed architectural features on the rear of the proposed development. Commissioner Porter stated that he feels single story buildings should be located along the south property line rather than two story buildings as shown on the plan. Robert Dingwall, Home Council, spoke in opposition to the project. The Commission was polled as to whether the merits of a rezone to R1 should be discussed. Commissioners Miller, Higgins, Bazil and Slates did not want to discuss the merits of rezoning and wanted to limit disucssion to the use permit and conditional exception. Commissioners Kerins, Duke and Porter were in favor of discussing the merits of said rezoning. It was the consensus of the Commission not to discuss the zoning. The following property owners addressed the Commission and spoke in opposition: Mr. Thomas, Mrs. Shear and Rod' Stingers. was closed. There being no other comment the hearing Commission discussion followed. A MOTION WAS MADE BY KERINS AND SECONDED BY DUKE TO CONTINLE USE PERMIT NO 70-61 (a) AND CONDITIONAL EXCEPTION NO. 70-59 TO FEBRUARY 17, 1971 FOR DECISION ONLY, IN ORDER TO STUDY THE POSSIBILITY TO REZONE SUBJECT PROPERTY Rl. -5- 1/19/71 PC MINUTES: H. PLANNING COMMISSION PAGE 6 JANUARY 19, 1971 ROLL CALL VOTE: AYES: Bazil, Higgins, Porter, Slates, Miller, Duke, Kerins NOES: NONE ABSENT: NONE THE MOTION CARRIED ZONE CASE NO 70-28 Applicant - Bainbridge, Welch, Jacober and Evangelical Free Church Change of Zone from C4 High- way Commercial District to R3 Limited Multiple Family Residence District. Located east side of Florida Street, between Utica and Adams Avenues, except the north 150 feet and the south 275 feet to a depth of 300 feet. The hearing was opened to the audience. Dr. Elden Bainbridge, appli- cant, stated that rezoning of the subject property should not cause any great number of apartment dwellings in the area. He further discussed zoning patterns in the area. There being no further comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY BAZIL AND SECONDED BY MILLER TO RECOMMEND APPROVAL OF ZONE CASE NO 70-28 TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. The R2 District will comply with the zoning pattern in the area and the Master Plan of land use. ROLL CALL VOTE• AYES: Bazil, Higgins, Kerins, Slates, Miller, Duke, NOES: None ABSENT: None ABSTAINED: Porter THE MOTION CARRIED PRECISE PLAN ALIGNMENT NO 71-1 Said plan proposes to establish access to and circulation within that property bounded by Beach Blvd. on the east, Warner Avenue on the south, Southern Pacific Railroad R/W on the west and Orange County Flood Control District channel C5-4 on the north. The hearing was opened to the audience, there being no comment the hearing was closed. .. Commission discussion followed. A MOTION WAS MADE BY MILLER AND SECONDED BY HIGGINS TO RECOMMEND APPROVAL OF PRECISE PLAN NO 71-1 TO THE CITY COUNCIL. PLANNING COMMISSION PAGE 7 JANUARY 19, 1971 SIGNAL OIL AND GAS The Acting Secretary read a letter submitted by Signal Oil and Gas Company, requesting approval of the use of substitute materials in place of masonry walls surround- ing their oil operation site fronting on Pacific Coast Highway and Goldenwest Street, as per Section 9682.6 of the Huntington Beach Ordinance Code. Said Section reads as follows: "The operator of an oil operation site shall construct a minimum 6 foot high decorative masonry wall with a gate for access entirely around said oil operation site, except that upon filing an application to the Commission for administrative action, the Commission may approve the use of substitute materials which, for safety reasons, shall be at least as secure as a chain link fence. The Commission may condition such approval." Bill Woods, representing Signal Oil and Gas Company, informed the Commission that the existing fence along Pacific Coast Highway, encroaches in the highway right-of-way and was erected under an encroachment permit issued by the State. Mr. Woods pointed out that the right-of-way encroachment was negotiated with the State several years ago under the provisions of such permit construction with masonry material is not allowed. The Commission reviwed the request. Commissioner Porter stated that this request should be reviewed every two years and that a masonry wall eventually should be provided. A MOTION WAS MADE BY HIGGINS AND SECONDED BY MILLER TO GRANT THE REQUEST FOR A PERIOD OF SEVEN YEARS, AFTER WHICH THE MATTER SHALL ONCE AGAIN BE REVIEWED BY THE PLANNING COMMISSION IN ORDER TO SEE IF THE LANDSCAPING AND FENCING HAS BEEN MAINTAINED IN GOOD REPAIR.
