Williams To permit a mobilehome for watchman's quarters. The subject property is located on the north side of Ernest Street, approximately 320 feet east of the centerline of Goldenwest Street. The Chairman read the request. The Acting Secretary advised that the Staff has requested a continuance of this item until March 17, 1971, to allow time for the Planning Commission to review this request at their March 16, 1971, Study Session. The subject property is located on the south- west coiner of the intersection of McFadden Avenue and Commerce Street. The Chairman read the request. The Acting Secretary advised that this item had been continued to allow the applicant time to revise his plot plan, and that said revised plan had not been received to date. Mr. Art Hoffpauer, representing the applicant, addressed -'-he Board and submitted a revised plo•: plan. The Acting Secretary advised that the applicant had been in contact with him and has requested a continuance to the March 24, 1971, meeting as he has not been able to get all tenants together to discuss the consolidation of signs. The Acting Secretary advised that Mr. Hocutt is withdrawing as applicant on this item and that Mr. Gills will be taking over as applicant. The subject property is located on the northeast corner of Delaware Street and Knoxville Avenue. The Chairman read the request. The Acting Secretary advised that the appli- cant has not yet submitted sufficient evidence as to whether the subject property is a legal building site. The applicant was not present. To permit the installation of signs and tire storage cabinet. The subject property is located on the north- west corner of Warner Avenue and Magnolia Street. The Chairman read the request. Bill Lange, applicant, addressed the Board and answered various qu9 stions. The Acting Secretary advised that the Planning Commission, at their September 29, 1970, meeting set standards for the outside storage and display of tires. The plans were reviewed, The applicant advised that the poposed cabinet is 915" in height and is the same prefab structure used at all Union 76 stations. on -site. USE PERMIT NO. 71710 Applicant: Harold Klein To permit renewal of Use Permit No. 69-53, which would allow a 286 unit apartment complex in the R3 Limited Multiple Family Residence District. The subject property is located on the northwest corner of Warner Avenue and Edwards Street. The Chairman read the request and opened the hearing to the audience. Mr. Charles King and Mr. Parker, representing the applicant, addressed the Board and answered various questions. Renderings were submitted. Elevations were reviewed and discussion was held pertaining to the block wall, parking facilities, landscaping, screening of concrete block wall, setbacks and drainage. It was noted that the setback along Edwards Street for the carport structures was only three (31) feet or four (41) feet in lieu of the originally approved ten (101) foot setback. There being no further business, the hearing was closed. Board discussion was held. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE USE PERMIT NO. 71-10 TO ALLOW THE APPLICANT TIME TO REVISE THE LAYOUT TO FACILITATE PROPER ENTRANCES TO THE UNITS. CONDITIONAL EXCEPTION NO. 71-9 Applicant: Bernard Saul To permit a 2 1/2 foot x 23 foot (50 square foot) real estate sign in lieu of one (1) square foot of sign area for each ten (10) Feet of street frontage or 10 square feet permitted by ordinance. Also, to allow said sign to be constructed at a ratio of 8 to 1 in lieu of the ratio 2 to 1 permitted by ordinance for sign height ratio to width in the R3 Limited Multiple Family Residence District. BOARD OF ZONING ADJUSTMENTS PAGE 5 WEDNESDAY, MARCH 10, 1971 Mr. Saul, applicant, and Mr. Davis, on -site manager, addressed the Board and answered various questions. Mr. Saul stated his hardship is that people are unable to see the apartments from Main Street as said units are behind the 5 Points Shopping Center. He also stated that his vacancy rate has been 8% to 20%. The Acting Secretary explained the intent of the ordinance and stated he felt approval of this variance would set a precedence. Provisions of the code were discussed. Stanley Fann addressed the Board and stated that he felt it is not the size of a sign that attracts potential renters and that if a person is looking for a rental, he will see even the smallest of signs, perhaps placed in the manager's window. the hearing was closed. There being no further comments, Board discussion was held. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO DENY CONDITIONAL EXCEPTION NO. 71-9 FOR THE FOLLOWING REASON: 1. USE PERMIT NO. 71-11 Applicant: Stanley Fann To permit the construction of the following: 1) a 350 seat theatre, 2) a proximately 8200 square feet of additional retail shopping area, and 3� an 800 square foot take-out restaurant. In Conjunction With CONDITIONAL EXCEPTION N6. 71-10 Applicant: Stanley Fann To allow a portion (69 spaces) of the required 116 parking spaces for a 350 seat theatre to be parking spaces which are presently assigned or required for the existing and proposed retail shops. The subject property is located within an existing shopping center at the northwest corner of Warner Avenue and Springdale Street in the C4 Highway Commercial District. The Chairman read the requast and opened the hearing to the audience. Mr. Fann, applicant, addressed the Board and answered various questions. The Acting Secretary advised that the turning radius was not sufficient in some areas of the parking lot. -5- 3/10/71 BZA MINUTES: H. B. BOARD OF ZONING ADJUSTMENTS PAGE 6 WEDNESDAY, MARCH 10, 1971 Discussion was held pertaining to landscaping, walkways, parking, traffic circulation, width of drives, etc. Mr. Fann stated that the elevations of the proposed structures would be as the existing 31 Flavors Ice Cream Shop, which is at the opposite and of the complex. It was noted that the building encroaches into the required setback and therefore, the request should be readvertised to state said encroachment. Discussion was held. There being no further comment, the hearing was closed. It was the consensus of the Board that revised plans were needed delineating landscaping, parking stall dimensions, 6" raised curb boundaries in parking areas, etc. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO CONTINUE USE PERMIT NO. 71-11 AND CONDITIONAL EXCEPTION NO. 71-10 TO THE MARCH 24, 1971, MEETING, TO ALLOW TIME FOR THE CONDITIONAL EXCEPTION TO BE READVERTISED. ROLL CALL VOTE: AYES: Gerarden, Spencer, Palin NOES None ABSENT: None THE MOTION CARRIED. CONDITIONAL EXCEPTION NO. 71-11 Applicant: Mr. Aubrey L. Medley To allow a reduction in the required 900 square feet of open space to 800 square feet with a minimum dimension of twenty (20) feet in the R1 Single Family Residence District. The subject property is located on the north side of Doncaster Drive, 250 feet west of Newland Street. The Chairman read the request and opened the hearing to the audience. Mr. Medley, applicant, addressed the Board and answered various question,-j. Discussion was held pertaining to the detached garage, open space, and the existing 15 foot sideyard. There being no further comment, the hearing was closed. Board discussion followed. A MOTION WAS MADE BY PALIN AND SECONDED BY SPENCER TO APPROVE CONDITIONAL EXCEPTION NO. 71-11 FOR THE FOLLOWING REASONS: 1. The lot was recorded in 1926 and is only 40 feet in width. 2. ROLL CALL VOTE: AYES: Gerarden, Spencer, Palin NOES: None ABSENT: None THE MOTION CARRIED. .M MISCELLANEOUS: DIVISION OF LAND NO. 70-32 Edison Community Park At the request of the City Administrator the Board reviewed prior conditions of approval and deemed no longer necessary that the property be restricted as per condition #6. Parcel #1 shall be conveyed as fee simple defeasible upon the condition that if said property is used for any purpose other than the operation of a public park, playground, and recreation facility, the parcel and all improvements thereon, shall automatically revert to the City of Huntington Beach without any further action necessary on the part of the City. USE PERMIT NO. 71-8 Applicant: F. B. Clendenen To permit the construction of a 242 unit apartment complex on approximately 8.3 acres of land. The subject property is located on the east side of Bolsa Chica Avenue, approimately 995 feet south of Warner Avenue in the R2 Two Family Residence District and R3 Limited Multiple Family District. The Board reviewed per Planning Commission's request. It was determined that the plan complies with the existing apartment standards adopted October 21, 1969. The plan has a total 65,000 square feet of usable open space which is 18,400 square feet more than required by said standards. THERE BEING NO FURTHER BUSINESS, THE MEETING ADJOURNED. James W.
