COMMISSIONERS ABSENT: None NOTE: A TAPE RECORDING OF THIS MEETING IS ON FILE IN THE PLANNING DEPARTMENT OFFICE MINUTES: ON MOTION BY KERINS AND SECONDED BY MILLER THE MINUTES OF THE HUNTINGTON BEACH PLANNING COMMISSION OF OCTOBER 13 AND NOVEMBER 3, 1970, WERE ACCEPTED AS TRANSCRIBED AND MAILED BY THE SECRETARY ZONE CASE NO 70-20 (continued) In Conjunction with CONDITIONAL EXCEPTION NO 70-52 (continued) Applicant - Mr and Mrs David Meredith Change of zone from Ml Light Industrial District to MH - Mobilehome District. Located south side of Slater Avenue, approximately 660 feet east of Gothard Street. To permit the construction of a 137 space mobilehome park on a 20 acre parcel of land in the M1 Light Industrial District. Commissioner Bazil abstained from this item due to a possible conflict of interest. Commissioner Duke stated that he feels the hearing should be re -opened to the audience. The hearing was re -opened to the audience. Joe Evans, representing the applicant, discussed the soil conditions on said property, and offered to answer questions. Mr. Evans informed the Commission that the price for the property was $20,000 per acre when offeree to the City for a corporation yard. COMMISSIONER PORTER: Ccmmissioner Porter arrived at 7:15 P. M. and assumed his duties. There being no other comment the hearing was closed. Commission discussion followed. Commissioner Miller stated that he feels there is a hardship on the property and the owner should be able to develop their property; further, that it will be some time before anyone would be interested in developing said property with an industrial use. Commissioner Duke stated that his reason for abstain- ing from voting on this item last time was because he was under the impression that the city had considered purchasing the property for a corporation yard and he was interested in the price per acre at that time. PLANNING COMMISSION PAGE 2 FEBRUARY 2, 1971 John DeFalco representing the applicant, explained the soils report and informed the Commission that if the subject property were to be developed industrially, it would cost $10,000 to $13,000 more per acre than for a mobilehome park. Bill Hartge, City Engineer, informed the Commission that he needs more time to study these new soils reports. A MOTION WAS MADE BY KERINS AND SECONDED BY PORTER TO CONTINUE ZONE CASE NO 70-20 AND CONDITIONAL EXCEPTION NO 70-52 TO FEBRUARY 17, 1971, TO ALLOW TIME FOR THE CITY ENGINEER TO STUDY THE ENGINEERING ANALYSIS OF THE SITE AND WITH THE APPLICANT'S CONSENT. TENTATIVE TRACT MAP NO 7338 in conjunction with USE PERMIT NO 70-59 Subdivider: Derby Land Co. 168 unit planned residential develop- ment on 10 acres of land located west of Newland Street, 660 feet south of Slater Avenue in the R2 Zone. The hearing was opened to the audience on Use Permit No 70-59. John Mandrell, engineer for the developer, objected to condition #2 requiring the design of the intersection of the private streets with the public street which shall be approved by the Department of Public Works. Mr Mandrell stated that the developer would prefer to have said street public. John Moreno, architect, made a presenta- tion on the proposed townhouse development and reviewed with the Commission the elevations of the dwellings. COMMISSIONER MILLER: Commissioner Miller was excused from further participation at 7:40 P. M. The tentative map received January 149 19719 shall be the approved layout. 2. Tree planting along the local street shall be equivalent to one 30 inch box tree for each 60 feet along both sides of the street. A plan showing the street tree planting shall be approved by the Planning Department and Street Tree Superintendent. 5. A landscape plan for the total complex shall be approved by the Planning Department and Street Tree Superintendent. 6. Provisions shall be made to provide facilities for storing equipment and materials required by the association for maintenance of the project. Such areas shall be shown on the plot plan prior to issuance of building permits. 7. Trash collection areas shall be designed so as to eliminate visual and noise intrusion on adjacent property. B. Rear elevations shall be the same as the renderings submitted by the architect. 9. Parking requirements shall comply with the provisions of the R2 zone, 10. To permit: 1) A maximum of 16 R1 lots on a 48 foot in width cul-de-sac in lieu of the maximum 14 lots permitted by ordinance; 2) An average of 57.6 lot width for each 6 contiguous lots in lieu of the required 60 foot in width. Located northeast corner of Bushard Street and the extension of Indiananapolis Avenue in the RA Residential Agricultural District. The hearing was opened to the audience. George Putnam, representing the applicant, explained the proposal and stated that the existing street system and school site have pre -determined the street layout for this map. David A. Diamond, 9521 Zion Circle, Huntington Beach opposed the request on grounds that the developers proposal to reduce lot sizes would reduce the value of adjacent homes. He further stated that the density will be increased in the area and the developer will be selling the homes for less money than other homes in this area. the hearing was closed. There being no other comment Commission discussion followed. Bill Hartge, City Engineer, stated that the engineering department feels that 50 foot street widths are acceptable. A MOTION WAS MADE BY PORTER AND SECONDED BY BAZIL TO APPROVE THAT PORTION OF CONDITIONAL EXCEPTION NO 70-62 FOR A 50 FOOT STREET SECTION UPON THE FOLLOWING CONDITION: to The cul-de-sac streets shall be 50 feet wide and the street sections shall be to Derirtment of Public Works requirements. CONDITIONAL EXCEPTION NO 70-67 Applicant - R. J. Zinngrabe & W. L. Borwn, Jr. To permit the construction of a 140 bed rest home on a 1.03 acre parcel of land in the R2 Two Family Residence District. Located west side of Florida Street, 600 feet north of Garfield Avenue. The hearing was opened to the audience. Bob Zinngrabe, applicant, offered to answer questions. Commissioner Kerins asked Mr Zinngrabe what plan he has for the existing oil well on subject property. Mr. Zinngrabe stated that he hopes to remove the well. There being no other comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY KERINS AND SECONDED BY PORTER TO APPROVE CONDITIONAL EXCEPTION NO 70-67 UPON THE FOLLOWING CONDITION: 1. Conditional Exception No 70-67 shall be referred to the Board of Zoning Adjustments to establish such conditions of approval as deemed necessary. AND FOR THE FOLLOWING REASON: 1. An application to rezone the property has been approved by the City and this application was only filed to expedite development on the parcel. To permit the construction of a 250 unit apartment complex on approximately B acre parcel of land with the following exceptions: 1. Averaging of density between the R2 and R3 portion of subject parcel; 2. Construction of carports at zero setback along the south and west property line in lieu of the required 5 foot setback along the south and 10 foot setback along the west property lines; 3. Open carports in lieu of garages within the R2 portion of said development. Located southwest corner of Atlanta Avenue and Newland Street in the R2 Two Family Residence District, R3 Limited Multiple Family Residence District and R3-0 Limited Multiple Family Residence District combined with oil production. The Planning Director informed the Commission of the City Council's action on February 1, 1971, -5- 2/2/71 PC MINUTES: H. B. PLANNING COMMISSION PAGE 6 FEBRUARY 2, 1971 regarding subject parcel of land and surrounding properties. Mr. Reynolds stated it was the Council's request that the Commission study the possibility of rezoning the multiple zoned property in this area R1. Mr. Reynolds informed the Commission that the applicant was aware of this action taken by the City Council. The hearing was opened to the audience. Donald Severe, architect for Fredericks Corporation, stated that he will agree to 30 days continuance. There being no other comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY KERINS AND SECONDED BY PORTER TO CONTINUE CONDITIONAL EXCEPTION NO 71-1 TO MARCH 2, 1971, TO ALLOW TIME FOR A REZONING STUDY OF THE MULTIPLE ZONED PROPERTY SITUATED AT THE SOUTHWEST CORNER OF NEWLAND STREET AND ATLANTA AVENUE TO BE PRESENTED AT THE FEBRUARY 23, 1971, STUDY SESSION. ROLL CALL VOTE: AYES: Bazil, Higgins, Porter, Duke, Slates, Kerins NOES: None ABSENT: Miller THE MOTION CARRIED. CONDITIONAL EXCEPTION NO 71-3 Applicant - Rex Reynolds To permit boarding of horses in the RA-0 Residential Agricultural District combined with oil production. Located south side of Taylor Avenue and west of Goldenwest Street. The hearing was opened to the audience. Rex Reynolds, applicant offered to answer questions. The following property owners addressed the Commission and spoke in favor of the request: Walter Sweet, 6431 Yale Circle; Harold Munday, 17322 Avalon Circle; Alfred Braneld, 6800 Westport Place, West- minster and Terrie Kelly, 6672 Chele Circle, Huntington Beach. Kathy Dean asked the Commission where the riding area wc__d be located and if the stalls would be painted when the residential subdivision ui, ttio north side of the lake is con- structed. Miss Dean stated that she hopes that the opeation will look attractive since it will be situated across the lake from a single family development. A. C. Marion, stated that he was concerned with whether or not this proposal will be a part of the Central Park when it is completed. Chairman Slates informed Mr. Marion that this will not be a part of the future park. Bill Williams asked the Commission if the applicant will acquire additional acreage for riding purposes. Chairman Slates informed Mr. Williams that this will be answered after the hearing is closed. There being no other comment the hearing was closed. Chairman Slates suggested that the Recreation and Parks Commission review this plan because of its proximity to the Central Park. -6- 2/2/71 PC MINUTES: H. B. A MOTION WAS MADE BY SLATES AND KERINS TO REFER CONDITIONAL EXCEPTION NO 71-3 TO THE PARK AND RECREATION COMMISSION FOR REVIEW AND RECOMMENDATION, AND TO CONTINUE CONDITIONAL EXCEPTION NO 71-3 TO FEBRUARY 17, 1971, FOR DECISION ONLY. ZONE CASE NO 71-1 RESOLUTION OF INTENT Change of Zone from RA-01 Residential Agricultural District combined with oil production to RA-0 Residential Agricultural District combined with oil production. Located: a) west side of Brookhurst Street, north of the intersection of Brookhurst and Bushard Streets;-b) 660 f t. north of the intersection of Brookhurst and Bushard Streets. Change of Zone from M2-02 Heavy Industrial District combined with oil production to M2-0 Heavy Industrial District combined with oil production. The subject property is located on the west side of Goldenwest Street and south of the westerly extension of Acacia Avenue. Change of Zone from R1-0 Single Family Residence District combined with oil production to R1-Ol Single Family Residence District combined with oil production. The subject property is located approximately 200 feet north and east of the intersection of Goldenwest Street and Palm Avenue. The Acting Secretary informed the Planning Commission that zone case No 71-1, Resolution of Intent was improperly advertised. ON MOTION BY DUKE AND SECONDED BY PORTER TO INSTRUCT THE SECRETARY TO READVERTISE ZONE CASE NO 71-1. ROLL CALL VOTE: AYES: Bazil, Higgins, Porter, Duke, Slates, Kerins NOES: NONE ABSENT. Miller THE MOTION CARRIED. RECESS CALLED: The Chairman called a recess at 9:00 P. M. COMMISSION RECONVENED: The Commission reconvened at 9:15 P. M. POLICY PLAN: The Commission held discussion regarding the time schedule and number of study sessions to be devoted to the Policy Plan. Chairman Slates appointed Commissioners Porter, Duke and Kerins to serve on an ad hoc committee to review the Policy Plan with the staff and to report back to the Commission for action. TRAILS ELEMENT OF THE MASTER PLAN The Planning Commission received a memo submitted by Norm Worthy, Director of Recreation and Parks and Tom Governs, Development Coordinator, regarding a Trails Element of the City Master Plan. The Recreation and -7- 2/2/71 PC MINUTES: H. B. PLANNING COMMISSION PAGE 8 FEBRUARY 2, 1971 Parks Commission requested that the Planning Commission create a Trails Element to the City Master Plan. Jere Murphy, Associate Planner, made a presentation and discussed the general criteria for a city trails system. Mr. Murphy further informed the Commission that the Recreation and Parks Department staff and Development Coordinator will offer full assistance to the planning staff for creation of a Trails Element to the Master Plan. DISCUSSION: The Planning Commission reviewed the Civic District Criteria as submitted by the Design Review Board. A MOTION WAS MADE BY KERINS AND SECONDED BY PORTER TO ACCEPT THE GUIDELINES AS PREPARED BY THE DESIGN REVIEW BOARD, EXCEPT SECTION 4, ITEM "C" WHICH STATES: "THIS DESIGN MUST STRESS PURITY OF FORM IN RELATION TO FUNCTION, WHILE ENCOURAGING HONESTY TO MATERIALS AND PROCESSES." AND TO REFER SAID GUIDELINES TO THE BOARD TO BE REFERRED TO THE COUNCIL FOR ADOPTION. ROLL CALL VOTE: AYES: Bazil, Higgins, Porter, Duke, Kerins NOES: Slates ABSENT: Miller THE MOTION CARRIED. DISCUSSION: ADMINISTRATIVE REVIEW NO 71-2 Applicant - Wm Lyon Development Co. The Acting Secretary reviewed with the Commission the proposed development at the southeast corner of Talbert Avenue and Edwards Street. Mr. Harlow stated that the staff was -concerned with the roofing materials in the overall project and the fencing and land- scaping along the north side of Lakeside Drive because of the proximity to the Central City Park. Mr. Harlow informed the Commission that the subdivision has been recorded. He further stated that the developer will construct wood roofs on all houses within the subdivision and is proposing to landscape the property along the north side of Lakeside Drive. The Commission reviewed the proposed development. Mr. Langlois, representing the developer stated that he is agreeable to changes as outlined by the staff. A MOTION WAS MADE BY SLATES AND SECONDED BY KERINS TO APPROVE ADMINISTRATIVE REVIEW NO 71-2 UPON THE FOLLOWING CONDITIONS: 1. The north side of Lakeview Drive shall be landscaped in compliance with a plan approved by the Planning Department. Such landscaping plan shall be prepared by the developer in cooperation with the landscape architedt for Huntington Central Park. The landscaping shall be installed prior to acceptance of the tract by the City. 2. A fence shall be constructed along the north side of Lakeview Drive where lots side -on Lakeview Drive. Such fence shall be constructed of wood and masonry materials. The fence location and design shall be approved by the Planning Department and shall be installed prior to final inspection of the houses where the fence is located. 3. The sidewalk along the north side of Lakeview Drive shall be 4 foot wide and located adjacent to the curb. The remaining right-of-way shall be landscaped along with adjacent private property per condition No. 1. Special attention shall be given to the side elevation of houses siding on Lakeview Drive. 5. A plan showing side elevations shall be approved by the Planning Department. 6. All roofs shall be constructed with wood materials. 7. All CC & R's shall contain a provision prohibiting rooftop T. V. Antennas. ROLL CALL VOTE: AYES: Bazil, Higgins, Porter, Duke, Slates, Kerins NOES: None ABSENT: Miller THE MOTION CARRIED. USE PERMIT NO 69-6 - Review Applicant - Assoc. Southern Investment Co. James Palin, Associate Planner, made a presentation regarding the wall construction around a mobilehome park located at Ward Street and Yorktown Avenue. Mr. Palin stated that the applicant has requested that the wall be constructed at the property line with 4 or 5 insets for landscaping and that said wall would be constructed of slump stone block material along Ward Street. Bill Hartge, City Engineer, informed the Commission that he would recommend against the insets in the wall, because of maintenance problems. Chairman Slates requested that the staff persue other wall design and report back to the Commission at their February 99 1971 meeting. INFORMATION: The Planning Director informed the Commission of the City Council's action regarding Zone Case No 70-26. Mr. Reynolds stated that the City Council sustained the decision of the Planning Commission and approved Zone Case No 70-26. ON MOTION BY PORTER AND SECONDED BY BAZIL TO RECOMMEND THAT PREPARATION OF THE ORDINANCE TO ADOPT ZONE CASE NO 70-26 BE WITHHELD BY THE CITY COUNCIL FOR 60 DAYS. AND FOR THE FOLLOWING REASONS: 1. To avoid the possibility of speculative zoning. 2. The primary reason for zoning this property commercial was that the parcel is undevelopable as Rl and a conditional exception with a specific development plan was approved.
